If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017

It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.       My H1B Lottery is picked in April11th and I got the receipt number May21st from my employer.
      Any idea how long it will take Approval? still the status is Case Was Received…

        Gowtham, most of us are in same boat. Cases have started getting Approvals/RFE. So we just need to wait for our turn. Keep tracking your case! Hope we will all get an update soon.Good luck!

    Hi all, wanted to share a strange news. My employer had told me in may 1st week that my check has been cashed. But no receipt notice received. I was following up with them every week, but till this week i used to receive same answer and they mentioned USCIS is transferring cases from one service center to other, so mine was probably was transferred from California service center(my petition was filed under WAC) and hence no receipt notice. i was so fed up and frustrated since this is my 3rd time to H1b and have been working with same employer from 2 years.

    Today I called HR again and she shared receipt number with me!! and she said my case is transferred from California to Nebraska(which is really strange) and no receipt notice received yet.

    When i tracked Receipt number on USCIS website, this is the status.

    Case Was Received
    On June 1, 2017, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number LIN171905****, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by July 1, 2017, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    Should i believe this receipt number belongs to me??

      Very strange!! But I would suggest you to wait till July 1 and get back to your HR as by then they are going to get I797 C and the same can be shared with you then.
      I assume it is correct but u can always google about Nebraska RN number pattern..

      I thought usually the receipt number is generated and then the case is transferred. But it seems to have happened in reverse for you. If filed in California, then transferred you should have got receipt number starting with WAC. This is the first time i am seeing this. Please do verify the receipt notice and keep us updated.

        @ Ram – Even i feel the same. After getting WAC receipt it should have been transferred. I somehow feel they are playing with me because i received this receipt number after multiple follow ups. But last 2 years they had informed straight forward in May that i was not picked in lottery and i never paid any money for H1b. Its so frustrating! Thanks for your reply though.

        Any body in this group whose case has been processing in Nebraska service center can share RN patterns which will help me? TIA

          I completely get you. I have a question, how come they got the receipt number now? They should have the receipt notice already right? Check with them ASAP.

            @Ram – Check was enachsed in May 1st week. But when i asked them receipt number they said whatever is written behind the check is not clear! And today HR said, attorney shared the receipt number and receipt notice is not yet received.

          When I apply EAD at Nebraska center , I get the case number/receipt number for EAD which starts with LIN-15-800-***** . LIN refers to Nebraska center. In your case status it is clearly mentioned that they received the form I-129 and hence it is for H1B and not any other application. Maybe USCIS is randomly picking few more applications as there are many RFE’s going on…Anyways, Congratulations for getting selected!!

            @jj – thanks for your reply. Somehow i don’t have that good feeling that this number belongs to my case. If you see above mine was filed under california and HR provided me this Nebraska RN. I agree it says Form I129, but I129 is not only for H1b. And LIN-17-190(this 190 is day from Jan 1 or Oct 1?). it somehow does not match.

        @amy – As per HR, receipt notice is not received, but attorney shared receipt number. I am guessing may be from check encash. but not sure why they waited till today to share because as per them check was cashed on may 1st week

          Probably receipt notice is with Attorney and it is yet to be shared with HR. Please request your HR to raise a request to Attorney for the receipt notice. This should solve all your confusions.

        @TCSBglr – Which service center did you apply? can you please share initial few digits. For companies like TCS/Infy/Wipro etc receiving receipt notice/number now might be valid case since it takes time for them to get information from US counterparts and total number of people applied are more.
        My employer is a small consulting firm in US and they had applied for around 20 people. So sharing info this late is strange and hard to believe.

    I checked with my employer and they said that they haven’t received any more selection and no other cheques has been encashed.

    On rejection notice too they haven’t started getting them either.

    So one can easily say there is no hope of getting through 2017-18 h1b.

    Most of the folks who had their application filed from India have received RFE.

      Atleast your status has been changed to RFE.Dont worry RFE s are mostly regarding your project details and employees can chill in that case as attorney handles those issues.And MNC s are good in that way.
      On the other hand USCIS is so slow this year that most of the cases are still in Case Was Received status

        Rejection letters should have started coming but unfortunately I dont know /heard of anyone who got it. All receipt number should have come out by now. But if your company has withheld the result, then its worth the wait. Have you heard anything about check being en cashed or SEVIS (For AD) being updated?

      Complete lottery results means they need to receive unselected petitions.. untill then they will say awaiting lottery results… it’s over already… please move on…

      If your employer has withheld the result for all employees, you have a chance. Else, sorry to tell, getting a RN number now is difficult. Better work on alternative plans if any.

          The only way is to wait. Ideally, unless you get the rejection package, you have a small ray of hope. But since its mid-June already, its going to be remote. Did you hear anything about check being en cashed or SEVIS update?

          Friends, just don’t keep false hopes. The guy who gets rfe email today would have a status of ‘selected in the lottery’ in the list that was shared 10 days ago. So its not a surprise, may be his GL wouldn’t have revealed the result earlier.

          If the status is ‘awaiting lottery status’ in the final list, but if he/she receives an rfe email then its a big news. Any one like that?? I don’t think so.

    Does anyone know if IBM will withdraw my petition if I resign now before the stamping? I have another offer and am really confused.

      Go with your better offer & forget about your IBM h1b. As it is in initial stages, no need to think much. First of all it should be approved, not an RFE. @ stamping ; it can be either way – approved or denied or RFE for further documentation.

      By the time you get know all these, you may spent 5to6 months in new company.

    After Lottery being selected , how much difficulty will people face to land in US due to current scenario in US? Will there be more filtering in petition approvals and PA interviews?

      Kannan, The process has been tightened to catch the fraudulent and mocked up applications. If you are one of the genuine applicants, none of this needs to be your matter of concern. Hold on till your application is approved, then you can go for your stamping. The most difficult part is going to be the waiting time for getting our approval, getting date for stamping and the right project to travel. Don’t worry about anything. Just keep looking at your case and its progress.

        Our requirement in project is open and my case manager is not there in ibm anymore. Should i follow up with someone? I have not started following up yet.

          What I got from manager is once immigration team will get whole list then they will share with the project managers from which it is filed.
          And let say in any project only 5 requirement are there and 8 visa got approved then they will inform only 5.
          But in some projects where they need resource urgently already started informing.
          Not sure how much truth in that.
          Regarding case manager, he is only for managing tool related activity. Also I think they are working as a team so if one is not there other can work. In my case my case manager still in IBM but I got application submitted email from other person from immigration team and the person who signed application is from US.

            I have not received any emails yet – But in INS zoom it was already updated to filed – 31st March(No emails though). my colleagues from my project got their cases closed – Case closed closed pending adjudication – i doubt it could be an RFE. but their case is closed. me and one more person still have our cases open without any updates.

            I was just thinking if i should be waiting yet or move on.

            Also, someone told me that visa results come in batches – not sure if all the batches are done or not.

            Also, if your project is in Finance you can see the excel file of selected cases in the h1b community. Some guy uploads the lastest data in a spreadsheet.

    It looks like there are more RFE notices than approvals at this point.
    Does anyone know if this is normal practice or if this year is special.

    This will definitely slow things down for majority of applicants.

      Unfortunately, TCS, INFY, CapGemini India, TechM kind of companies spoiling the H1B process by filling massive numbers and other Telugu consultations from Hyd making H1B Process as mockery.

      Other-side, India based so called staffing companies cum call centers making US IT jobs as worst

      India factor in H1B saga is literally making IT Jobs as cheap coolies. Hope these RFEs can detect, and prevent fake H1Bs.

      Overall, there is hidden mafia in the IT recruitment, jobs and visas.

      Last year it was the same trend. Loads of applications were given RFE.
      I agree its going to delay the process but one way I feel its good. As it means strict scrutiny of the applications. This will enable only genuine applications going through.
      Again as far as I have seen few examples, the RFE issued have been the usual ones. Nothing new or complicated I have encountered so far.
      But unfortunately many didn’t get through the lottery it self. Hope USCIS takes some steps to eliminate lottery soon.

    Hi Ram,
    My h1 Status is case received. At time of interview employer told me we will give h4 also for my family. Is it possible to go to US at a time with my family or after my arrival in US then they will start h4 processing?? Is there any case like employer offer complete family to go to US at a single time?
    Also my family dont have passport, when shall I start this process, after h1 approval or rite now?

    1. Ram

      Rajen, you can travel with your family or you travel alone and ten take your family with you. Usually for the first travel for the entire family, company bears the cost(Can vary depending on your company, better check with your immigration team).
      Apply for passport ASAP and get it done. You need not wait for Visa approval. To apply visa, you need their passport numbers.
      when your H1 is in progress, its possible to add H4 dependents to it and will get processed along with yours. Else, the other way is possible too, wait for your approval and then apply H4. But H4 can be applied in normal processing only and might take 4-5 months for approval. After approval, Visa stamping can be done together or separately.

          Your H1 status is received so you can apply Passport for your family and stamping you can go along with your family. No issue going with family for stamping. You can go to US with your family first time also if your company is ready to give H4.

    Great folks – please help me with info. My petition this year got selected. But I also applied last year from a different consultancy, which is still in Received status. I would like to go with this year’s petition. Will there be any issues in processing of this year’s petition due to the last year’s petition being still in Received status? Should I withdraw the last year’s one? If the last year’s one gets rejected, will it impact this year’s petition?

    Sorry for asking too many questions, but I think all of these are related. Kindly throw some light, if you know something in this area. Thanks a lot!!

      If you are sure to go with this year’s petition, then the previous petition has to be withdrawn ASAP. The withdrawal can be done only by the employer, so please check with them for progress.
      As far as I know, two different petitions from two different employers would not create any issues.
      Meanwhile if your previous year’s petition is approved, the current petition has to be withdrawn immediately.
      As long as you have submitted any fraudulent documents or previous petition has been rejected on grounds of forgery or breaking some US law then current petition would be impacted.
      If the previous application is a genuine one and gets rejected for some other reason, then there is no issue.

        @Ram – Thanks for a very balanced reply.. I did not provide any fradulent info, but the previous year’s petititon could get rejected due to issues from the employer side (client-letter etc).

      There is no deadlines. All cases are in normal processing. So it will take its own time. But the processing of other cases filed along with us has started. We got to wait for our turn! Keep tracking your case. Hope our turn comes soon. Good luck!

    I am in a little situation and wanted to get all your input.

    I work for company A where I recently completed my OPT 12 month period and started on my STEM Extension; so its been a little over a year. They applied for my H-1B this year and I have yet to hear back or get any news (no check cashed, no receipt notice, no change in SEVIS). I am 99.99% sure now that I didnt make it.

    Recently Company B approached me and said they were interested in me and wanted to interview. Few weeks later now, I have a offer from them and I would very much like to take it. So my question is…

    1. Do I need to wait for an official rejection (meaning return of application) until I can switch employers?
    2. Can I tell my employer to withdraw the application? (Is that a possibility?)

      Mala, I think everyone would love to switch to H1B (non-immigrant visa) from OPT if given a chance as you may not need go through the cumbersome lottery again( if it s again the process of selection for next year???). I would never recommend withdrawing H1B. Why would you want to waste your chance of getting visa??
      If you feel that you have made through lottery, please go ahead and make the switch.

      It is normal to switch the work load among service centers. It is not going to inhibit your normal process of case in anyway. Please be patient and keep tracking the case. Since all the cases are filed as normal processing, it has no deadlines.

      You may get decision on your case early as new center having less work load holds your case now. Same thing happened with my H1b extension too and i got decision within 1 month though the average wait time in other centers was 9 months.

      Yes you can get the visa without any issue. If you can prove that you are qualified for the job though you possess a non computer degree, I think you can hold a chance. Talk to your Attorney and do the documentation accordingly.

      What????? I140 is associated with green card dude. If your i140 is approved that means u are already working in USA with valid visa.

          I140 is a separate process. After I140 is approved, you may not need a non- immigrant visa any more. You can check this with your employer once.

            Even after your I140 is approved, you still require to have your non-immigrant visa. The only thing changes is, you don’t have 6 years limit on your h1b visa and your spouse can work on EAD

          Employer can apply for PERM even when you are in non-immigrant visa. But I-140 does not get approved till you get an immigrant visa. This is my second lottery attempt. So it took me 2 years to get an approved I-140, and my employer initiated GC process as soon as I joined the company.

            I don’t think your PERM will get approved from company A when your h1b is from company B. PERM is tied to a specific job. It took me 6 months fr PERM and 4-5 months for i140 after filing.

    How many rejections or denials happened because of non-computers in graduation. I have seen many cases rejected due to this. In my case Despite having 7yrs of IT experience as a java developer after my MASTER IN COMPUTER APPLICATIONS (MCA) , they still pointing out my graduation is a non-computers. Will this work if I Challenge with a proof for educational evaluation or will still be waste of time and money ?

      Obviously it is a mistake in either filing or on their part, as you have more than sufficient experience and a degree in relevant field. If what u r saying is accurate u have chance to get the decision reverted in your favor. Better consult an attorney ASAP. Cheers

      Note: If your undergraduate degree is not in CS, it might raise red flag for the officer as to how you got into MCA in the first place. Be ready to prove your cookie trail.

    2. 4th time picked

      All your attorney need to do is make the evaluation of your MCA and your experience which shows that you are qualified for that job position. Also, your attorney have to write a justification letter describing you as qualified beneficiary by showing evaluation and key points. Both of them are important, unable to produce any one of them can have worse scenarios. If submitted, it should be very easy RFE and you will get approval for sure.

    I don’t understand how they are taking so long time to take the cases..even if there are 150 workers working for this ,only 430 cases they are handling each., and they are keeping all PP shutdown so we can assume they are only working for this (other than GC, students and all other visas) so already had 2 months of time.       one to two weeks.. There will also be a date mentioned in the status, within which your Attorney/Employer will have to receive the RFE notice. If not, they can raise an e-request.

    My petition got approved but received I-797B, Notice of Action with COS status denied. I am planning to go to Canada for stamping but for that i-824 application has to be approved since my consulate is different in my approved letter. Can you please help me with below queries.

    a. I have valid EAD till next year June and H1b starts date in the approved letter is October 1st 2017. DO I need to go for COS before October 1st or anytime before my EAD expires?

    b. Who is supposed to submit i824, it is me or my employer?

      i824 for a H1B has to be applied by your Employer i think as H1B is applied by your employer. Kindly check these details with your Attorney once again.
      As for COS, I think it can be done anytime. But sooner would be better.

        My employer is saying that there is no need to submit i824 but it is clearly mentioned in the approval notice that i824 should be submitted to notify different consulate than that in the approval notice.

  30. Challenging the decision

    Changed mind to go for Challenging the USCIS decision after the 30 day period from the date my petition got denied. Any hopes of getting approved ? I got proofs from the educational evaluation and my Client letters with me. My denial reason is about client letter and the educational qualification.I heard from some forums that we can challenge after the 30 day period from the denial date by showing some reasons or excuses from my employer or attorney.

            EEE will come under circuit branch category. Also you have 3 years of It experience so better you can check with your attorney or company for challenging it. Meanwhile when it got rejected? In RFE response or during stamping?

      I am not sure about applying after 30 days. But if you have the right documentation for challenging the decision, you can always get it approved. Its all about providing the right documents and representing yourself correctly.

      Congrats!!! Did you get your RN number?? If not, get it and start tracking the progress in USCIS case status page. If possible get your H1B Receipt notice too, to check whether your name is spelt correctly in it. It also has your RN number in it.

      Vardhan, was your H1B filed last year (FY2017)?
      This might lead to a RFE. If so, you might have to provide a renewed client letter or new project details. But if you provide new project details it’s equivalent to filing an amendment. Better to discuss with your Employer/Attorney.
