When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    My company applied H1 for me in April for 2014 from India. I got my H4 in June while I am in India. Came to US in August. And found that my H1 got approved. Assume that I can start working on H1 from Oct 1st with out going for a VISA. Can you please let me know whether my assumption is correct or not because I believe that this is technically not a COS.

    Have got my H1 approved with company A and am about to take an appointment for visa. Now company B wants to offer me a job. Can I get my visa stamped with Company A and then start the process with Company B?

      Can I still go to US with the Visa from Company A while working for Company B bcoz visa and H1 are different or should I go for visa after getting approval for H1 from Company B?

    I am on my OPT right now and I am planning to apply to a new university for the upcoming semester as my OPT is expiring next month. I have noticed that there is a gap between my OPT expiration and the start of the semester at the new university. My Visa is expired as well. What would be my status during the time from OPT expiration to the start of my studies at the new university. There is a gap of about a month for me.

    I have been waiting in Initial Review status for my H1B since april and its frustrating. Please help me on understanding the below status

    The content in USCIS is “On April 16, 2013, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. Please check our website at http://www.uscis.gov for further updates on your case” etc

    But for few other petitions with IR status i see the content as “On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice.” etc

    Can anyone let me know what is the difference between those two ?

    My series is WAC1313550***. RP/RQ IT sector.

  11. Everyone in my series EAC13144517** got approved and I am the only one still under initial review .Can anyone please advise what is going on? USCIS is not processing the petitions in serial order.

      Mine is EAC13145539** still in IR

      Let me provide some light for you, from past one month i’m checking series from EAC13145539** to EAC1314554000 which are in IR status. Initially(Aug 1st) there are 20 cases in IR status. As of today there are only 6 cases are in IR . I don’t think USCIS is processing as a serial . We may get approval soon .

    Is there anyone from Beta Soft Systems who got their H1B approved.
    Mine is in RFE response review but the lawyer told me that the chances of getting H1B approved are very bleak since BSS doesn’t have a good history with USCIS.

    Can anyone suggest what can I do in this case?

    • Why your company had bad repo with USCIS? Was it earlier abused visa policy..like infosys. Who was got caught when an american infosys employee filed case that they using B1 visa holders to work as regular H1 visa holder and billing huge bug from client fooling them.. and abusing visa policy.. If it is the similar case then nothing can’t be done.

      Change the company if your visa rejected. shift to tech mahindra or TCS or congnizant or accenter for better future.

        I dont know the exact reason but last year all the visas applied by my company got approved.
        This year 3 applications have been rejected till date so I am a little worried.
        I put my case for premium processing and today is the 13th calender day but the status is still showing Acceptance.

    I had my interview on 2nd august and i was issued 221(g) and i submitted my documents they request on 16 th august. Today i got email from consulate saying to collect my documents. Also in check visa status it shows “Issued” previously it was showing under administrative processing. so is that means visa issued to me?? could not wait till morning to call courier service.

    Can we transfer H1b from Non profit organisation ( University) to a profitable organisation ( private sector/ companies) . If it is possible then does the transfer can be done at any time/ month? or the profit oranisation have to apply for H1b in April and I would wait until October to start working for them if approved? Please let me know when you get a chance. Thank you so much!

    • Dear Indian,

      H1b transfer from a non profit organization to a for profit company can be done but all rules of new visa quota will be applicable. That means you can apply only after April 1 as you are yet to be counted against the H1b visa quota for that fiscal and cannot start before Oct 1 in the same year.

      Please note that, this is applicable if your current petition with non profit organization was filed as a cap exempt petition. If you already have a cap subject petition approved then the quota limit doesnot apply. Neither does October 1 start date apply in that case.

  17. Now this is horrible.

    I attended the VISA interview and as per the VO, my VISA was approved. I was waiting for my passport to be delivered to me with the VISA by today and all of a sudden I get an email stating that the bio page of my passport is damaged and that I need to get a new passport and send it to the embassy. This is frustrating.

    I never used the passport before and everything is visible and in good state in there. I do not see any damages.

    Anyways, the other part is, VISA Status on CEAC shows as “Administrative Processing”. If this was the case, why did the VO said my VISA is approved. By God’s grace I never got any slip for 221G and it was a sure shot approval that was given by the VO.

    Frustrating. Now I need to get my passport re-issued.

    Any comments ?

        I’m myself planning for the TATKAAL scheme. But 1st, I don’t need to get it renewed as the current passport is valid for another 7 years, I’ll have to get it reissued under this scheme.

        The worry here is only about the Administrative Processing which sounds real strange. That too when, by God’s grace, I didn’t receive any 221G slips.

    Here is my Case, Right now I am in L2 EAD valid till 11/15/2013 and working with MNC, applied for H1B and still in Initial review. My spouse H1B ( L1 to H1B) is approved and will effect from Oct 1st.
    1) Can I stay in US if my H1B not approved by Oct 1st( My H4 is not applied)
    2) By Chance if H1B is denied how many days grace period to apply H4.

      1. If your spouse’s H1 was filed in COS, then from october onwards his status will change to H1, and hence you will be out of status.
      2. There is no such kind of thing called grace period.

      You have EAD, i assume you would be working some where. If yes then definitely you can not continue on your L2 visa after October.
      My advice would be …apply for L2 to H4 at the end of September and if you get your H1 then withdraw the application (L2 to H4) or else you will not be out of status as L2 to H4 is in pending.

      This is my personal advice, better consult with some immigration lawyer.

    • i’m in RFE response review status since june 24th , still waiting , though it says that they would update the status with in 60 days of they receive the response. but did not happen, waiting ,….waiting…

    I received REF on Aug 7th and I asked my employeer what kind of documents should i need to submit and they said nothing is required from your side and we are preparing.

    What it means? Please somone explain the same.

    • That mean, the RFE details that USCIS asked is related to employer (such as tax details, project contract info etc etc). It is not related to employee, that’swhy they didn’t asked you. If anything they wanted from employee then your employer would have contacted you. Its good they didn’t asked you…kamse kam aaram to hey..you can sleep well without tension and have devils dream …sorry sweet dream.. 😛

    Here’s my situation. I have an approved H1 from my previous employer (Company A) with start date 10/01/2013.

    Problem is, about 3 weeks ago, I was laid off from Company A. My OPT (STEM extn) expired 8/8/2013. So it means today I completed 18 days out of my 60-day grace period. I have been interviewing with several companies, but no offers yet.

    1) What are my options at this time? I’m not married so H-4/F-2 is out of question.
    2) How long can I stay beyond my 60-day grace period?
    3) If I do stay past my grace-period “illegaly” for say, 15-20 days, and I get a willing sponsor by then, what would be the consequences?

    I got an RFE and my consultant is working on that, I am on my OPT extension right now. I am planning to apply to some universities as a back up plan if something happens to the H1B processing. My question is if i apply and get admission from a university, when do I need to ask my current university to transfer the SEVIS. Does SEVIS transfer occurs during the first day at my new university or in order for them to issue me a new I-20 they would need to have SEVIS transfered from my current university that holds my opt and SEVIS?

    • Patience bahut badi chiz hoti hey. Only people who have patience, they wins the race. See how much india has patience. Pakistan is backstabbing india all the time and our indian govt shows patience, not doing anything.
      Similarly china enter our border of ladhak and arunachal pradesh, and our govt says this is routine task with lot of patience.

      Think if someday india lost its patience, then what will happen?? India will nuke pakistan and china and finish it from global map..which india don’t want..see the patience india contain. So patience is good thing. Don’t take any decision in hurry, have patience.

    • It will take another month or two..depending upon visa officer how lazay he/she is. But they will have to complete it prior october..so wait until they approve. You cannot bribe them like some people do in india to get ready made license card without going RTO office. 😛

    I need suggestion on how to proceed in the below scenario.

    I got my H1b this year which is valid from Oct 1st 2013 (COS from H4 to H1).

    My H4 was expired on Jul 31st 2013 and we have applied for H4 extension(applied for 2 months only as I have H1 valid from Oct 1st) along with my spouse H1 extension both of our applications got acknowledgement from USCIS and in ‘Initial Review’ status as of now.

    My question here is, what if my H4 extension is still in progress after Oct 1st 2013 also.
    Do I need to withdraw H4 extension application or can I leave that as it is?

    Please suggest what to do here in this case. Thanks in Advance.

    • Yeah buddy. same case with all my friends..don’t worry prior october the status will change.
      Waise bhi october se pehle tum US ja nahi sakte….no matter your case approved in june or july…so why to worry and why to waste money to upgrade case. Those who are upgrading their cases to premium are really fools…

    My case status was in IR till Aug 4th. On Aug 5th none of the status is highlighted and many people said that it would be RFE/approved. Still no status is hihlighted. Would be happy at least if it says RFE. When i checked with uscis they can reveal details to employer only. Asked my employer to find out the reason as the too unaware of the status. No updates as on date from employer and USCIS site.

    Only option I have is to WAIT and the process sucks.

    It’s really frustrating and makes me feel depressed. I have to depend on this as I am on H4 and in US.

    Lets see. Will update then and there.

    If anybody is in the same boat pls share urs.

    • What is the message is appearing in the portal..

      Is it something like thing “At this time uscis cannot provide your the status for your case. contact bla bla bla for addtional information”……

      If this is the msg then you will be getting RFE for sure..If it is other then this msg you can share..

    I do work for MNC and got RFE around one month. I dont know Reciept number and even RFE letter contents too, But my empoyer is asking for Experience Letter from previous employers with detailed Job description which might not be possible to get at this time as I have no contact their. Even I am not in contact of any colleague to get affidavit letter. Do you know if there is any RFE where usually USCIS ask for Previous company experience letter with detailed job desciption. In my current company I am working since last 6+ years and they are in process of getting experience letter for this duration. I have all experience letter from previous employers but with no Job Description.
    I will really appreciate to anyone who can reply/comment promptly. Thanks a ton to Saurabh in advance for his expert advice too.

      USCIS does ask for history of previous employment to verify the experience of a candidate is genuine. Ususally the RFE is like evaluation of your education and along with that USCIS wants confirmation of atelast your past 3 yrs of experience. As I do not know the exact ask in your RFE but your employer should be able to tell you that. Hope this helps.

Do you think in response of RFE we/attorney/company generally give that document also. I am from Mechanical Engg background.

    • If you know any of your friend of your previous company, you can write an affidavit and take signature of your friend and their contact details..

      See basically USCIS want to confirm whether you are the employee of that company and the work and position you handled for that entire period. So you can mention all those details in the affidavit and take signature of your office colleagues with whom your worked. If your earlier manager is in contact with you then taking a written proof from him on plain paper will also do the needfull.

      If USCIS want to enquire, they will call on the provided number. But normally USCIS dont do it. they don’t have enough time..only they need is some documentation evidence, that’s all.

    I need advice from all my friends here. It’s been 3 months now that I haven’t recieved any communication from my company regarding my petition status. All I know is that my petition got selected in lottery which was 3 months back. Company is not ready to share my petition number with me to track my status myself. When I as about my status, they dont give any answer.Friends please suggest what should I do in this case. Is it worth eaiting or shuld I start planning to quit.? M confused n frustrated. Plz help

    • Company should share at least your receipt number. So if your company has a practice that they will share only if you submit resignation then doing that is not a harm sine you can take it back resignation at any time . But before that try to get it somehow. If not, you can try the above option only. No other way..since there is no guarantee that your petition is in progress. In case, If your case turned into RFE , your name will appear in RFE letter.

      • Thanks Ganesh… But I have a question, is it necessary that once a case goes in RFE, then my company has to come back to me for documents? Is there a chance that they will reply to RFE without ever letting me know…. ?

        • There are chances, but little. Say if USCIS asked for document which are employer specific then company will reply to it without letting you know. IF USCIS aked for document which are employee specific then your company will further contact you to submit document.

          Don’t worry after RFE 99.99% are approved..but yeah you will have to fulfill the extra document that USCIS asked. If you fail then it will go negative. Once all document submitted it will take time from 2 week to 2 month to approve.

    • Your company is fooling you. By this time all companies whether IT or non-IT they told their employees the receipt number. ..so that they don’t quit. In your case its vice-versa

      Even infosys type of company who is not considered as employee friendly among ITpians has shared the receipt number with their employees. then why not your company. Let me know your company name..i will take out background details.

    I am on L1B with company A and same company applied H1B for me and it got approved with I797A.
    at the same time one more compay B applied for me and i got I797B(cos rejected as that time i was in india) . Now i want to stay back with my current employer A.
    I beleive if i do nothing then from 1st october cos will happen with my employer A only?Please clarify.

    Do i need to tell employer B to cancell/revoke the approved petiton before 1st october?

    My situation is little different. Two employer filed the H1 petition for me and luckily both got picked up in lottery and both got approved. (I know i will get cursed nicely by lot of ppl here).
    My Question is, What would be my status from 1st oct. Means which H1 will be applied to me.
    Would i have a choice to choose any of the employer?

    • The petition which u take for stamping will be the one which will be valid for travel. U can take use anyone of the 2 petitions to get ur stamping depending on which employer u want to work with.

    Thanks for all your support. Just a quick question:

    Strange part is I read such kind of post recently in this forum. When I checked the Visa using the Visa tracking facility it says

    “Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days.”

    Not sure why this is written when the VO kept my passport and informed me about the approval. Any idea if they haven’t updated the status or it might be a glitch with their website.

    Hopefully will get the passport with a stamped Visa.

    • Normally administrative processing is done for the people of specific community. Say if you have muslim name or you are a muslim then administrative processing is done. Normally muslim names had bad impact after 9/11 attack. So VO does administrative processing for cases of people belong to muslim community.

      Sometime it is even denied. And sometime admin processing take more then months and months.

  41. Hi Saurabh/all,

    Here is my situation.

    I got an RFE on employer-employee relationship and USCIS is asking for client letter, MSA, SOW etc. While filing my case, my employer had a vendor in between and they shared the contract documents only between the employer and the vendor.

    Now, what is the best way to handle this situation? Should my employer find an end-client who has a contract with the vendor (which is a little difficult situation at the moment) or a completely new client should be shown while submitting the RFE response by filing a new LCA?

    Please help!!!

    What type of questions asked at the Consulate ?
    My employer gave all the fees , I just had to give the Attorney fees. Should I tell this at the visa interview if asked ?

      Please make sure you never mention about any type of fee you’ve paid. You need to understand that everything has to be borne by the company / employer etc.

      I’d recently gone through my interview and have been given the approval for visa.

      Questions were:

      Which company will you be working for?
      How many people work in this company?
      How much salary will you be getting in the US?
      How did you come to know about the company?
      Is your day to day work similar to what will you be doing in the US?
      Which client will you be working for?

    I guess many users of this forum would have asked this question earlier. But i am unable to find information on this. My petition has moved to RFE on 22nd August. I want to know how long does it generally take for the RFE notice to reach the attorney(in Boston,US).

    Also, what is the general time period provided to us to reply to the RFE?. Does this vary from a case to case basis?. I have also heard rumors that once you get RFE, our petitions are processed rather slowly. Please carify if these rumors are true.

    • Even I got RFE on Aug 13 th. As my friends are all going for stamping I am just not sure when will my petition be approved even. Gonna take atleast more than a month.

          My case history :
          Received RFE : June 18
          RFE Response Review : July 29
          Approved : Aug 20

          mine is RQ/RP/CSC.

          Generally RFE notice takes 1-2 week to reach the Attorney. Do n’t worry, U’ll soon get your notice. then respond quickly. All the best

          It took 5 days for the RFE notice to reach my employer. From Rihaan’s comments we could see that RFE takes 2 months solid minimum for approval. But our RFE itself came 2 months later than his! Going by the processing speed we should get the approval by Oct 1st week.

      • Oh..pratty. You visa will be approved soon. I’m so touched with your line that it is still in intial review. Another option is there to start going temple and do 16 monday pujja…so that you visa should proceed for further stages.

    I’ve a question. My H1b petition is in Initial review. I’ve B1/B2 visa. I worked in Mexico for 2 years and came back to India via Europe instead of USA. I thought transiting US via B1/B2 would affect my H1B process.

    Now, i have to return to Mexico again from India. I need to get a new visa for Mexico. But according to mexico embassy, if I have US visa I don’t need to get Visa from mexico embassy in Delhi. I can get an ‘on arrival’ visa in mexico if i’m coming via US. Now i’m confused. Can I transit US with B1/B2? will it affect my H1B processing? My case is still in Initial review.

    Even if it doesn’t affect, what if my H1B gets approved when i’m in Mexico? and I can’t return via US with B1/B2 after completion of my job in mexico? Mexico allows only ppl with US visa who are coming from US or going to US.

    Please let me know what i can do.

      Your are perfectly allright. Your visit to Mexico via US on B1/B2 visa has nothing to do with your H1 petition in progress.

      Regarding your second question, while you are in Mexico and if your H1 petition gets approved it won’t have any issue since it would be a consulare petition and whenever you are back in India you can go for your H1 stamping. Hope this answers your queries.

            I am in the similar situation as you. I had to travel to US on B1 just 2 days before my H1 got approved and my B1 trip is purely for training and i have the invite letter (for 5 weeks) which says its for training at the client location. My H1 got approved on Aug 1st (by 2nd atleast USCIS would have notified all US immigration about the approval), then i entered US on Aug 4th. There were no questions asked at the immigration (i had been on B1 visa before 4-5 times and its was purely for meetings and i have stayed not more than 4 weeks) about my H1, only thing the immigration officer asked was why were you here, when was the last time you visited and how long.
            Guess what, my I94 date is valid till Feb-2014. I am returning back to India on September 8th and i have scheduled my Visa interview at Chennai for 17th and 18th. I am lookign forward to that.

            So, your B1 has nothing to do with H1, and make sure you have valid reason about your trip on B1 while your H1 is pending approval.
