USCIS News : H1B 2019 Lottery Completed – 190,098 Petitions Filed

The most awaited number by many, with tons of calculations using LCA numbers and other correlations on comments, etc. have come to an end. USCIS released a press note indicating that they have received 190,098 H1B petitions for FY 2019 quota. Below is the press release summary.

 Summary of USCIS H1B Lottery 2019 Competed 190K petitions filed :

  • USCIS completed Lottery for H1B Visa FY 2019 on April 11th.
  • Total H1B Petitions received for FY 2019 quota – 190,098
  • USCIS accepted petitions for 5 working days from April 2nd to April 6th and announced that they reached regular cap of 65,000 and Masters cap of 20,000 on April 6th.
  • USCIS will reject and return all petitions with their fee for all the H1B petitions not selected in H1B Lottery, provided they are not considered as duplicate petitions as per the new rule. Check Sample H1B Reject Letters for Not picked in Lottery
  • Lottery Process used for FY 2019 :  USCIS conducted H1B Lottery for Masters cap first and the unselected petitions form that pool became part of the regular quota lottery.
  • USCIS  will continue to accept H1B petitions that are cap exempt or the ones counted for the cap in the past that fall under the categories of H1B Extensions, H1B petition for Change of employment terms, H1B Transfers to new employers, and Concurrent filing of H1B for second H1B position.
  • Also, they gave split of number for Masters and Regular quota on their H1B 2019 page, which is new. Some people are confused on where we got these numbers, it is on the USCIS H1B 2019 Updates page . I have put a screenshot for your reference.

What are our Predictions vs.  USCIS actual numbers ?  
Many were speculating less numbers for H1B FY 2019 as there were many new rules, changes and the political climate was not that great in the past one year… Despite all of these, our H1B 2019 Lottery predictions were from 170,000 to 190,000 . USCIS actual numbers of 190,098 is very much close to our predictions… Though our predictions were not popular among many that we were forecasting more numbers…but, the reality is that there is tremendous demand as seen with numbers…Hope our lottery predictions helped at least some plan in one way or other.

What’s the take on press release ? What’s Next ? 
The press release is not very different from previous years. Also, the process of H1B Lottery is not different from previous years and is same. As we know from previous FOIA request, USCIS selects additional 5k for masters and 10k for regular quota considering denials…Also, this year, they updated the number of petitions filed for regular quota and masters quota. This was not published in the past.

Now that lottery is done, the waiting game begins for everyone. All of you, who have been selected will get a receipt notice and it has a number that you can use to trace your case on USCIS site. Read Understand H1B Case Number

It is sad that many smart, talented students and professionals from Ivy League Schools, IITs, Many good companies like Google, Microsoft and many more have to go through lottery putting all their hard work and effort for luck to decide in lottery…Its unfortunate, but that’s life and reality…If you get selected in lottery good, if not, take it as another part of life as it comes and move on…don’t put yourself under pressure thinking about it, it was not in your control and you have nothing to do about it…

  1. I’m checking my SEVP, and I see that my OPT end date was changed to 9/30/18 (it was previously 8/16/18). I haven’t received a notice yet. I was planning to visit my country during summer, but I’m not sure if I can reenterto the U.S. while my status is processing. Does anyone know when my status will be changed to F1B from OPT? or when I can visit my country and come back to the U.S. freely?

    I got my OPT end date extended yesterday afternoon to 09/30/2018 (previously 08/09/2018). I dont know if this means that I was selected in the lottery or not but I wanted to share updates from Vermont center.

    can I change to day 1 cpt during my 60 day grace period? My cap gap expires on 01 june and university has a start date of july 13. Plz advise.

      • It should not be a problem. I have had friends on day 1 cpt get approvals on h1b with out any rfe . It all depends from case to case.

        • It might be successful in the past. But given the current administration’s penchant for RFEs and their new interpretation of CPT, do you really want to take a risk on the ‘should’ part?

          • 3 of them got the approval last year. Anyways it’s a way better option than packing your bags and leaving.

            A good lawyer , strong documentation and not to forget luck plays a big role in the approval process of an application. Those laws have been in place since years the only difference is people got to knw about it recently.

          • I work for a American company as a FTE and they are encouraging me to opt for Day 1 CPT. Should I still expect a rejection in case my H1b gets picked next year?

    • @3rd Attempt, how is it a better option than packing your bags and leaving? What kind of strong documentation proves that you need Day 1 CPT for doing a second Masters, which itself is illegal? I hope you know that your one VISA stamp rejection could cause issues in even getting a L1 visa. And just because your 3 friends got through doesn’t mean that you would get through too. I know a lot of people who were stuck in limbo because of Day 1 CPT.

      At least if you pack your bags and leave now, you will be able to come back to the Us in a year in L1 visa. With Day 1 CPT, you might never be able to enter the country again.

        If you don’t mind can you please show me an official document from USCIS stating that day 1 cpt masters is illegal and they would give RFE’s/Reject everyone who is on day 1 cpt. May be I’m wrong and I just need the reference to the document which you are reading .

        As per law which I know you need to complete 9 or 12 credit hours in your master’s degree to be on cpt frm the next semester. Unfortunately for students who do not go through the lottery they resort to day 1 cpt which is after completing a master’s degree with a minimum 36 credit hours.

      • @edwardss you are talking like companies are just eager and ready to file the L1Visa .. and they are so easy to get. The party for L1 visas had been over a long ago.. one of the effect of that you can see rising the number of H1b applications since 2011.
        Not really sure about the impact of Day 1 CPT but i can guarantee that L1 visa is way more harder to get then H1B. It’s also a misconception that once your application is denied or issuing visa is refused then you cant get the visa again.

      • I totally agree with you. To all the others asking for legal points against this, if only US had a black and white system. A lot of things have worked in the past. The current system is scrutinizing every single thing. Yes, it is not totally true that once your visa is rejected you wont get it again but we are greatly decreasing our chances is the point here. The desperation to be here can be found out when more number of students start doing this. Imagine the number of such CPT things going up from this year, the next year USCIS can easily find out.

        • Okay they are scrutinizing every thing diligently but, I would like to add a point here this CPT fiasco is nothing new and it had been in works since years. USCIS is very aware of it and its legal just like 2 application with different employers and different job opportunities. When on CPT a student may retain all information such as parking tickets, library passes , flight tickets , CPS plan , CPT plan , assignments and etc. to prove they have been attending school regularly. I’m not a lawyer nor I’m on CPT but I can say one thing for sure it’s not illegal to do your second master’s.
          Whereas, visa rejection it can be rejected for numerous reason excluding CPT and you can apply again with a stronger profile.

          • My feeling is that if school recommends a student to have a job offer for pursuing their course, it shouldn’t be a problem. Also, be it H1b with COS from OPT or H1b with COS from CPT, if our employer and attorney can provide proper documentation, we shouldn’t see rejections. Increase in scrutiny doesn’t mean your case will be rejected. Why are there so many approvals in spite of increased scrutiny? Not every approved application is genuine from FY 2018. I have friends who applied multiple petitions with fake desi employers with internal projects and got approvals. It is case by case and majorly depends on how will you support your CPT.

            RFE doesn’t mean rejection. They are just asking for stronger evidence and you should have an approval come your way if you can submit proper evidence.

          • @3rd Attempt….I really appreciate your comment and explanation. I had the same question like where is the evidence that if we do day 1 CPT , USCIS will reject our application? Yes, I understand it would be more difficult next year but my lawyer said we need to keep all the information and maintain proper documentation to prove that we are regularly attending our classes.

            All am I saying is, if we really want to stay here and also our employer appreciate our work , then we should take a chance. We have been through a lot already. Why not taking our last chance? I am a not-STEM and only have one chance for h1b and still haven’t got any news. So as a backup plan , I had to apply for day 1 CPT school and got accepted.

            I might be wrong but If someone has a proper evidence that USCIS has set a new rules saying day 1 CPT is illegal, then please do share. Thanks!

  4. Any update on H1 for the people whose OPT ending after 9/30/2018 ? I did not get any update from DSO or attorney. Neither i could see any update in SEVP portal. Not sure it gonna change for people like me.

  8. Got an email from Fragomen this morning saying that the check was cashed and they gave me my receipt number. I had called up my University last Thursday and they had said that my status has changed to Pending.
    California Center, AD, STEM, expiry in Feb 2019, Change in “Relation to” field in SEVP portal (not sure if that matters).

Same commas were added. So.just wanted to understand is it just regular system update after creating account, or is it SEVIS actually updating something!

      Could you please share a screen shot of your SEVP portal, what has been updated. So far every one said that, whoever’s EAD expires after Sep 30; their SEVP will not change. After hiding ur details, could you please share the general details in some google share link.

    • I got the same relation to field update on April 20th. They added commas. My stem opt ends in jan 2019. No news from lawyers so far about and school DSO won’t answer anything about H1 COS in SEVIS. Not sure what to make about this.

  9. Finally got the update from the lawyer with the receipt notice. SEVP updated on 4/17 so it took some time. Going to contact DSO and ask for the new I-20. AD, STEM, first and last time, Vermont.

    Good luck everyone! And don’t loose hope. Think about it: we haven’t heard from anyone from Regular Cap about SEVP update. And numerically, more AD people will go through Regular Cap tham Master’s. So everyone still has a chance.

  10. Is there a chance that SEVP port gets updated to reflect the Cap-gap ( i.e, the port gets updated to Sep 30 for a person whose OPT end date is before Sep 30th) when the petition wasn’t picked up? Is the SEVP portal update a sure-shot way of knowing that the H1 was picked in the lottery?

    • Not sure if it’s an accurate indicator of being picked. But my experience was my SEVP Portal End date changed to 9/30 From 5/17 on a Friday afternoon and later the same day I got an update from my employer that the check was cashed.

    • Just got an update that my check got cashed. Sevp portal updated on 4/16. Hopefully this means that sevp updates do indicate selection. Not saying if sevp portal not updated means your petition is not selected. It might just not have been entered in Sevis. Single petition filed, last attempt AD.

  11. Anyone from NC applied through ogletree deakins law firm got any update? I called them but they are not willing to share any information on checks being cashed. No update in my SEVP as my STEM OPT ends in Jan 2019. This is my last attempt. Last year my H1b was denied due to specialty occupation reason. I am full time employee and works in specialty occupation but my company didn’t do great job in replying RFE. They are very new to the immigration stuff as there are only 3 – 4 employees on H1B until now.

    Face palm. Only facepalm.
    Don’t you realize that H1B visa is for HIGHLY QUALIFIED professionals?! How ex-student, fresh graduate can be highly qualified professional?? This is insane.
    Real professionals doesn’t have SEVIS. Because they are not students.
    I hope you all smart enough to understand what I’m hinting here.

    • I assume you are saying that none of the SEVIS updated people should get H1bs. It should only be wizened old folk with 20 years of experience , right?

        • I don’t disagree, lots of careers qualify as ‘specialized’ but there’s a marked difference between someone getting hired by Apollo as an associate, or Amazon as a product manager vs. the average software engineer.

          Either way, stress does bad things to people’s mental states, leave people be. No one likes uncertainty over the future due to a lottery.

    • I feel like you are discounting people graduating with Higher studies. These people tend to be highly specialized in their fields, not to mention, most of them pursue Higher education after a couple of years of work experience.

      So people looking at SEVIS can still be “HIGHLY QUALIFIED” maybe even more so than the others who apply for the Visa

    • Well, you might be wrong. Many foreigners with experience go back to school to get a MBA or a PhD and all of them have a student status and are able to participate on the OPT program. So, yes, you can be highly qualified, a real professional, and still be on a student status with a SEVIS portal.

      For exceptional professionals who are foreigners there’re other type of visas such as the O visa, even though many very good professionals go through the H-1B path instead of the O visa path.

      That are many hard working professionals going through this lottery and it’s not fair to make fun of them for being foreigners wanting to have a good career.

    Timeline

    2012 September : H1B was approved.
    2013 Augsust : Visa Stamping done – Got Validity till OCT 2015
    2013 November : Travel to USA
    2014 November : Came back to India ( 1 Year was completed )

    Till when I will be eligible for Cap Exempt?

    • For the sake, you must apply for the STEM…you never know, sometimes it goes to an RFE…so you should have atleast valid status…for License and for other stuff.

      It just you need to pay $410… but I think it will help

  18. My employment end data has been updated in the SEVP portal from June 11th to Sep 30th. My DSO issued a new I-20, which indicates: my new OPT end date, H1B status: pending, and my receipt number (WAC….). This all looks good, but my company/lawyers have not yet received official notice.

    I am trying to track my receipt number in the USCIS website (https://egov.uscis.gov/casestatus/landing.do) and I get a sign saying that they don’t recognize the number. Is anyone in a similar situation?

    • The USCIS website takes some time to get synced up with newly updated receipt number. Kindly wait patiently to get the receipt notice. Probably its on the way.

        I have not been picked up three times previously with an AD and working for one of the top software companies in Seattle. This is my 4th time after I went for a h4 ead under my wife’s I-140. Now with the h4 ead almost on the verge of being abolished, I dont know what to do when we have already been living here for 5 years. Any advice will be appreciated. Is anyone else in the same boat? I am guessing if I dont have a receipt by start of May, means I was not selected yet again for the 4th time!

  19. My authorized end date also just got updated to Sep 30 today (04/20/2018) at 17:52 in the website SEVP.
    My OPT (not STEM) was supposed to end on Jun 25th 2018.
    I don’t know if it was sent to California or Vermont. But I personally think it was sent to California because the headquarters of our company are in Texas!
    My employer did everything. As of now, I have no information about whether my check is cashed, and I have not heard anything from my employer lawyers or DSO (I actually didn’t check with them either). I also got no email from SEVP.

    Please do’t worry everyone. It will take time until you hear back. Just relax and enjoy your weekend.

  20. I got an update on my SEVP portal too! It changed to 9/30 at 19:01 today. Also my colleague got an update today.
    We are both AD OPT, non-STEM, and sent petitions to Vermont. I think they are finally starting to process updates at Vermont.

    Please dont panic on reading these comments and not seeing any change on SEVP.
    Reach out to your international office and ask them to check the status.I just got reply from my advisor and she said they can see change in my status and shows that my I20 is to be extended to 30th Sept, but my sevp has still not changed.
    I am now waiting to hear back from my lawyer.
    Just hold on till May mid something good should turn up for you. Meanwhile prepare for backup plans, may be you can work on any other country/home country for a year and come back on L1.

      • Well just because there’s a trend towards more rfes and lawyers are coaching the adjudication process. In their view the administration is making it difficult every year and generally lengthening or complicating adjudication to deter future applications. I don’t work off site or for another client or in the much debated IT industry but you never know these days…plenty of my friends on Wall Street were stuck in the rfe boat.

  24. I ‘m currently on STEM OPT and it ends on 01/03/2019. This is my last attempt. I checked my SEVP portal now and I saw edits from source SEVIS on “Relation to Field” column. The old and the new texts are basically the same. I asked for a new I-20 couple of days back to check for COS and I have not received the I-20 yet. Is this edit coming because of new I-20 request?

    • This is something different. Everyone is clueless about why “Relation to Field” column is changed by SEVIS. This change is definitely not by the DSO. Even I have the same change. Still waiting for the decision.

      • RFE for what? The application is not even selected in lottery. The edit did not change anything from what’s already there. Yes, at least I work in the field of my major.

    I think it would be great if those of you whose case has been picked up in the lottery so far (you know it either through SEVP or DSO or lawyer or cashed check) to add their details in the tracker of this website. Currently, the tracker says that only 1.8% of cases have been picked up. This makes me question if we should still expect many more pick ups, or if people haven’t marked their case as “picked up”. It would be helpful if you update your case so we can know where we are standing.

    • There will be lots more ‘pick ups’ – folks are just starting to see receipt notices!

      Last year, people were finding out as late as 2nd week of May, maybe later – hold tight.

  27. Looks like SEVP portal has been updated for candidates who are eligible for Cap-Gap. So, would it be accurate to assume that game is over for whoever is eligible for Cap-Gap and hasn’t seen any update on their respective SEVP page? 🙁

    • @Falcon3748 – I can be wrong but if you go through comments, there are cases where others were also picked who are not in a cap-gap situation so one can’t be sure of this.

    • Well, i think its too early to assume that no way they have gone through all 85000+ applications for all cap gap eligible applicants, what i think is the SEVP updates have been done for all cap gap eligible petitions that were picked in the AD lottery because most of that chunk would have needed that. For the regular cap lottery I think it takes them a while to do the data entry so don’t think they have a process in place to update sevis and sevp for all applications in one go, I think and hope that it will be done as and when they go through the applications one by one. (At least that is what I hope !)

    • My STEM OPT expires in 2019. My check is cashed but there is no update/change in SEVP at all.

      I think SEVP update only applies to CAP-GAP ppl

  29. USICS just updated their STEM OPT site with new requirements. This will tighten the STEM extensions too.
    Not sure what they are trying to achieve by closing all the corners

  30. to everyone who’s ripping Sashi apart in the comments:
    While I despise Sashi like you all for sending two applications; it’s actually perfectly legal (granted the two filling companies are two different bona-fide companies). I had a job offer at another company before I sent my H1b application, I asked my lawyer what would happen if I wanted to take it and he explained that I’d need to file for H1b through the other company too. I decided not to pursue the opportunity and only filed one application.

    The sad fact is that this is perfectly legal; you can consult with your lawyer to confirm it. It obviously increases your chances at getting picked (if you find another company that wants to hire you and take that risk on you).

    • yes 2 applications sadly is legal. But, more than 2 is definitely illegal! Anyone sending more than 2 need to be reported!

    • also, please don’t forget that if someone filed multiple applications illegally and got picked, once they start processing their application and determine it’s illegible they will deny it or revoke it if was accepted. Their spot will be given to someone else on the “Await List”.

      • What if the number of denied applications exceed the await list… we cant be back in lottery … how do you justify that ?

        • There is no awaiting list, everyone who gets picked in the lottery either gets an acceptance or rejection, they just have a buffer of applications already picked that will get processed irrespective of the number of rejected applications. No waitlist!

            According to the USCIS website, they’ve been wait-listing some petitions since 2008.

            “USCIS has “wait-listed” some H-1B petitions, meaning they may possibly replace petitions chosen to receive an FY-2009 cap number, but that subsequently are denied, withdrawn, or otherwise found ineligible. USCIS will retain these petitions until a decision is made whether they will replace a previously selected petition. USCIS will send a letter to the wait list petitioners to inform them of their status”

          • I just read it on immigrationgirl, this looks like an old post, as per the post if they “USCIS will send a letter to the wait list petitioners to inform them of their status” then they would also let soemone know that they have been waitlisted right ?

        Yeah uhm.. I’m going to choose to believe the USCIS website over “immigrationgirl”. The USCIS website doesn’t say anything about letting “wait-listed” petitioners know that they were wait-listed. Instead it says”

        “USCIS expects that for each of these wait-listed petitions, it will either issue a receipt notice or return the petition with fees within six to eight weeks.”

        which explains why some applicants in the past years received their receipt notices as late as June\July.
