When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

Also, typically USCIS sets aside 6,800 visas  for Singapore and Chile Free Trade agreement filings, which is H1B1 Program. Also, read article All about H1B Caps – Basics Calculations, Lottery

 

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  1. My RFE response review date is sep10 and still it is in same status..fcu** Are these VO are working or not. I see below many people status changed from RFE response review to approved on oct 1, 2 and 3rd. Why not mine when RFE response date is same.

  2. I got approved today on October 3. After an Rfe received on August 19, the attorney responded on Sept 18 and changed to PP. I got approval today. Don’t lose hope. Everyone will get it.

      • Changed to Premium on Sep 18. But still it first Changed to IR PP clock startedafter 3 days and then after 2 hrs to acceptance and then it was on acceptance for more than 15 days then it changed to IR on Oct 1, and showed PP clock stopped but approved after 3 days. those 3 days were nerve wrecking. But my attorney hasn’t received the paperwork or I 797 just email or approval.

  3. My case is changed to premium on Sept 25 on EAC center. it is been on the acceptance status since Sept 26. Anything to worry ?

    • In the same boat. My case was converted to Premium after RFE Response review. It moved to Initial Review – clock started directly since Sep 30th. No update since then. I read in few forums it moves to Acceptance after Initial Review but for me nothing has changed. Is there any issue with this?

      • Yeah. For me , it was on Initial review on sept 25. The next day it is changed to Acceptance. Then it stays in the same status 🙂 Guess EAC center is way slower than other center

          • On the first change , from initial review to acceptance , it happened in the next day . When we applied premium , it said initial review and on the next day , it changed to acceptance. that was the usual case i believe and few posted the same in this blog. But considering the slowness they process , that will be changed soon for you too

            The wait is over . My application is approved today. The status is changed from Acceptance to Initial review on 3:45 PM . The status is changed to decision on 4:30PM. All is well :–)

  4. I am waiting for stamping after approval from past 2 months. But my employer is making execuses. I am not sure of the reason behind this delay. Please let me know if anybody else in the same boat? and anybody from AgeeYa solutions in this forum?

        • Hey… my H1 B was filed through Agreeya and my petition was approved on May 6th, 2013. I have been waiting since then until last week. After emailing them so many times during these 5 months, they moved forward explaining the reason for delay and starting working on my case. The problem for the delay is about the current job opportunities in the US. They cannot employ new people when their employees are on bench and so they are waiting to fit in everyone, so that when the new employees go for Visa, they don’t have any issues.

          I had my Visa interview scheduled this week and my visa got approved on Thursday. Fortunately, interview was easy with just couple of questions. I would suggest you to talk to them over phone and get your case moving.

      Did your employer is one who is going to give you job on there payroll or it’s a consulting agency? If it’s consulting agency then did the arranged any interview? In my view till date they didn’t find any suitable job for you that the reason your employer is making execuses for stamping.

  5. Finally got my via stamped from chennai consulate on october 1st. :):)

    The interviewer asked me my 1797, client letter and a letter which had my job responsibilities defined.

    Questions asked in the interview
    1. Why do you want to go to US.
    2. Company name which i will be joining
    3. Client Name

    And than the golden words came “your visa is approved” and than he handed over a white pamphlet. The stamping interview just got over with in 3 minutes.

    I feel it all depends on the interviewer also. In another line next to mine the interviewer rejected two to three cases in front of me.

    • Same. I was working on OPT in US and came home for a stamping (as I was going to travel abroad soon…). Inetrview went well and I was told “visa has been approved and you get your passport in a few days”. Ok now checking the status I see this “ADMINISTRATIVE PRCOESSING” WHY!? I did not get a pink slip….i was told everything is fine….so what now?

      I would like to know how many days it took for change the status to RFE response review from RFE status. My consultancy has replied to RFE on 10th Septemeber but still the status is in RFE only.there is no change in the status.

          • I think you should follow up with ISG Bangolore team closely. They can let u the exact reason. Call them directly to make process faster. Also keep WPC SPOC in loop.

    I changed my case to premium after responding to the RFE for my H1B.

    29th Sep – Went into acceptance
    30th Sep – Initial Review

    Still stuck in that status . Do I still have chances for approval ?

      I guess you are seeing intial review with 15 Days Clock Stopped .. message.

      Your case seems to be approved.

      For some reasons the USCIS site for RFE PP is stuck in the same status for many people Sept 30th onwards — Atleast two other, I know of and both found out that their case got approved. This could be due to short staffing and people going on leave after hearing about the govt. shutdown. So, don’t worry. You can check with your employer / attorney, if they haven’t received the email response then they can call on the premium processing line to find out the decision. Request them to be a little patient because generally it takes 15-20 mins to reach to the customer representative on this line. You can call yourself too. The PP line no. should be mentioned on your RFE PP receipt which you can request from your employer / attorney. Thanks & All the best!!

        Yes – I did recieve the clock stopped message . I read in some forums that if this message stays for more than 2 days its negative , that got me worried .

          • finally got approval today. But status in USCIS is still in Initial Review with premium processing clock stop message.

            One query if anyone here can answer this: My H1 petition was approved for client X and I need to travel for client Y. Locations are different states. Both cases my employer remains the same. Please let me know if anything else needs to be done before stamping like LCA approval for client Y. Please HELPPPP…

    • I797 approval notice generally takes 30 days or less.. It depends, few even get in a week or two.. if your employer/attorney attached a self addressed envelope, it might come soon…
      DS160 can be filled once u get i797 hard copy in ur hand, because it just takes an hour or less..

    I was on L1B visa and my company did my H1B this year and it got approved with COS and from today onwards i am on H1B visa for the same company.
    Now i got a job in another amrican multinational company and they are ready for H1B transfer.
    I read in net that we cannot do H1B transfer without paystubs and it may get rejected or RFE or approved without I94.
    Please suggest me that shall i go ahead now or wait for my first paystub which will get generated on 31th oct.

    – RFE Response Received Date : July 26th, 2013
    – Filed Inquiry : September 27th, 2013 (More than 2 months since USCIS received RFE response but no change in status)
    – H-1B Approval Date : September 30th, 2013

      I am also working on OPT- STEM. My Status is RFE – ReponseReview past one month. Should i file for Inquiry or should i wait. Another thing, my F1 visa and OPT expires in december. So do i need to go back India immediately for stamping or what are other options?

      • There is a time frame for Response Review of 2 months. If you don’t hear anything within 2 months, then you/company/lawyer can contact USCIS, they will then ask you to check what is the application received date on your receipt and what is the processing center. If the processing center is processing applications after your application received date then your application is considered “Out of time-frame”. If this happens then your “applicant” (company/lawyers) can formally file a e-request for inquiry. The inquiry has a time frame of 30 days.

        I think stamping can only be done anytime after 3 months of your approval of H-1B. Depends on you when you want to leave the country and come back. I am not completely sure about this, I am still waiting for my package which should have detailed instructions.

    • only they know man.
      I have been waiting in rfe review for over a month and i saw few people replying to same question saying that they are waiting from july 5 , july 29 in rfe review and some people getting approved after getting rfe in sept itself. so there is no definite answer to this question.
      but hope for the best and keep doing what you are.

    I need a help from you.. My H1B is approved. My wife is working with a reputed IT company.
    a) I was wondering if she needs to resign before appearing for H4 visa or she can take unpaid leave and join me in US
    b) If her company wants to file L1 visa, is it possible from US or she has to comeback and apply/appear here in india for the same.
    c) If her company is applying for L1, can I apply her visa for H4 or 2 applications are not permitted?

    Work Authorization valid till August 17
    Currently waiting for Work Authorization , May be take 5 days from now.
    Will be joining the same client.
    So It would be any problem if i submit the RFE now ? or I shd wait till I start to work at client site again with Work Authorization?

    Hi Saurabh,

    I had my L-1A(Blanket) stamping today @Chennai (From big Indian MNC). Unfortunately it was denied mentioning “Not Clearly Approvable”
    I also have my H1 from a consultant, after how many days can I go for my H1 interview? Also what effect this denial will have on my future H1 stamping, any comments/tips.

    My H1B is in RFE response review, my OPT expires in one week. what are my options now, I have a current job write now. I am not sure if I could work after my OPT expiration? I have also applied to a university as a backup, not sure if I should start the new school or wait for my H1B? Please let me know your thoughts and suggestions?

    • This is confirmed from my lawyer.

      If your H1B is selected and your OPT expires, you can work till your H1B adjudication is done, even if it is post 30th September.

      Also, I am quoting from the USCIS website “Once a timely filed request to change status to H-1B on October 1, 2012 has been made, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed”

      I was confused earlier as well, but now I know I can work.

      • Also, many people confuse this with (quoting USCIS website) “Once a timely filed request to change status to H-1B on October 1, 2012 has been made, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension will continue through September 30, 2012 unless the petition is denied, withdrawn, or revoked.”

        Which only states that if your H1B is approved before 30th Sep, you will still be in automatic CAP GAP period through Sep 30 post which your H1B will kick in.

        People think that this also applies to regular cases where H1B is pending. But that is not the case. You can work! Go drink a chilled beer now.

          I had the same feeling that the Cap-Gap works until september 30 and u cannot work after that until your H1b is approved. Though you can stay legally but cannot work after sep 3o. Your comment makes sense.

          What am I supposed to do now to obtain work permit when my opt expires. I called my University the other day ( I have a very new DSO), they told me that the govt will update the SEVIS automatically with any extension if applicable. If they see any update, they will print me a new I-20 by which I guess i can continue working. Not sure what would be the right approach for me here. My SEVIS does not even show that my H1B is applied/ pending. I checked my case status at USCIS, I see RFE review. Whom should I contact now to get the work permit? Appreciate your suggestions and thoughts again.

          • You dont need any official document (confirm) nor do i think it get updated on your Sevis (not sure). Also, it took a lot of follow ups with USCIS to get my Sevis updated. Even if it is not, it is not a problem.

            Also, where are you based out of? and which university you took a course (just in case my genuine case is not approved)

        • I am also worried about the cap-gap…. My lawyer told me I can work until decision make. But I asked school, they replied I can only work until 09/30………. >…..<

            My lawyer says the same, the University is depending on USCIS to update the status in order for them to issue me a new I-20. It seems some Universities does not allow you to work after Sept 30 unless you have valid OPT. Not sure what do do in terms of paper work if we want to work. Employers wants me to stop working if I don’t get any work authorization from University. Not sure what to do. I hope we will hear something this week.

          • You do not need any paper work. Your lawyers can confirm your Immigration/Employer that you can work.

            In this case school DSO has NOTHING to do with your status post Sep 30 and H1B.

            I got reply from my DSO that he is not authorized to comment on this, as this is related to H1B and my OPT is over. He asked me to talk to my lawyer (who then confirmed it to my employer through an email copying me).

    Also, my employer is a relatively small Desi Consultant firm – any idea if that leads to more scrutiny by the VO?

    • I think it would be safe to say ‘Yes’ to this answer so that they don’t consider you as a potential immigrant. You can say that after couple of years you will be retuning to India since you have a family back here and you are not planning to stay permanently away from them.
      This is just one of the many answers..may be experienced people here can also suggest something…

  24. Yesterday my case moved to IR with following message. What does it mean ? I have gone through some of the blogs , says that it should the status to decision after few hours. But my case is still pending ,No update from USCIS. btw, No updates to Attoney also as per my employer.

    What does it mean apporval/denial ?

    On September 26, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.

    My wife is on F2 status in USA, She got admission into a state university. i know she can apply for COS here, but COS is taking 4-5 months and her classes starts from Jan. Can she go for f1 stamping to Canada?in any case if f1 is denied can she come back to US on her valid F2 status?

    My case was in RFE Response review. It was upgraded to premium yesterday. The status was initial review yesterday and changed to acceptance today. Anything to worry about or is it normal ? Any help is appreciated

    • Its normal.
      It goes from Initial Review (15 Days clock started) to Acceptance on the very next day and then wait continues. Generally, it takes around 3-10 days from Acceptance to Decision.

      • Your comment helped me with my case!! Did you hear anything in your case. If not then hope the below information helps you. Mine got approved yesterday… In my case it went into acceptance on 20th Sep (PP). And it was in acceptance until yesterday ( 26th).. Then it changed to initial review. Please dont get worried when you read the automated message in IR. It can be positive or negetive news… However you should get your decision in a minimum of 3 hours from IR. Best of Luck!!

          • I was on OPT… So OPT to H1B… Advanced degree… Started with regular Processing but converted to Premium and USCIS received my packet on 19th Sep. California service center.

    • I am in the same boat except the H4 part. I got RFE on 19th Aug. Submitted response(employer-employee relation) on 25th Aug. Since then it was in RFE Response Review. then upgraded to PP on 17th Sept. Till date it is in “Acceptance” status.. When will the status move? I presume it to 7th Oct(15days window ends) .. Am i correct? When do you think I will get a status update according to recent trends?
      L2 to H4 update doesnot take much time.. one of my friend has recently done whilst at US

    With gods grace my petition has been approved.
    Receipt date: April 8
    RFE : June 19
    Submitted RFE response on sep10
    Approval : Post Decision Activity Sep 25

    Mine is RP/RQ – WAC1313651- – –
    We cant predict how much time it will take to process one petition.
    Its not done in any order.it may take even 2or 3 days or even few months to process a petition.

    Be patient and follow up with your employer regularly.

    Received RFE on 11th july my employer said he will response to RFE in 3 4 days. As there were many RFE to handle he took time.I dont know why he is taking so much of time to response. Tense….

    • Those who are working on RFE response are idiots and they does not understand feeling of applicants.
      same thing happend to me.my RFE answered one day before to RFE due date.
      We can’t do anything as it was not in our hands.Be patient and wait.I know it is difficult but we dnt have any other options.

    • Hi W8ing,

      By this time you should have come to know status of your application if the employer had replied properly in time. REF should be provided with in few weeks I think, not with in few months. Check with your employer / Attorney. Usually REF means emp/employer relationship, client letter which can be arranged in no time and it is not so complicated. I know the how difficult waiting for status update. All the best.

        As my visa is not yet approved ,its in RFE state. And employer is gonna response to my RFE in some days. he said i can go out side of US as RFE result wont come in a month.

  35. I’ve got a question to which all inputs are very much appreciated:

    I received a 221G when I had applied for my F1 visa. I will be graduating in Dec and will start working in Jan on OPT and my company has accepted to apply for my H1 in April of 2014. I wanted to know if the 221G I received during my F1 visa application will cause any issues in the processing of my H1B i.e will USCIS send out an RFE because of this or are there chances that my application will be rejected because of the same reason?

    Is that possible lawyer to respond REF to USCIS through E-mail for the Regular case?

    • No. It has to be sent through post. Overnight courier can be used for quick delivery.

      I think response can be FAXed also but that’s only for PP cases.

    I have got an RFE on H1B Numerical Limitation Information,

    Company X has filed an H1B Petion in 2008 for me. I 797 B is approved for 3 years.This petition is revoked ( after subsequent RFE’s)

    Company A has filled an H1 B Petion this year to me.On Part C of Form I 129 H1B Data Suppliment collection, company A mentioned my case as ‘CAP Exempt’.
    As my case was revoked last time. USCIS now gave an RFE to provide evidence establishing that the benificiay’s has been counted toward CAP.

    There one other company B also filed my H1 petion this year.
    In The Comapnt A RFE document they have even metioned about this.

    Please advise .

  38. Can I stay in US without work, if L1B extension rejected aftr Oct 1, and H1 is in RFE Response review ?

    I-94 and L1B already expired in June 2013, filed L1 ext and, L1 ext and Fresh H1 is in RFE response review.

    • If L1 extension approves and H1 also get approved, is it necessary to switch employment with H1 employer ? how much (maximum) time I have to switch my employment ?

      • If its H1 COS, then you should switch immediately, as your L1 will go void and status will change to H1B. Unfortunately, as per USCIS rule, there is no grace period for H1B COS.

        If your H1 employer has filed consular processing then you can continue on L1 as long as you want. But in that case to work on H1, you will need to get your H1 stamped first by going out of US.

          My employer says I can definitely stay in US if L1 ext rejects after Oct 1 and H1 is in ‘RFE Response Review’ stage. I doubt.
          He says I can continue on L1 (if ext approved), for 3-4 months, no need to join immediately. H1 applied with COS

    I had applied H1B through some outsourcing company. On July 10th My Status was updated to RFE and my employer had furnished all the needed details. Today my status updated to Denied and mentions that the reasons have been mailed to the employer and also the further options.
    I have a strong feel that the rejection is due to some company issues and nothing to do with the individual.
    If the rejection is due to company issue, what other options do I have ? Can I re-apply in the same Quota through some other company ?

    • Yes, you can use the same petition with other employer if your docs were correct and you are completely sure it is denied coz of the company. When you apply from a big MNC under BPB program chances are strong for approval, they hardly take few minutes interview.You will be tried in cap exempt quota, but you have to reapply and go through the same procedure again, i will suggest you to go for premium.

    My H1B Petition for this year got approved on July 23. My employer sent me mail and parcel got lost in transition from US to India which has having I-797 original approved notice.

    Now, what are the option left for me ? how to get duplicate approved notice ? how long it takes? suggest me whatever information you have on this.

      • How to request ? i read some blog stating that i have to file I-824 petition to issue duplicate approval notice and it may takes around 3-9 months to get it. also there is no premium processing available for that petition.

      • If you have a digital copy (scanned), print it and bring it with you to the interview, otherwise just bring the application number with (starts with WAC or EAC). They should have all the information needed in the system at the consulate and they can verify that your application was approved. Stop worrying for not having the original copy.

          I heard same thing form many people that you can take copy and get the visa stamping done. But this could be serious issue with port of entry. By that time you must have to have original copy. I also feel nervous to be appear to visa interview without original copy.

      “My H1B visa documents are couriered from USA to India last month via. USPS and still not yet reached me.
      When we enquired about this to USPS they said unfortunately they are unable to track my shipment and they are sending me claim form & insurance money.
      Now the employer is resending me all the documents and as u know the original I-797B was lost in the previous courier.

      • Hi Imran,

        I talked with my employer and they told me not to take any chance, do not go for stamping carrying photocopy they need original. Also even if you may get visa but whey you fly to US, at port of entry you must have original copy otherwise it may cause problem and you may got deported.

        So your employer has to file I-824 petition to re-issue the original petition. It may takes 3 month but thats the only option left with us.
