Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

      The same thing has happened to one of my close relatives and her employer said that there is nothing to worry about because it is a glitch in the system…Not sure about whats the truth as there is no way to confirm

        As i mentioned earlier, my consultant said that he is looking a job for me, after he arranges interview and i clear it, then he arranges stamping process which takes lot of time and is stupid. All the people from india go to US and search for jobs their itself, as even the employers their prefer the ones who stay in US. So I am thinking what to do. Absolutely freaking my brains out. What about U ?? why is your case getting delayed??

      Try to ask your petitioner/attorney to give USCIS a call.
      My case was stuck in RFERR for 5+ months, no case update and no docs from USCIS. Eventually my petitioner gave them a call. Guess what? They said my case was approved 5 months ago… (california center)

    I did my bachelors in mechanical engineering from a university in US(2008-2012)..got a job and have been working for the comanh since 2013 january..my company doesnot sponsor h1b but i found an american contract company that is willing to sponsor h1b this year..they applied for last year aswell, but didnt get into lottery.,,does being rejected last year increase the chances this year?
    And with 4 years of bacheors in engineering and 2 years of work experience in the related field qualify for 20,000(masters cap)..please let me know Asap..my OPT expires june 02,2015 and i’m kind of worried

      Not getting picked up in lottery last year does not increase chances this year. There are people who got though lottery in their first attempt and some after 5 attempts .It is totally based on luck..And coming to eligibility for masters cap , one should hold a maters degree (MS)in the US or Ph.D if in indian education. So, to increase your chances of picking up in lottery apply from multiple employers which is legal too..hope this helps

        can one file H1b 5 times? I mean how can one do that , when the max opt period is 29 moths ( ~2 years).

      Hi,
      my case is same as yours. completed BE mechanical in 2008-2012 and working in an IT company. Now the Company is initiating H1B visa for me, But specific team from my company who is responsible for H1B applying , rejects my application saying not sufficient IT experience, as my IT experience is 2.7 -( 3 months yet to complete 3 yrs). you have same case of mine and yours got approved. Please let me know how to proceed, or how to get other employer to sponsor for me.

      A piece of information will be more useful for me. I got my rejection yesterday (25/2/2014). if u give me info i call ask my employer again stating this reason.

    I atteneded my visa interview at chennai consultate , Got 221g Blue sheet which indicate nothing except they need to perform administrative processing before taking final decesion , it was all in Dec11 , but still the status shows NO STATUS in ceac website how kong does it take before moving to administrative processing , Expecting your reply guys…

      Even i got the reply for my query from US Consulate (Chennai) stating it will take nearly 60 Days.

      when i spoke to my US Employer on this, they are also not giving me the clear date.

      But one thing would like to convey here is my case “Status Updated Date” is changed twice.

      Date of Interview: 31st Dec 2014
      First Update: 20-Jan-2015
      Second Update: 22-Jan-2015

      I am not sure on these date updates, when i asked my Employer, they said “You may here some update in couple of Days”.

      But its a week, no updates from Consulate or Employer 🙁

    My wife got selected in lottery and got the receipt no.She got a RFE for which the consultancy responded on Sep 8,2014.The status is RFE Response review from then.We had raised couple of service requests and target date for getting a response has already crossed.The application dates for next year’s h1 are fast approaching.We are totally confused on how to proceed.Can anybody advice how to get the current status of application.Is there any chance of getting a response before April 2015.

      Hey – same situation with me, I submitted RFE response on sept 10 and no response yet. Hopefully everyone will get a decision by last week of march. I’m planning to refile if I dont get any response by last week of march.

        Why don’t you guys upgrade your petition to premium? I think it is legal for employees to pay for premium processing and it make financial sense. You are waiting since 10 months for the petition decision, and the premium processing cost is way too less when compared to one month of salary (opportunity cost). Think about it.

      As far as I know, there is no way to confirm if receipt number belongs to you just by having receipt number. Why your employer is refusing to send petition documents? Did your employer charge anything to file petition?

          Just check on USCIS site when was your petition approved by using receipt number. USCIS takes approx 2 to 4 weeks to send petition approval notice to employer/attorney.
          There could be various reason for not sharing petition docs. if you go through recent post in this thread… there is a post where employer is not sharing documents for stamping as employer is still trying to find job for the employee.

          P.S. This is not a legal advice. Just my thought.

    My H1 B visa got approved on Jan 16th in Hyderabad.The interview was only for 2 minutes and the VO officer just asked for the employer name,client name and its business background, my roles and responsibilities.Just asked for the passport and didnt even ask a single document(not even I-129,LCA,I797)
    The last question was whether I have done BE or Master’s.

    I got my h1b approved on Oct 2nd 2014 and my petitioner received the same on Oct 13th 2014. I asked my US sponsor regarding stamping. My sponsor told that till new year it is a holidays season, so there wont be any jobs, so there is no point of coming to US then, so i waited all along. I talked to them in Jan 1st week, they told me to forward my CV so that they will search for a client who needs an employee with my profile which might take a week. Its been 2 weeks. Is this normal or is he delaying my stamping which is scaring me?? Well this is a different scenario from the guys who go onsite. Any views on this guys??? Does delay in going to the interview effect my stamping approval chances???

      It is normal for small time desi staffing companies. They want to play safe and would bring you onboard only when they get a job for you. That way they can start earning by contracting you out from day 1 since you land in US. Or else if they get your visa stamped and bring you to US they will have to legally pay you the salary mentioned on the LCA even if you have no project.

          @Red – My two cents. Did your petitioner charge money? If your petitioner have not charged money to file your H1B, why to worry? Since they have spent dollars to file your H1b, they may be more worried to get you the job. Just my thought. Not a legal advice.

          How soon you can find your job depends upon:
          your skillset,
          your years of experience,
          efficiency of the people who are marketing your resume
          your availability to join immediately
          your expected salary range
          your location preference
          and how your interview goes.

          Even after this, there could be delay factors like delay in negotiating and signing a contract between implementation partner & staffing company (in E-V-C model) – this particular delay would be beyond your control.

          So bottom line, it cannot be predicted and differ from case to case basis and your luck factor.

          To answer your q about jumping jobs in India – Since you have an approved h1b petition, be patient and sit tight till you get a job in US. I don’t see the benefit in jumping jobs in India if you have plans of moving to US.

          To answer your question about delay in stamping effecting approval chances? – i don’t understand this q. you can only go for stamping if your h1b petition is approved.

            @H1b hopeful – When filing petition, petitioner has to submit client letter, SOW and other supporting documents otherwise, in most of the cases, petition won’t be approved unless these documents are submitted. So if Petitioner has already submitted client letter, it means client is already ready. So why do petitioner need to find client/job again?

            You are right. But generally what happens is small desi company submit client letters and SOW during filing the petition on March 31st but the same open job position might not exist 6 months down the lane, come Oct 1st (job market is often volatile and clients do not wait for 6 months for a particular resource). So, after petition approval with old docs, in the month of Oct desi companies go out looking for a new open job position for the candidate and once found-interviewed-confirmed, they file an amendment to the old petition stating new job details(client, location, LCA) and thus get their candidates placed.
            I hope this make sense.

      I don’t think delay in stamping will cause you problem. I had stamped my visa almost after 9 months after petition approval date and then I traveled to US. Though it was L1 visa.
      Now I am in India and waiting for result on my RFERR sine 4 months. Losing hope day by day ((((:

      I too in the same boat. At least in your case, your employee told you that they are searching the job. In my case, they just informed me that my petition was approved and they are working on it for stamping. But after that there is no response from them. Waiting for past 2 months.

        They are not saying by themselves, I am calling that person all the way from India to US to his landline or cellphone and talking to him and he hardly speaks few words. I am doing this as those guys dont reply to email.

    I have few queries:
    a) Can I Apply H1B Visa With 2 Employers at Same Time?
    b) If I can file two full-time position H1B petitions with two different employers, do I face denials for both? Is it legal to do so and increase the probability/possibility in lottery?
    c) If both applications are picked in the lottery, then later to choose 1 employer to work?

          Once a petition is selected in the lottery, there is no refunds (whether the petition is approved or denied). Even if you file multiple petitions legally (via different company), you will get no money back if all the petitions are selected in lottery. The ones which are not selected in lottery are returned and the money would come back (only USCIS fees. Attorney fees is however incurred).

      I was in the same situation. RFERR for 5+ months. (California Center)
      Then my attorney gave them a call and was informed my case was approved 5 months ago… (yet we haven’t got any docs from USCIS) After a week my case status was changed to “approved” on USCIS website.

      so my suggestion is to call USCIS. Your case was probably approved very long time ago.

    I got my visa stamped and VO asked me below question.
    why do you want to go to US
    Who is your employer
    Who is your client and what they do.
    What you are going to do
    How much is you salary in US.
    Which place you are going.

    They asked my wife –
    how long have you been married
    Was it love or arranged.
    what is the current company name of your spouse

    Then VO approved our visa. We had interview for about 3 mints and golden word came “Visa approved”.

    I got my visa stamped on my passport and VO asked me only below question.
    Who is your client.
    How much is you salary in US.
    Which place you are going.
    Which company you are working for and since how long.
    They asked my wife – what is the highest qualification and what you will do there.
    Then VO told about the place where we are going and she approved our visa. We had interview for about 2 mints and golden word came “Visa approved”.

    VO: Thank you sir. Your visa is approved. Please carry your I797 while you are travelling to US.
    Me: Thank you. Have a good day.

    My appointment was rescheduled from 11AM to 2:30PM. I guess everyone who had their H1B interview yesterday had recieved a rescheduled mail since everyone in the line was carrying the printout of rescheduled mail from USCIS. There was a very long queue but it was moving quickly and I finished by interview around 2:20PM.

    Hello All,
    The situation is getting dragged now quite a long time with 221g added to its milestone , i attended interview at chennai consultate , its a New employer for me and Seems Vo is not satisfied with project Docs i submitted which was in 2 pages , he said he need some more time to take decision and retuned my passport and docs after waiting for more than 2 hrs , he didnt gave any oppurtunity to explain me the project details nor asked me any question except employer name and “will you be working at client location” Please let me know the chances of getting through after this situation.

    Thanks to all the mates in this forum.
    Done with Visa stamping in Chennai . Entered the consulate with a tension face and encountered the officer with a pretend to smile face. Finished the interview with just 2 Questions and came out with “yes i did it” feeling.

    Q1. who is your client?
    Q2.CTC?

    Try to carry a photograph with the mentioned dimensions. I ended up with last minute photo needed situation and able to get one outside consulate. There are many folks on the same boat on my big day.

        Here are my thoughts:

        There is no fixed time as such for 221(g), it can take anywhere from few days to months. You can always check with the consular office for status after 30 days or so.
        2. How long the visa fees is valid? (Fee paid in Oct 2014)
        The fees you paid is valid for this application until a decision is made, no need to pay again.

        If only one check box is done, it means that you may not need to submit any documents and it is the Consular to verify some data. If there is anything required, they would ask for that in the blue slip by checking other boxes.

        I approached them asking for the documents on 8th Sept 2014.

        1st Oct 2014 i received the documents.

          Thanks for the response. Do you know the reason as to why your employer took so long to send documents to you? Actually, it’s been more than 45 days since my employer received Petition Approval notice but they have not yet sent me any documents for stamping. So wondering why such delay

            Not sure why the delay from Employer.

            When i asked for the documents then only the employer responded that the petition is approved and we will send the documents, till that time there was no mail or response from my employer.

    need one answer. I attended my interview in US consulate yesterday and now i checked my status online by entering the DS-160 bar code number and it is showing:

    Can any one tell me what this mean. and If I enter my passport number in US passport tracking site it is showing my passport is still with Embassy/Consulate.

    Please let me know what is this mean. Is my passport will come with stamping..

      Hi im also in same boat. What was your RFE about? You need to wait till you get the denial copy to know the reason for deny. And also looking at your other post, does your skill set and the job position match?
      If the RFE was on same, then your employer should have put it more clearly. But anyway u need to wait till u get the deny copy.
      My RFE was on education nd case is denied. Suprised to see that but had to wait till i receive the deny reason. Based on that my employer/petitioner can proceed with MTR (motion to reopen)/ Appeal.

    Here goes my dates and experience
    RFE:: July 18th
    RFERR:: September 9th
    approval:: october 30th
    OFC date:: 30th decembet
    visa date:: 5th jan ( delhi consulate)

    Interview questions::
    1) which company
    2) duties and responsibilities
    3) project ( internal project) – showed the documentaion
    4) role
    5) which place
    6) salary
    7) project explanation
    8) how long you been working with present company
    9) how many years of experience do you have
    10) why are you leaving present company

    interview was for 3-4 minutes, VO said visa approved.

    Important tips ::
    1) questions will be asked based on what u fill in ds 160 and employment docs (i.e I129 and offer letter) – ( Interview will never be technical so dont worry untill you are scrutinized )
    2) confidence is the mantra, dont be tensed or panic coz its not the end of world.
    3) if you dont understand what VO is saying then ask her to repeat ( i personally didnt understand few questions coz of noise and poor speaker quality)

    I have got a 221g white form indicating additional administrative processing two weeks back when I attended the visa interview. However when I am trying to check the case status it says “Your search did not return any data”. While this 221g processing is still going on, is it possible to change the employer to a different one ?

      yes you can change but again your petition with new employer will go through initial review>…..desicion(rfe)……..>approved, that is also a time taking process. So, think about it..
