When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    I have 2 question.
    1.I have got petition approval this week ,but due to project start date changed (look like it may happen anytime in march-april 14) can I appear for interview during this time. Infact I have other personal commitments.Does that have any problem during visa interview.

    2.In my petition till set it says it is valid..It means I can attend anytime within this time period?

  6. Dear Saurabh and other friends,

    My H1B is pending, it is in RFE response review since August 30, the employer is not willing to do PP, I stopped working working this week as my OPT expired. Instead of being in grace period I joined a new school, sevis transfer is done to this new School. The School starts in a week from now, my question is will that be a problem in terms of out of status if I quit School immediately when I get my H1B approved?

    or Would you recommend me to finish atleast one semester as I will be paying the fees for the first semester as the school has weekend classes?

    • Why did you stop working? I dont get it. You may be misinformed here. My wife is in same situation and got a confirmation that she can continue working till H1 decision comes.

      • I thought the same but I contacted the University and the other lawyer and confirmed that I cannot work. It is different from H1B extension. Here is the proof from ICE website too.

        Can the cap gap extension of OPT be extended beyond September 30 if the H-1B petition filed on the student’s behalf has not been adjudicated by USCIS?
        No, pursuant to 8 CFR 214.2(f)(5)(vi)(A), the duration of status and any employment authorization granted under 8 CFR 274a.12(c)(3)(i)(B) and (C) of an F-1 student who is the beneficiary of an H-1B petition and request for change of status can only be extended until October 1.
        If the H-1B petition is pending beyond October 1, a student can remain in the United States based on the pending change of status petition. However, a student with OPT employment authorization extended through the cap gap period must stop working until the H-1B petition is approved.

    • My case moved to post decision activity on 11th September.But till now I have not received any call for interview .When I asked my employer they are responding the documents not yet reached to them .I don’t understand what is happening. Can any one tell ideally how many days it takes to reach the confirmation document after post decision activity..

      • Panigrahi..your name suggests you are from odisha. Oriya people are nice and hardworking people. I have many friends from Ganjam and cuttak. Anyway regarding your question..normally by this time you should have got your original petition. Normally it takes 10 to 15 days if your employer put a self envelop while sending your packat. If not it will take close to a month…! nothing to worry it will be on the way…!

  7. Hi all,

    My attorney/employer is not calling to USCIS. PP clock 6 days over. Employer is saying attorney won’t work coz of US shutdown. If I have paid the money should he work or not?

      • He is saying US shutdown so he can’t work. I called USCIS and they said your attorney can only call if he didn’t received any email. He won’t give me any updates. Even i e-mailed them but no answer. My husband got H1b extension on 4th oct and my PP clock stopped on 4th. Will this be a reason for second RFE?

      I am also in same situation. I received RFE on 21st and my employer respond on Septemeber 10th. Still it is showing in RFE status. He told me that he submitted in PP. I am not sure now, is it delay due to slow process or my employer is telling lie.

      • Your employer is lying same as mine. Some coz attorneys are using US shut down as their holidaying time. They are saying they can’t work. Just fooling around and wasting time and money. My PP case has RFE and he is saying USCIS is not working so can’t do anything.

  9. Just think about that, Buddy.
    Some people wait for 3 more months but don’t get the result from USCIS. Then they upgrade to PP. They still pay the money. However, long waiting makes PP lose it meaning. Sometimes paying at the beginning is better than this…
    Just come up this thought.

    My Application is in Acceptance stage since last 3 days. I’m not able to reach my employer to know as what exactly is the issue. Till 6th Oct it was in RFE and then moved to PP, Now it shows Acceptance. Anyone on the same page.

  12. Not sure if someone is getting approved from California Service Center. Please post here if getting approved so we know they are operating. It seems it has got slowed down…

    • I have been waiting from Jul month in RFE Response Review Status.

      No updates from Vermont center. When i checked the applications in the series for 100 numbers, 7 applications are pending. But this 7 is from last month. No updates.

    • I got approval in oct 4, My RFE date was sep 10. So in 24 days only i got approval.
      Even many other people got approval around that time..That mean they are working.. 🙂

  13. I dont understand why they cant work a little faster. US what they call is technologically advanced takes more than 2 months at one stage. Cant they expedite the process so that all those waiting can get free from stress. Waiting on Response Review since sept 24. God knows what they keep checking again and again.

          Even my wait is killing me..Sep 27 is my RFE response review and its 2 weeks now. ppl say we get updates from 2 weeks – 1 month for RFE. Fingers crossed yet again after IR-RFE for 4 months! DAMN!

      Floating on same boat. I really don’t understand what VC employees are doing at their desk. Atleast USCIS should publish that what actually on their mind. From 1st August my visa status is at RFE Response review. Just they asked me to provide ‘when I entered USA last time?’ My attorney is also not willing to convert it into PP. No use of PP. Really staying in USA by doing nothing is feel like hell. This is the only single hope for me, otherwise I ve to return back India. No options for me. 🙁 Life is too challenging and unpredictable now adays. Hope and Luck playing hide and seek with us. Waiting waiting and waiting. Hope for the best. Let’s see how many days it will take.

    • Is it true that status update SMSes for EACxxx cases arrive at one of the two times.
      7 am EDT = 4:30 pm IST
      3:45 pm EDT = 1:15 am IST?

      Does anyone has received at a time different from these from the Vermont center?

  16. Is Vermont Center still working for H1 Visa processing. Till now my status is at RFE RESPONSE REVIEW since 2 and half months. I really don’t get the way what to do actually? Waiting waiting and waiting. Will my hope be worked out? Anybody got approval from V center for RP? Plz share.

    • Hi, mine is processed in CA. i have been waiting for 2month and a week, still on REF. have no idea why are they delaying cases. My employer filed e-request for me. not sure if that will help. what is your solution though?

  17. My H1B Petition got approved and my employer sent me the documents, but it got lost in mail. So finally with no other open left, my employer filed I-824 petition to re issue the original I-797 approved notice with CSC.

    Does anyone know how long it takes for CSC to approve I-824 petition ?

  19. Dear Saurabh and Friends – My petition was receipted on April 8 and since from August first week i am able to see the following message against my receipt number,

    ” At this time USCIS cannot provide you with information for your case. Please contact NCSC 1 (800) 375-5283 for additional information.”
    (Till now the same message existing for my case)

    I spoke to above number but i was clearly informed by USCIS that they will be able to provide information to attorney or the employer. I informed the same to my employer.
    After long case with my employer attorney spoke to the above number and informed me that it was RFE. Again after long chase employer they informed that they will file the evidence around Oct 10th..

    Kindly advise me whether my case is going in right track or is there anything i need to do from my end within a speculated time. Please also guide me what to do next.

    Is anyone in this forum facing the same issue? Please reply.

      I think you can ask your lawyer to contact them as it is more than 60 days. I don’t know how they are processing, I have seen RP case getting approved in 3 weeks to 3 months or so. It would be advisable to got for PP. My employer does not want to go for PP if your employer is fine go for it.

    I have heard that even if someone got the visa approval before oct 1. They will not get SSN?? as a result of US shutdown?? That means if someone is going for a job search, he wont be able to start working coz of no SSN?? Please clear this. If yes then a its a bit of relief for people who are still waiting for approval!!!

  27. Not sure what is happening in California Center Either. I am still waiting for final decision from August 30. The status says they RFE response review from August 30. “On August 30, 2013, we received your response to our request for evidence ” . Mine was AD/RP. As mentioned by other people it seems the process has slowed down from past 2-3 days. It would be helpful if we hear that people are getting approved indicating they are working fine.

      Same here. I have responded to my RFE @ WAC on July 12 and still in response review. Right, It seems shutdown has significant impact on USCIS. Anyways what’s your receipt no series?

      • RFE Response Review cycle is just for 60 days. I think you should follow up with your attorney or company who filed for you.

  28. My status was converted to premium on 24th Aug. Move to initial review on 4th Sep. Rfe submitted on 25th sept. PP clock stopped on 4th oct, no email received by employer or attorney. Then again i saw the PP clock stopped message with updated date of 6th oct on sunday. Till now no email is received and neither the status has changed. I think vermont centre is not responding at all. Just want to keep the PP money with no decision on time :(. hard luck ,money wasted with no decision on time.

    Quick question..my application moved to RFE on Aug 29th. RFE was responded on sep 10th and since then it was in RFE status. Today when I checked the status it moved to Premium Processing. But I’ve not requested for premium process. Status moved to Initial Review. I’ve also checked with my employer and he said that he has not upgraded the case to premium. Is this some error from USCIS? EAC1314651***.

      Intitial Review on Oct7th (It says Premium Processing clock started)

  31. I received my H1B in August. Last week, I started at my new job. As I understand, my employeer should validate my official presense at work via E-verify. If E-verify is down right know due to government shutdown, how does the USCIS know whether I am already working. I don’t use OPT and the last class I was taking was during the summer. You usually have 30-60 days to transition from the F1 to your homecountry) or another status (like H1B). I wonder whether my gap in time due to e-verify being down may impact my visa terms?     My H1B is in RFE response review from last week of August. My employer is not willing to go for PP even though I am willing to pay for it. Do you think I can apply for PP from my side without involving lawyer or the employer? I heard about i-907 form for pp but was not sure if I can submit it to USCIS center in California? I don’t have time now as my OPT expires this week. Please let me know your thoughts, suggestions and advice.

Does anyone know if I can renew my license based on my H1B receipt or am I not eligible for it? Also, my license belong to a different state and now I am in a different state.

          There is a little complication here, I work for employer A right now on my OPT and employer B has filed my H1b which is still pending. I can produce employment letter from employer A and not from employer B who has filed my H1B and from B i can get h1b receipt only as I don’t work for employer B. Probably a rare situation but this is my situation.

          Please let me know what would be the best thing I could do now?

    I am on OPT extension right now and my OPT is expiring next week. I am currently working on my OPT. My H1B is not approved yet, it is still pending and is in RFE review when I check the status. I am not sure if I can continue working when my OPT expires next week until my H1B is approved. I thought I would hear about my H1B status by now and could work on my H1B from October but it is not approved yet. I am not sure if I can continue working after my opt expiration?
    I have a admission letter from a university that provided CPT from first semester and I can continue working when the school starts that is from 21st of October 2013, about 2 weeks from now. Not sure if I should go with the Univeristy or if I can work on my extension if applicable following the OPT expiration.

          it is same process for new H1 or Transfer. your new Employer has to file LCA and then he has to send the Petition to USCIS. due to Gov shut down you cant file LCA.

          How much time does it take for H1b transfer?
          if it is PP it should not take more than 15 days. regular would take 3-6 months.

            Once you change from F1 – H1 your current student visa is no longer valid, You don’t have to worry about it until you go out of country.

            It is not Necessary to go to India for stamping, you can wait until you really need to go

  37. Hello.

    My H1B petition was approved in late August with COS. I went to Japan anyways at the end of Sept and I had an interview on Oct 1 morning at 9am. Interview went well, and the interviewer said “your visa has been approved. you’ll get your passport in 3 days.” Now, I do not have my passport yet and I checked the status. It is being under administrative processing! I did not get any “pink slip”s and I do not have a case # either. I was just told things look good and visa was approved! So what now?
    I just wait for several weeks and hopefully they will issue my visa? Why is my visa under admin processing?

    I brought everything but they only took
    Passport
    DS160 confirm page
    Appointment cnfirm page w payment proof
    I797A and I797C
    A copy of passport ID page
    Undergrad & grad transcripts and degree certificates (both USA)
    Continuation Job letter with a signature prepared by a lawyer…

    They did not take I-129 copy or RFE copy, W-2, paystubs etc at all…..

    What will happen now?

    1) Project site Detail
    2) In House project Detail
    3) Employer-Employee relation

    I know that each case is different for USCIS but just want to know if someone’s petition is approved after responding these details.
