Steps after H1B Registration Lottery – Flow Chart, Process

If you are new to the H1B process, one of the many questions you might have is, what are the typical steps after the H1B Lottery happens. USCIS introduced H1B Registration Process from H1B Visa 2021 Season and is applicable for H1B Visa 2023 Season as well. In this article, we will cover typical flow and steps after H1B Registration Lottery selection all the way through visa approval and put it in a flow chart so that it is easy to comprehend.

What happens after H1B Registration Lottery ? 

After the H1B registration period starts, employers or attorneys submit the H1B registrations for their prospective applicants using the H1B Registration Online Tool. USCIS runs the lottery for the submitted registrations after the H1B registration period ends. Below are the next steps, after USCIS completes H1B Visa Lottery for the submitted registrations:

  1. USCIS notifies employers regarding registration selection results
  2. Employers file H1B Petition with USCIS using H1B Registration Selection Notice.
  3. USCIS processes and adjudicates the H1B petitions
  4. USCIS re-runs lottery as needed, updates final results

Let’s look at each of these steps in detail in the next section.

Step 1 : USCIS Notifies H1B Registration Lottery Results

USCIS sends out an email notification indicating changes in the online system and they need to login to view the updates on their submitted registrations. If a registration was selected in H1B lottery, then the status of the registration would be changed to “Selected” and the employer can print H1B Registration Selection Notice.

If the H1B applicant was not selected in the initial run of the lottery, then the registrations would be put in the waitlist pool until the end of the fiscal year. Based on the previous season’s data, the H1B Visa 2023 season submitted registrations could be waitlisted until February 2023 as we may have multiple rounds of the lottery. Step 2 : Employers file H1B Petition with USCIS – LCA, Other info

After the registration process is complete, Employers or Attorneys representing the companies will file the H1B petitions with USCIS for those selected in the H1B Registration Lottery. Employers get 90 days, starting from April 1st, until June 30th to file the H1B Petition for the selected applicant.

As part of that filing process, first employers would need to file for H1B LCA with DOL and get it approved. Also, in the meantime, the employer would prepare the entire H1B package with all details related to the employee. This is where your employer would request documents. Read H1B Visa Petition Documents Checklist, What NOT to give ? Once the H1B petition is ready, the employer or attorney would mail it out to USCIS.

Step 3 : USCIS Sends out H1B Receipt Notices

After USCIS receives the H1B application package, they will process it and will send out H1B receipt notices. USCIS in previous years stopped the premium processing filing option for everyone during the initial filing. But, for FY 2023 season, they have not released any press note indicating the suspension of premium processing.

As of March 21st, 2022, we have the premium processing option available for FY 2023 Season and employers can file H1B petitions in premium processing. Read H1B Premium Processing Vs Regular Processing, if you are new to this. If you file an H1B petition in premium processing, you would get receipt notification in email. Below are the various categories for getting receipt notices.

  • Premium Processing Email Receipt Notices  : If your H1B petition was filed in Premium Processing, then your employer/ attorney would get email receipt notice. After that the email notice, a physical copy of the H1B receipt notice would be sent to your employer/ attorney.
  • Regular Processing Receipt Notices : If your H1B petition was filed in Regular Processing, then you will start to receive physical receipt notices, there will NOT be any email receipt notice sent. They usually send via postal mail like USPS, so it can take couple of weeks or so.

Also, around the same time, your employer would see below for their fee checks.

  • H1B Fee Checks Cashed : Your employers/ Attorney will also start to see checks cashed for the filing fee, during this time. Only employers or attorney, who used the check would be able to see this in their bank accounts. This is something that cannot be verified by applicants.

Step 4 : Processing of H1B Petition by USCIS – H1B Case Statuses

After the H1B receipt notices are sent, then USCIS starts to process/ adjudicate the petitions filed. The H1B receipt number your employer or attorney gets starts with EAC or  WAC, depending on where it was filed. Read What is H1B Visa Receipt Number – Meaning, Status . You can use that receipt number to check H1B Visa Petition Status online on USCIS website. You can even signup for a free online account with USCIS and track your status.

Below are the various H1B Visa Case Statuses that your H1B petition can go through, after it is selected in Lottery. All of the below are possible case statuses and not mandatory for all the petitions to go through each of the below statuses.

  • Case Was Received and A Receipt Notice Was Emailed
  • Case Was Received
  • Request for Additional Evidence Notice was mailed
  • Response to USCIS’ Request for Evidence Was Received
  • Case Was Approved And My Decision Was Emailed
  • Case Was Approved
  • Decision Notice Mailed
  • Error : The application Receipt Number is invalid
  • Name was updated.
  • Fees will be Refunded

Timeline of Next Steps after H1B Visa Lottery

Below is the typical timeline of events that happen after H1B Registration Lottery results are out. Some of these activities go in parallel. There is no SLA for H1B petition processing, so some of these can extend beyond October 1st as well.

Timeline ( Dates/Months)Processing Step of H1B Visa
April 1st to June 30th– Employer/ Attorney files H1B LCA
– Employer / Attorney creates the H1B petition package with LCA, relevant fee, I-129 form, supporting documents and sends it to USCIS
– Employer/ Attorney receives H1B Receipt Notice.
– If the petition was filed in premium, you may see a decision of approval or RFE within 15 days. Read H1B Regular vs Premium Processing
June 30th to October 1st or later– USCIS processes the submitted petitions and either approve or issues RFEs
– Employer responds, if any RFEs, and submit to USCIS to resume processing.
– Also, if there are not enough petitions filed, USCIS may run a second-round lottery.
July 1st to October 1st or later– H1B Applicants with approved petitions go for stamping as needed to be ready to work in the US
October 1st to Dec 30th– USCIS may run a third-round lottery if enough petitions are not received.
Jan 1st ( next year) to Feb 28th– USCIS will set the status of all registrations as “Not Selected”. This means that there will not be any more rounds of lottery and officially their registration was not picked in the lottery

Someone said, “A picture is worth thousand words“…Below is that picture on H1B visa status flow from employers submitting H1B registration, H1B petition to getting a decision from USCIS. Depending on your case, you could go through few or more of the statuses listed above. We will look at the various scenarios below in detail.

Steps after H1B Registration Lottery until Approval - USCIS processing

H1B High Level Process Flow with Lottery, Processing by USCIS

As you can see in the above H1B case status flow chart with USCIS, the best case scenario after being selected in registration lottery, then petition filing and then to go to approval without any questions or additional information required.  From USCIS Case status standpoint, it would be like below based on premium processing or regular processing category of filing.

Scenario 1 : H1B Process flow for simple Approval Scenario, without any ask for additional documents (Request for Evidence – RFE)

  • H1B Premium processing :
    • First, you will see status “Case Was Received and A Receipt Notice Was Emailed”
    • Second, you will see status  “Case Was Approved And My Decision Was Emailed”
  • H1B Regular Processing
    • First, you will see status “Case Was Received”
    • Second, you will see status “Case Was Approved”

The key information that you need to be aware of is that for regular processing H1B petitions, USCIS do not have any SLA(service level agreement) or time limit and their processing can take few weeks to few months. We have seen cases being approved after 6 to 8 months at times or more, so do not panic, just stay calm and work with your employer or immigration attorney. If you need a result early, you can upgrade regular processing to premium processing to get the decision in 15 calendar days. But, you can only upgrade, if premium processing is available.

Scenario 2 :H1B Process flow after Lottery with Request for Additional Evidence ( RFE)

Not all cases go to direct approval like above. USCIS will ask employers to submit various documents depending on the complexity of the case. Typically reasons for RFE could be for the below reasons:

  • Specialty Occupation
  • Needs of the Petitioner for the Services of the Beneficiary
  • Beneficiary Qualifications
  • Employer-Employee Relationship
  • Maintenance of Status
  • Validation Instrument for Business Enterprises (VIBE)

  • H1B Premium processing statuses with RFE:
    • First you will see status “Case Was Received and A Receipt Notice Was Emailed”
    • Second you will see status “Request for Additional Evidence Notice was mailed”
    • After your employer/ attorney submits documents, you will see status  “Response to USCIS’ Request for Evidence Was Received”
    • Finally, after USCIS processes the petition and approves it, you will see status “Case Was Approved And My Decision Was Emailed”
  • H1B Regular Processing statuses with RFE :
    • First you will see status “Case Was Received “
    • Second you will see status “Request for Additional Evidence Notice was mailed”
    • After your employer/ attorney submits documents, you will see status  “Response to USCIS’ Request for Evidence Was Received”
    • Finally, after USCIS processes the petition and approves it, you will see status “Decision Notice Mailed”

As far as RFE processing goes, it can takes anywhere from few weeks to several months depending on the response time of your employer and USCIS processing times. It is best to work with employer and submit the documents required on time for timely decision and status.

Scenario 3 : H1B Denied Status – Decision Notice Mailed
Not all H1B petitions filed are approved, some may be denied due to various reasons. In that case, instead of approval you would get denial letter and the final status would still be “Decision Notice Mailed”. Also, some of you may see “Name was updated” at times during the flow, the system does the update whenever some clerical updates are done to your case in the system or some internal activity happening on your case, nothing to panic. It is an internal status.

To put things in perspective, the above case status flow was much more complex in the past with the old system and there were much more statuses. You may read Old H1B case Status flow to get an understanding.

Step 5 : H1B Registration Lottery Final Results – Not Selected Status

In the past, USCIS would mail out H1B reject notices after all the receipt notices are mailed in late July or August of the same year. But, since the H1B Registration process is in place, this is not applicable. The registrations that are not selected in the initial round of lottery are put in waitlist category and USCIS can run multiple rounds of the H1B lottery as needed at a later date.

For FY 2022 season, USCIS ran the second and third round H1B lottery on the registrations. The third round lottery was done in Nov 2021. For selected applicants, the above steps 1 to step 4 would repeat. You can check Sample H1B registration Selection Notice from Second Round Lottery .

USCIS announced final lottery results saying that H1B Cap for FY 2022 was complete in February 2022. So, basically, they kept the registrations in waitlist from April 2021 until Feb 2022. We may expect the same for FY 2023 season as well. So, we may see H1B 2023 registrations waitlisted until February 2023. All the registrations that were not selected would be set to the “Not Selected” Status when USCIS announces the cap is complete for that fiscal year( which could be Feb 2023).

    I plan to travel to India on March 21st 2021 and only return May 1st 2021. I am currently on STEM OPT and I have a valid F1 Visa till June 2021 and a valid EAD till 2022. I will be applying for H1B this year.

    Can my Employer file the H1B Petition, if selected, once I am back in the US? And if so, can it be submitted as a change of status? At what stage (H1B Registration period or H1B Petition period) do we need to let USCIS know if we are filing the petition as change of status or consular notification?

      Yes, they will have time as they get 90 days to file the same. Yes, you will need to indicate that. This only happens after the registration. So, you should be fine. Make sure your employer knows this and they file it after you arrrive. This all depends on if you get lucky in lottery. Of course, stay positive, just saying.

    I have been notified by my employer that your H1B application has been selected in second round of lottery which was around in end of August 2020. I had to ask by employer to reinitiate the case but it due to some reason it was not filled to USCIS by project/account team. Can you please somebody suggest if any chance I got chance to case reopened, can somebody suggest,
    Will it be acceptable to USCIS now?
    Is there any timelines/deadlines to filling case with USCIS after lottery selection for FY2021?

    Im in India now. My H1b petition for this year has been approved and is yet to go for stamping. I have plans to go for MS and have got admission for spring intake. Can I go for F1 stamping? In that case, can I use the h1b visa after completing the MS ? thanks in advance.

    • Hi, thanks for your insights!
      I am in the US and I got approved with consular processing. I have not been able to travel outside of the US to get the H1B activated because of COVID. I am looking at a few opportunities (very similar job description) now and I don’t think they will wait for me to get a stamp from a consulate. If I take an offer from a new employer now:

      Can they file a H1B transfer, even though technically I am still under OPT?
      If transfer won’t work, and I switch firm with opt, will my new employer need to file a new H1B and go through the lottery again next year?

      Essencially I am trying to understand if CAP can be kept will H1B approved but not activated. Also, whether I am under any risk that my old employer withdraw h1b before im able to transfer.

    I am currently on OPT with my final work date being in July. If my H1-B registration status is ‘submitted’ and doesn’t change until the end of the fiscal year after the the initial H1-B visas have been awarded. How do I then apply for H1-B if my registration is ‘selected’?

    Since my grace period will end before the end of the fiscal year. I know I will have to stop working July 9th but can I apply for H1-B from my home country?

      You cannot until you get it changed to selected. Yes, you will need to stop working once your OPT ends. Yes, you can do that from your home country, it will be under Consular processing.

      Only, if you applied for actual H1B petition with USCIS before OPT expired, then you can avail cap gap provision. You cannot work, just with registration selection.

  7. Hello,

    I am on F1 STEM OPT at present. My company filed a petition for my H1B visa last year (FY 2020). It got picked, got an RFE and ultimately got denied because of the specialty occupation reason. Even though I felt that my RFE arguments and evidence were very strong. My company filed for an appeal and that got denied as well. The position that was filed was systems analyst. This year (FY 2021) it got picked again and at the time of registration my title was still systems analyst. Is it ok to change the title to software developer at the time of filing or will that be a complicated situation raising questions from USCIS. My company agreed to filing with a different title but I am worried as the job description is not as different as last years.

      It all depends on the job description, SOC Code, that you are working on. Talk to your attorney on the issues last time and see, if you can correct it with new SOC Code…
      Just changing tile for the sake of it, is not going to get approval, it has to be backed by proper roles, responsibilities, etc. talk to your attorney.

  8. I’m planning to work in the USA and I have an employer who told me last year that my name was selected in the H1b lottery. All of the necessary documents requested by the USCIS were completed. However, it’s been a year since I was selected in the lottery and I’m still here in my country outside the US. This is because I haven’t passed my TOEFL exam which is needed for the visa screening. Do I need to undergo another lottery for H1b again?

    • No, there is no need for TOEFL for H1B. It cannot be that long, if you were to be selected, you should have heard by now…Something fishy here…Ask your employer to send the copy of receipt notice, so that you can check. If you already were selected in lottery and your h1B was approved, you do not have to go through it again

    Here is a scenario if an employer A filed H1 for the first time, picked in lottery, received RFE.
    At this stage, can I change employer to keep the same petition and respond to RFE with all the documentation required with new employer.
    Essentially i’m asking if I can change employer during RFE stage.


    • If filing for first time and under lottery, you cannot do that as you never had H1B approved, you would have not been counted towards cap.

    After that i got an RFE on my application and no action was taken by my employer on the same.
    Now the deadline for RFE submision is passed. What would be the next step for the same.

    One of my friend H1B got selected this year, Then he received RFE they submitted documents but it got denied. All of sudden he got the mail to his gmail today like ” We Still reviewing your case and there are no updates at this time: We will notify you when your case status changes. We last took action on your case on November 13, 2018″

    November 13 he got denied notice.

    Can some one tell me what is this about again?

      • If he reopen the case is there any chance of getting approved, Because till now he was not received hard copy also. If he reopen, can he apply in 2020 lottery if it is pending status?

    • If you have seen/have the physical receipt, it should be fine. Sometimes, the online system can behave strange. Check with your attorney.

  21. My wife got her name on lottery for h1b this year and we are still waiting on her approval or RFE. By when should we be knowing one way or the other ? We wanted to travel to india and so wanted to know the decision on this also the dates of travel would be dictated by this decision i believe.

    • There is no set timeline for the regular processing, it can be few weeks to few months…As you cannot do premium until USCIS instructs, wait for that and then maybe do premium processing, once the window opens.

      • I dont want to do premium , all i want to know is when we can travel to india to get stamping in sept oct. Lawyer says they cant suggest any dates until they hear from USCIS on the case. So how long do we have to wait to hear something is what I wanted to know.

    Looks like I am in a pretty messy situation here. I would really appreciate it if some one can help me here!
    My OPT extension expires on may 26th 2018, and yesterday my attorney informed me that my filing fee checks have been cashed. I contacted my school to check if cap-gap has been added! She said my record does not reflect a change of status request at this time.
    Is it common? Or will it take a while for the SEVIS portal to be updated? Should I go ahead and join my masters in a different university or wait for the receipt?
    If I have to join masters I need to do it by tomorrow! Please help me out

    • If you are sure about checks have been cashed, contact DSO again to make sure the status is “change of status pending”. If it is so, you may sit back and relax. As far as i know, it does take some time to reflect on SEVIS portal. I assume you already know, starting from this year we have access to few details of sevis portal through sevp.ice.gov/opt/ website. If you don’t have one, ask DSO to provide the registration link.

      • I already have the portal, nothing has changed there. Even my DSO does not see ant pending COS. But my attorney is sure that check has been cashed! What do you think is a good idea? Join masters or wait?

        • Probably, DSO too lazy to check anything. I’ve had experience before and also happened some of my friends. So, i would suggest you to contact SEVIS directly at 703-603-3400 .

    I’m reading the article above and gave me the impression that after being selected in this lottery for FY2019 we could then request for a premium processing in the decision, is this correct? I’m aware that the premium processing was suspended and thought that this was only an option when the case was initially filed.


    • For FY 2019, you may request Premium processing after USCIS resumes accepting premium processing for Cap subject petitions.

  24. Your English is rather poor. Would it not be better to improve yourself first before asking others and blabbering out the prejudices that you have? You do not know the proper use of articles, punctuation, or even have a basic understanding of clauses. Additionally, unless you do masters in English, write a thesis, publish peer-reviewed papers, or do a doctorate, your English is not going to improve.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    2. I have also checked on the USCIS website and there it was mentioned as ,

    Case Was Approved And My Decision Was Emailed
    We approved your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number XXXXXXX, and emailed you an approval notice. Please follow any instructions on the approval notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    I am a bit confused as in mail it was mentioned Your Case Status: Decision – During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner.

    But on website it’s, We approved your Form I-129, Petition for a Nonimmigrant Worker

    Also, I see that in Case History I don’t see the approval date.

    Can you guys explain me the current status of my H1.


  27. Hello, My H1B visa application was selected in the lottery in April 2017 but my employer did not reply to the RFE before the deadline(Dec 6) and also does not want to continue with the visa application.
    1) Can I get it transferred to another employer?
    2) What is the way forward?
    3) Do i need to go through the lottery again?

    • Since your employer is not willing to proceed with the application and has not taken steps to respond to the RFE, the petition would be rejected automatically.
      1. You cant transfer the cap subject petition in the RFE state or after denial
      2. This petition once rejected, cant be used again. You will have to undergo the visa lottery process once again and get a petition approved.

    • Does it say Approval notice has been mailed or emailed?
      If its mailed it would come in normal post.
      If its emailed a soft copy of the approval notice could be emailed to Attorney.

    I got an RFE in August and sent the response in Nov 1st, before the deadline. The status got updated as , ‘Response To USCIS’ Request For Evidence Was Received’.

    I upgraded my H1B petition to premium processing and they received it on Nov 17th. The status currently says “we received your petition on Nov 17th and emailed you the receipt notice”.

    By when can I expect a decision? It’s almost close to 15 calendar days, but I’m not sure if I should be counting thanksgiving holiday and weekends.

    • Its 15 calendar days. You need to include the holidays and weekends in that. Probably your attorney received an update already. It happened to one of my friend, the USCIS site never got updated till now. So please do check with your Attorney once.

    My H1b petition was selected but soon I received an RFE notice. So, my employer and lawyer send the necessary documents sometimes at the end of the October. Now, it’s just a waiting game. But my OPT is going to expire at end of January coming year, so should file for OPT stem extension or wait till I get the decision for my H1B?

    • If you wish you can expedite the H1B process by upgrading it to premium processing. If not its better to apply for OPT extension so that you will not lose your work authorization.

    I got RFE on Oct 12th, mentioning beneficiary qualification. My BTech was in Applied Electronics and Instrumentation. I have been working as a Software Engineer for almost 6 years now. And for the past 3 and a half years I have been working for the same end client and project, which I have been leading. They are saying in the RFE that my degree is not related to the designation. They have also mentioned that I can show a combination of educational qualifications and work ex to establish my credentials. My end client badly wants me working in the US and they would give a strong letter of recommendation if needed, detailing why its necessary for them that my petition is approved. Will that help my case? Anything else in particular that I can do? My employer’s attorney would be preparing the response and most probably, but just wanted to know if there is anything that I can/should do. Thanks in advance.

    I got an email stating that i was picked up on the lottery since May and also received a receipt of it starting with EAC17XXX . But they also said that they transferred my case to another USCIS. That office now has jurisdiction over your case…

    Its now October and I have still haven’t heard if i got the visa or not.. I am currently on my OPT which expires next year on May. HR also doesn’t know whats going on..Can you please help me and elaborate what do you think is happening?? Do you think i got the visa?

    1. My H1B application has been picked up by USCIS for H1B FY17-18 [known as lottery picks] and the status on the USCIS website is ‘ Case was Received’
    This status doesn’t seem to change for the last 3 months.. Can some one help with what should i be doing? Is this delay normal?

    3. The LCA petition is valid till 2020 – How long should i wait to see the case getting approved and passport being stamped?

    • of course yes. All cases are filed in normal processing. This year there seems be tighter scrutiny of applications. So its normal that process is getting delayed. There are many petitions still pending with USCIS. Please be patient and wait for an update.

      • Thanks Ram . But Many people were telling this year processing is fast even without premium processing. That’s probably false news I guess my friends who ever have applied from big mncs are also waiting.

      I have applied for H-1B visa and my name got selected in the lottery process, after that i didn’t get any update , I’m afraid as everyone was expecting that we get the approval letter by September end , its almost end of august and i didn’t get any update .
      Is anything to be afraid of, or its their way of processing the visa’s

      • Tanvi, Have you received your receipt number? Are you tracking it in USCIS site?
        This year please do expect delays in processing as there is a strict scrutiny of applications. There are thousands of applications still pending with USCIS.

      • Rony and Rohan, there was many others like you with case received on April 11 and still waiting for an update. As all cases are in regular processing, we don’t have a deadline from USCIS. So please wait patiently unless your case is picked and processed. All the best!

  36. I have done my masters from US (in May 2017)and mine is a STEM degree. My OPT start date is 26 June 2017. I have a job offer but my employer is not e-verified, though he is willing to file my H1B. So I will not get OPT extension. My question is that if I get selected in 2018 lottery, I may get a decision around May/June 2018 but I will be entitled to work from 1 Oct 2018. My OPT will expire on 25 June 2018. How can I continue to work/live in USA from 26 June 2018 to 30 Sept 2018?

    • If your H1-B is picked, your Employment Authorization will be automatically extended until 30 Sep 2018, It will be updated in your I-20. I suggest, Google about “Cap-gap” when you get a chance. Thank you.

    My employer submit application for H1B visa on Sep 30, 2016 but still he is saying that he is waiting for decision. Can anybody tell me How much time will this application take? My employer saying that every thing is Ok in case but decision is still pending. Please guide me what should I do?

    • How come the employer filed on 30th Sept? During April-May 2016 itself, there were around 2,36,000 applications already with USCIS. Only 65,000 applications get picked every year. Then why did your employer file on Sept 20th when the applications were already full in Apr-May itself? I think he is bluffing. (Though I’m not very sure if it’s still possible to file in Sept after knowing that the applications were full already). Please check with someone who has proper knowledge about it. FYI, my employer filed on April 1st 2016 and by end of May, I got mail that my visa didn’t get picked in the lottery.

    • With this English, how do you expect to work in the USA? It’s important to make yourself better to obtain better opportunities. Unfortunately many North Indians (Delhi, Mp, up and Bihar persons are the worst) and people from Andra /telangana-villages don’t think it’s important to improve their English, this is one is the reasons, Americans feel, unworthy-Indians steal their job. Get a masters degree and improve your English, your prospects will improve automatically. There are a lot of intelligent educated Indians out there.

    My H1 got picked yesterday in masters quota. My question is I checked my LCA today and there is a mistake in zipcode of my client location. will that be a problem? Do I need to change it now or I should wait for the receipt number and if I get any RFE then need to proceed with the change?? I haven’t informed to my employer.       Too late to change the LCA. How big is the typo? Is it still in the same MSA? Did you contact your employer/attorney about this?
