As many of you know, USCIS changed the form I-539 for Extensions, added Biometrics, which delays overall processing of H4, even if it is filed with H1B in premium processing. Many are waiting for experiences and wanted to have a look at sample Biometrics Notice as well. One of our awesome readers, anonymous for privacy, shared a copy of the Biometric Notice as part of the new H4 and H4 EAD processing and shared his timeline. Thanks a lot to him for taking time to share his experience. We also have many users, who shared their experiences in the article, they are further down in the article and in comments.  In general, biometrics is not required, if you are  applying for H4 EAD only and not using I-539 form for H4 Extension. 

Background of H4 Extension with New I-539 form filed with USCIS for Biometrics:  Applied for H1B, H4 and H4 EAD together in Premium Processing at Vermont Service Center.

H4 Extension with USCIS – New Biometric Process

  • You file the H4 application with New I-539 Form that includes additional fee for Biometrics
    • Most of the cases, you file along with H1B. If H1B is filed in premium, you will get the H1B approved, and then H4 processing happens as it needs biometrics. USCIS guidance is that they will adjudicate it soon after biometrics are done.
  • You get H4 Application Receipt along with H1B and EAD receipts
  • You get the H4 Biometric Receipt physical copy in snail mail to visit Application Service Center (ASC) that has date and time
    • If you cannot make it on the given day, you can request for re-scheduling.
  • You visit ASC on the given day and time and give Biometrics.
  • Your H4 Biometrics may go through criminal history check of FBI
  • Decision on your H4 application with USCIS
  • Physical copy of H4 Decision Notice mailed to your address.

The process is as it stands today, we will update it based on general users’ experiences as we go along.

H4 Biometric Documents Required at the Application Support Center :

  • The Biometric Appointment Notice sent to you by mail
  • Photo Identification Document issued by Government like below
    • Passport
    • Driver’s License,
    • National ID
    • Military ID
    • State Issued Photo ID.
    • If you fail to get Photo ID, you will not be fingerprinted / allowed to take biometrics.
  • It is recommended that you review that H4 I-539 application form that you submitted or sent to USCIS, so that you can confirm, if all the details are the same.
  • Any additional Biometric forms : USCIS does not have any special biometric forms and there is no need to fill out any separate forms related to Biometrics to visit the ASC.

Experience of Giving Biometrics at Application Support Center

Giving Biometrics at ASC by H4 applicant is a very straight forward process. As mentioned above, you need required documents : Government issued Photo ID and Appointment letter. Below are the high level steps at ASC for biometrics

  • Step 1 : You are given a Token Number and will be asked to fill a basic form
  • Step 2 : You need to fill the form Applicant Information Worksheet (AIW), given to you, where you need to fill in information like Name, Date of Birth, Eye and Hair Color, Height and Weight, etc. Below is the sample shared by another user. Thanks to the user (anonymous for privacy) for sharing the form with the community.
  • Step 3 : Your token number is called and they will take your Photo and Fingerprints
  • Step 4 : They stamp your Biometrics Appointment Letter after the process is complete. The stamp indicates that your biometrics are taken proof that you visited the ASC. See below sample of the stamp given at ASC. Thanks to our user for sharing the stamped letter at ASC. At the end of article we have the full receipt notice with stamp as well for your reference on how it looks.
  • Step 5 : Wait for the decision from USCIS. Your Biometrics status is may or may not reflect on the USCIS status. Sometimes, you will continue to see the status “Case Was Received” , which is the status before  giving the biometrics.
    • Update : One of our readers shared that they have seen a status update on USCIS that says ‘Fingerprint Review was completed’. So, some of you may say this status
  • Step 6 : Decision from USCIS [ waiting for it. ]

What will USCIS do with the Biometrics given by you ?

USCIS may use your biometrics/ fingerprints to check criminal history of FBI. You may request a copy of your own FBI identification record using procedures listed at Title 28 C.F.R., Section 16.32. You may also get it corrected or updated as outlined within the same Title 28 C.F.R., Section 16.34.

H4 Biometric Appointment Letter from Application Support Center (ASC)

Even though some of you may know the standard Biometrics Letter from USCIS, it is good to re-confirm the same and have a look at the same ASC Appointment Notice . Again, thanks to our reader for sharing the Biometric Appointment Letter. See below screenshot at the end of article. It has the below details  on the same

  • H4 Petition Tracking Number
  • Name and address of the applicant
  • Application Support Center (ASC) Address
  • Date and Time of Appointment at ASC

Key info from the Biometric Application Support Center (ASC) Appointment Letter :

It says that you to process your H4 application/petition with USCIS, you need to appear at the Application Support center  of USCIS at given time and date and give biometrics. If you do not show up at the ASC, then your application/petition will be considered as abandoned.

Can I reschedule my H4 Biometric Appointment with ASC ?

Yes, you can request to reschedule your appointment, if you cannot make it to ASC on the specified data and time. The process is simple, you make a copy of the Appointment letter for your records, check the box as listed in the ASC Appointment Letter and mail the Original letter to  below address:

  • BPU, Alexandria ASC, Suite 100, 8850 Richmond Hwy, Alexandria, VA 22309-1586

Also, if you have open wound or bandage/casts, when you appear for appointment, USCIS may reschedule the appointment if they believe that they will interfere with taking the biometrics.

What if I am outside of the Country ? H4 Biometrics with Travel and outside of USA ?

As per USCIS guidance, on their I-539 form instructions (page 12), you should call up the nearest US consulate/ embassy and arrange for the biometrics. It says “If you are currently overseas, instruct you to contact a US Embassy, US Consulate or USCIS Office outside of United States to setup an appointment “,  see below screenshot. 

What are not allowed at Application Support Center for Biometrics ?

You cannot carry Cell Phones, Cameras or any Recording Devices to the Application Support Center (ASC), when you go for giving biometrics.   Also, due to limited seating, they suggest that only person giving biometrics and who are necessary for transportation or helping with biometrics should be entering ASC.

Can you Travel outside of Country, with H4 Extension/ COS Pending with USCIS ?

Yes, you may travel out of US, but if you travel, your pending H4 Extension / COS with USCIS will be considered abandoned.  There are few scenarios with H4, H4 EAD and travel, read Travel out of US with H4 Extension, COS or H4 EAD Pending ? Options ?  

Can you continue to work on H4 EAD, with pending H4 EAD Receipt Notice ? Do you get 180 days automatic extension ?

No, you cannot work with pending H4 EAD receipt notice as the category of H4 EAD, which is C26 is not eligible for automatic 180 days automatic extension. For all details, official references, read Can you continue to work with Pending H4 EAD Receipt Notice ?

Approved H4 Petitions Experiences without Litigation

  • Documents sent to USCIS Offices : March 26th, 2019
  • Documents Received by USCIS at Vermont : March 27th, 2019
  • All three (H1B, H4, H4 EAD ) receipts generated : March 28th, 2019
    • Processing time – 1 day from documents received by USCIS
    • H4 Biometric Notice was generated as well.
  • H1B Petition Approved : April 3rd, 2019
    • Processing time – 6 days from receipt generated date
  • H4 Biometric Letter Received : April 5th, 2019
    • Processing time – 8 days from receipt generated date

    • CBP officer at port of entry gave I-94 with H4 on it until end of new H1B approved in April 2019.

  • H4 Visa Application I-539 form Approved : June 12th, 2019
    • The status of I-539 Extension shows “Case Was Approved” on USCIS website.  Yet to receive the notice. See below. We need to see what happens to I-94 number.
  • H4 Approval, EAD Approval :  June 17th, 2019 in Mail.
    • For H4, Online Status Says “Case Was received”, but under DHS account it says Approved.

  • H4 Approved after almost 20 Days after giving Biometrics or about 45 Days from filing H1B + H4 together in premium

  • H4 & EAD approved on June 19th and received the courtesy copy on June 24th.
    • H4 Online status has also changed to case approved.
  • Waiting for the originals and EAD card.

Took 66 days from application and 39 days from Biometrics for the H4 case and EAD to be approved.

  • Documents Needed : Passport, Appointment notice.
  • Outcome: They will stamp acknowledgement of your attendance on same appointment notice
  • Details of Biometric Process: Smooth process . No hassles. We went before they opened at 8:00 am and we got token number 3. So it was pretty quick .
  • One minor issue:  Wife did not have Alien number as she is not eligible for EAD yet. So they double checked her details and continued with process. Not any obstacle.

    • Receipt Numbers generated by USCIS is not exactly in the order of application received date. Some of the receipt numbers before mine were from April 18th while my receipt date was for April 17th. This gives us an impression that some how April 18th applications are approved and they might have skipped some of the April 17th applications.
    • My status got updated on Aug 22 at 3AM Pacific time. Probably some cron job updates status in bulk. IMO your case might have been already approved but it does not reflect on the website.

  • I did raise an expedite request through USCIS and Congressman, both of which got denied immediately. Finally logged another request on August 30th stating that my EAD was going to expire in 4 days. I received a mail stating that the case is already with an officer and there is no need to expedite it.
  • Also when I called USCIS to raise the expedite request, they told me, NSC received Bio-metrics for my case on August 21st. This was not updated on the online portal. So that might explain why a lot of people are seeing ‘Fingerprint review complete’, because NSC started to get actual bio metrics information in third week of august (smh). I hope this is a sign of the process getting streamlined and hopefully this will trigger faster approvals for everyone who are waiting.

    • I have been following this forum and at one stage I thought of going with RN law but later decided to wait. My expedited request status is still not updated and congressman request was not fulfilled by uscis. But I felt like raising awareness to uscis on our case is helping .

  • Reached US back August 2nd week and raised expedite request.
  • Status changed on H4 to Fingerprint review completed on Aug 21, 2019
  • Even after 3 weeks after the expedite request, no updates..
  • Raised another expedite request on Sept 3.
  • Expedite request got denied on Sept 4, saying that application is already approved. Not sure if the second expedite triggered the approval or it was already approved.

  • July 20 – Had to travel to Canada. I had expired visa but valid H4 i-797 upto Oct 2019. Asked many forums, company attorneys, even called USCIS and was told I am eligible to travel under 30-day rule, automatic visa revalidation. USCIS said my applications should not be affected since I would not get a new i-94
  • July29 – Returned from Canada. At vancouver airport, the visa officer first denied entry. Then a senior officer in back office gave me entry but issued a new i-94 and online i-94 showed F1 status.
  • Aug 10 – CBP i-94 correction office corrected the status back to H4 but was stuck with new I-94. Didnt know what would happen to my applications. Company attorney said if RFE comes, we will address it.
  • Sep 5- EAD application changed to “new card is being produced”.
    • H4 / EAD Approved in 99 Days after filing
    • H4 / EAD Approved in 81 days from Biometrics
  • Sep 6- EAD I-765 was approved
  • Sep 10- EAD mail picked up by USPS.
  • Sept 11- Called USCIS why H4 was still “case was received”. The rep told me they mailed the H4 I-539 approval also on Sept. 6th itself.

  • I have same experience as many users that online status of H4 did not reflect the approval. I was super worried that I would be given EAD up to Oct 2019 and my extension would be denied because of my new I-94 after Canada trip.But Everything worked out finally. Got EAD and H4 approval for 3 years upto May 2022.

  • Lesson: Not sure if expedite request helped, since I did not hear any response or update, and we’ve waited long enough. But if it did, I think using USCIS language in the cover letter and submitting clearly arranged documents were important.

    Hi Friends,

    I am filing the litigation with R & N lawgroup. Hope I want to share the info which I got the info from there..

    1) R & N law group file litigation every 2 weeks..
    2) As of now they filed 2 litigations, First litigation filed last month not sure on the dates they informed All of them got approved , It took 36 days to get them approved for everyone who filed litigation, some of them approved some ppl got late but all of them got approved in 36 days.
    3) 2nd litigation they said they filed 2 weeks ago.. few of them got approved until now and few of them are pending basically it will take 60 days to get them approved.
    4) So ppl who’s H4 EAD is still 60 days pending its right time to apply now, so that you wont loose the job.
    5) ppl who already lost the job and pending its up to you guys you can also file the litigation if you need it.
    6) To file litigation below are the conditions to eligible
    a) your spouse H1 should be approved
    b) your h4 and h4 ead should be applied and should be more than 30 days.
    c) Bio-metrics should be done.

    I am trying to apply guys Hope the info should help to you…

      What are the repercussions of litigation. They might give the approval but what about future things like GC, next extension etc ? I know R & N law group says there will not be any repercussions, but remember they are attorneys.

        Its up to us guys.. if we need H4 EAD approval sooner and wants to work and dont want to loose our jobs we have an option to file litigation.. if we think something happens in the future then there is no answer to this. if we think something will happen on this we have to just wait ,,this option is only for ppl who wants there EAD sooner like me….if you guys want to wait please wait …

    Hello,
    H4 extension and H4EAD renewal application is pending at NSC since April, H1b was approved in less than a week. Current visas are valid until September. Now we must travel to Canada in August. I’m very worried about it’s effect on the pending applications. If we cross the border via road, someone suggested that I-94 will not change and hence the applications would not be affected. Is that correct? Please help.

      if you use Automatic visa revalidation (AVR) for short term trip, and use the existing I-94 to re-enter, it will not change.

        I thought that AVR was if the current visa was expired. Can you please confirm that current I-94 can be used for a short trip with a valid H4 visa which is valid till September but the trip is in August.

    H4 extension and H4 EAD renewal applications are still pending at the NSC since late April. H1 was approved in PP in less than a week. Now, we have to urgently travel to Canada next month. I’m worried what effect will traveling will have on the pending applications. Is it true that since the I-94 would not change if crossing border by road, there would be no effect on pending applications. Is that correct? Current H1b and H4 visas are valid till September.

    Everyone I recieved this from uscis this morning after an expedited request , “We have researched your inquiry regarding your application. Although we are sensitive to your current situation, there is virtually no expedited processing available for this type of application. We apologize for the inconvenience. Your application is awaiting review by an Adjudications Officer and you may always review the status of your application by visiting our website at www.uscis.gov.”

    I know its denied request, but I dont understand what this means, can someone help me understand?

      My H4 EAD is pending at NSC with the receipt date 4/22. I am already out of job on unpaid leave. I’ve opened several requests…

      5 expedited requests
      2 times Congressman’s office reaching out on my behalf for expedite request
      1 time Senator’s office (Reached out to USCIS, awaiting response)
      1 mail to NSC with all physical copies of the evidence.

      All of the above for nothing. Either they respond with ‘They are sensitive to our situation but the application type is not available for expedite processing’ or no evidence received we can’t grant the approval for expedite request’.

      Did everything at my disposal to open an expedite request, nothing as of now. Hopefully NSC may start approving the cases that were applied after biometrics sooner and we all start receiving the approvals. We are almost there.. Let’s keep faith.

      I tried expediting through senator and uscis which didn’t worked. Finally joined litigation filed by RN law group and got approval.

          We applied H1+H4+H4EAD on July 15th in PP to Nebraska.
          July 17th case was received.
          July 23rd H1b was approved.
          Waiting for biometric appt letter.
          H4EAD will expire on Sep 30th 2019.
          I have checked 1000 plus applications before my receipt date. Noticed one of the receipt has Finger print review completed 7 days before and for another receipt, new card is produced.
          Are there anyone who applied in July to Nebraska location and received biometrics appointment?
          Any idea, how many applications gets approved by Nebraska per day ??

    Hi,

    My husband Has i140 approved and h1b extension approved . I went for biometrics for my h4extension on May 28th. It’s still in “case was received” status. My question can I be able to apply h4ead now?

    If so can I proceed in this scenario:

    H4ead applied in a week and leaving to India. H4 extension interview in India and getting the approval and coming back after three months. In this case when I leave the country h4ead will be pending since my h4ext case is pending. Once I leave the country current h4 will be abandoned. And I’ll get h4ext approved from India. So my h4ead will be continued with the h4 ext approved status and I’ll get h4ead in three to five months.

    Will this scenario work? Pls advice

      It does not work like that. As they are not together, you would get RFE for EAD to submit H4 approval. As you will not be in US, it may not work if you get RFE. Ideally, you should apply after H4 approval to avoid confusions..

    Hello folks,

    I am in a similar boat

    H1B extension, H4 and H4 EAD extensions filed in premium @ Nebraska on April 16th.
    Biometrics on May 6.
    H1 Approved with in a week and still waiting on the H4 & H4 EAD approvals.

    On going through a few threads about expediting the case by contacting USCIS, I just spoke to the USCIS representative about expediting the case on financial and medical grounds.

    The representative clearly stated the following:
    – The case can be expedited only the financial loss to the company and supporting documentation states the same.
    – Humanitarian reasons, Asylum seekers on case to case bases and an administrative error from USCIS can be deemed as a reason to expedite.

    Medical grounds and personal financial loss are not an option for filing a expedite request.

    To all the gullible H4 people who are being tricked by the law firms into paying them to expedite the processing in hopes of a positive outcome, please don’t waste your hard earned money.

      I applied at Nebraska center on April 12 for H4+H4EAD with bio metrics on May 8 . I called USCIS yest to expedite the case requesting of financial loss as we brought tickets to India and all and informed I have new born and it is essential for me to continue working as H4 EAD valid till sept first week and cannot travel with my case in process . Today got email my case cannot be expedited . Hoping they will start working on our cases soon.

      @H4 all the reasons that you mentioned about expediting through USCIS are correct. Even I tried to expedite bunt they rejected .
      Then finally I opted lawsuit through Rn Law group and got my approval yesterday . It’s purely because of lawsuit. I have been waiting from past 3.5 for approval from Nebraska center and I finally got it yesterday. Please don’t blame people who are genuinely helping in getting things done. I don’t know about any other fake ones but Rnlaw group is genuine. That’s the only hope for people waiting from long time.

    biometric date: April 28
    EAD approval: July 23

    H4 is still pending approval

    My lawyer called USCIS to expedite my case but got a denied letter.
    I called the congress man and they got response after 2+ weeks saying that USCIS finally assigned a case worker to my case.

My congressman talked to uscis on my behalf and they said that they are processing feb applications right now. But I have seen lot of california cases getting approved which are filled in April end or May beginning. Not sure how uscis work. Any idea?

    Is it possible for my spouse travel to India without loosing the H4 & H4 EAD application? I have seen may people commenting that H4 will be invalidated when H4 applicant travel back to India. But i have seen many cases where H4 is getting approved even after applicant travel to India. Does any one have any concrete information about this? How do USCIS know that the applicant traveled back to India? Planning for a travel for my wife.

        H4 expired on Jun 15th. Yes, she needs to get visa stamped before entering US. But i am still in US and i can collect H4 approval notice, go back to India and get both of us stamped and come back togather.

      Yes, H4 will be invalidated if you travel with H4 applied as COS for sure. But, for H4 applied as extensions ( though there is no official reference), couple of users reported ( see above experiences), they traveled out and after they re-entered they got their H4 and EAD approved… Read Travel with H4 pending to get some insights. Concrete or official information does not exist for extensions on USCIS…

      I have applied for H4 and H4 EAD in May. Receipt Dates for H4 and H4 EAD are 31st and 28th May. During this time H1b was in RFE phase.
      Biometrics completed on June 19th. H1b approved on July 15th. Status of EAD was changed to ‘card production’ yesterday (July 24th) and H4 is approved today (July 25th).

    I got my fingerprint done on April 29 but I still see the case status to be ‘Case was received’. My application center is Nebraska.       CSC and still says fingerprint fee is received. They don’t pay any attention in updating unless the case is approved ( with few exceptions)

        I called the USCIS number provided online and chose the option something wrong with your case ( don’t remember the exact words). I asked the agent about expediting my request process. She said it has to be under these categories. I mentioned that I fall under first category of severe financial loss. She asked that do you have any documents to support. I told her that I have lost my job and sitting home from last three months and now it’s getting hard for me to meet up my daily expenses. Then she told me that she has raised the request. My service center is Vermont. I gave my biometric on 04/26/2019.

        @WaitingH4, I got the exact same response. I raised an expedited request on Friday July 19th and the rep told that the officer will contact me in 5 days asking for documentation. I was waiting but yesterday I got an email saying the expedited process has been rejected.

      I also called them -USCIS and requested just before my visa was expiring and they refused.it was around 45 mins call after waiting for an hour for rep. on the call to connect…supervisor also said no.

      Not only I lost job even I was relocated from my family, all rent, apartment lease, furniture , flights money etc etc gone….then also they didn’t expedite. You are quite lucky! Congrats!

      No, there is no regulation as such to file a lawsuit against processing sequentially. It is their internal operations and you may not challenge that…You may file it for delay in decision….Also, most of the data is misleading as the Form is used by many other visa types and NOT just H4, so people checking and concluding based on that is not true.

      It should specify details on what is the RFE like prove status of the spouse, etc. Re check the RFE and respond accordingly. If you think it was a mistake on USCIS part, then explain that you do not work, etc and send additional details for the same.

    I checked first 200 receipts from the range (LIN1913250XXX) which someone suggested had I-539 approvals , but I could not see a single approval between LIN1913250001-LIN1913250200. If whoever posted it can point out atleast a range where they saw the approvals, I can check and confirm that. Otherwise, seems to be false information. Not sure why someone will post something like this.

      Kumar

      Well, one of our above had similar experience, they left the country and came back and had their H4 and EAD with them. They did not had to apply. The only trick is the I-94 number of the H4 that you get with extension vs. what you have when you enter US. Check with your attorney and act accordingly, also do share your experience with community.

    1. As her current H4 Visa status expires on July 31st, 2019. Can she travel out of country (if needed) and get H4 visa stamped with my H1B new approval (which is valid Aug 1, 2019 – July 31, 2022) and she is eligible for Dropbox.

    2.If she travels after her H4 visa expires on July 31st, 2019 and she travels on August 5th, 2019 to India. Does her stay between August 1st, 2019 – August 5th, 2019 considered as illegal stay? (Her H4 Extension is in pending status with Receipt date – June 54th, 2019)

    3. If she travels to India, her H4 extension application will be abandoned. But what happens to H4 EAD extension application? Does it also gets automatically denied or is it still valid and we may get a RFE to submit the new H4 Visa stamp and new I-94? or We need to withdraw the H4 EAD Extension and file a new I-765 for H4 EAD?

    Please help me with these questions. I have read the Travel with H4, H4 EAD pending options link. But I’m still confused with below statement.
    “Yes, you can travel out of US with your H4 EAD in pending status, provided you meet all the H4 visa requirements to re-enter US. “

            Yes, I do. I use USCIS Case Tracking App, and you can look for 500 case status at once. I put LIN1913550XXX and search from there. and I can see I-539 approvals.

            March 22nd? That too late… you gave biometrics? Most of them before 23rd March got approved along with H1b premium without biometrics.

            There are many on I-539 who got approved. All can’t be only L2 visa.
            Nebraska was about premium and no change H1b visa. L1 visa is mostly big indian IT companies who hardly apply premium and they rarely change location so they won’t apply from Nebraska.

            By August April approval will start for h4 visa, ead I have not seen any.

The biometric fee is tied to the new form but individuals who applied with the old form after March 11 still have to do biometrics but did not have to pay the biometric fee. I know this first hand.

          This is not right. My H4 receipt date is 22 March. Till now no approvals have come. The approvals u have seen online are not for H4 extension. Form I539 is used for multiple reasons including H4 and L2 extension. The approvals we are seeing are definitely not H4 approvals. Don’t want anyone to loose hope but wanted to put forward the truth.

      Probably, you need to work with your spouse’s employer as well and keep them informed. Talk to your spouse’s company’s attorney. Ideally, their attorney should be the one handling it…

      Well, one user said that their petition got approved after lawsuit, but they also tried other factors like congressman, etc..so, not fully sure, what really worked…If you can afford, it does not hurt to file a litigation…They say that the same results cannot be guaranteed as well…take an informed decision.

        Uscis got back to congressmen saying potential loss of job isnt a criteria for expedition, there has to scenario like
        Financial loss severly( which anyways happens after we lose jobs, but they dont agree right away untill we lose so wait to watch the horrible thing coming up than preventing)
        Health issues like long hospital stays. So finally uscis denied the expedition though it went via congressman so ultimately congressman got back to us saying to provide more evidence for expedition criteria, so am just waiting here to lose my job so I fall under there criteria, this is ridiculous I just dont know what happens next

        Yes, you can go, get stamping and come back on H4. The only trick is with the I-94 number mismatch that you will have after your current H4 with USCIS is approved and it comes with your old I-94 details.

      I am not sure, if it works that way…You cannot choose your service center by your choice, there are clear guidelines on where an application should go.

            Hey folks I think it’s good if we can apply the litigation with Reddy & N group yesterday I looked the Reddy and N law group YouTube every Tuesday call they confirmed we can apply litigation after 1 month of applying H4 EAD .. so I think it’s time for us to apply for that especially Nebraska service center ..I called uscis service center couple of times they said they can’t expedite the case and currently they are working on January cases and the dates are not moving … so most of us applied in April May .. we have to wait another 3-5 months for sure … I heard from R & N group that they filed for litigation and they got approved in 15 days -1-2 months …I guess it’s better to apply instead of waiting every day … I see Vermont cases are approving but Nebraska service center not even 1 application approved …. I am planning to apply litigation in 1 week …I know it’s costs 2000-2500$ but better than loosing current job good to apply better than waiting for long…

            Have you heard of any other law firm who is filing litigation for the H4/H4 EAD delays? Just wanted to see if there are options. I contacted RN and they quoted us $2800 to be co-plaintiffs in the case that they will file on August 2. We are contacting other attorneys ourselves too and will update here if we find another option. I agree filing jointly will be most productive.

I noticed that my case number starts with WAC199** whereas other CSC cases are WAC191**. Is that because my case is COS or its really 800 cases apart?

            I am not sure on the numbering part…In general after the year, it is the computer working day…

    Hi,
    My husband’s H1 got approved and I completed biometric for H4 extension on May 13th. waiting for approval from Nebraska center. We did not apply for H4 EAD at that time. Can I apply for H4 EAD now or should I wait for my H4 approval?

      It is better to wait for the H4 approval and then apply. The reason is, if you apply for H4 EAD now, they may ask for H4 Approval to give EAD approval, if your EAD application is processed before and you do not have the H4 by then, then you have nothing and it will be denied…So, better wait and apply after H4 approval. You can check with your employer as well and attorney to get guidance.

    Below is our timeline

    Processing Center: Vermont
    H1 +H4+H4 EAD filed under PP on April 11th.(4/11)
    H1 Approved: 4/18
    H1 Approval Notice Arrival: 4/20
    H4 Bio-metric Appointment was on : 4/29
    7/15 : recieve H4ead and h4 approval notices along with the new h4ead card.
    H4 online status is still the same “case was received”
    H4ead online status says “card was delivered ”

    H1B and H4 (not EAD)extension filed in premium. 26th Marc. RFE 8th APril.
    RFE reply 11th April
    Approved H1b 12th April
    H4 biometrics notice mail received 16th April .
    18th April: biometric given at local ASC
    07/12 – RFE H4.

    does H4 gets an RFE. it is not even H4 EAD.
    My spouse i94 was valid till 06/16. Is this rfe because she is out of status .
