Why do we call H1B Visa 2014, when the petitions are filed in 2013 ?
USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014. So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.
What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?
If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)
- Regular Quota Cap – 65,000
- Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?
Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.
- For H1B Visa 2012, the cap was complete on November 22nd,2011
- For H1B visa 2011, the cap reached on January 26th , 2011
Will there be Lottery for H1B Visa 2014 ?
This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?
There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).
International Students – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?
Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option. The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country. You have to do the COS before your OPT expires to maintain legal status in America.
How soon Can I start working, if I file for H1B visa 2014 fiscal year ?
One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.
What is current H1B visa 2014 cap count ?
The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

My L1b Visa got expired in June 2013, since L1 extension is in process, I continued staying in US till now.
Meanwhile, another employer applied H1B visa for me. Now it got approved for 3 years with cable notification sent to consulate office in my Home country. so, employer is asking me to go and get Visa stamping now.
Here is my question.
My spouse is currently working in US with H1 Visa. Can I apply for H4 visa. so that, based on my spouse’s I94 I will get new I94. Then , I can convert my H4 to H1 visa in cap exempt(since H1 already approved) right? Do I need to go for stamping in such scenario?
Also, please do let me know if there is any risk associated with this.

I had received a 221G (pink slip) at the Chennai Consulate when I had interviewed for my F-1 visa. I have completed my graduate studies and am now working full time after moving to OPT for 9 months and am now on H1B (since Oct 1st, Filed COS and got approval without any hastle).
I am thinking of going to India in December for the stamping process. Does anyone here know if a 221G once received mean 221G always? Also if anyone has had a similar experience please share your experience.

Sorry to say, once you get the denial, you will not be able to transfer the visa. Though you have one option to re-apply the visa. Can not advice what will be the process for that. You can talk to your employer.

As per your work permit(i797) approval time frame you will get visa.
once you enter into US, before expiration of your work permit you can extended it for many times till limit of 6 years.
But after extension of your work permit, if you go outside of US and again returning to US then you need US Visa based on your extended work permit time frame to enter into the US.

If you are staying in US and extended your work permit then for you not required US Visa on your passport. But when you leave US for any reason then you definitely required US new visa to re-enter again into US if your old visa which is in passport valid date expired.

Visa – is to enter into US.
I94 – comes attached with your work permit(i797) from. When you enter into US, at the airport(US) immigration officer will stamp on I94 and attached in your passport which you need keep very safe. At any reason when you leaving US then you need to return that i94 stamped slip to airways people. Hence I94 is evidence that you came to US legally on H1B not on other option like L1, H4 or etc. But all other option also will have their own I94 slip attached their respective form

Oct 22: RFE responded
Oct 24: 1. First the PP clock stopped.
2. with an hour there was a message saying “USCIS cannot provide any information on this case”
3. Finaly update within 3 hours – Approved and email notice sent
Relieved now. Now I can concentrate on my work and other things in life.

When I called this number the IVR says “Clock stopped…”
I don’t know if its a second RFE. 🙁
I read a lot about this thing while working 😛
People had different opinions. Opinion which appealed to me is:
USCIS might be updating your case during this time. Call up your attorney and ask if they have received any RFE again (through fax it should be quick enough)
If not, then it will eventually change it to a decision in couple of hours.

The expiration date of my H-1B visa is almost one year prior to the end of the period stated on my I-797. On my electronic I-94, “admit untill” period is the same as my I797.
Why the visa wasn’t issued with the same an expiration date showed on my I797? What should I do after my visa expires?

Visas are just to enter US. You can continue to work and stay in
US until your I 94 and petition is valid. The only catch is after your visas
expire in case if there is any emergency back home you might have to wind up and exit US as you cannot re-enter until you get your visas stamped and so its a stamping risk iin case f you do not wind up. But this is all in worst case. Hope this helps.
Anybody has any idea as to how many numbers are approved. Since there is a quota of 65000.
since ur petition is already accepted, you are in that quota. how does it matter how many are done. you can go to uscis and check the tracker. its updated till august. will give u an estimate, i guess it says EAC approved around 9000 and almost 11000 are pending as on august.

My H1b petition was approved on Sep first week, and I applied for visa stamp at Chennai consulate. The VO asked me to wait for second round of document verification and project details. Then they issued 221(g) and selected “Your petition is returned to USCIS for review”.

this is what is asked..
VO: Where are you working now?
Ans: Company A (One of the Big MNC)
VO: What is the purpose of the trip?
Ans: I got new employment opportunity to work for Comapny B (Small company(4 employees only))
VO: The company B, where are they located,Is it for internal project or client project?
Ans: Client project…he asked name….I gave name..he asked me to spell the name of client..
VO: How long did you work in the current company MNC?
Ans: 6 years.
VO: Show me project description..and asked abt project details in client
ANs: Gave answer confifdently . but I did not use exact terminology as mentioned in the project description…but my explaination was okay I guess.
VO: We need to discuss more on your project, gave yellow slip and asked me to wait.
After 30 min, one indian lady looked at all documents..
and asked a lot of questions about education, previous us trips, company,client etc…
and again VO came…and said…we need to discuss with USCIS…we dont know how much time it will take…and gave 221 (G)…he took all petition papers and other documents….returned passports..
very desperate now…I never anticipated this…

Visa is not an entitlement, refusal are common now a days when you go with a small time US based indian body shopper. In face all big 4 big IT services company also go through so many rejection, so don’t get dejected. I can understand the feeling, but you know the reality, what is is!, what is not is not!.
Your process might take few months… Be patient and move on… If you get the visa, then nothing better than that, if not, then god has a better plans for you.

I can see that all WAC nos (before and after) in my series are getting approved, however mine still shows in resp. review even with earlier Rfe resp date than others. is that a sign of that something not in favor. anyone is same situation or anyone (gurus) here have any clue.

What was your RFE all about? mine had some 12-13 questions. Employer didn’t tell the exact details. It had to do with Client letter, relationship, SOW, how performance will be monitored… etc. just know this much.
Any one have any experience or advise on this?

I got my H1B approved petition and even stamped last week from reputed MNC company in India.
My employer as given us one of our company branch location in LCA but now they would like to change our location directly to our client location which my employer is saying that they need to file amendment instead of new LCA as it is client location and they are saying they it would charge 4K to 5K US dollars. Because of this reason they kept our travel dates on hold.
Could you please let us know the process of this ammendment and is there any way to work directly in client location.

Only LCA change is required.Amendment is not required.
Also 4k to 5k, thats totally insane amount. Mainly you need to do LCA ammendments and which cost max 500 dollars not more than that.

I am under H1B extension process and I got an RFE. My employer responded to the same.
On 15th OCT the pp clock was started but my status since i received my RFE and the first time pp clock started is in Initial review. Quite Surprising.
No change of status like request for evidence/ request for response request evidence.It’s still Initial review?
Is it normal because i assume status should have changed from the time i received rfe. IS this a good sign that my online status never went for RFE stage or a technical glitch .
I understand that though i will get the response within 15 days calculating from 15th OCT ?Any tentative time (i mean based on experience/frnd’s inputs) as when can i expect response( today is the fourth day of my pp clock).
My employer responded to my RFE on 18th.
It showed status as IR and message – Clock started.
Next day status changed to Acceptance, and in the same status since then..
Hopefully u shoud get it by this week..

If your status is showing Acceptance then it will certainly change to IR again.

Nothing was done till 1st october. I finally converted my case in pp on 3rd october. Got RFE on 11th october. RFE responded on 15th october. Got approval today.

I have applied for L1 to H1B and L2 to H4 at the same time. H1 got RFE on 24th Jun then attorney replied to that RFE on 10th Sep, on 16th Sept status changed to RFE RR.
Today I got RFE on H4 (FYI – My wife travelled back to india for couple of months and came back to USA).
Question.
1) Who will get H4 RFE mail from USCIS? Me or Attorney
2) Will H1 processing go on hold untill we repond to H4 RFE?
3) Does H4 RFE takes time to approve?
4) What If H1 get approval first and H4 still in RFE RR?
H4 RFE,
1. Your attorney if they have filed the H-4 COS application
2. It will proceed while H-4 processing will be put on hold
3. Once responded, it should be processed within few weeks. There is no set processing time
4. Your wife will go out of status as there is a strong chance that her H-4 COS will be denied. Her travel out of US invalidates the COS. You should talk to your H-1 attorney immediately to take corrective actions.

Yes, that’s correct. I got RFE on 24th Jun and attorney responded to RFE on 10th Sept.
I have got 2 petitions filed this yr one is counted in cap and got approved and another was filed under cap exempt case (my 2008 petition,)
My 2nd petition was in RFE to justify cap exempt status as my 2008 petion was later found to be revoked( this we did not know at the time filing)
What does my 2nd employer do, as my first petition is approved, can be respond to RFE cap exempt showing the 2013 case,
Or
Can he go for a h1 transfer.
If I go for stamping for my approved petition and consider if I get an 221g then can
I go for h1b transfer with my 2nd petionn by submitting an RFE.
