When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    Need help in scheduling date for Visa Appointment. I work for an IT company and due to work schedule I won’t be able to schedule a date in next couple of weeks. I’m looking out for a date during last week of Nov or First week of Dec.

    My Question is, Nov 28 being a holiday due to Thank Giving Day. I want to know if it will be good to schedule an appointment on or before thanks giving day.

  3. My Case was denied and appealed so on 29th onwards my status was changed to USCIS is cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information so i asked my employer,he send me Form I-797C, notice of action which was received from USCIS there my receipt no was changed, but my employer said receipt no should be changed after appeal is it right? and by using this new receipt no it shown like Initial review and your case was send to your local USCIS Office for further processing and one more thing if we were on premium process (At the time of filing) then USCIS might deliver the decision within 90 days is it right?

    Anyone in Initial Review status after replying to RFE with the following message:
    “your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER”

    what does this mean and how long does it usually take to get a decision??

    Really frustrated with this long wait!!!!!!!!!
    Someone please help!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

      Dont be panic. USCIS some times show random MSGS.
      I havent repply RFE yet and it shows as IR and Yur address of i129 has changed..
      That is false message. Wait and watch.

    Thanks a lot for all your support in this Portal.
    I have got my Visa stamped but only for 11 months, though my petition clearly mentioned for a 3 years project. I was also asked the same question like how long you gonna stay in USA. I replied 3 years but don’t know how he gave only for 11 months.

    My petitioners asking me to drop a mail at consulate office with the hard copy of my petition and the copy of my stamping, asking if this made by any typo or intentionally due to any reason. will this effect anything to me . I went to interview with my wife and kid and all 3 got stamped for 11 months only. Please suggest me what can/should I do for this case.

  6. I got my ssn today…for those on COS needing ssn urgently.you can apply the ssn and check with the ssn office in 2 days to get the number assigned to you instead of waiting for the card to be mailed..just carry valid id proof to the ssn office. .and ur petition and the ssn receipt.

    My new employer (Based out of US) has filed H1B FY2014. Currently its under the process.

    Meanwhile, my current employer (India) wants me to travel to Dubai for a project (Duration : 2 months).

    Can we travel to other country(Middle East Countries) while the H1b is in process or will it have any impact?

    I was told there will be a delay in the Visa processing as the Background check will be initiated for the persons who got Middle east Visa stamp.

    While I submitted my Passport Photo copy to the new employer, there was no middle east stamp. but now when I have to go to the interview,and filing DS160 there will be middle east visa stamp.Will this have any impact. Kindly let me know as my current employer initiated the request fot Dubai travel for two months.
    Also While I’m in Onsite Dubai. If I get the documents from the employer for further processing. Can I wait till I comeback to India and proceed for interview.

    Saurabh, Please let me know your suggestions.

    PS: Onsite Dubai cannot be escaped as it is a project requirement.

    1.Do I need to file for an extension if H1 does not get approved before my H4 expiry date?

    2.Will I be out of status if my H4 expires, but my H1B COS is still in process?

      • My employer didn’t raise any service request.. BTW what’s a service request? when does USCIS REOPEN a case? It’s a new petition, regular processing. It was in RFERR from Sept, 26 to Nov 5…

      I got an approval on Oct, 16 and as of now my attorney hasn’t received approval letter from USCIS. Wait for another couple of weeks and if you don’t get in next 2 weeks then you can contact Customer care as they ask us to wait for 30 days.

      Update here once your attorney receive approval letter from USCIS.

            I am not sure but it may not be suspicious, one more person is waiting from last 4 weeks. We may contact USCIS once 30 days are over. I hope we receive it before 30 days period gets over.

    I m on L1A with employer A and my H1 COS is approved on 30 Oct 2013 with employer B.
    My wife is on L2+EAD. Her H4 is not applied yet.She is not working currently but is getting a good offer starting soon.

    My question is – I may take 2 months to switch to my H1 employer because of some important commitments with my current company, is it ok for my wife to join a project on L2 EAD for these 2 months ?
    Once I switch to H1, we will apply her H4. Will this cause any issues in her H1 application next year. Please suggest.

    • Hi Pankaj,

      If your H1 COS is approved from 30th Oct then legally your status changes to H1 from the very next day. Although I have seen where people will take a week to max 2 weeks to resign from their existing company and get on to the new H1 employer. Its in your best interest to get on to H1 employer as soon as you can. But the complexity in your case is your wife will become out of status. My advise is is to apply for COS for your wife if you plan to get on H1 soon or consult a professional attorney. Yo can also check your options with your H1 attorney if you can openly discuss your options with him.

  19. H1B Visa Stamping experience at

    Firstly I would like to thank all the people who have shared their experience on this forum. This forum has been a great of information and also great moral support during my wait for approval. Now its my turn to contribute.

    OFC:
    My OFC appointment was scheduled on 24th Oct, it’s a straight and simple process. Reached there 10mins before the appointment time and was allowed in within no time. After waiting for a couple of mins I was sent to one of the many
    counters where I was photographed, 10 finger printed and stamped on the DS160 confirmation page. Thats it I was out of OFC within 15mins flat.

    The only documents required are,
    1. DS160 confirmation page
    2. Interview confirmation page.
    3. Passport
    4. I-797

    There are couple of things that I have observed when I stood in the line briefly,
    1. Reaching the OFC 15mins before the scheduled time is more than enough. You could be in and out within 20mins.
    2. Try not to get any extra baggage with you, just the documents mentioned should be good enough. In case you get extra bags/covers you’ll have to leave them outisde the OFC unattended at your own risk.

    Interview:

    My Visa interview was scheduled for 25th, again reached the consulate 15mins before the scheduled time and was allowed inside after they have scanned the bar code on a piece of paper that was stuck on the back of passport at OFC the day before. One important thing to note if you are planning to attend interview at Hyderabad, please do not get your mobile phone and they are not being allowed inside and also they do not have a place where you can deposite it so please plan accordingly.

    After entering the consulate we were asked to be seated briefly before people were being sent inside in the order of their appointment time. There we had to go to a counter where a slip with a number was glued on to the passport. After the usual security scanning procedures were allowed to go inside.

    Once inside there are two screens on which we could monitor the token number along with the counter at which the token was being serviced after waiting for about 15mins my turn came up, the following is the conversation I had with the VO,

    VO: Good Morning. How are you doing?
    Me: I am good mam. How are you doing today?

    VO: Please pass on your passport and I-797
    Me: Gave her the passport and I-797

    VO: Tell me where is your employer located?
    Me: Answered accordingly.

    VO: So does your employer have any clients?
    Me: Gave the name of the client where I would be working.

    VO: Thats it we are done here!!!!!
    Me: Thank you Mam you have a great day.

    VO: You too…..

    As you can see it was a very brief interview with not many questions. From what I have seen while waiting for my turn to be interviewed, I have seen a couple of H1B’s being issued along with F1’s and also a B1. I have not seen any rejections while I was waiting.

    And for all those who are planning to attend an interview, prepare well and be confident. All the Best !!!!

    I am currently employed with X and my stamping is completed for a client of ‘X’. If however I leave X would this stamping be useful in anyway to travel to the US or would I need a totally new stamping before I head to US.

    • Status on my application is same since Last Friday OCT 25. As per my Attorney the system is not updated with most recent status. It will change as soon as USCIS make any decision on the petition. Earlier my status was initial review and now it changed to “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    My H1B petition has been approved on Oct 11 2013. I would like to visit the US consulate (with my wife and kid) at hyderabad to get the Visa. In order to book appointment slot I need to get the HDFC receipt. My question is: Do I need to make a single payment of $190.00 or Do I need to make 3 payments of $190.00 each.

      Last year when I attended I had to pay 190$ per person. so in your case it will be 570$. however, I am not sure if they have changed the rules any time recently. Please visit the Hyderabad consulate website for their specific rules. That would be more up to date information.

    I see the status as,

    Decision

    On October 10, 2013, this I129 PETITION FOR A NONIMMIGRANT WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    My Question is, what is the difference between PDA and Decision. Does the above statement means that the application is approved or do i have any twists :(.

    My H1B Petition was approved on July 23 2013 and my document got lost in mail in transiting from US to India. My employer filed I-824 petition to re-issue the duplicate I-794 receipt of approved petition. Now my new petition also got approved any I got duplicate papers also, but my case status shows on USCIS website under “Acceptance” status.
    Do i need to wait till it goes to Post Decision Activity or can i schedule the visa interview now ? (I have all the documents required)

    I had change of status from L1 to H1 and my visa got approved a month back. Right now my employer is not able to find any opportunities for me.
    My L1B expires on 2nd Nov however I do have valid I94 for another year so can continue to work on L1 until then I guess however I am not sure if there is an end date by which I should be starting to work on H1B as after the shutdown and being end of year, job opportunities are very less 🙁

      I am not sure COS works that way. you will have a max of 2 weeks from the Date of your COS approval to start working on your H1. Your employer may run paystubs for you even if you dont find a job, but, you cannot continue on L1 for more than 2 weeks from the date of your L1 to H1 approval. Saurabh, please guide.

          Yes, you can’t continue to work on in L1/I94, becasue your status got changed from L1toH1. So if COS approved (H1B approved) your L1/I94 will become invalid after 2 weeks.

  38. What the hell is USCIS doing for the RFE cases? Why so much of variation for some cases getting approved in 15 days and some cases even after 1.5 months still in RR

    My case is still in RFE RR from Sep 19th even though the response is provided by Sep 13th which is getting processed under VERMONT CENTER.

    This kind of uncertainty towards the future career is literally killing!!!

        • I was in this situation and got approval in 1 month. This never ending waiting time made me crazy also and I almost forgot everything except my H1B. Finally got approval and after a long battle I came USA.
