H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ?
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018.
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota 65,000
Master’s H1B Quota ( Only US Masters Degree Eligible)20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017

H1B 2018 Lottery Predictions ?
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. Check out our H1B Visa 2018  Lottery Predictions – Data Analysis  to get an idea on how many H1B petitions you can expect for this fiscal year.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

For FY 2017, we have put together a Step by Step Plan on How to apply for H1B 2017 Quota, it gives a guideline on the planning and what steps exists.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.
  • Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. Please be careful

We have an article that we wrote for previous season, you may read article How to find H1B 2017 Sponsors to find out various options.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B Fee ComponentFee in USD
 Base filing fee$460
AICWA Fee$750  or $1,500
Fraud prevent & detection fee$500
Fee based on Public Law 114-113 ( if applicable)$4000
Premium processing fee (Optional)$1,225
Immigration Attorney FeeVaries from $500 to $3000

H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

H1B 2018 Case Tracker  :
Did you apply for FY 2018 ?  With premium processing suspended, it is quite hard for applicants to know the general status of everyone to understand their situation. It is community contributed data, the more you add, the better for everyone, including  You !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season. You can check H1B Bills Tracker to get more details on current status. We will keep the article updated as new things are passed.

    Hello Ram

Can you please let me know that once a person selected in lottery what is the chance of approval and stamping of h1b visa and how much time it will take

    1. Ram

If the documents submitted for the application is all genuine and perfect, you will get approval. There is no specific deadlines for regular cases. All we can do is watch the progress patiently.

    1. Ram

It means your name was updated. If you check your receipt notice, your name would have had some typo. Hence your Attorney/Employer would have raised an request to update it. This has resulted in the above status. Nothing to worry, it will not inhibit the normal processing in any way.

  2. TCS_NotSelected

One of my frnd was informed by FDFU about his selection. So I checked with my manager, he hinted that the chances are very very slim now.

  3. Cases Filed before 3rd april rejected?

Uscis has said that any petition filed before april 3rd would be rejected.

Im from ibm and my h1b was filed on march 31st as per the status in inszoom.

Does this mean that my petition was rejected because it was filed earlier?

    1. Ram

If you have the FedEx /USPS tracking number, you will know the exact date the package was delivered to USCIS.
The status update in Inszoom might be internal to your company. They would have sent the package through FedEx or usps with delivery date as April 3rd. So rather than getting confused, better to check with the tracking number.
I don’t think they would have made such a mistake.
Unfortunately, if it had arrived earlier, yes it would be rejected.

    2. Marvin

April 3rd means the actual date when USCIS receives your petition.

It was the perfect date to express mail the petition on March 31st (Friday). Since USCIS was not open during weekend.

  4. JANA

My current employer processing me L1 and also through consultancy I have selected for H1B. Most probably I will take L1 interview at the end of july. If I got selected for L1 can I attend H1b interview?
Pl advise me on this otherwise also.

    1. Ram

If you get H1, why would you want to go attend L1 interview? Once your H1 is approved, you can transfer it to your current employer, get the stamping and travel.

      1. Ramana

        Hello Ram,

I have question on h1 b transfer. I had sponsored h1b by xxxx company and h1b visa got approved. Due to some reasons , xxxx company unable to process further. Do we have the provision to transfer this h1b visa. If so, please guide me the process

        1. Ram

Yes if you can find an employer to initiate a transfer for you, you can transfer it to another company. Currently in normal processing it takes 5-6 months to get a transfer approved.

          1. Can they?

Can the current company stop the transfer/invalidate the h1 in any way if transferring before stamping?

  5. Stem OPT

I am presently on STEM_OPT valid till Dec, 2018 and my H1 is picked for 2017 and approved on Jun 1st 2017 with future start date Oct1st, 2017, COS i797A – EAC17146XXXXXX

For some reasons, I want to use my OPT time completely and then shift to H1 on Oct 2018 instead of Oct1st, 2017.

Pls Advice, what is the process to change my future start date from Oct 2017 to Oct 2018.

    1. Ram

Your H1B would have been filed as COS, if so from oct 1,2017 your OPT might become invalid. So better to check with your Attorney. Had u filed it as consular processing, you could have started using H1B at later point of time.

    2. Ram

May be filing an amendment with future start date would work? I am not again sure.. please check with your employer. But I am bit curious, why would you want to use OPT completely?

    3. Marvin

      Don’t be too greedy.
I understand you would like to leverage everything you can. But you do not want to risk your H1b with 1 year OPT. Right?

      1. Stem OPT

Not really a Greedy and not a selfish business here, but there are some concerns around current job, location and project commitment kind of factors weighs-in.

New H1 rules driving top tier companies to keep the tab on H1 hiring to some extent (not applicable to all H1’s in the market though)
On H1, typically one need to keep on moving between hands and short-time stints are common, isn’t!.

  6. Nishant

Receipt no. EAC1713XXXXX and the case was transferred to other jurisdiction. I want to travel out of US in July 1st week. Any chances of approval before that? -_-

    1. SPB

Yes, there are always chances, no guarantees. I believe you applied for COS. Then you have to wait for approval, whenever that happens.

  7. LuckyOne!!!!

just got RN today 🙂 , no info on cheque cashed was available,my employer told not to hope much, i lost hope but lucky day today 🙂

    1. Prerna

      Congratulations LuckOne!!!!

It would be great if you could give some details like AD/NonAD, Organization, Location, etc ?

      1. WaitingGame

Where did you get this data?

I would like to see the same for WAC. Ideally if there is a website that regularly updates this, that would be great to see.

  8. CTS Hopeful Guy

Anyone from CTS who have got RN after May 15? Did any one from CTS have got RN recently?

People who got their application picked up in lottery in FY2017(April 2016) through CTS, do you have any idea whether CTS resource got receipt in month of June or July?

      1. CTS Hopeful Guy

Hi CTSer_HYD! Has any one from your project or account has been picked up in lottery? From our account none have been picked up.

    1. CTS Hopeful Guy

Also can some one let us know how to contact GM team on asking whether the check attached to my application is cashed or not? How can we contact GM regarding lottery results?

      1. CTS_H1B_4th_attempt

Based on my previous year experience . ! its 99% over. Move on. its a bitter pill to swallow. accept it and work on plan B.

        1. CTS Hopeful Guy

          Hi CTS_H1B_4th_attempt,

          Thanks for your inputs.

Just curious to know if CTS sends us the returned application copy (or) update in the internal portal if the application is not picked up in lottery. I know, USCIS returns it back to attonery/Employer.

  9. rajen

    Hi Ram,
I am reading all comments mentioned here regularly. I got rcpt # and waiting for approval. I agree now it may take 4 to 5 months for approval. Is there again any possibilities that approval may take 1 year or 1.5 year as premium processing is not there and also seen one comment that one of guy got approval now and lottery done last year. Isnt it???

    1. Ram

Yes Rajen there were few cases ( last year) which got approval after 1-1.5 years of wait time and few still awaiting results. Probably they were all struck due to some extra background verification process. But if you worry so, once PP is resumed again, you can always upgrade it to premium processing. You can check with your employer regarding this.

      1. Ram

Typo : stuck due to additional background checks. Most of such cases got RFE too. If we get RFE, it will always take more time to get result.

    2. Ram

I also know of people who got approval earlier by June or July last year. There are few who has their case in received status for past 15 months. So it varies case to case. Right now all we can do is wait patiently till October and see if we get any updates. If not we can always request our employer to raise service request or upgrade it to premium processing.
I know loads of other factors depend on this one decision, but still there is nothing much we can do unless they bring more transparency in what’s being done.

  10. CG_FS_Pune

Any updates from RFE team for CG guys. I tried contacting them, they are saying they haven’t received anything yet.

    1. capgemini-emp

It seems, the petition takes about 3-4 weeks of time to reach the RFE Team. so, check after 4 weeks of the date mentioned.

  11. Worth going ?

Does it worth going US now leaving job in india ? Its full of RFEs and even if petition gets approved and stamped we dont know whether the extension will be success. What if extension didnt go success and we need to come all the way to india without a job here.

    1. Depends

Completely depends on whether you want it to do it or not. If you are genuinely qualified for the job I don’t think there is any issue in obtaining visa or extension.

  12. MNC guy

Is Still Indian MNC guys like TCS CTS WIPRO INFY are waiting with hope.. Lottery is used as tool to retain people and give less hike.. For FY1617 cap, only 10000 allotted to top 7 that means even we take top five would have got 2000 each and in that if we neglect the counts for renewal and extension ( around 500 to 1000) they might be applying only 3000 petitions only and this yr FY1718 will less.. Don’t get confused with LCA count.

    http://indianexpress.com/article/world/seven-indian-companies-receive-less-h-1b-visas-in-2016-report-4690947/

“It said, the 9,356 new H-1B petitions for the top seven Indian-based companies approved in fiscal 2016 represent only 0.006 per cent of the US labour force.”

  13. Waiting for results_Tachyon

Has anybody heard from Tachyon? I called the employer. They are still saying they do not have any update regarding my petition. I don’t whether they held the result

  14. Curious

Is it just me ..or did anyone else notice the huge difference between EAC and WAC in terms of RFE vs Approved. Every single series under WAC has more RFE than Approved and exactly the opp for EAC . Barely any RFEs and so many approvals!!! I wonder why so..

      1. Ram

It was same last year. Slowly EAC caught with WAC and started issuing more RFE too.
Again, I would like to emphasize here that if we have the right documentation for our application, we will have absolutely no issues.

        1. capgemini-emp

It seems, the petition takes about 3-4 weeks of time to reach the RFE Team. so, check after 4 weeks of the date mentioned.

  15. TCS hyd

Sent a follow up mail to ISU RMG group.
They replied “only phase 1 and 2 results have come. Your status is ‘awaiting lottery status’ “.
I think, It’s all over for this year. Very slim chances. Best of luck guys… Moving on.

    1. Another TCer, HYD

I too got the same message. However, they told that there are few more phases coming in. Hope for best. Having said that, chances are very slim.

  16. Worthy enough ?

Does it worth going US now leaving job in india ? Its full of RFEs and even if petition got approved and stamped we dont know whether the extension will be success. What if extension didnt go success and we need to come all the way to india without a job here.

      1. Lol

Haha. He will first have to ask himself “does it worth to learn English”. I am sick and tired of seeing people start questions with “does” here. Does anyone has received? Does it worth waiting?. The list is endless. I don’t know what they were doing in elementary and middle school. I studied in an Indian language medium until 10th. So, that is really not an excuse foe getting such basics wrong.

  17. HOPEFUL IBMER

HI does anybody know the approximate dates for IBM ?
how long can an IBMer stay positive ?

Should people expect any updates in June or is it OVER for IBMERS if they didnt get any updates by MAY ?

  18. Krish2017

    Hi,

Could you please let me know whether can I use my old petition for H1B exempt without any approval notice document(i.e. old petition is waiting for RFE yet) for fresh filing with my new employer this year? Kindly clarify. Thanks.

    1. Ram

You mean to say that you wanna transfer to a new employer? No unless approved you can’t transfer it to any other employer.

    1. Tcs

      Not sure …..
My PL said that very less petitions got selected for our ISU. Till now I heard of only 1 RFE. My seniors who got last year said that they started getting results from june mid …

  19. MakB

    Folks,
AD/CA application selected on for processing and RN on 26th April but no update thereafter. On worktheme I saw that the series before and after me have updates but not mine. Any thoughts/comments/suggestions as to when can I expect approval?

    1. Ram

MakB, please hold on. All cases are filed in regular processing. So there is no defined deadlines. Be patient and keep tracking your case. Your turn would soon come. H1B Visa process is a game of patience!

      1. MakB

Hi Ram, Thank you for response! I guess I am just getting little impatient because lot of other things and decisions depend on getting approval.

    1. 3rd Timer

Yes It is possible..But first you should get approval from Emp A. Then transfer to Emp B, means the transfer also should get approved. Based on the approval notice from Emp B you can go for stamping. However, there is a confusion about how to transfer from A to B, like when to initiate a transfer, whether before OCT 1 st but after approval from A or After OCT first. After October 1st means if you need 3 pay slips if you are not working in Emp A etc. So you need clear guidelines from your Attorney. Conclusion, it is possible.

        1. 3rd Timer

@Do not advice if you don’t know a thing !

Opps..i am not that clear in my answer..but the answer to the original Q is “it is possible” with approved transfer petitions from Emp B who is not an original petitioner. And i believe most of them know that the original approval and subsequent transfer approval will come from USCIS.

    2. Ram

Once your H1B is approved, you can initiate a transfer. If you have the approval copy it would be better. If not, receipt number would suffice.

      1. NONAD/VT

        Hi Ram,

If in case H1B already approved but during stamping was denied. Is the approved H1B can be used for cap exempt to apply again?

        Thank you.

      2. Thanks Ram

Thanks, I got approval notice, but now my company saying that people from last year have not traveled yet, so no chance for me..
so, i am planning to search for an employer who would be interested in transferring my H1B..

          1. Hey Ram

I read somewhere that the employer who filed can cancel the H1B in case they find about that I am transferring. Is it true?

        1. Reason

This precisely is the reason there is a random lottery year after year. They don’t have work for people who already have h1b, but are applying more, just to get a pool ready. That wasn’t the way it was supposed to work. If companies only applied when there was a need, every deserving candidate with a real offer would get a visa. Not blaming you personally.

          1. Help

I get that..the project for which I was supposed to go is gone now..
but I need some help with my situation now

          2. Laxman, not quite Ram but close

You can get another employer to file a petition claiming cap exempt status based on your approval notice. If you ask I forums, many will try to scare you saying the new rule is that you should start working for the original petitioner in h1b before transferring. However, it is not a “rule” just a guidance that us is primarily enforced in 2014 mainly. Now, the risk is if your current employer knows about your attempt to leave and revoked the visa before Oct 1st. Then your second petition will be in jeopardy. I would recommend finding another job and starting the process, and get it converted to premium whenever that option is available again. Then, once the new petition is approved, and preferably after Oct 1st resign and trace for the new job.

  20. JJ

“Bill seeking H-1B limits exemption for foreigners with US PhD introduced” Is it true? So going forward one has to hold an American PhD to get H1B visa?

    1. 3rd Timer

If I read/interpret correctly then US PHD holders will not be cap-subjected or counted towards 85000 limits. However, the bill to become law is very limited, i.e, it is probable if not impossible. I would say may be after 2020 if all the branches of govt controlled by same party. Currently, Senate doesn’t have (technically the threshold of 60 votes). So, no chance at least near future.

  21. OldLegacy

Anyone here who got the petition returned? I hope that USCIS returns all non-selected petitions asap so that we can continue with plan B.

    1. Ram

I feel they might return in batches. Our company might inform it much later as they will be waiting to get all the petitions.

    1. Ram

Sri, if you feel your employer has withheld the result of all employees, you still hold a chance else the chances are bit slim right now.

  22. Weird

This forum used to be my home from mid March to mid May. So weird that it (naturally) got quiet now. Somethings missing now. Got used to pressing F5 😀

Had to say that. Anybody else?

This is more delayed than usual even by TCS’ standards, perhaps all those who are waiting including me haven’t gone through., Others who have cleared are keeping mum..

    2. TCS

Drop an email to fdfu banglr to id which you sent your docs at the start. If its awaiting lottery status then no hopes. The select ratio for the over all petitions from banglr is 31% which is a good number and almost on par with outside and they r not expecting any more additions and the list looks to be final. Its 1:3 for you.

Everybody in CG are getting rfe.
      My guess,

Legacy igate folks might get rfe due to igate appointment order filed with Capgemini petition. Not sure abt legacy CG folks.

      1. CapGemmmm

I suspect even old CG guys have offer letter from capgemini India Pvt Ltd but now CG had filed petitions from Capgemini technology services which was just renamed and announced few months ago by our Indian CEO… Might also be the reason for RFE… What u think guys???

Anyways, anyone got to know about RFE reasons?

    2. CG SYF

May be your job designation is computer programmer. They might have issued an rfe to check is this is a speciality occupation.

Case Was Transferred And A New Office Has Jurisdiction. What does this status means? I have already refered blog explaining case status but this is not included. Please help Sourabh.

    1. Ram

This means your case has been transferred and the transferred office has jurisdication. Your employer will also receive a transfer receipt. You can refer it for further details.

    1. SPB

If you got one RFE from one of the employers, it would be same as other RFE’s, if proper evidence is provided, it wouldn’t be any problem.

If you got two RFE’s, one from each of the employers, there is something about both of your petitions that USCIS didn’t like. This need to be handled more carefully, or it will end up being denied.

Having said that, it all depends on the reason of the RFE.

      1. Popatlal

Thank you for your reply. So far I haven’t received rfe for either one but was just wondering if an rfe can be issued just because they are 2 different applications for the same person (different employers of course). Also, is it advisable to ask one of them to withdraw the application at this point or just wait till they are approved etc.

        1. @Popatlal

I feel your RFE won’t be related to two applications at all. It may be for different reason.
You can request your employer to withdraw at any point of time. Right now, I feel it’s better to wait n get one approval. Then withdraw other. Just to play safe.

    1. Ram

After lottery results, ( hope you have your RN, n u have verified all info in receipt notice) we need to patiently wait and keep tracking our case for any update.
There are couple of approvals or RFE provided for some other new H1B applications. The ball has started rolling, So we got to wait for our turn.

          1. Ram

Oh ok. I doubt that, they might be withholding it for some reason. Get the receipt number and start tracking the case! Good luck!

    2. HCLCHN

After the lottery results no update in GIS or any emails from ISG. I got the status from the DU SPOC after that no update. What would be the next step?

      1. Dhans

ISG might have all the selected candidates receipt numbers. But you will get the details during your stamping time. They will regularly track all the cases and update you on the status of case is approved or RFE. if it is RFE, they will request the additional documents or else they will proceed on the next step of stamping initiation from October.

The above mentioned details are collected from last year batch members.

          1. Hcl_answer

Yes they will notify the rejection and when is the big question mark. One of my friend case is updated after 18 months. They will give very least preference for rejected case.

          2. HCL

Ok, please do update here, if you get to know your approval or RFE status or get to know anyone in HCL has got to know.

          1. CollaberaGuy

            Hi,
I’m still waiting for any kind of an update from Collabera. If anyone gets any sort of an update, either approval or reject notice, please update this page for the benefit of the others.
