When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

Also, typically USCIS sets aside 6,800 visas  for Singapore and Chile Free Trade agreement filings, which is H1B1 Program. Also, read article All about H1B Caps – Basics Calculations, Lottery

 

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  2. Hi Saurabh,

    I was on L1B visa with I-94 expiring on May 31st 2013. My employer filed for H1B on April 1st 2013 with COS. My employer also filed the L1B extension (and L2B extension for spouse) on time. On November 1st 2013 my L1B extension denied and approved H1B with COS (L1B to H1B) valid from November 1st 2013. On September 27th 2013 I filed I539 (L2 to H4 COS) for my spouse. Her COS got approved on November 26th 2013 and her I-94 has valid from date as November 19th 2013. She got new i-94 as well. However since her L2B extension was denied with my L1b extension on November 1st 2013 I have below two questions:

    Questions –
    1) Since my spouse L2B extension was denied on November 1st 2013 and COS to H4 was valid from November 19th 2013. Was she out of status for the period 11/01/13 to 11/18/13.
    Note: I filed I539 in SEP prior to expiry of L2B

    2) Should her I-94 been from 11/01 as well?

  3. Visa successfully stamped. Mine OFC date was 24th Nov and interview date was on 9th Dec. It was very smooth process and got approved in just 3-4 minutes without any hurdle. Mine was at Mumbai consulate.

  5. Hi All,
    I have applied for my h1b and got and RFE against client letter and my education evaluation on august 9, i worked with the top most MNC in india. my case cordinator later asked my to submit previous organization letter dipicting my skillset againts for my education, i have done 4 year graduate diploma in Interaction design from a reputated collage.

    My previous employers straight away refused to provide anything on thier letterhead, after a while my case manager gave me different format werein i needed to get a sign of my supervisor or collegues from my previous emloyers stating my skillset.

    Travelling within differetnt cities and getting the sign of supervisor on an notarized affidavite was a success.

    I submitted that affidavite to my case manager and they later on gave that to third party for evalution,.

    My RFE finaly went on 1st nov 2013 and its in RFERR since then, till date i am waiting for my approval.

    Now, my question is. how relieable is the affidavite and will it work as i have 12 + 4year diploma and further 4.5year EXP.?? Does anyone in this forum experienced similar RFE and went through this procedure??

    My employer planing to Push my case to PP, as thier is urgent requirement in Jan, Will this kinda RFE will have further Pitstops??

    i recently went for chennai counsolate along with family

    After few questions they asked for proj doc or client letter

    i did not have client letter or project detail documents from the petitioner.

    later i was given the blue 221g from asking for the above documents. and the VO said that its not my fault, they required documents from petitioner to further proceed

    They did not take any of the documents from me ,

    wanted to ask what are my chances now?
    Whether do they take any documents from people for whom visa is been issued?

    • Blue slip should not be an issue based on my experience..Once you get the documents you can submit it along with the passport and you should get it stamped..
      Did the VO mentioned that you have to come again for stamping? I guess No..

    I had got approval notice in October. The date of birth was wrong. We raised a service request to get it changed. Now my case status has moved to acceptance status with the below mentioned message.

    ” On December 10, 2013, an amended notice on this case was mailed describing how we will process your case”

    Can you please let us know if that means they have mailed the changed approval form?? or they have started processing the request???

  9. Its really frustrating now. Can’t take it anymore. Feel like just leave US and start a new life. whole year has gone. Still no signs of H1B. My 60 days in RFE-RR will be over by 25th jan……….ohh know so late. Then also not sure wat will happen. One thing is certain if i get another rfe i am going back for sure. Feels like i am in a prison, specially in this winter season:(:(.

    • I feel your pain however you can leave and wait elsewhere. You have to contact USCIS and tell them where you are going.

      My case has been on RFERR since October 3rd, I am on day 69 now!!

    one question..

    My H1 is approved . I am currently in US on H4 but mine was not COS since i came on H4 after H1 was initiated. Question is for stamping should I go back to India or can I get it done from Canada or any other country near by? Is home country always preferred ? If yes, why? or is thr any other option.?

    I have one question:

    I have been working on this company from the past 1 year and 3 months in opt. Last year I applied for h1 under eb3 category and didn’t selected in lottery. Since I have 3 and 1/2 years experience prior to my bachelor degree which I worked for small IT company back home and I will have 1 and 1/2 year experience with my bachelor degree in US by march which will make the total of 5 yrs experience. With this, Do I qualify for EB2?
    Also, can I apply on both under EB2/EB3 category?

    I asked employer and he said that RFE response submitted on time. he also said that package is with USCIS now. I belive that package received by USCIS on 4th Dec.

    So my question is how many days USCIS takes to change status from RFE to RFERR.

    I’m waiting for my H1 visa approval and would really appreciate if anyone can clarify this for me.

    Here is my journey so far:
    Receipt on 8 April 2013
    REF on Aug 12
    Status update to REF response review on Nov 6 ( last action as of 12/4/13)
    Center: EAC
    My petition is not yet approved on 12/4/13

    1.If approve (after 12/4/13) will the H1 I-94 be valid from 1 oct 2013 or from the day of the approval ( ie after 12/4/13) ?

    2.The bottom line is that I recently got my H4 approved (COS) on Nov 16 and not sure what will be my status as per “last action rule” ( if my H1 is a approve later).

    I would really appreciated if anyone have got there H1 approved after the 1st of October and let me know the date I-94 is valid from on the approved notice.

    My H1 petition is approved. I need to plan for my visa stamping. I had applied H1 through a small consultant. He doesn’y have any project in hand and I would need to hunt my contracting opportunities once am in US. My skill has good demand in US but I would like to find an opportunity while I am in India.

    My question is if I go for stamping with the current petition in hand and gets through with it then if i find any other consutant who has a project and is willing to do h1 transfer then can I use the same stamping once my h1 is transferred while am in india or I need to go for another stamping with the new employer?

    They have issued Blue slip for me in the consulate during VISA interview and they had asked for Police Clearance Certificate. Do anyone have idea on how to get the PCC.
    1. Do I need to get that directly from the nearest police station?
    2. Do I need to obtain from Regional Passport office?

    Also, does anyone have the format for the PCC.

    • Could you please tell why did they asked for police verification at the time of your interview ? Until unless if it is personal then it is fine. I am asking because I’ve not heard about any such questions during H1B visa interview.

    • Step 1 Register through the Passport Seva Portal. (Click on “Register” link under the Apply section on the Home Page).
      Step 2 Login to the Passport Seva Portal with the Login Id created in Step 1.
      Step 3 Click “Apply for Police Clearance Certificate” link.
      Step 4 Fill in the required details in the form and submit.
      Step 5 Click the “Pay and Schedule Appointment” link on the “View Saved/Submitted Applications” screen to schedule an appointment.

      Online Payment has been made mandatory for booking appointments at all Passport Seva Kendras.
      Online Payment can be made using any one of the following modes:
      Credit/Debit Card (MasterCard & Visa)
      Internet Banking (State Bank of India (SBI) and Associate Banks Only)
      SBI Bank Challan
      Step 6 Click the “Print Application Receipt” link to print the application receipt containing Application Reference Number (ARN)/Appointment Number.
      Step 7 Visit the Passport Seva Kendra (PSK) where appointment has been booked, along with original documents.

  26. Any body knows how to handle FNU issue. All my US documents are FNU and My full name. My whole name is my full name section on my passport . And last name section is left blank, on visa they put everything in last name and made me FNU, Now i have to apply for H4 for my wife, Thinking what to do ? get it corrected or apply as it is and get it corrected later on .. any body having any idea on that ?????

    • @FNU issue : you mean your I797 has issues?? I also faced the same issue. DOB is wrong in I94 part attached at the end of I797 approval form. My attorney has raised a service request. It has been a month. There has been no update. I am not sure if it has to be corrected now or later. But it is like giving a chance to VO at an embassy. If you have time, get it corrected. If you think the time is tight, go ahead and hope for the best.

    I’ve got my H1B approved. The H1B was filed by a new employer. I’m yet to go for stamping. New employer wants me to go for stamping at the earliest. I’m planning to go for stamping in December.

    However, my current employer wants me to travel to Mexico for 10 days in Januaury. Will it be possible to travel to mexico after h1b of new employer is stamped on my passport?? Please answer me. It will be helpful to decide.

    Please note that I can’t extend my stamping beyond january. The new employer will not agree.

    • Hi Depressed,

      Don’t worry, if you can get the things asked for in the RFE or the denial, that is any extra evidence, which you could not furnish with your original petition, like that of a client letter or the SOW (Statement of Work) between the vendor and the client and if you could appeal within 33 days of the denial notice, I am sure you will have a positive response, but the wait time for the processing of an appeal ranges anywhere between 3-6 months,

    Acceptance : April 8th, got the receipt # on April 29th.

    RFE: August 12th

    RFE Response Sent : october 10th

    RFE RR: october 17th

    Approved: November 22nd.

    If the documents are good and you are atleast 4yrs experienced, approval is sure, only key is patience. All the best to people still waiting.

    I am employed with desi company and they had taken 10k USd bond.Now i a leaving them and they are asking 10k USD for experience letter.
    I heard we need experience letter at the time of Green card application and that is the only use of that letter.

    Is this a blocker and we need to get the experience letter just for GC or is there any workaround for this.Please suggest.

    My application was approved on Oct 10. My employer hasn’t given me the papers yet. I’m not able to schedule interview as I don’t have the docs. Now my employer is not responding to my calls or I’m not able to meet him…Any idea as why he is not responding…is thr something fishy…its a small company thru which i applied for H1…

    Still waiting for a response. Can anyone clarify what exactly an E-Request does? It’s been 93 days and I still haven’t gotten a response. I proposed filing an E-Request with my employers and the lawyers advise me that it’s not a good idea. What’s the chance that they will deny my case if I raise an E-Request? Will the outcome be the same if I carry on waiting. This is killing me!

    My H1b cap exempt petition was processed in Premium processing after the RFE Response i got result in 2 days i.e today it changed to post decision activity approved and after 3 hours it moved to decision though it’s approved…Please confirm if this changes has any thing unusual
