As many of you know, USCIS changed the form I-539 for Extensions, added Biometrics, which delays overall processing of H4, even if it is filed with H1B in premium processing. Many are waiting for experiences and wanted to have a look at sample Biometrics Notice as well. One of our awesome readers, anonymous for privacy, shared a copy of the Biometric Notice as part of the new H4 and H4 EAD processing and shared his timeline. Thanks a lot to him for taking time to share his experience. We also have many users, who shared their experiences in the article, they are further down in the article and in comments.  In general, biometrics is not required, if you are  applying for H4 EAD only and not using I-539 form for H4 Extension. 

Background of H4 Extension with New I-539 form filed with USCIS for Biometrics:  Applied for H1B, H4 and H4 EAD together in Premium Processing at Vermont Service Center.

H4 Extension with USCIS – New Biometric Process

  • You file the H4 application with New I-539 Form that includes additional fee for Biometrics
    • Most of the cases, you file along with H1B. If H1B is filed in premium, you will get the H1B approved, and then H4 processing happens as it needs biometrics. USCIS guidance is that they will adjudicate it soon after biometrics are done.
  • You get H4 Application Receipt along with H1B and EAD receipts
  • You get the H4 Biometric Receipt physical copy in snail mail to visit Application Service Center (ASC) that has date and time
    • If you cannot make it on the given day, you can request for re-scheduling.
  • You visit ASC on the given day and time and give Biometrics.
  • Your H4 Biometrics may go through criminal history check of FBI
  • Decision on your H4 application with USCIS
  • Physical copy of H4 Decision Notice mailed to your address.

The process is as it stands today, we will update it based on general users’ experiences as we go along.

H4 Biometric Documents Required at the Application Support Center :

  • The Biometric Appointment Notice sent to you by mail
  • Photo Identification Document issued by Government like below
    • Passport
    • Driver’s License,
    • National ID
    • Military ID
    • State Issued Photo ID.
    • If you fail to get Photo ID, you will not be fingerprinted / allowed to take biometrics.
  • It is recommended that you review that H4 I-539 application form that you submitted or sent to USCIS, so that you can confirm, if all the details are the same.
  • Any additional Biometric forms : USCIS does not have any special biometric forms and there is no need to fill out any separate forms related to Biometrics to visit the ASC.

Experience of Giving Biometrics at Application Support Center

Giving Biometrics at ASC by H4 applicant is a very straight forward process. As mentioned above, you need required documents : Government issued Photo ID and Appointment letter. Below are the high level steps at ASC for biometrics

  • Step 1 : You are given a Token Number and will be asked to fill a basic form
  • Step 2 : You need to fill the form Applicant Information Worksheet (AIW), given to you, where you need to fill in information like Name, Date of Birth, Eye and Hair Color, Height and Weight, etc. Below is the sample shared by another user. Thanks to the user (anonymous for privacy) for sharing the form with the community.
  • Step 3 : Your token number is called and they will take your Photo and Fingerprints
  • Step 4 : They stamp your Biometrics Appointment Letter after the process is complete. The stamp indicates that your biometrics are taken proof that you visited the ASC. See below sample of the stamp given at ASC. Thanks to our user for sharing the stamped letter at ASC. At the end of article we have the full receipt notice with stamp as well for your reference on how it looks.
  • Step 5 : Wait for the decision from USCIS. Your Biometrics status is may or may not reflect on the USCIS status. Sometimes, you will continue to see the status “Case Was Received” , which is the status before  giving the biometrics.
    • Update : One of our readers shared that they have seen a status update on USCIS that says ‘Fingerprint Review was completed’. So, some of you may say this status
  • Step 6 : Decision from USCIS [ waiting for it. ]

What will USCIS do with the Biometrics given by you ?

USCIS may use your biometrics/ fingerprints to check criminal history of FBI. You may request a copy of your own FBI identification record using procedures listed at Title 28 C.F.R., Section 16.32. You may also get it corrected or updated as outlined within the same Title 28 C.F.R., Section 16.34.

H4 Biometric Appointment Letter from Application Support Center (ASC)

Even though some of you may know the standard Biometrics Letter from USCIS, it is good to re-confirm the same and have a look at the same ASC Appointment Notice . Again, thanks to our reader for sharing the Biometric Appointment Letter. See below screenshot at the end of article. It has the below details  on the same

  • H4 Petition Tracking Number
  • Name and address of the applicant
  • Application Support Center (ASC) Address
  • Date and Time of Appointment at ASC

Key info from the Biometric Application Support Center (ASC) Appointment Letter :

It says that you to process your H4 application/petition with USCIS, you need to appear at the Application Support center  of USCIS at given time and date and give biometrics. If you do not show up at the ASC, then your application/petition will be considered as abandoned.

Can I reschedule my H4 Biometric Appointment with ASC ?

Yes, you can request to reschedule your appointment, if you cannot make it to ASC on the specified data and time. The process is simple, you make a copy of the Appointment letter for your records, check the box as listed in the ASC Appointment Letter and mail the Original letter to  below address:

  • BPU, Alexandria ASC, Suite 100, 8850 Richmond Hwy, Alexandria, VA 22309-1586

Also, if you have open wound or bandage/casts, when you appear for appointment, USCIS may reschedule the appointment if they believe that they will interfere with taking the biometrics.

What if I am outside of the Country ? H4 Biometrics with Travel and outside of USA ?

As per USCIS guidance, on their I-539 form instructions (page 12), you should call up the nearest US consulate/ embassy and arrange for the biometrics. It says “If you are currently overseas, instruct you to contact a US Embassy, US Consulate or USCIS Office outside of United States to setup an appointment “,  see below screenshot. 

What are not allowed at Application Support Center for Biometrics ?

You cannot carry Cell Phones, Cameras or any Recording Devices to the Application Support Center (ASC), when you go for giving biometrics.   Also, due to limited seating, they suggest that only person giving biometrics and who are necessary for transportation or helping with biometrics should be entering ASC.

Can you Travel outside of Country, with H4 Extension/ COS Pending with USCIS ?

Yes, you may travel out of US, but if you travel, your pending H4 Extension / COS with USCIS will be considered abandoned.  There are few scenarios with H4, H4 EAD and travel, read Travel out of US with H4 Extension, COS or H4 EAD Pending ? Options ?  

Can you continue to work on H4 EAD, with pending H4 EAD Receipt Notice ? Do you get 180 days automatic extension ?

No, you cannot work with pending H4 EAD receipt notice as the category of H4 EAD, which is C26 is not eligible for automatic 180 days automatic extension. For all details, official references, read Can you continue to work with Pending H4 EAD Receipt Notice ?

Approved H4 Petitions Experiences without Litigation

H4 + H4 EAD with Biometrics –  Premium Processing H1B Petition – Experience – #1

  • Documents sent to USCIS Offices : March 26th, 2019
  • Documents Received by USCIS at Vermont : March 27th, 2019
  • All three (H1B, H4, H4 EAD ) receipts generated : March 28th, 2019
    • Processing time – 1 day from documents received by USCIS
    • H4 Biometric Notice was generated as well.
  • H1B Petition Approved : April 3rd, 2019
    • Processing time – 6 days from receipt generated date
  • H4 Biometric Letter Received : April 5th, 2019
    • Processing time – 8 days from receipt generated date
  • H4 Biometric Appointment : April 19th, 2019
    • Appointment date – 21 days from H4 receipt generated date

    • Walked in to a Application Support center, as they gave out of state location, ASC accepted it and gave biometrics.

    • Traveled out of Country and re-entered with valid H4 visa ( previous H4 stamp valid till mid July )
    • CBP officer at port of entry gave I-94 with H4 on it until end of new H1B approved in April 2019.
    • Technically H4 status is extended until end of H1B expiry.
  • H4 EAD Decision  Online :  June 11th, 2019
    • Online Status of H4 EAD Changed to “New Card is being produced” ( see below screenshot )
  • H4 Visa Application I-539 form Approved : June 12th, 2019
    • The status of I-539 Extension shows “Case Was Approved” on USCIS website.  Yet to receive the notice. See below. We need to see what happens to I-94 number.
  • H4 Approval, EAD Approval :  June 17th, 2019 in Mail.
    • For H4, Online Status Says “Case Was received”, but under DHS account it says Approved.

04/18 – Received receipt numbers for H4
04/25 – Attended Biometrics.
05/16 – Received H4 Approval Notice along with H1 Copy.

  • H4 Approved after almost 20 Days after giving Biometrics or about 45 Days from filing H1B + H4 together in premium

    • As the card is issued, assuming that H4 is also approved, but the online system is not updated. So, may not be accurate online messages.

  • H1B Approved on April 19th
  • H4 Biometrics appointment done on May 10th
  • H4 & EAD approved on June 19th and received the courtesy copy on June 24th.
    • H4 Online status has also changed to case approved.
  • Waiting for the originals and EAD card.

Took 66 days from application and 39 days from Biometrics for the H4 case and EAD to be approved.

  • Documents Needed : Passport, Appointment notice.
  • Outcome: They will stamp acknowledgement of your attendance on same appointment notice
  • Details of Biometric Process: Smooth process . No hassles. We went before they opened at 8:00 am and we got token number 3. So it was pretty quick .
  • One minor issue:  Wife did not have Alien number as she is not eligible for EAD yet. So they double checked her details and continued with process. Not any obstacle.

  • H4 Receipt Generated : March 27th

    • Receipt Numbers generated by USCIS is not exactly in the order of application received date.     • My status got updated on Aug 22 at 3AM Pacific time. Probably some cron job updates status in bulk. IMO your case might have been already approved but it does not reflect on the website.

  • I did raise an expedite request through USCIS and Congressman, both of which got denied immediately. Finally logged another request on August 30th stating that my EAD was going to expire in 4 days. I received a mail stating that the case is already with an officer and there is no need to expedite it.
  • Also when I called USCIS to raise the expedite request, they told me, NSC received Bio-metrics for my case on August 21st. This was not updated on the online portal. So that might explain why a lot of people are seeing ‘Fingerprint review complete’, because NSC started to get actual bio metrics information in third week of august (smh). I hope this is a sign of the process getting streamlined and hopefully this will trigger faster approvals for everyone who are waiting.

    • 9/4–H4 EAD card being mailed to me

    • I have been following this forum and at one stage I thought of going with RN law but later decided to wait. My expedited request status is still not updated and congressman request was not fulfilled by uscis. But I felt like raising awareness to uscis on our case is helping .

  • Reached US back August 2nd week and raised expedite request.
  • Status changed on H4 to Fingerprint review completed on Aug 21, 2019
  • Even after 3 weeks after the expedite request, no updates..
  • Raised another expedite request on Sept 3.
  • Expedite request got denied on Sept 4, saying that application is already approved. Not sure if the second expedite triggered the approval or it was already approved.

  • June 17 – completed Biometrics
  • July 20 – Had to travel to Canada. I had expired visa but valid H4 i-797 upto Oct 2019. Asked many forums, company attorneys, even called USCIS and was told I am eligible to travel under 30-day rule, automatic visa revalidation. USCIS said my applications should not be affected since I would not get a new i-94
  • July29 – Returned from Canada. At vancouver airport, the visa officer first denied entry. Then a senior officer in back office gave me entry but issued a new i-94 and online i-94 showed F1 status.
  • Aug 10 – CBP i-94 correction office corrected the status back to H4 but was stuck with new I-94. Didnt know what would happen to my applications. Company attorney said if RFE comes, we will address it.
  • Sep 5- EAD application changed to “new card is being produced”.
    • H4 / EAD Approved in 99 Days after filing
    • H4 / EAD Approved in 81 days from Biometrics
  • Sep 6- EAD I-765 was approved
  • Sep 10- EAD mail picked up by USPS.
  • Sept 11- Called USCIS why H4 was still “case was received”. The rep told me they mailed the H4 I-539 approval also on Sept. 6th itself.

  • I have same experience as many users that online status of H4 did not reflect the approval. I was super worried that I would be given EAD up to Oct 2019 and my extension would be denied because of my new I-94 after Canada trip.But Everything worked out finally.     – H1+H4+H4 EAD applied in PP in April 8,2019, California SC
    – Received RFE on April 11
    – Initial bio metric appointment was on May 3rd, rescheduled to June 4th

    beginning in USCIS case status site. When I created account in USCIS,
    status shows as “case received”.

    Question: As biometrics were already completed by the time USCIS starts working on my case on July 3rd, any chance H4 and EAD will be approved along with H1 as well? Did any one face such situation?

      USCIS has not been adjudicated in premium processing for H4 and H4 EAD, so you may not get that along with H1B. Many are waiting with Biometrics completed as in above experiences or comment section…

        I have read the experiences above and in the comments section. But my case is little different, as due to the RFE, my biometric process as been completed by the time my response was submitted. So logically, when my case is worked on, the USCIS officer should have biometric info already…only question is if he will approve H4 and EAD as well or adjudicate them later. Thanks!

            I finally received my EAD card today. No litigation, no expedite request. Below is the timeline:
            – April 8,2019: H1+H4+H4 EAD applied in PP, California SC
            – April 11: Received H1 RFE
            – Initial bio metric appointment was on May 3rd, rescheduled to June 4th and completed bio metric on June 4th.
            – July 3rd: Responded to RFE
            – July 12: H1 Approved
            – July 30: EAD status changed to “New Card is being produced”, H4 status changed to “Case is Approved”
            – July 31: EAD status changed to “Card has been mailed”
            – August 2: Received EAD and H4 approval notices and EAD card in mail.

    04/18 – USCIS received H1, H4 and H4 EAD extension application in PP (Vermont).
    04/25 – Received biometric notice for H4 extension.
    04/29 – H1B Approved.
    05/06 – Attended Biometrics.
    07/06 – Received mail that H4 is approved.
    07/11 – Received H4 extension.

    Waiting for H4-EAD. Status of H4 and H4-EAD still shows as “Case Received” on USCIS website.

    I have H4 extension applied for my wife. We gave bio-metrics on 11th June and still awaiting result. We have a travel coming up in first week of September.
    Is it fine if we travel to India with Extension still in process?
    Also, our visa is expiring this July, so we have to go for Visa Stamping as well before returning. How does it impact this extension?

      You may go to India, couple of users have reported that they got H4 stamping done and returned and their H4 application was also processed here… If you do not hear back before you travel on H4, one of the things you could do is to send a withdraw letter to USCIS before you travel back and get H4 visa stamping done in India.

    My company has applied for my h1 extension in premium last week and upon the advice of my attorney -we did not include my wife’s h4 extension as part of the application. The advice was to go outside the country and get h4 stamped with my approved h1 to speed up the process and then apply for H4 ead extension as she is already working on H4EAD currently.

    The question I have is that once I get my extension, if I plan a trip to India -will both of us get an option for Drop box?

    And if we do, will it be a problem for my wife’s H4 EAD application when we come back, as she would have not given updated biometrics? Thank you.

      Yes, you can do that and go for dropbox, if you fulfil the general dropbox requirements.
      No, it will not be problem. H4 EAD does not require biometrics, it is only for H4 application filed using I-539 form and NOT for EAD

        So just to be clear although she is working with h4 EAD now, since when we go to dropbox in india she is considered a ‘new’ H4 application, the request for Biometrics wont be required for her as we wont use the i-539 form?

          If she never had H4 or H1B visa, then she may not be eligible for dropbox. Don’t mix up I-539 process with US Visa stamping, both are different and not related for biometrics.

    H1 got approved on June 11th
    On June 17th walked in for Biometrics appointment
    On June 18th the status got updated “Finger print Review completed”
    June 21st called Usics to expediate the H4 visa on humanitarian aspects , as we have planned India trip for July 13th

    No any update after that , since we have stamping In Chennai consulate and H4 is not approved we are planning to cancel the trip

    Heylo everyone, I have been following this group for a while now and here are my details.

    Service Center – California
    04/29/2019 – Filled H1, H4 and H4 EAD in premium processing.
    05/09/2019 – H1 B approved.
    05/22/2019 – Completed Biometrics appointment.
    07/09/2019 – Provided my case details to local senator office, they did followup with USCIS on 07/09 and USCIS replied back to the senators office on 07/10 and mentioned that H4 and EAD will no longer be processed under premium.
    07/10/2019 – Case status for EAD shows “New card is being produced” while H4 case status still shows “fingerprint review completed”.

    Will update more details once I receive the approval and EAD card.

        Senator’s office was not able to expedite the application. USCIS clearly told them that H4 and EAD are no more premium. I am not sure if the EAD status changed because of inquiry from senator’s office or just the timing.

    Hi,

    My applied for H1+H4_H4EAD in May last week. Got H1 approval in a week and i gave my Biometrics on June 10th. The service center is Nebraska.

    I’m not expecting this early, but my H4 and EAD expires on September 12th and i don’t have any hope that i will get approval by that time. I will loose my job if i don’t submit my approval in that week.

    Do i have any options now? Will i have hope if i go out of country and get my H4 stamped?

    Below are the my case details:

    Service Center: Nebraska
    H1+H4+H4AED filled in PP on April 15th, 2109.
    H1 Approved within 15days.
    Biometric for H4 is done on May 10, 2019.
    H4EAD status: Still status is showing as Case was received as of 07/09
    Raised couple of expedite requests stating i will have a financial loss and loose medical coverage if it is not approved by July 1, 2019.
    Both the requests were denied stating it is not eligible for expedite process.

    Spouse has to quit the job due to this. Any suggestions?
    H4 is also pending.

          Its waste of time. I tried all the ways. They made the criteria stricter these. They just don’t want the EAD’s to get approved by expediting. Believe me I submitted solid proofs twice . But they asked me the proofs that showcases failing of employer which is impossible to prove at least for IT companies.

      I wish, there was another option. Unfortunately, there is no other option…You may travel out and re-enter to get H4 extended, but may not help as you will still need H4 EAD to work…

    Not sure if this helps but on July 2nd I called the uscis help center and asked them to expedite my case. I was told that I would receive a call in next 5 business days and I was asked the expedite reason. I mentioned that my job was at stake due to visa expiry.

      Hi Vineeta, I am also on the same boat right now. Will be losing my job as mine expires next week and my EAD status online says “case received” We had our biometrics on 5/28 (oakland,CA) and still awaiting for updates.

        Same here. The status is Case Received. I did my bio-metrics on 6/12. It is very hard to keep a job in this situation and make ends meet. Our application is in the Nebraska Service Center. What about you? I have put in for an expedite request but haven’t heard back from them.

    My wife is currently out of status more then 10 months in June i have applied H4 with nunc pro tunc process along with H1B in premium process. My H1B approved and she got receipt and gave Bio-metric is on July 1st 19, wanted to know if she can stay in the country legally with the new receipt number and to wait for an approval ? 1st Aug 19 she will complete 1 year, if the approval is delayed beyond ?

    This has been the status from day we received the H4 receipt.

    I created an account on the myUSCIS site and it shows
    “We received your case
    You do not need to do anything at this time
    We will let you know if we need anything else from you as we continue to review your case.”

    Waiting for H4 and EAD approval.

      Looks like you filed H4-EAD separately while H4 extension is pending. I need some help. Did you leave I-94 column in the questionnaire blank and provided I-797C as the proof of status?.

          I filed the h4 extension separately on 06/20. It is Nebraska service center. I received the H4 notice on 07/10. I called USCIS about the biometric notice today but the representative said that there is no information about my appointment in the system. Does that mean USCIS has not generated my appointment notice yet? Or the representative does not have the right to see the information? Thank you and expect your reply.

    One question please. I am currently in the same boat as most of you all with h1b approved for 3 yrs but h4/h4ead pending.
    I need to file h1b amendment for change in work location now.
    Assuming that I file it and it reduces my h1b validity to dec 2019.
    – would this invalidate the in process h4/h4 ead?
    – If current h4/h4 EAD does get approved, would that validity be 3 yrs or until dec 2019 as per my amended h1b petition?

      – Well, it may not invalidate that as it is amendment and not change of status. I suggest you check with your attorney filing H1B amendment to be sure.
      – It will be based on your H1B validity usually, if anything changes on that side, similar things would reflect for H4.

    Need some suggestion regarding H4 visa for kids using Dropbox option.

    My kids are currently in India. H1 is approved and H4 for Spouse, kids are still in pending with USCIS post biometric.

    H1 holder passport has expired US visa, can I use dropbox option to get my kids passports stamped?

    Can anyone please help me on this ASAP?

      Hi NSP,

      H4 visa with Dropbox can be availed by spouse and kids if it’s valid for you. Considering the fact that your visa has not not expired past an year. Good luck with your stamping!

      H1B expired visa does not matter. Yes, as long as your kids meet the general H4 dropbox requirements, they can go for it using the H1B approval notice.

    04/05/2019 – H1 Approval received for my spouse
    04/12/2019 – I got physical mail for Biometrics appointment
    04/24/2019 – Biometrics Appointment
    Process was pretty straightforward. I could carry my phone inside but had to switch it off, that’s all.

    As on 5th July 2019, still no change in status – it’s the same as “Case Was Received”

    I travelled to India and went for Dropbox on 27th June and I got approved visa on 5th July. The effective start date is 3rd Jul and end date is the expiration date of H1 visa. I had existing visa valid till 4th Sep. At least one hurdle passed, I’ll keep you guys posted on how things go at the port of entry when I’ll travel back to U.S. in Aug.

      @VCEAD Even we applied for H1B+H4+H4 EAD on march 28th at nebraska service center and they are still pending. When I asked about traveling outside country my attorney suggested not to do that as it would cause issue in approvals. But seems like it is very easy in your case. Any update on your EAD?

    Applied H1 Extension, H4 Extension and H4 EAD Extension all together in premium processing in April 2019

    California Service center

    1) USCIS Received date 04/26/2019 for H1 Extension, H4 Extension and H4 EAD Extension in premium processing
    2) USCIS Notice date 04/29/2019 (receipt notices i797c for H1 Ext, H4 Ext and H4 EAD Ext)

    3) H1 approved on 05/06/2019 for 3 years until Aug 2022.
    4) H4 biometric notice received on 05/10/2019
    5) actually scheduled biometric appointment for 05/24/2019 but we did direct walk in on 05/13/2019. So we did biometric 9 days before actual scheduled appointment date.

    After my H1 approval and biometrics, we were waiting like any others for H4 Ext Approval and H4 EAD Extension approval.

    6) We had to travel to India when H4 Ext and H4 EAD Ext where in pending state, our travel was un avoidable. So we both left the country on 05/25/2019.
    7) We both did drop box in India for h1 stamping on 3rd June.
    8) I got H1 stamped in drop box, spouse got 221g asked to come in for in person interview.
    Many people told that our H4 and H4 EAD are going to be considered invalid as we traveled outside the country when h4 and H4 EAD were pending
    9) I came back in to the country.
    10) Once i reached home i see approval notices in mail box for H4 and H4 EAD (i765).
    11) Notice date for H4 and H4 EAD (i765) is 06/25/2019. Which is like 1 month and 13 days after biometrics.
    12) Approval for H4 and H4 EAD is until August 2022. My H1 is also approved until August 2022 on 05/06/2019
    13) Online case status shows correctly for H4 EAD but not for H4. For H4 Case status says application received when i have an approval H4 i797A original in my hand . I also have the i94 copy for H4 approval. Spouse is still in India trying to attend in person interview for H4 Stamping

      I am in the same boat, traveling to India in mid of July and have dropbox. So, according to your case your wife(H4) was issued 221g and asked to come in person – did she had to schedule and appointment? usually 221g will ask the person to come in person but no appointment is needed right? Please clarify becoz I am H4 and I am worried that I would have to face the same situation and my child is in middle school, so I don’t want her to miss school.

        spouse got email on her email about 221g asked to come in for in person interview in Hyd Consulate. We got this email after 11 days from the day we dropped our documents.

        In the same email , we where asked to login back to the UStraveldocs website. when we logged in it prompted automatically with a list of dates which were 2 week away from the current day and we choose the first day on the list and appeared for the 221g inperson interview for H4 in HYD consulate . In the 221g interview at HYD asked some basic questions. We were told that visa approved but was also told admin processing will take time. As of today 4th July 2019, Still waiting for response its been 3 days already after attending the 221g interview.

    According to USCIS official website info, NEBRASKA service center is only dealing with the case submited in Jan, 2019….I guess this is not the real time situation right?

      Jan 2019 is worst case scenario cases. So if you check processing times website, Nebraska Service Center has a timeline of 3.5 to 5.5 months. These numbers mean that 50% of the cases are approved in 3.5 months and 90% are approved after 5.5 months. Remaining 10% go into outside processing times. So Median for approval is 3.5 months.

          Yeah I don’t think posting on their Twitter is going to help. USCIS twitter account is already flooded with processing delay posts (especially I-130 form, not sure what that is). I think the best way to proceed is to go to your local congressman and ask them to help you out. (I did it last time when my EAD card was lost in the mail, not sure if it helped but I got the card earlier than usual processing times). If that does not work then file a litigation with RN law group. I am going to go ahead with this in 3 or 4 weeks if nothing happens.

    2. Submitted dropbox visa application for H1b and H4 using new H1b I-797. (Technically it was not required as old visa is valid till 06/2020. Still decided to get new visa stamp)

    3. Got passports with new visa stamp in 1 week valid till 04/2022

    I will update about immigration experience and dates on i94.

      You can give it a try, it does not hurt. If you look at the sample, it says to bring the notice, does not say This original notice..
      No one has posted such experience. If you chose to try, do share the experience with community.

    Thank you for maintaining this site and this page. It is very very helpful to see experiences from people in similar situations! Sorry for the long post in advance. I have a couple of questions about my unique case. It is as follows:

    I have an approved H1B and my spouse has approved H4 both stamped and valid until Oct 2019. My company filed for my H1 extension in premium processing along with H4 extension and H4 EAD and my H1 got approved last month(valid from OCT 2019 – OCT 2022) but both H4 and H4 EAD are pending. Both of us wanted to travel to Canada and our attorney suggested that we should go by air so that both of our I-94s would get updated for sure to end date of my latest extension approval(until Oct 2022). In this case even if my wife’s H4 ext and H4 EAD gets denied due to travel while pending, we won’t have to file for her H4 as I-94 would get extended when we come back(we would just re-file H4 EAD if denied). So taking this advice into consideration, we traveled to Canada and came back via flight. However at the border, officer did not update both of our I-94 to my latest I-797 end date(even after showing him the I-797), he said he cannot give I-94 until that date because the petition has not started, it will start in October. Instead he gave I-94 with new number but same OCT 2019 expiry. My questions on this are as follows:

    1) I read about the last action rule and there are conflicting opinions on this. According to last action rule, last action taken governs the stay, in my case my I-94 at CBP, so would that invalidate my approved H1B extension? Do we have to re-file H1 Extension or do I have to leave just before October and get a stamp and come back? but if extension is no longer valid, would I be able to get a stamp? My attorney is suggesting, I don’t have to do anything and my extension is valid and would get kicked in normally after in Oct, I am looking for more opinions on this. Has anyone faced this before?

    2) Regarding H4 extension and H4 EAD, they might both get denied as they are still not approved and we traveled. However according to the first experience posted on this page, both of them got approved regardless, so should we wait for a month or so to see if they get approved? First experience posted on this page is very similar to my case but it had all best case outcomes. Both H4 and EAD got approved regardless of travel and most importantly I-94 got updated to H1 Extension expiry date(even though H1 start date was in the future similar to mine), which in my case is the major problem.

    Has anyone had similar experience? Any help would be greatly appreciated.

      Sri,
      Your situation is exactly like the first experience. As far as that user is concerned, they also got different I-94 at the entry and at least for them, they got H4 approval with old I-94 with extended date and it was not abandoned as it was an extension it seems. It is a grey area and seems conflicting info on this as per USCIS website as well…So, Maybe you can give it few more weeks and then take a call as you still have date till October. There is very little data on this. Please share your update with community, once you hear anything back…

    it will take around 7 days for dropbox approval. administration processing is valid state. You will get approval in few days.

    05/15 – H1B Approved.
    05/29 – Attended Biometrics.
    06/30 – H4 EAD case status changed to “New card is being produced”. H4 COS status is not yet changed.

      Great. Thanks for sharing. Do let the community know, once you have the documents of H4 and EAD. H4 should also be approved as EAD is dependent on that, just that it could be the online system is not updated.

    For Visa stamping/Dropbox you just need the primary H1B approval. You dont need the H4 approval. I went for dropbox last week with just primary H1B approval

      Is it ok for H4 candidates travel to India now? If I travel by 20th Jul 2019, all of us eligible for Dropbox?

        we did travel to india when H4 Ext and H4 EAD Ext was pending. When spouse was still outside the country. we got our H4 and H4 EAD approved. California center.

      That’s great news Vijay. Have you received your H4 stamped visa yet ? Officer at the drop box office told me that H1 approval is important but he in anyways took all my documents. I told him the same thing that H1 approval copy should suffice. He indicated that because of EAD situation it’s not a straight forward process anymore. I hope he is wrong.

          I had opted for Dropbox and my application falls under Delhi consulate. I went to submit the docs on 27th June. My application status changed to ‘Administrative Processing’ on 1st July. Still awaiting further information. Not sure if Vijay also got similar status.

    Hi all,

    H4 -expiring in October 2019.
    Submitted my H4+EAD along with spouse’s H1B on May30th.
    H1-B approval – June 4th
    Biometrics -finished on June 17th
    USCIS status – still “case was received”.

    I need to travel to Canada for a few days. I called CBP (Customs and Border Protection) and they confirmed I can re-enter using automatic visa revalidation. But they could not say what will happen to the pending H4/EAD applications. I called USCIS multiple times but they were not able to give a clarity..keep telling me to try again when a level 2 officer can take the call (which didnt happen so far after 5 calls 🙁

    If use AVR, will my pending H4 and EAD applications remain unaffected?
    Anyone has clear idea?

      When you use AVR, the key thing is that you will carry your valid paper I-94 that you got previously and use that during re-entry. So, technically you are using the same I-94 and your I-94 number would not be changed. Essentially, it will be the same one that you use for H4 as well. So, technically it should be unaffected. But, we have NO experiences or proof that it will work. I suggest you check with your attorney on this and get clarity before you travel, so that all goes well with H4. Also, do share with the community after your experience, how it worked.

      So far, couple of users reported that they got Biometrics notices for transfer after extension. Hopefully this will change. We have little data.

    An observation I made based on the different groups I am following for h4&ead. Looks Like Nebraska Service Center did not even start processing h4 cases after the change of March 22nd, where the biometrics were introduced. Anyone else feels the same way?

      yes…but I saw someone who previously posted message in this forum(around mid of June) mentioned that he called Nebraska center to check the application status, got the reply which is they were processing the H4 visa extention apllication submited in March…not sure if it’s true

        I have filed in Nebraska on Mar 25, and yes they have not yet started processing h4 with biometric cases. Infact I have a receipt no of H4 extension from Mar 11, and that case also is not proccesed.

    Completed biometrics on 6/14/2019 but USCIS still showing “Fingerprint Fee Was Received”. Is that a problem? Do I need to call them? We also have a trip planned for August, what are the chances of approval for expedited processing request? California service center

      No need to call, it is normal. Unfortunately, we have not seen any California cases reported by users yet on our blog, all are primarily Vermont. We have no data on the processing times, need to wait. If something changes on your side, do update the community.

            this Info was shared by my attorney last week who filed my spouse’s extension..

            As an update, our office just received the first H-4 / EAD approval since the new I-539 procedure was implemented.
            To get a sense of timeline, this client’s applications were received by the USCIS (California Service Center)in early April, biometrics appointment was in late May, and the approvals were received today.

      yes I got info from other trusted group first h4 and h4 ead aprrovals are reported from california center on june 25th (3 months) with receipt date of march 27th.

      I hope to see approvals from Nebraska center soon.
