When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    Kindly clarify my doubt.

    My case was RFE and my employer responded to RFE.But by sep 10th my status was changed from RFE to initial review again. Instead of changing to RFE response review why it got changed to initial review again.

    below is the status update i can see in USCIS website for my WAC1313651

    On September 10, 2013, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. Please check our website at http://www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.

    anyone has any clue on this.

    • Status changes in RFE are quite unpredictable. What in most cases happens is –
      IR (Clock Started if PP) –> Acceptance –> RFE Response Review –> IR (Clock stop if PP) –> Decision or Post Decision

  2. Hi Saurabh,

    I got selected in this year H1 lottery and my VISA is approved too. This is with consultant A, now I got permanent job in big company B , this company B filed my H1B visa transfer and I got premium processing receipt on sep 19th.

    Now company B wants me to join them on Oct 1st, and consultent “A” also want me to join him on same day. I want to join this “B” but its case is still on “Acceptance” and 15 day premium processing can take it upto Oct 4th. So what should I do?

    Should I join company B on H1B premium processing receipt only ( without approval)?

    What will happen if my consultant “A” will revoke my H1B visa with him on Oct 1st? How much time it take for him to withdraw my VISA?

    What will happen if company B’s visa get a RFE or denial?

    • Ram,

      Assuming you are in India and if so my advice you shouldn’t join B until you are through with the approved petition. You can easily let your consultant A know that you cannot join him until 1st week of Oct and give any genuine reason. Consultant will not revoke ur visa as he will have to do H1 cancel which is like about 2 to 3 thousand dollars. So wait for your petition to get approved with B.

        But once I will join my consultant on Oct 1st then he is forcing me to sign cotract which says that I have to give him 10 days of notice. So If I join him I will there till oct 3rd and then I will resign and then I have to serve there till atleast Oct 15th.

        If it was a matter of only 2-3days then it could be ok but now it will be matter of atleast 15 days.and my consultent is too small comapany that I doubt that if I join him for only15 day he will pay me anything for that small period.

        Also as you said that revocation could take thousand dollar for him but can you tell me specific form name which he has to submit for this to USCIC , he threatened me that he can revoke my visa online in 5 minutes,is it true, how much least time will it take for anyone to revoke ?

  3. Tomorrow will be my visa interview. I just noticed that my company’s HR has n’t sent me the Offer Letter signed by the President of my sponsoring company. All other documents are signed by the President. but Somehow my company’s HR lady missed the Employment Offer Letter. She sent all the documents in a PDF version as I am out of USA. As a consequence, I’m taking all the printed versions with me at the interview. Today is Sunday in USA. So, no hope for the signed one. If I take help of Photoshop and copy paste president’s signature, will that be ok ? I can be honest here too and can go to the interview without the signature. Will that be a cause of rejection ??? Pls, help me.

    I am working in india IT based MNC and this year applied h1b.I got RFE mail yesterday ,uscis requested a bundle of docs.I have checked with my Visa team and manager ,they asked me to prepare the documents and deadline is sep 24,i don’t know how to prepare the docs with 2-3 days.
    So please help m e friends i need sample template for “Evidence of Specialty Occupation”
    its very urgent.

  5. Hi All.I have the following scenario.
    Currently I am staying at residence A. This is my permanent residence and the same is mentioned on my passport. I stay at this residence with my parents. I also have my H1 approved this September. This is my first visa and I haven’t traveled yet. I want to know if I travel to USA this December/January, then can I change my residence address in India once I am in US. I mean, can my parents sell the current flat and purchase a new flat at location B after I leave for US. Since, residence A would no longer belong to me, I believe passports need to be updated. But how is it possible since I would be in USA. Would this residence address change affect my stay in US and my visa/passport. If yes then how? Please suggest what do I need to do?

    • NO need to worry about change in address buddy. 90% of applicants have their college addresses these days and there is no trouble.

      Even mine visa is through with Tamilnadu address whereas I am living in Bangalore and also I ll be travelling USA soon.

    My Application number starts with WAC1313651***. Its in RFE response review since past 2.5 months. One of my collegue whose case also had gone into RFE got an approval one month back. But Mine still no update. Anyone in the same state ? Did anyone contact USCIS on similar case ?

      I am also in the same series..I spoke to USICS and they r not ready to provide any info to us..they want employer/attorney to call them and get the latest status.

      Any idea,how long will it take to go for approval status.Did u try from ur end..wat abut your friend and hw long it took for him to get the status after submission of RFE

  9. I am on L1B and one of consultant filed my H1B got RFE for employee employer relation ship, client letter and Education evaluation. Today replied RFE in PP. My employer is very much confidence that my H1 will be approved. Employer has 10 years of exp in USA for filing H1. Now he is asking me to put paper for my current company. I am very much tensed. Employer says this is normal and usual so it will be approved. Pls help and let me know that i need to put paper or not. I want suggestions because of your exp. pls don’t comment if you just to laugh.

    • After so many people shouting across the forums not to commit this mistake, i am surprised that you are considering the option of resigning before approval.

      But i can tell you one thing, no one can predict future. So obviously we always need to be on safe side.

      So you decide what is the safe side for you.

      I am thinking to resign once my case will say premium clock started.
      I am working in this company since 7 years and discussed with my current manager he suggested put paper and wait for 15 days if some thing wrong then take your resignation back. My manager is very good and genuine and I know him personally. Will this work?

    My H1B is approved and I just received my I-797 after 2 months of approval (thanks to my attorney). I saw my last name is wrong on I-797 and now I am worried again what to do about it. I am already in USA and wanted to travel to get my stamping done. Is there any form that I have to file to get my name corrected? Please help.

  12. All US VO’s are BOSS DK. No country in any part of world has that much waiting for any type of visa..why US only BOSS DK? Its almost a year to complete im running for H1B visa, but still in RFE Response Review. This shows how US thinks about himself..they think they are BOSSDK

    • Don’t think you are doing any favor on US by applying for H1 visa. They are better without you too. H1 visa is a luxury and not your constitutional right. The US govt is doing a favor on you by accepting you H1 petition, Respect them and their decisions.

  13. My H1B petition was approved in Aug’13 (last month). So, its a month now since my H1B petition is approved but my employer has not sent me a I-797 approval notice so far or any other documentation. I have the receipt number with me through which I know my H1B is approved.
    I contacted my employer and asked about the stamping & travel to US but he is saying since we are finding client for you where we can place you so cannot go for stamping until we find client. I agree on what they are saying and want to wait for 1-2 months more.
    Since my H1B petition is approved (by checking same on USCIS web site by searching receipt number). I have following questions –
    1. Can I go for H1B transfer if my current employer won’t able to find any clientm and further delay the process for few more months?
    2. I am not sure if H1B transfer can be done from India without I-797 approval notice?
    If answer to above questions are YES then how tough is to find a sponsor for H1B transfer and how much time it will take from India?

      • No. its a big Indian consultancy company. I am just searching the options if my current employer further delays stamping process.
        Although I searched on many forums and found transfer can be done if its approved once from any employer. But I want confirmation and opinions from experts in this group.

Mine was denied on May 14th after attending query and also my attorney received denied notice ,But its still in “Initial Review”I would like to know even if the decision is over and appeal time is also over on June 17th why its still in “Initial Review” why its not moved to decision (approved/denied) thanks in advance for answer.

    Mine is in RFE Review status.

    I spoke to USICS guys 3 days back over the call,look like system refresh happens every 15th of the month and the status will be know after that.

      I am WAC13134*** series and in RFERR….
      I checked couple of petitions in my series and found that none of them are having a update since 10th September… There may be some updates in other WAC series… but not sure what is happening…

    Until Aug 5 my case status was in IR and on Aug 5th it was unknown. upon raising e-request my case has been changed to RFE on Sep 6th. Today received the RFE reason bt attorney and the reason is employer and employee relationship. Came to know form attorney that this RFE is the easy to address and they will send me a copy of the RFE reply to review.

    Is this RFE not a bad one?

My consultant says it is because of employer-employee relationship and it can be resolved. I suspect we might have applied through the same consultant.   26. Dear Saurabh and other friends,

    What is the last month or week that USCIS releases the H1B approval/ denial for a fiscal year. I understand that some people are currently receiving RFE and some has already responded to the RFE’s. If I am correct, they usually take between 2 weeks to 2 months to come up with the final decision from the time you submit your RFE. I am just trying to see how long would it take for them to release the final result? Do you think we would know by November or December to the max or it could more than that?

    I guess if our current EAD expires by October 1, some candidates may not have EAD at all, I guess we cannot work until we get H1b. I would really appreciate any thoughts or suggestions.

    • 1) There is no specific date for last approval/denial.
      2) RFE decision is left to USCIS’s descrition. They can give decision based on the response to RFE or it could be another RFE if they are not satisfied with the rssponse.
      3) No specific date set for final decision.
      4) I don’t have answers for your EAD related queries. Someone else can answer it.

    • I am still waiting for my receipt number too, employer says he has not received the rejected packet back, so not sure exactly if USCIS has kept some packages in wait list or May be employer got the rejected packet back but he is not willing to disclose.

    • On Sep 18 .. Everybody barring me who had applied from our Unit have either got Approval or RFE.
      The VISA team, my account, and RMG all have given the same status update that My Case got through Lottery and further update is awaited. There were cases identical to mine that have been sent with RFE or have been approved. But not heard of anyone getting a rejection till now.
      Anybody has an explanation?

  28. Hi All, My petition went to RFE response review on sep 10. My question is when it will move to decision\denied. How many days it will take. Some people was telling it will take 15 days to 60 days. Is it correct?

        My status still shows as ‘RFE’ even through RFE response is provided by my consultancy in US. Will it change to ‘RFE RESPONSE REVIEW’ or it would directly goto ‘PDA/Denial’. I have checked with consultancy and they are saying that it could directly goto a decision mode instead of ‘RFE RESPONSE REVIEW’. Please clarify!

    I am from India and currently working outside India. My petition got approved and my employer had sent me the documents. I am yet to book for visa interview.

    My question is, can i attend interview from outside India ? If so, what is the guideline to do that ? I heard that Rejection rate is little more in India (especially Chennai). Please help by providing details.

  32. Hi Saurabh,

    I would like to check I should apply for H4 extension or not as my H4 current visa is getting expired on 30-Sep-2013 and H1B visa is in process with RFE status. My spouse company is sayin i have to apply h4 extension to maintain the status however my employer is saying once h1b is in process untill you get the result you will be in valid status.Please suggest if anyone have faced similler issue that How to maintain the staus after 30-Sep-2013 once h4 visa is expired but i94 baased on h4 is valid.

    Current status (16-Sep-13): H4
    H4 Status Expiring on: 30th Sep 2013
    i94 expiring date: 10-Oct-2014
    H1B Visa Applied in 8-April-2013: H1B
    Current H1B Visa Status: RFE

    • Yes It is better to Apply for H4 extension, as there are also chances of denial on H1(I know this is the worst case that can happen), your intent should be expressed to clearly state that you want to stay legally.

      As Gourav suggested you must apply for H4 Ext. What if by chance H1 gets denied? (I hope it will get approved). If denied imagine ,your status from next day. you will be left with very little time to apply for H4 or some other status.

      I think you no need to apply for H4 extension. Becaseu still your i-94 is valid until Oct 2014.

      Scenario1: If your H1B approved, then only your status changed and i-94 became invalid.
      So you will safe.

      Scenario2: In worst case your H1B denied, still you can stay in your old status i-94 which valied until Oct 2014. You can apply for H4 extenmsion based on your H1B decesion.

        Are u sure about scnerio 2. if I apply h4 extension for safer side, is ther any harm in that. will it impact h1b decesion.
        I mean if I dont apply for h4 extension right now, which status i will be after 30-sep as h4 will be finsihed but h1 will be in process.

  33. Hi, I could not find a proper answer to this question on any forum and would be glad if someone could answer it. My H1B has been approved on September 13 (COS from H4 to H1B). My employer is an MNC who sponsored my H1B. Can I defer my joining date to Nov 1, 2013; instead of Oct 1, 2013. Is there a maximum amount of days beyond which the joining date cannot be pushed?

    • Now it will be not possible to get H1B by oct 1… Your employer will recieve the RFE and it will take time and then prepare for RFE and then USCIS will start working on it… Good Luck

  36. Still H1B IR since April, anybody know what should I do if I still in IR after Sep 30th ?? Is USCIS have to let everybody know their results of application, whether approve or deny before Sep 30th? Can they directly deny me without ask for REF? If USCIS deny my application at the last minute It will be very difficult for to find other ways to stay in US. Should I call someone? any suggestions plz kindly reply me. Thanks.

    My Situation is as below.
    My last working day with her employer will be 09/27/2013. Presently H1 extension is in premium process from my employer. My I-94 got expired on 10-Aug-2013. I got RFE for H1 extension and my employer is responding to the RFE by mid of this week. Hopefully decision will come before her last date.
    My spouse is also on H1B visa in USA.

    1. In this situation If I transfer the visa to H4 now, is it possible to transfer again to H1B under cap exemption so that I can start working before 1st Oct – 2014?

    2. If I gets a job before filing the H4, is it possible to file cap exemption H1B by the new employer before present petition decision comes?

    3. If I gets approval for my present H1B extension petition after quitting my present job, is it possible to file cap exemption H4 to H1B without I797 copy of the present H1B extension petition?

    Please help me..

    I have a tricky question (at least to me)….I am on L1B with company A and applied for H1B(RFE as of now) through consultancy B.
    Now my question is….I am more attached/inclined towards my current company A and would like to work with them on H1..
    I would like to look at the options of changing my status to H1 for my current company A without having separated….
    What would be my options? I have a strong hope my company A hires me as a permanent employee after I get my H1B approved.

    I am also scared if my current company A applies for H1B transfer before I join company B whether it gets approved or not…
    Or I don’t want to leave company A and comeback after few months…

    • Ok…. Your H1b from company B should be applied before your company A applies for transfer.
      If your Company B H1b gets approved, then i think you should join Company B (if you applied through COS).

      The only case where you will be able to transfer your H1b to Company A without joining Company B is when it gets approved before Oct1 or your requested start date.

    My petition got approved and my employer told that, he will send me the documents. He also asked me to book for interview slot by myself.
    1) Can someone please send me the ‘step-by-step’ guide to book for visa interview ?
    2) Booking for interview is like slot type ? ie, only one person can attend the interview at given time frame and two persons cannot book/attend the interview at same time ?

    Also, any useful information regarding this might be of great help..

    My H1b got approved after answering an RFE. My employer received my petition copy also.

    But now my current project is getting over for which I applied for H1.
    If I have to go for stamping, then should I still claim that my project is still going on? or should I need to get fresh documents filed for new project?

    And one more question is, when my h1 is approved and stamping is pending, can I swith my job and still can go for stamping from new company?

Applied H1b in regular quota, on Aug 5 it has been moved to RFE and my Employer responded for RFE with premium processing.yesterday , my case moved to RFE response review and later it moved to IR saying that 15 days clock started for premium process. Currently it is moved to acceptance . What does it mean ?

    My H1B petition got approved and I have also filled and submitted the DS-160 form. But, I have two concerns right now…
    1.while filing petition, in my CV I had mentioned my graduation as Electronics and communication but I am actually graduated on Electrical and eletronics. However, i have mentioned the correct stream while filling my DS-160. Will there be any problem during the interview are there any chance of rejection based on this???Pls reply to me urgently am very worried about it.
    2.In CV and Ds-160 I have mentioned my degree as bechelor of engineering but it is actually bachelor of technology. Will there be any problem during the interview are there any chance of rejection based on this???Pls reply to me urgently am very worried about it.

    • No need to worry at all. One of my office mate had done BTech and company submitted MCA in this form. Nothing happened. Just say what is correct, coz if questioned you will have proof for the correct one.

    • The VO is going to screw you during interview. Pray that they don’t see your mistake. If they do see it, tell them the truth and don’t try to give excuse that it happend becoz of this that, or someone did mistake etc..!

      Visa is approved based on your qualification and experience. So always try to pass correct info and take due care while filling it.

  43. Hi, will my gap in employment be a problem for h1b ? I have total 3 years of experience – 1st company, I have worked for 1 year and for my 2nd company, I worked for 2 year. then I remained jobless for 5-6 months. My H1B sponsoring company works with my 2nd company. They are satisfied with my performance and agreed to sponsor my visa. My h1b has been approved. Now, afraid, whether Visa Officer creates an issue with this jobless situation ? What can I do now? Can anybody answer.

    • It will not hamper as per my knowledge. Tell them that due to some family issue, you have to opt out of job for 5 to 6 month..later you joined but the company was not ready to take you becoz of long leave which was not approved, after that you went to other company from where ur visa applied…i mean try to give some type of similar excuse confidently…!

    Q2> Work Experience letter is required for the visa stamping interview. I have 4 years + exp., and I did it for 2 companies. My last company gave me detailed experience letter but My 1st company’s HR gave a typical ordinary experience letter like this –

    “To the best of my knowledge she bears a good moral character. She doesn’t take part activities
    Sub-aversive to state or discipline. She performs her entire task to a very high standard. At all
    Times I have found her to be reliable, hard-working, honest, peace-Loving, well-mannered
    etc.”

    Will this be enough or I have to ask for a new one where all my experiences will be described properly ?

    Me: answered.
    VO: Are you married?Do you have kids?
    VO: I am going to give u Visa ?
    VO: Do you what this booklet(general instructions)?
    Me: No
    VO: Please read it before entering to US, U will receive passport in 4-5 working days.
    Me : Thank U

    (by the way it was not that much easy as i mentioned above)

    Guys please don’t take it easy/lightly, because I was lucky that my VO was satisfied with my answers , but i have seen that ppl are grilled for 20-25 mins and even after that their visa got rejected.

    My Suggestion is to be prompt while giving answers.

          • It depends which day is available for OFC/Consulate. I guess you can have that schedule on different days. You need to check while scheduling for interview.     I have an RFE on H4 to H1b with COS filed stating that :-

    1.on what basis beneficiary worked during the dependent visa status.
    2.whether beneficiary is eligible to work during this period.
    3.the tax treatment of the beneficiary

    Reason:-I worked for a small Indian local IT firm occasionally to do a time pass on my H4 status in US without any salary. It belong to one of my friend. And to increase exp. for better chances of H1b sponsorship i added on my resume. My employer and attorney didn’t notice this blunder and submitted resume as it is to USCIS.

    Now after receiving RFE mentioned above he is scared and is not ready to submit any reply.He says we will be booked under fraud and i will be deported. He wants to void my application. I paid him, and waited for 2 yrs on H4 to get H1b. Please suggest if anything could be done.

    • That is a big blunder. So rather than being deported for the fraud, it is better not to reply for RFE.
      You should never work when you are on H4. So better not to send reply.

      • As long you prove that you were WORKING AS A VOLUNTEER and NOT GETTING PAID, IT IS NOT AN ISSUE. Just get a letter from the company U were working for to say U WERE WORKING AS A VOLUNTEER AND DID NOT GET PAID….

    2. My employer state that he again re appealed but i don’t know how far it is true how can i came to know ?
    3. If he really re appealed then what was the chances of getting approved?
