As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. NO lottery…. Few factors to consider that FY16 will have less H1 B applicant or possibly no lottery or less competitive lottery.
    Note: There cannot be any concrete prediction on the count of FY 16 H1B applicant. Below listed factors are just an angle to think through.

    Factors which may lead to less H1 B applicant or possibly no lottery or less competitive lottery in FY16:
    1. EAD for H4:
    Under Obama Executive Action on Immigration 2014 there are good number of people would rather wait a month or two to get the process implemented for getting EADs, rather than going through lottery process and process of finding employer/sponsor.

    2. Single applicant filling from multiple employers:
    In ideal situation multiple employers would file H1 on behalf of one applicant if that one applicant has high demand in specific technology / area of expertise. However, we see a trend that common IT professional also manages to get multiple employers/sponsors to file H1 on his or her behalf. Lately there has been RFEs on such cases. Therefore people of observed that fact that even if they manage to file H1 from n number of employers and increase their chances of selection in lottery, but it does not increases chance of H1 approval. There is good chance of reduction in such numbers, thereby reducing the overall number of application for FY16.

    3. Trend from Indian IT companies:
    Indian IT companies file H1 for their employees so that the employees can perform company’s operations from US. Indian IT companies have no interest in just filing H1s so that their employees can relocate and switch company while they are in US. In recent past there is trend that most of the IT professionals who travel onsite on H1 end up switching the company. Therefore it is predicted that this year IT companies will be very selective in choosing the employees for which they will file H1Bs. This trend will drastically reduce the number of applications as the majority comes from this bucket.

    Again above listed factors are just speculation which may or may not be true for FY16 H1 B processing.

    • Interesting opinion, I have heard the EAD – H4 argument from another friend…but i believe we will have the lottery again and numbers would be north of 200000, maybe I`m a pessimist and I of all people need this to happen as this is my last shot.

      • I completely agree, I dont think companies would stop applying for H1b, because they recover the cost sooner than most people think so they really dont care about attrition rates etc.

    • Very Optimistic post. Last year my employer filed 8 H1b and only 2 got approved. This year he has already filing 32+ visas and counting. Mine is going in lottery again. Hope I get it this time.

    • No; it won’t come under masters quota! you will be in regular quota! If you did from IIT too, it will come under regular one 🙂

    • No one would know how many applications will be filled in FY16; in other words there is absolutely no way for anyone to predict if there will be lottery or not this year. Even if there is lottery no one can predict what will be the ratio.

      All people who visit this site pretty much know about the above listed fact. Still people post stupid, really stupid questions.

      These people do not deserve to get H1 actually, because they are stupid and on top of it they go about demonstrating their stupidity to the world.

      Please understand that there is no way to predict these things. If you want hear prediction then better go to astrologers !

      I mean I don’t understand the thought process when you as about prediction in this forum? While asking do you think some here is astrologer who can answer your question. Or do you think some has developed a computer program for H1B prediction? I mean what exactly you think when you ask for prediction?

      • More than the OP, I am baffled by your response Bob. Ofcourse will have a lottery this year, I am 99% sure we would (Based on an educated guess and previous year trends).
        Also lottery applications will be north of 170000, my best guess is around 210000 applications. I am surprised you think these are stupid questions, while its hard to determine number of applications in AD, its easier to guess the number of applications based on previous year trends.

        This lottery will be tough on all of us to say the least but all i can pray for is the H-1b total quota to increase but at this stage that is wishful thinking and nothing more. Good luck OP, its understandable you are nervous, so am i as this is my last shot.

    • You should have a good dependable employer… Would have to brwse thru lot of sites.. There have been a few links in the form…review them
      Your attorney should have already received the docs by march 1st to max 2nd week…If you reach here by march last week and then start searching for employers..You are very late for this years quota

  2. I can file two H1B petitions on my name from two different employers?
    Some say you cannot file more than one petition from the same employer where as some say you cannot file more than one H1B petition even if it is with different employers.

    Please clear the confusion and also if any articles are there on this, please help me with the link.Thanks.

      • These kind of people will increase the number of application eventually increasing the chances of lottery. These people find n numbers of employer for the sake of it.. In reality or if you are real, there will not be more than 1 or 2 employers who will file H1 on your behalf. Guys, you need to a rock star of IT world for n number of employers willing to hire you !.. And if you are not that rock star and still you have n number of employers filling on behalf of you.. then its questionable!

I have found a employer who will be filling an H1B for me in this year quota.Once they send H1B packages to USCIS ,Does USCIS provide any accptance mail or any number which confirms that our package has been recieved by USCIS.Actually I want to know, how can I be sure my H1B is filed to USCIS,whether its selected in lottery or not that is the second step.So I want to know if employer recieves any confirmation from USCIS upon recieving H1B package.Please reply.Thanks

    • As far as i know they don’t get an acknowledgement receipt but i could be wrong, but you can at least obtain the tracking number for your package.

    • Not many employers will give you that data… If you are selected then they might let you know you are… Some do give out the tracking info but many dont…

  4. Hi,
    I have H1B done in the year 2006. I worked in US for 2 years in the US from 2008 to 2010. I have not used the whole Six years, can I still do the exempt process for the rest of the period?
    Also now, my employer is changed, can I apply transfer of the H1B. Or I can consider it as expired and apply with a fresh application and test my luck again in lottery?

    • Yes, you can ask your new employer to apply for the ‘remaining’ years of your old H1b. You will not be considered in the lottery.

    • I feel very nervous and excited as well, and like you…I feel like this is my last shot. Last year I didn´t get through the lottery. I hope this bill became law to avoid the lottery!

  8. It seems that a new Immigration reform bill is introduced last week which has the provision to keep the cap open acccording to demand that could certainly abolish lottery process.what is the chance of it getting passed before FY16 H1B filing starts up ?

  10. My employer(One among the Top 3 IT Companies in India) is going to file H1B Cap 2016 for me. Does this mean I have 90% chance of getting selected in the lottery ?

    • We are not sure if there is lottery this year. Even I am waiting for the prediction report.

      In case if there is lottery, we can tell the percentage chance with out knowing the number of application received in first week to USCIS. Lets hope for the best and keep fingers crossed…

    If you really sponsor the visa (The entire fees of visa processing to attorney fees is sponsored by you the employer. As required by USCIS).

  12. Seriously guys, no offence. You guys look so desperate coming to U.S directly through H1-B, I mean there are freaking thousands of students who work all the way through GRE/GMAT and pursue Masters here with hefty fees taking loans or parents assistance, they deserve more after maintaining good GPA, Already IT firms like MCS, Infosss, Pipro have ruined quota.
    Don’t try for shortcuts, either come directly through Big IT firms or pursue higher studies here but not on small consulting firms who file relentlessly without brains.

    • Folks,
      avoid this advise.
      The reason that H1b visas are available without MS route is because US govt wants it that way (either due to scarcity of talent in STEM field or any other political reason) and so it open for people to apply and it is perfectly legal. Whether your sponsor is a big US multinational/Big Indian IT giant or a small startup/desi consulting, it should be a matter of personal choice. Such options exist due to forces of market (demand/supply) and no one option is a shortcut or longcut.

    I am currently on a H1B Visa expiring July 2016. And my spouse is on a H4.
    Both of us have got our visas stamped after extension.
    Right now my spouse is currently in India for a vacation.

    A consultancy firm here in the US had agreed to sponsor and file a H1B for my spouse.

    She’s planning to come to the US in January 2015.
    If my spouse files for a H1B while on a H4 Visa – Can my spouse travel back to India after the filing process and return back to the US after she gets her H1B approved ?
    She is currently doing her Masters degree in India

    • Ask your wife’s sponsor to file the H1b petition as Consular processing and not as Change of Status (COS). This way she can travel to India any number of times she wants. Eventually when she intends to join the job, her employer will have to additionally file a COS (I-539).

      Date of the lottery and when it will be done will be announced by USCIS in April. Lottery results will be communicated individually in due course of time (there has been cases of intimation in April as well as in Sep).

  22. Heard that the new president of India is working on building more “bathrooms” Apparently half the population don’t have them. Hopefully that will help “reducing” the number of applications for the H1B.

    • Don’t underestimate the Power of an INDIAN.. You guys score max 520 – 600 in your GMAT. We score 750-800.

      And that’s the reason most of the Indians are selected for H1B.

          Typical reaction to such comments would be defense by a bunch of “us”. However, coming from here I know how people think and approach things.

          I have to agree there is much truth to what you have to say. There are a lot of fake resumes and hell lot of bullshit consultants.
          Sadly, many of us are facing the choice of which is worse and eventually go to consultants!!!

      First get your facts right, it is not Indian President but Prime Minister of India who has taken the initiative to do so.
      You are right that half the population don’t have “bathrooms”, its ok Indians are not ashamed of that but you should be ashamed of one fact that more than half of the worlds’ most talented people are Indians. Talk about medicine, IT, Construction and think of anything [if you are knowledgeable enough] Indians contribution to each of these fields is uncountable.
      So, rather commenting on internal issues of any other country better concentrate on your country development by doing some good to it.

    • At the time cap submission you have to pay total fee what they wil declare for 2016. Once you pick I lottery ur cheque/dd wil be encash. That time ur attorney wil.come to know u r picked in
      lottery. After long waitng this torture wil starts frm 7th workng day of April 2015 to 15th june 2015. Thats it. The end. Again apply next yr.
