Steps after H1B Registration Lottery – Flow Chart, Process

If you are new to the H1B process, one of the many questions you might have is, what are the typical steps after the H1B Lottery happens. USCIS introduced H1B Registration Process from H1B Visa 2021 Season and is applicable for H1B Visa 2023 Season as well. In this article, we will cover typical flow and steps after H1B Registration Lottery selection all the way through visa approval and put it in a flow chart so that it is easy to comprehend.

What happens after H1B Registration Lottery ? 

After the H1B registration period starts, employers or attorneys submit the H1B registrations for their prospective applicants using the H1B Registration Online Tool. USCIS runs the lottery for the submitted registrations after the H1B registration period ends. Below are the next steps, after USCIS completes H1B Visa Lottery for the submitted registrations:

  1. USCIS notifies employers regarding registration selection results
  2. Employers file H1B Petition with USCIS using H1B Registration Selection Notice.
  3. USCIS processes and adjudicates the H1B petitions
  4. USCIS re-runs lottery as needed, updates final results

Let’s look at each of these steps in detail in the next section.

Step 1 : USCIS Notifies H1B Registration Lottery Results

USCIS sends out an email notification indicating changes in the online system and they need to login to view the updates on their submitted registrations. If a registration was selected in H1B lottery, then the status of the registration would be changed to “Selected” and the employer can print H1B Registration Selection Notice.

If the H1B applicant was not selected in the initial run of the lottery, then the registrations would be put in the waitlist pool until the end of the fiscal year. Based on the previous season’s data, the H1B Visa 2023 season submitted registrations could be waitlisted until February 2023 as we may have multiple rounds of the lottery. Step 2 : Employers file H1B Petition with USCIS – LCA, Other info

After the registration process is complete, Employers or Attorneys representing the companies will file the H1B petitions with USCIS for those selected in the H1B Registration Lottery. Employers get 90 days, starting from April 1st, until June 30th to file the H1B Petition for the selected applicant.

As part of that filing process, first employers would need to file for H1B LCA with DOL and get it approved. Also, in the meantime, the employer would prepare the entire H1B package with all details related to the employee. This is where your employer would request documents. Read H1B Visa Petition Documents Checklist, What NOT to give ? Once the H1B petition is ready, the employer or attorney would mail it out to USCIS.

Step 3 : USCIS Sends out H1B Receipt Notices

After USCIS receives the H1B application package, they will process it and will send out H1B receipt notices. USCIS in previous years stopped the premium processing filing option for everyone during the initial filing. But, for FY 2023 season, they have not released any press note indicating the suspension of premium processing.

As of March 21st, 2022, we have the premium processing option available for FY 2023 Season and employers can file H1B petitions in premium processing. Read H1B Premium Processing Vs Regular Processing, if you are new to this. If you file an H1B petition in premium processing, you would get receipt notification in email. Below are the various categories for getting receipt notices.

  • Premium Processing Email Receipt Notices  : If your H1B petition was filed in Premium Processing, then your employer/ attorney would get email receipt notice. After that the email notice, a physical copy of the H1B receipt notice would be sent to your employer/ attorney.
  • Regular Processing Receipt Notices : If your H1B petition was filed in Regular Processing, then you will start to receive physical receipt notices, there will NOT be any email receipt notice sent. They usually send via postal mail like USPS, so it can take couple of weeks or so.

Also, around the same time, your employer would see below for their fee checks.

  • H1B Fee Checks Cashed : Your employers/ Attorney will also start to see checks cashed for the filing fee, during this time. Only employers or attorney, who used the check would be able to see this in their bank accounts. This is something that cannot be verified by applicants.

Step 4 : Processing of H1B Petition by USCIS – H1B Case Statuses

After the H1B receipt notices are sent, then USCIS starts to process/ adjudicate the petitions filed. The H1B receipt number your employer or attorney gets starts with EAC or  WAC, depending on where it was filed. Read What is H1B Visa Receipt Number – Meaning, Status . You can use that receipt number to check H1B Visa Petition Status online on USCIS website. You can even signup for a free online account with USCIS and track your status.

Below are the various H1B Visa Case Statuses that your H1B petition can go through, after it is selected in Lottery. All of the below are possible case statuses and not mandatory for all the petitions to go through each of the below statuses.

  • Case Was Received and A Receipt Notice Was Emailed
  • Case Was Received
  • Request for Additional Evidence Notice was mailed
  • Response to USCIS’ Request for Evidence Was Received
  • Case Was Approved And My Decision Was Emailed
  • Case Was Approved
  • Decision Notice Mailed
  • Error : The application Receipt Number is invalid
  • Name was updated.
  • Fees will be Refunded

Timeline of Next Steps after H1B Visa Lottery

Below is the typical timeline of events that happen after H1B Registration Lottery results are out. Some of these activities go in parallel. There is no SLA for H1B petition processing, so some of these can extend beyond October 1st as well.

Timeline ( Dates/Months)Processing Step of H1B Visa
April 1st to June 30th– Employer/ Attorney files H1B LCA
– Employer / Attorney creates the H1B petition package with LCA, relevant fee, I-129 form, supporting documents and sends it to USCIS
– Employer/ Attorney receives H1B Receipt Notice.
– If the petition was filed in premium, you may see a decision of approval or RFE within 15 days. Read H1B Regular vs Premium Processing
June 30th to October 1st or later– USCIS processes the submitted petitions and either approve or issues RFEs
– Employer responds, if any RFEs, and submit to USCIS to resume processing.
– Also, if there are not enough petitions filed, USCIS may run a second-round lottery.
July 1st to October 1st or later– H1B Applicants with approved petitions go for stamping as needed to be ready to work in the US
October 1st to Dec 30th– USCIS may run a third-round lottery if enough petitions are not received.
Jan 1st ( next year) to Feb 28th– USCIS will set the status of all registrations as “Not Selected”. This means that there will not be any more rounds of lottery and officially their registration was not picked in the lottery

Someone said, “A picture is worth thousand words“…Below is that picture on H1B visa status flow from employers submitting H1B registration, H1B petition to getting a decision from USCIS. Depending on your case, you could go through few or more of the statuses listed above. We will look at the various scenarios below in detail.

Steps after H1B Registration Lottery until Approval - USCIS processing

H1B High Level Process Flow with Lottery, Processing by USCIS

As you can see in the above H1B case status flow chart with USCIS, the best case scenario after being selected in registration lottery, then petition filing and then to go to approval without any questions or additional information required.  From USCIS Case status standpoint, it would be like below based on premium processing or regular processing category of filing.

Scenario 1 : H1B Process flow for simple Approval Scenario, without any ask for additional documents (Request for Evidence – RFE)

  • H1B Premium processing :
    • First, you will see status “Case Was Received and A Receipt Notice Was Emailed”
    • Second, you will see status  “Case Was Approved And My Decision Was Emailed”
  • H1B Regular Processing
    • First, you will see status “Case Was Received”
    • Second, you will see status “Case Was Approved”

The key information that you need to be aware of is that for regular processing H1B petitions, USCIS do not have any SLA(service level agreement) or time limit and their processing can take few weeks to few months. We have seen cases being approved after 6 to 8 months at times or more, so do not panic, just stay calm and work with your employer or immigration attorney. If you need a result early, you can upgrade regular processing to premium processing to get the decision in 15 calendar days. But, you can only upgrade, if premium processing is available.

Scenario 2 :H1B Process flow after Lottery with Request for Additional Evidence ( RFE)

Not all cases go to direct approval like above. USCIS will ask employers to submit various documents depending on the complexity of the case. Typically reasons for RFE could be for the below reasons:

  • Specialty Occupation
  • Needs of the Petitioner for the Services of the Beneficiary
  • Beneficiary Qualifications
  • Employer-Employee Relationship
  • Maintenance of Status
  • Validation Instrument for Business Enterprises (VIBE)

Check out the article Some of the common H1B RFE Reasons for details on above listed RFE reasons and why you may get them.  As you can see in the flowchart above, typical flow by USCIS case status for approval is like :

  • H1B Premium processing statuses with RFE:
    • First you will see status “Case Was Received and A Receipt Notice Was Emailed”
    • Second you will see status “Request for Additional Evidence Notice was mailed”
    • After your employer/ attorney submits documents, you will see status  “Response to USCIS’ Request for Evidence Was Received”
    • Finally, after USCIS processes the petition and approves it, you will see status “Case Was Approved And My Decision Was Emailed”
  • H1B Regular Processing statuses with RFE :
    • First you will see status “Case Was Received “
    • Second you will see status “Request for Additional Evidence Notice was mailed”
    • After your employer/ attorney submits documents, you will see status  “Response to USCIS’ Request for Evidence Was Received”
    • Finally, after USCIS processes the petition and approves it, you will see status “Decision Notice Mailed”

As far as RFE processing goes, it can takes anywhere from few weeks to several months depending on the response time of your employer and USCIS processing times. It is best to work with employer and submit the documents required on time for timely decision and status.

Scenario 3 : H1B Denied Status – Decision Notice Mailed
Not all H1B petitions filed are approved, some may be denied due to various reasons. In that case, instead of approval you would get denial letter and the final status would still be “Decision Notice Mailed”. Also, some of you may see “Name was updated” at times during the flow, the system does the update whenever some clerical updates are done to your case in the system or some internal activity happening on your case, nothing to panic. It is an internal status.

To put things in perspective, the above case status flow was much more complex in the past with the old system and there were much more statuses. You may read Old H1B case Status flow to get an understanding.

Step 5 : H1B Registration Lottery Final Results – Not Selected Status

In the past, USCIS would mail out H1B reject notices after all the receipt notices are mailed in late July or August of the same year. But, since the H1B Registration process is in place, this is not applicable. The registrations that are not selected in the initial round of lottery are put in waitlist category and USCIS can run multiple rounds of the H1B lottery as needed at a later date.

For FY 2022 season, USCIS ran the second and third round H1B lottery on the registrations. The third round lottery was done in Nov 2021. For selected applicants, the above steps 1 to step 4 would repeat. You can check Sample H1B registration Selection Notice from Second Round Lottery .

USCIS announced final lottery results saying that H1B Cap for FY 2022 was complete in February 2022. So, basically, they kept the registrations in waitlist from April 2021 until Feb 2022. We may expect the same for FY 2023 season as well. So, we may see H1B 2023 registrations waitlisted until February 2023. All the registrations that were not selected would be set to the “Not Selected” Status when USCIS announces the cap is complete for that fiscal year( which could be Feb 2023).

  1. My H1B got picked in a Lottery but , my employer has terminated my job.How could it impact my petition approval. Will there be any RFE even tough it is a Full time opportunity?

      If H-1 petitioner no longer wants to hire you, they may withdraw the petition. If petition is withdrawn before approval, you will be considered out of cap and will have to go through the lottery again.

      No money is refunded so its a financial loss to employer (assuming they paid for the petition)

    My Application for H1b Visa (Form-129) got approved on 25th Jan.
    I want to know, what is the time limit within which i can go for VISA Stamping ? as i am stuck in India with some important work and this might take some time.

      You can go for stamping anytime during the petition validity period. You may be asked about the delay during the visa interview and you should respond to it truthfully – personal reasons or whatever.

    I have applied for H1b transfer for 2016 and the status is ” Case was received”.
    My current H4 visa is till feb 2017 , so now I am forced to give for extension since it will affect my husbands visa extension too.
    So is it advisable to give for my h4 visa extension too or I should not ?

    I got this below message as my case status today . I didn’t get RFE, after i applied my amendment i directly got this messsage on USCIS case status page.

    “On October XX, 2016, we began reviewing your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC1614250xxx. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by October XX, 2016, please call Customer Service.”

    Can you please suggest what it intend for?

      What happenned to your status. Same thing was updated on my case today. Pleaseee let me know what documents they asked and your current case status. I am quite tensed as many people have blogged saying this is almost a denial.

      My question is if my H1b gets picked up and my contract for job ends by that time. Is it possible to not do the further prcocess.
      I mean if I would like to remain in student visa status only then what would be the right process to follow from there ?

        If you want to get rid of the entire petition, then employer will have to contact USCIS to withdraw it. If you want to get the petition but still stay in F-1 status, then travel outside of US while selected H-1 petition is pending, and your H-1 would be approved w/o COS.

  6. My status is still showing as “Case Was Received” on April 11 at the Vermont office. Its been such a long wait. Would be worthwhile to move to PP or wait it out.

    Is it a norm for the approval to come as late as mid Oct ?

    I am currently on L1 visa and my family on L2. I got approved H1b for this year with COS applicable from 1st of Oct.

    But I and my company missed to process COS for my family from L2 to H4.

    We today sent the paper work through attorney for the COS from L2 to H4.

    My question is how much time will it take in this transfer.

    Till that time will my family will go out of status, or what other implications would be there.

      The COS processing time is typically 3-4 months (or longer). You can follow the timeline on USCIS site for form I-539 for your service center.

      As long as USCIS receives the petition before Oct 1, they should be fine.

    • My case was stucked under “Request for Additional Evidence was Mailed”. Some of my colleagues already have their statuses changed to “Response to Request was Received”. Then some was “Case was Approved”. I am really worried by this time since no action has taken place since last August.

    My company has filed L1B to H1B COS.
    Currently i m on I94 valid till feb17
    The status says Case received.
    Is the COS process automatic or does the company/attorney/me need to do
    some paper work to actually change the status to H1 once approved by USCIS.?
    My wife is working on L2 EAD hence i need to know when she needs to stop working.I have seen cases approved as late as Dec every year.
    Appreciate your help.

      If USCIS deems you eligible for COS, they would approve it along w/ H-1 petition. No additional paperwork is required. I assume you included your wife as well for L-2 to H-4 COS.

    My petition of H-1B picked up in the lottery this year and since May month the status is showing as “Case was Recieved”.

    Still my case has not updated.Can you please tell me how much more time it will take to change the status and why it is taking time.

    My petition of H-1b picked up in the lottery this year and since May month the status is showing as “Case Was Transferred And A New Office Has Jurisdiction”.I have come to know that petition is valid from october 2016 to travel if stamping is done.
    Can let me know why they have not taken any action till now…in my office most of the colleagues status is same without change.This year, is there any possible delays in approval.

      The delay this year is not different from other years. Every year there are petitions left in pending status even after Oct. So not an alarming delay yet.

            Even if you upgrade to PP, you may not get any visa interview dates until Dec-Jan. So you have to decide whether you want to get decision now and then wait for interview date availability, or get more clarity on your visa process and upgrade it now.

            Also, depends upon your travel plans to US.

    I am working in a service provider, initially they filled the petition for Client A and now Client B.

    So my question is that can we change the client before petition approval ?? As I came to know that we can change the employer only after the Approval.

        The first step I would suggest to take some English Language courses, as it would be the only language you will speak in US, instead of some ANNA language.

        Then join some primary school where you would be able to understand what human being interprets.

        Its good you know about RFE, but you dont need to bother about it unless you gets it. Just like cancer/AIDS. etc…

        I wonder how ill you survive when you cannot even understand plain English statement or even write it.

            It was moved from VT center to CA center. USCIS made an announcement for this earlier, and this is being done to equalize the work load. You are not alone.

  16. Hi ,

    I on my 19th May when I queried my case status it said “Case Was Approved” and that USCIS will mail my approval notice. Subsequently my attorney got the approval email from uscis which clearly stated “The form I-797 Approval Notice will follow in the mail.” Now when I check my case status it says “Name Was Updated” on May27. Further it says “On May 27, 2016, we updated your name for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WACxxxxxxx”. What could be the possible reasons for this status change considering my case was approved, anybody else has got similar experience, is there a cause for concern?

    Mine is a peculiar case, I have received my receipt. But i would want my visa to get approved late, if not attend the interview late by around November. Because i am travelling to mexico between July to November and may bot be available in India for h1b Stamping and interview before November.

      You can’t delay the approval date for your petition. Even if the petition is approved, doesn’t mean that you need to get the visa stamped immediately. You can appear for visa stamping anytime during petition validity date.

  19. After being picked in the lottery, is it possible to switch to PP for quicker processing? Also, can a PP processed applicant allowed to travel and work in US before 1st October?

      Once selected, it can be upgraded to PP. Even under PP, timelines for stamping and travel remain the same as RP. Its just that you receive the decision quicker than RP.

    My employer filed my petition through PP and it’s got picked up in H1B lottery this year. Now, on USCIS website, the status is RFE.
    My question is once USCIS receives what they want in RFE, how much time will they take to give the final decision for PP candidates? Will USCIS process early after they receive the response to RFE for PP candidates.

  22. Hi Kumar, I have a simple question. My employer said that they had filed my petition as premium processing for me but when I see the status, It shows “Case Was Received”. Does it mean that my case was filed with regular instead of premium?

      If the status message uses the word “email” then it has been applied w/ PP. In addition, you should hear about approval or RFE by May 27, if it has been applied in PP.

    My question is, what’s the process to take my family along with me.
    My employer says that i need to taken them along with me for stamping with just ds160.
    Is there anything specific i need to do for H4..

      Your employer is correct. Whenever you are ready to go for stamping, your dependents can accompany you after paying visa fees and completing DS-160 forms. No additional action is required.

    Today I came to know that my petition was selected in lottery, but unfortunately I was laid off by my employer. However they have said they won’t withdraw the petition till Nov 1st.
    What are the chances my h1b is approved ? Is it still possible USCIS will approve or would they reject based on fact that i am no longer with the company that filed my h1b … (I am optimistic in landing a new job by May end.)
    Appreciate any replies.

    • I dont see a reply to this comment. One of my friends is in a similar state. His name was picked in the H1 lottery this year but he was laid off yesterday. The company which registered his name with USCIS has not filed H1 yet after lottery.
      Is my friend still eligible to file his case through a new employer based on this year lottery result or does he have to register his name again in next year’s lottery ?

        No they cannot file, there is no transfer option. Only the company that did registration can file H1B. He has to go through lottery next year.

    I have a question on Travel Plan for india. By luck, my file is picked up in current lottery. My case is in regular process and my OPT is expires on Novemeber 1, 2016. Should i travel to India in Decemeber, if my don’t get response by that time (before Decemeber)? Or i should apply for Premium right now?

      You can wait to see if your petition gets processed by Nov. By Sep, you can upgrade to PP to get result by Nov. You would have to get H-1 visa stamped when you go to India, so make sure it gets approved by that time.

  27. Got mailer from my employer that my petition got picked in lottery.

    2 attempts, 1st petition expired, tried to process CAP exempt last time, got denied stating I was not Cap Exempt as I exceeded 6 years of allowed time limit plus some weird reason that my case does not qualify as specialty occupation which is weird. Anyways, 2nd attempt picked again, so I guess I am lucky after-all. Now the wait begins. Good luck folks!

    If gets approved,
    should I still register for classes sep ’16, and register a course for CPT to cover till oct 1st or not necessary.

    And how soon can I apply for Green card with employer.

    sorry guys if you feel this is unrelated, I just want to know and maybe it will be good for guys to know what next steps are so people who are waiting are not pissed off.

    • Walter,

      It has started and people are getting notified slowly. First the selected PP candidates are notified, followed by selected non-PP candidates. Rest will know about the rejection letters June-July onwards.

  31. Still 3 more days to go. But no news on the status. Mine is still showing ” transferred to ………..” . Shall i be optimistic on the approval???. Any chances of my petition getting approved?. Kumar can you please tell me your opinion on this.

  32. I have couple of questions:

    1) How CV is important for H1B petetion to be approved? Is it should be same as Last year submitted for H1B Application.
    2) If I apply from #2 employers …then what happens? If one selected and one rejected then is the H1B Fees paid by employer to USCIS will be returned?

      1. You can change the CV and it is ok as long as it remains truthful.
      2. Fees is returned only if the petition is not selected in the lottery. If they both are selected, and one gets denied, then the fees is not returned.

    There has been absolutely no change in my case ever. No RFE, no approval/rejection either.
    I believe I am not the only one facing this situation.
    Is there anything I should be doing now ? My employer has no information either.

        • you cannot raise an inquiry on your own, your employer has to do it. you can search online about the procedure. Most of the times uscis just gives a standard reponse that they are working on the case. which does not help much. you can try inquiry if it does not help you get an approriate answer upgrade to premium. dont know how much patience you can keep.

    • Once it has been denied, there is no more PP. PP is available while the petition is still pending.

      Your only option is to file MTR or appeal and that too if employer agrees. They will have to look at rejection reasons and then evaluate whether they have a case for reversal of decision or not.

      Otherwise, go for next year’s cap.

  34. Not sure if everyone is following the news in U.S. Media these days but the H1-b reform bill aims to address the loopholes in the system! Yay! I feel sorry for all the outsourcing companies abusing the system but finally things are getting straightened up in a way that would help the economies of both the countries!

    This site is really useful and had helped me a lot to keep my calm while waiting for my visa approval. Thanks a lot to everyone!

    I had a quick question. Now that the approvals are coming in after Oct 1st, what would be the start date of the employment be for people who are already in U.S ? So, suppose my visa gets approved on 11th November, can I start working immediately or do I have to wait for all the approval documents to reach my employer?

    • SS,
      If H-1 is approved w/ COS (i.e. an attached I-94), then you are considered on H-1 status from the date mentioned in I-94. You need to start working and getting paid from that date.

      However, some employers prefer to wait for approval copy in hand (for compliance purposes and to know that it has I-94 attached), before getting you on-board. So this may delay the start by a week or so.

    I applied for H1B (COS) this year through “B” company. But got RFE.

    Now can “C” company apply for my H1B, as I have already been selected in lottery.

      C cannot file for cap-exempt petition until B’s petition gets approved. If B’s petition is denied, then C can file for a cap-subject petition in April 2016.

    My case status still shows Received on April 13th. Its been like this since day1. I am starting to get a little worried now. A few of my friends have even got their stamping done(non-premium processing).
    Does it depend on the employer? Is there something I should be doing now ?

      • I had more than one sponsor and RFE was dispatched to both sponsors on the same day on October 5th. Don’t have the RFE in my hand yet so not sure of the content. Did you have more than 1 sponsor? Do you think they decided to process folks with more than 1 sponsor a bit later in the process..like after 10/1?

      • I just have one sponsor. No status change, no RFE either.
        Its alright if they are taking time to process the case… they should at-least keep us informed. All governments work alike irrespective of the country I guess.

      it depends if you case is regular or PP
      also there is no last date for approval
      The best thing you could do is sign up for USCIS notifications service using your email account. As soon as there is any activity on the file you will get updates.
      It happened with me on 28th Sept Monday morning officer approved my petition and as soon as he updated it on his system I got email saying I129 approved.

    I have a quick question regarding an RFE… My Company applied my H1B with a Project work for CLIENT A when the LCA was filed in 2015 and it got Certified followed by which the Petition was picked up in the Lottery…

    Now we received an RFE for Client Letter from CLIENT A … However the Client A is not providing the Client Letter, So my Employer is likely to change the project to CLIENT B get a Client Letter and MSA from CLIENT B and respond back to the RFE…

    Please Note : The Work Location mentioned is the same as mentioned in the Initial LCA that was Certified since it is a In-House Project that will Support the Customer from my Employer’s Location..

    Do you have any suggestions in this Approach ? Is this even possible ?

    Appreciate your Thoughts…
