USCIS News : H1B 2019 Lottery Completed – 190,098 Petitions Filed

The most awaited number by many, with tons of calculations using LCA numbers and other correlations on comments, etc. have come to an end. USCIS released a press note indicating that they have received 190,098 H1B petitions for FY 2019 quota. Below is the press release summary.

 Summary of USCIS H1B Lottery 2019 Competed 190K petitions filed :

  • USCIS completed Lottery for H1B Visa FY 2019 on April 11th.
  • Total H1B Petitions received for FY 2019 quota – 190,098
  • USCIS accepted petitions for 5 working days from April 2nd to April 6th and announced that they reached regular cap of 65,000 and Masters cap of 20,000 on April 6th.
  • USCIS will reject and return all petitions with their fee for all the H1B petitions not selected in H1B Lottery, provided they are not considered as duplicate petitions as per the new rule. Check Sample H1B Reject Letters for Not picked in Lottery
  • Lottery Process used for FY 2019 :  USCIS conducted H1B Lottery for Masters cap first and the unselected petitions form that pool became part of the regular quota lottery.
  • USCIS  will continue to accept H1B petitions that are cap exempt or the ones counted for the cap in the past that fall under the categories of H1B Extensions, H1B petition for Change of employment terms, H1B Transfers to new employers, and Concurrent filing of H1B for second H1B position.
  • Also, they gave split of number for Masters and Regular quota on their H1B 2019 page, which is new. Some people are confused on where we got these numbers, it is on the USCIS H1B 2019 Updates page . I have put a screenshot for your reference.

What are our Predictions vs.  USCIS actual numbers ?  
Many were speculating less numbers for H1B FY 2019 as there were many new rules, changes and the political climate was not that great in the past one year… Despite all of these, our H1B 2019 Lottery predictions were from 170,000 to 190,000 . USCIS actual numbers of 190,098 is very much close to our predictions… Though our predictions were not popular among many that we were forecasting more numbers…but, the reality is that there is tremendous demand as seen with numbers…Hope our lottery predictions helped at least some plan in one way or other.

What’s the take on press release ? What’s Next ? 
The press release is not very different from previous years. Also, the process of H1B Lottery is not different from previous years and is same. As we know from previous FOIA request, USCIS selects additional 5k for masters and 10k for regular quota considering denials…Also, this year, they updated the number of petitions filed for regular quota and masters quota. This was not published in the past.

    One of my colleague(who was on opt) filed 6 different applications, unlucky him 2 already got selected and who knows more for him.

            6 applications????!!!! ridiculous! you need to report this to [email protected] immediately! Doesn’t matter if he is a colleague or not, abuse is abuse. That person could be spared if it was 2 applications, but 6 just cannot be spared. He/She is taking away so many other Genuine applicants slots.

      Assuming he/she paid $5000 per petition, that is a total of $30000. Almost 20 lakh INR is equivalent to life time expenses of a poor family.

          That is my first thought when I saw this. But we don’t know if that is a girl or a boy. If that is a boy he must be aiming for high amount of dowry by showing his so called “H1b + Job in America”

        You are not supposed to pay anything. The Petitioner (Employee) is responsible for all the costs. If that is what you did, it is against the rule. You should be the one get reported.

      That is why USCIS picks up extra application than just 85K. Multiple petitions like these will be rejected even after being picked up in the lottery and they will give it to someone in the buffer.

        But if one person files 6 petitions, that is way more than the 20k buffer. Also, so far 2 petitions are picked up in the lottery we never know how many finally. It is definitely a scam and needs addressed.

    I just called up my University and they said my status is set to Pending. They’re not really saying clearly if the petition was picked in the lottery or not. They just said to contact my attorney.. Any ideas?

    I just hope there will be strict rules pertaining to H1 visa next year so that the DESI consultancies wont be able to abuse the system and merit based system where preference being given to the AD. I hope the consultancies see more RFEs this year and lot of rejections.

      Preference already given to AD except to those who has come to US on papa’s money and filing the application for so called High skilled worker…….This has all become business where many such universities has been set up in US for the foreign students who dont even fall under First 500 universities of the world.

    You can apply for cap gap I-20 from your college. It is valid until june 1st. Even we got to know recently about this and one of my friends used this as his visa expires in april. When someone visa expires before june 1st and if they have applied for H1B visa, since it takes until may end to know the results, they have provided an option to get cap gap I-20.

    This is what my company’s lawyer wrote me:

    “I spoke to a colleague who works at a local college. She said her experience with USCIS updating SEVIS is not always accurate. Last year, some of her students SEVIS records were extended to 9/30 but their cases were not accepted in the cap.
    The only way to know for sure is when we receive the H-1B receipt notice or the rejected petition back. ”

    I guess we just have to wait… but I hope since the introduction of the SEVP Portal this year the changes in SEVIS status will become more accurate 🙂

    I just checked with my DSO and got a response that there’s no change or update to my SEVIS information as of now, does this , by any way mean that there is now slim chance of my application being selected? Or, we can still hope to see any positive outcome?

    This may be a really stupid question but. . .

    If my OPT expires by the end of July, and I get a notice that my H1B was not approved (say in May), I can still work until my OPT expires, right?

    I got tripped up by some post that says you have to stop working immediately after getting notified of H1B denial and then have 60 days to leave. I think that was only if you’re already in a cap-gap

    They also files petition for opening XYZ sister company and there has been no update.. what should I do? Should I withdraw filings for XYZ? Would this impact my earlier petition? Please help..

      to everyone who’s ripping Sashi apart in the comments:
      While I despise Sashi like you all for sending two applications; it’s actually perfectly legal (granted the two filling companies are two different bona-fide companies). I had a job offer at another company before I sent my H1b application, I asked my lawyer what would happen if I wanted to take it and he explained that I’d need to file for H1b through the other company too. I decided not to pursue the opportunity and only filed one application.

      The sad fact is that this is perfectly legal; you can consult with your lawyer to confirm it. It obviously increases your chances at getting picked (if you find another company that wants to hire you and take that risk on you).

    This is bullshit news. If you are falsely trying to put some news atleast do it with some conviction. Copy pasted last years note and changed it with this years date. You forgot to change the date on the premium processing my friend. Uscis declared that they will suspend premium processing on 20 March this year not 3rd March.

    When I checked with my fedex tracking number I realized that my attorney has mailed the package to USCIS with shipper reference: H1B CAP- LAST NAME. I was looking into below details and found that all the petitions need to be filed in below format Attn:

    Question 1: Are the Shipper reference in tracking and Attn both are same?

    Question 2: I heard that USCIS does not open the packet until our application is picked in lottery. So how are the applications for Master’s cap and General Cap are differentiated?
    Is it based on Attn of our packet?

    @OPT folks & those who are getting anxious about end date change – In the past too, students could check with DSO to see end date change in SEVIS and many DSOs at universities with small international student populations are open to sharing this information. If anything, this SEVP is more helpful than constantly bugging DSO for updates. It especially helps last timers with making backup plans if they do not see any updates by the time USCIS confirms that data entry is complete. If you’re a last timer or not, you have no reason to panic until USCIS completes data entry.

    In last few years, none of the updates happened in a single day or single week so why would it be any different this year? Have patience instead of constantly posting repeated questions in forums such as “anyone’s check cashed? have you received any receipt notice? etc.” or constantly asking your attorneys. It will only annoy them more and take away time from their other activities if they’re nice enough to reply to you.

      Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States.

      The statement which i found in USCIS website says the cap gap extension is automatic and will continue if selected and approved. If you are not selected or approved then it does not apply…AM I READING IT RIGHT!!

            If you are in cap gap and SEVIS was updated to 9/30 means you were selected in lottery. If it was updated to June 1st means, your petition was just filed. Check the latest post on SEVIS that I posted today.

        @Yale 2017 – I meant everyone in general.. Not specifically attorney. They are anyway going to notify you once you get receipt notice. I don’t see what difference it makes asking again and again. With DSO maybe as they’re not obligated to notify you. But the attorney is obligated to.

    Yesterday i was going through all the comments above and finally i have checked my SEVP PORTAL & i have seen some change in History tab below the Source column change through SEVIS and in Description there is my EMPLOYER DETAILS and when i expand the column there is EXT NUMBER might be (phone number ) or some thing but i never see a change like date change my stem opt end date is 09/23/2018 (Sep 23 2018)

    Can you guys help me out what should i assume now

    i have contacted my DSO no response and i have contacted Lawyer they said that they Dont know anything about SEVP portal

      The only change on SEVP that might be a hint is if your stem end date gets updated to 09/30 and that will only happen if your stem expired before that time, everything else is generic system update with no relation to H1b.

    This is my 2nd chance and I like to think of the worst and I plan as per..I know it’s too early to conclude anything but I’d suggest keeping backup options ready if you haven’t already if this is your last chance..by the way my Sevis portal hasn’t updated butmy OPT extn ends after 09/30. I haven’t asked my attorney yet whether the check got cashed as I am not allowed to talk to my attorney directly, my employer does that and I’d sound too desperate if I request my employer to ask the attorney.

      Not really, I just spoke to our DSO everyone who have a date prior to 09/30 it will be updated. There is no correlation. Sorry to break the bubble. If your check got encashed then your H1B has got picked.

          Any changes that happen to SEVIS takes 1day to week to get updated. I spoke to them with the same issues that i read in my blog. Our DSO was good enough to share screen and show how it works and i saw people who see that Cap-gap extended were all done on 9th of april on the screen which means it updated everyone who’s opt was expiring before 1st Oct. Their i-20 also was being produced. This is done because students in a few days will come barraging esp the cap gap ones to have their i-20 reflect the new change date and this has been happening for years. This is the first time we see it on SEVP. lol . but be positive guys theirs nothing much we can do other than patiently waiting.

            I don’t think it gets updated for all. USCIS cannot change the end date to Sep 30 for everyone (whose OPT ends before sep 30) and then shorten it to their respective OPT expiry dates if they are not picked. That is going to take way more time than they already have.

            They showed me records FY-16,17,18 3 years before this. their screen looks different and they can search CAP -GAP and all that stuff. If you were a Computer Engineer what do you think will be easier updating each record or updating all then negating all that din’t get H1B?             @Al – If you were a computer engineer, you would also know the reason timestamp fields are added in databases. If there was any truth to your statement, the timestamp for all updates would have been Apr 9th, not anything else and all accounts would have been updated.

        Also, for those in cap gap and only if their SEVP got updated then their checks have been encashed.

    I just checked where my application went (via FedEx tracking) and it turns out that it went to VT. I originally thought that it will go to California since I work here, but the HQ of my company is in MD, so it went to regional center.
    The status changed on 4/16 at around 10:40 am (PST). I am AD, STEM. Have we seen more reports from VT?

      I contacted the company’s lawyer and they have no idea why my status was extended to 9/30. They think that my DSO did that. However, DSO confirmed the status change but doen’t seem like they did it. I thrully hope that idndeed USCIS are changing the End dates in SEVP.

      Does Nebraska Service Center not process H1bs? I am in Missouri but mine is sent to California Service Center. I know mine is sent to California Service Center because my employer shared Fedex Tracking Number for preliminary cap-gap purpose.

            Okay thanks Sriram. Mine got updated on April 16th as well but the down side is both my employer and DSO are not so helpful in reveling out if the cheque got cashed or if there is any update on SEVIS (With receipt number). 🙁

            @Naruto1546 Same situation here. The DSO suggested contacting the laywer for the details and did not say anything about issuing a new I-20. I suppose they will only issue it when you send them the receipt notice and the change of End authorization in SEVIS is not enough for them. However, some pepople reported that their DSO has already issued a new I-20 when SEVIS changed.

      around 10-15 people have reported that SEVP portal has been updated, and you lost hope already? Chill down. Wait till April 30th atleast.

          There are 94,213 Regular Cap application (quota 65,000) and 95,885 for the Master’s Cap (quota 20,000). So statistically speaking, there is higher chance to go through the Regular Cap, which is selected after the AD. I advice everyone be patient.

            @losing hope now.. & @Another one – After Master’s lottery, leftover AD applications (in this case, 95,885 – 20,000 = 75,885) are added in the Regular cap lottery. So, for the 65,000 quota, the applications this year would be 94,213 + 75,885 = 170,098.

            So, statistically speaking, there is higher chance to get H1B through the Masters Cap.

      Effect of H-1B Petition on F-1 Status during Cap Gap:
      Pending
      (Entered only through USCIS interface or SEVP data fix) SEVIS extends the F-1 status and any authorized OPT until September 30.

      This most likely means your application is now pending rather than in Filed state, which happens when lottery is picked.

    Anybody got an update from California Service Center for STEM OPT whose dates are expiring after OCT 1st ? Is your SEVIP portal getting updated & if so what is it reflecting ? Or contacting DSO is the only option ?

    Looks like Vermont Service Center is slow this time. All the updates related to SEVIS status or receipts in various portals/websites are from WAC service center.

    Any one here with EAC*** service center and received a receipt?
