When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    I came to USA on H1 visa. Later I went back to India for a few months and was on H4 visa for sometime before converting to H1 visa again.
    I wish to know will the time I spent in India and on H4 visa will also get counted in the time I have left on H1(H1 max out)?

    I’ve a situation. My H1b application got approved last year. I’ve approached a Person A for filing the application, but as he was not doing H1b he asked his friend to file H1b. It got approved, but Person B has landed into some issues and he never gave me the documents. Now Person A promised that he will file from his company as it was his mistake. Now when i check the status on previous petition number it says it has been revoked. Not sure what I should do now. Can anyone suggest if I still have any hope or am i wasting my time in waiting for updates on the same. Please respond.

If you have not received the notice within 14 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    I have gone to H1b visa interview on January 7th and Visa Officer issued 221(g) form asking few more project documents from my employer. But till now my employer I haven’t provided by Project documents to submit. Now they are preparing the documents. As it is delayed for 4 months, will it cause any issue to my H1b approval? Are there any chances of getting approved. Please suggest

    I have got selected in H1B lottery for 2015 and my petition is in Initial review status. But my onsite manager (whom i given during my petition submission) quite his job and moved to another organization within US. Will it be problem for my approval?

  8. Hello.. I have a few question regarding h1b and H4 visa. Could someone claify my doubts?

    I am working in USA for last one year on H1B and i am getting married on June in india. My fiancee is in india, A company from USA had shown interest to process her H1B. Now she got through the lottery this year. So Below are my questions.

    1. Can i apply H4 for her while her h1B is in progress? If she goes to consulate for H4 interview, does the consulate officer will have a knowledge on her H1B? Is there anything chance for H4 denial?
    2. Some said, she should get her H4 visa before her H1 is taken for process. Her H1 will be denied incase if she goes to H4 interview during H1 process or RFE? I have no idea about these law and rules. Could someone give me best and better way to approach this issue.
    3. She has already got visitor visa(B2). Does she really need to get her H4? or can she come with me on B2? If so what is the process?

    • In this case you need to act smarter. Well if her H1B is through in the lottery, she should not go for H4 visa interview as if she got H4 visa than RFE will be given for her H1B.

      I think best move should be to call her on visitor visa and once H1B is approved you can move her on H1B with proper EAD letter.

  9. I applied H1b visa through a consultancy for my wife last year and after 13 months it got approved today. She is in India right now and hold a valid H4 visa.

    – Is it risk to go to h1b stamping in India. Instead, travel to US using her valid h4 visa and later request to change of status from H1b to H4

    – Is there any other possible risk if we do COS, like request getting rejected, delay in getting SSN, difficulties in job hunt etc.

    Please let us know your thoughts.

    I am sincere follower of this blog since May 2013. I am happy to say that my husband petition got approved on Dec 2013. We went to stamping on Feb 1st week. We got tensed at that time. Interviewer asked simple questions and tricky questions. We got stamped successfully. We are planning to go to America in May.

    My H1B petition got approved in Oct, 2013 and then I appeared for Visa interview at Delhi consulate in the month of November where it was refused under 221 (g) and was put in administrative checking.

    Now I have received an update they want the client to get in touch with KCC. What exactly does this mean? What is the probability of Visa being granted?

    • Mandy,
      They are confirming if the mentioned client/project really exists or not. Once they talk to the client, they will report back the findings to the consulate who will then determine whether to issue the visa or not.

          That’s for the client to decide. Your client manager can check w/ their legal team to figure out who should be the right person.

            If the client doesn’t respond or fails to respond, considering petition is already approved (however the original copy of I-797 was held by the consular officer at the time of Visa interview) so can I apply for cap-exempt petition through some other employer?

  12. Hi Saurabh,Experts

    My petition was pending in RFE RR since November. My employer raised a service request on March as there was no action. Later on this month,I requested my employer to raise a second service request as the first service request has also gone past one month. But my employer told me now that when they tried to raise a second service request , they have got an update from attorneys that I will receive my approval notice in 14 days. But there is no status change in USCIS portal. Kindly advise me on the chances of getting the approval in 14 days as I am so much confused on how to proceed on this.

    • Confused with the updates after RFE RR,
      I don’t know why the attorney said so. Maybe USCIS has informed them of an upcoming decision, but am not 100% sure. If you have no reason to not trust the employer, then wait for few days to see what the decision is.

    I have submitted the documents required for 221(g)(only docs not passport, as you know even if we dont submit passport we need to provide passport no), Its been near to 2 months and no update till date, once the Passort reached to post from next week on When checking the status online with the passport no Its showing the msg ” There is no status update available for the passport number submitted” , What could be my chances now, any idea on this message, when mailed them they replied saying this “Please note that, your visa application is under processing at the Consulate. Most administrative processing is resolved within 60 days of your visa interview or the submission of supplemental documents, whichever is later. When additional administrative processing is required, the length of processing time will vary based on the circumstances of each case.

    Please be assured that, once the processing is completed or if the Consulate needs further information, you will be intimated about the same.”

      Unfortunately there is no set processing time for 221g and the process is not very transparent. There is nothing you can do except to wait for them to complete their processing.

      You will have to wait for the lottery result to be sure whether the petition was filed or not. Until then you can rely on your employer’s honesty.

    I am in confusion, please clarify.

    My H1B is approved for FY14. LCA is valid upto Feb 2016. However, i am no more working for that client. So now I know that i need to apply for new LCA based on the client location. Now i don’t have abroad plans because of family constrains. My concern is, can i use this H1B petition after one year from now.? Will there be any issue if i do not use my petition for a year.

    Please anyone provide suggestions.

      Yes, it can still be used in future. If the petition is still valid, then the same employer can send you to US w/ new LCA for the new location. If that employer is no longer willing in future, then another employer can file a cap-exempt petition for you.

  17. I got my H1B visa ..but now my employer is not having any projects. They are looking for contract positions in the market. I am still in India and waiting to travel. Will it affect my visa?

    • By H1-B visa you mean H1-B petition approval or did you get your visa stamped on your passport after attending the visa interview? If it is the petition then you will require a new LCA if your work location USA changes before you go for visa stamping. If you have already got the visa stamping done then you can travel to US but still you need a new LCA in case if your work location in the USA changes.

      FYI: Visa is a travel document, nothing more nothing less. It doesn’t provide you the right to work in USA. It is the H1-B petition that permits you to work.

        I have visa stamped on my passport. My employer is looking for contract jobs where I will be working on hourly basis on contract but the H1 remains with the filing employer only.

    I am working from Company A since 2012, now I got an offer from Company B and they will apply my H1B transfer in few days (i.e. April). At the same time, my wife’s H1B is getting applied for 2015 cap by one company. She is in H4. Her H1 documents includes my I94 and company A- H1B papers. So my H1B transfer from company A to company B will create any problem for her H1B application? Should I apply for her H4 transfer as well while her H1B will be in process? I need help on this.

    • Could you please confirm with me that we can apply this year even though our last year petition is with pending status ??
      My employer told me that he can not do that untill a decision is taken on that case.

    It has been four months from RFE/RR . It is still pending. Service requests has been raised twice. But there were no responses. Please let us know that you have come across such cases in which a positive decision would be taken even after 4 ,5 months ?? Totally hopeless nw….

    • My employer has withdrawn my case in jan 2014. But in USCIS website it still appears as RFE RR. So check with him. He may be fooling around. I came to know when i insisted in converting to premium.

    I m on h4 visa in US. I had applied for H1b and got rejected. What will be my current status of visa. Meanwhile my husband got his H1b transferred and his consultant now says i have to file new h4 bcoz h1b has over rided my h4b status. Also i want to go to my homeland india for visit. So do i have to stamp my h4b again when coming back to US?
    MY H4b IS ALREADY STAMPED till oct 2014.

    • I think you are fine, you can apply for new H4 before the expire of your current H4. Anyway, please consult with an immigration lawyer. To my knowledge, you have a valid H4 and it allows you the stay there till the date of its expiry without changing the status.

    • It can be transferred to company B, you must have the receipt of H1B transfer request petition before you start working for them along with previous employer salary slip.

    I have H1b approved, but my employer is playing all sort of games. Application got approved 4 months back and till now he has not given me the papers and keeps on pushing when asked about the documents. some times he answers the calls and sometimes turns of his mobile for weeks.

    Its a small company called MSK technologies, my question is how do I find if the company is still existing and he is not playing with me.

    Secondly if it is found that company doesn’t exist and he is playing around how can i take it legally.

    • If h1-b petition is approved, and you admitted or changed your status based on this petition, you perform services, get paid, but still do not have your paperwork?
      then
      Your employer must give you a copy of petition, original of approval as well, maintain paying schedule or stop your employment if he doesn’t have money to pay you. He also must sponsor you flight back home in case of termination. If he doesn’t pay you, you may find a new job who will transfer your h1-b and then file to DOL against former employer.

      You didn’t enter country or change your status yet based on this petition, didn’t start work and didn’t got paid?
      You are not yet employed, and you don’t have any legal right about it. Employer has every right NOT to use this petition, and the US will be much obliged if he will employ a citizen instead.

    I have a H1b petition filed by US based company and approved. but now it is in 221g processing. My current also willing to apply this year. But my Current employer will not file if they come to know about existing pending visa.

    Is it must to inform my employer about this pending H1b Visa?
    If I haven’t informed, will they come to know about my current pending visa?

    Please advice.

    • You don’t have to inform anything with about your other employers. However, my gut feeling tells me that 221g is processed against your person, not your petition. Second application for visa should be placed on hold awaiting your 221g results. (it just makes sense, however, I do not remember such dare people :-))

      I doubt your employer SHOULD be informed about other visa pending, if only visa officer will occasionally tell them that. But usually employer doesn’t talk to visa officer, you will just receive another 221g notice and that’s should be it.

    • This is the biggest delay I have even heard about USCIS. There is no change in the status even after Upgrading my case to Premium on 7th Feb 2014. The status is still showing Acceptance since 7th. My attorney has sent two requests so far to update on the Premium Request, but still no response from them. I think I am the only one without any status from April 2013 to till date. If anyone facing the same situation do let me know.

      • I think they probably lost your documents and no one want to take the responsibility. My case was similar, no results until Sep then I got a denial saying that I did not reply their RFE on time. After they found it is their fault they resend the RFE… But I am still waiting for the result…

        • Finally yesterday my attorney got an update from USCIS and she said that the delay is due to “Security Check”. It has been sent to Security Check. I don’t know how long it will take. There is no specific time given by them. Anyone in the same situation?

            I am also in the same situation. I filed for H1 in April 2013, and converted to premium in Oct 2013. I have still not got any response and the case is in Acceptance status. The last update from the attorney was that the case is under Security Check. Does anyone know what this step is and how long will it take for a decision to come.

  29. I came to US on L1b and my wife on L2. L1b/L2 and I-94 for both of us were valid till 6th Sept 2013. My employer applied for L1 to H1 COS in april 2013, got selected in lottery. While H1 COS was in progress, my employer applied for L1 extn for me and L2 extn for my wife for us to maintain status. My employer also applied for my wife’s L2 to H4 COS in Sept.

    Current Situation –
    My L1 extn denied on 20th Feb 2014
    My wife’s L2 extn denied on 21st Feb 2014
    My H1 COS approved on 20th Feb 2014
    My wife’s H4 is still in initial review since 19th Sept 2013 (her I94 has already expired on 6th Sept 2013)

    My Questions –
    1. Can my wife continue to stay here until her H4 is approved?
    2. Is she maintaining valid status as her H4 is in progress?
    3. If she is not in valid status how much time does she have to leave the country? I need number of days? today is the 5th day from when her L2 extn is denied.
    4. Is there any other option available for her to maintain status?
    5. Can we apply for H4 Premium Processing?

      2. No, she is technically on pending status.
      3. If H4 COS will be denied (highly improbable if H1 is approved) she will received denial letter with information on time to leave (usually 30 days).
      4. Doubt so, but I am not a lawyer.
      5. No. PP is used for time-sensitive applications, and H-4 is not in the list.

    I have H1 stamped now. and my husband is attending H4 interview now. But my employer said he will file H1B for my husband in FY2015. So can he travel on H4 and once the H1b is picked and approved, can we change the status there or what would be the case? will the H1B become Invalid? Please suggest.

    Note: I will be travelling now but my husband will travel in july 2014 on H4 and H1 will be filed in April 2014 in India.

    I need your help. My employer said my h1b is denied. But today I received an email from uscis.

    On February 25, 2014, the Administrative Appeals Office returned this case. If your case was remanded or your appeal was sustained, we will notify you of our action within 60 days of the date of the AAO decision. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center.

    Pl let me know if anybody can let me know what this means.

    I attended my visa interview today in Hyd and was given a while slip (221g) asking for product/project documentation.

    I could not completely get what the VO was saying or if she really said anything, however what confuses me is when I submit my docs do I have to take an appointment again or will it just be a drop box? I read online that this may take several months/weeks before we hear back. Are we supposed to submit our passport also with additional docs requested? I was given all my docs and passport back in the morning.

    My status was showing “Initial Review” from April 13 to Feb 5th. My employer upgraded my petition to Premium which was filed in April 2013 Regular. On 7th of Feb 2014 he filed Premium and no status change from USCIS till today. My 15 days time will be finished by coming Friday. I was wondering whether I can expect the result at least by end of this week (Friday). I heard people used to get their result in Ten days itself once they upgrade it to Premium. I also heard that there is process called “Extended Review” which will take months to get an upate irrespective of Premium or not.     My case status was showing “Initial Review” since April-2013 till Feb 5th. Finally my employer upgraded it to Premium Process and its now in “Acceptance” state. It says “On February 7, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case.” Earlier it was under “Initial Review” when it was normal process. It has been changed to Acceptance and no change from 7th of Feb to till date which is almost 9 days.

    I am aware that Premium Process will take 15 days to process the H1b Petition and give an update either denial/approve notice.

    I also heard that some petitions will be selected by USCIS and will be sent to “Extended Review” even though its Premium Process.

    What are they chances of getting my petition approved/RFE/Denial in this coming week which is remaining length of Premium Process time.

    How many of your petitions were changed their status from 10th day to 15th day?

    I am really tensed and have been baring this pain since an year. Kindly provide me your answers. Thank you

    • I did tried to get more details on this consultancy but unfortunately I didn’t get much through web. So I did checked the details of this domain and found that it is created in Dec 21 2013. So it is a new consultancy without any history. Also some of the website traces show the owner of the domain is http://website.informer.com/maxconsultant.org , sruchit kumar gupta polite software solutions pvt ltd. This is a fraud company which police caught them in September 13 on Visa Fraud, http://www.newswala.com/Hyderabad-News/Visa-fraud-Fake-consultancy-accused-arrested-and-about-Rs-50-lakhs-recovered-September-3-2013-45891.html. It seems to me a FRAUD company too.

  40. On February 11, 2014, we mailed you a notice informing you that your I129, PETITION FOR A NONIMMIGRANT WORKER, was reopened. If you have not received the notice within 30 days of the date above, please call customer service

    Wat does it mean. I got rfe in september and then it ws rfe response review for 2 months. now it has changed to case reopen. does it mean approved or rejected?
