When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  1. My case status just went to PDA directly from IR. So, how can I know if it’s an approval or denial? What’s the % of getting denial from IR without any RFEs?

    • Arrey bhutni k PDA itself mean (Post decision activity) mean approved, where all you details feed/sent to border security db and all consulate office.

      Abe jyada nakhre mat dikha, interview scheduled kar aur chup-chap interview de de. Wahan se stamp hua tab khus hona. Abhi se kyon uchal raha hey?? Consulate approval is main. Even that also not guarantee you will reach USA. At port of entry also you will have to go for an interview. Their also if you fails, they will send you back to your native country in another flight.

      So until you pass through port of entry, don’t dance or happy like some other idiots. Anything can happen at visa office and port of entry. Many people did expressed their happiness like this way, some of them sent back from POE…no they crying..So don’t be to sure until u start walking in USA land outside airport..

      Saala kuch pata to hai nahi… aur H1 process kar raha hai. Pata nahi kaise kaise chutiye aajkal H1 apply karte hai. It is becoz of these illiterates, genuine intelligent Indians are finding it difficult to get US visa.

  5. Hi,

    My H1B got and it had I-94 on it. But before I could receive the actual approval notice, I left the country in F1 Visa and entered again on F1 Visa and now I have different I-94 number.

    H1B I-94 number is from my trip before India and current I-94 after my trip to India.

    Is this a problem? Please help.

      If you left US after H-1 COS was approved, then your current status is F-1, but will change to H-1 from Oct 1 based on previously approved COS. Your H-1 attorney can confirm this.

  7. My case was stuck at initial review for more than three months. My employer finally decided to upgrade my case. After filing the upgrade, my case went back to Acceptance. Will the tracking number change after the upgrade? When will I know that the 15 work days start? Thanx.

      • After almost 4 months of waiting,i got an RFE today, not sure what is the evidence requested. All my project mates got direct approval from IR – not sure why they gave RFE to me.

          Hold your patience. within 1 wk or 2, you will receive the RFE notice from USCIS . then based on the queries, you have to apply..

      It is normal for it to go to Acceptance after PP upgrade. Unless it doesn’t get processed within 15 calendar days from that date, you should not be worried.

    It looks like USCIS is working on sundays as well. Did random check on the petitions and found that the below two numbers were moved to PDA on Sunday !!

  9. Hi,

    I got update from my Employer by saying “your case is still pending for the final decision on Approval/Denial from the USCIS. It would take several more days for us to hear the decision from the USCIS (Approximately 1 to 2 months). We will notify you the moment we have the update from USCIS.”
    Does it mean, will I get RFE? or Approval/Denial decision soon?
    What the chances of H1B is getting Denied without getting any RFE?

      This message is from employer and not USCIS. So it is not possible to say what the actual status is. If you know the receipt number, you can track it online and know the actual status.

  10. Hi All,

    I got a RFE on Aug 9th , I am in WAC1313654**** series and that too after 4 months of review. My question is how long does it take for USCIS to send out tht RFE to my employer and is there any hard deadline on submitting these back on time ? I have a bachelors in non-it but carry over 8 yrs of IT experience. would that be a problem or is that justified by the attorney through my edu evaluation ?

      That is correct. If you worked inside US on 2012 or before, then you should have received W-2 from the employer for that year.

  13. Dear Saurabh and other friends,

    I am non-IT guy and a consultant has filed my H1B and he mentioned that I would be working for him from the month of October as a Programmer Analyst.( He filed as future employment from October2013). I hot an RFE about project details along with some general questions he says. I am not an IT guy and my attorney wants me to get an experience letter and some sort of certificates to make it up for my non-IT background. I have been working in my NON-IT field for about two years on my OPT. My consultant is asking me to get some certificates and experience from India ( I did my bachelors in NON-IT field )I know the fact that the certificates that I would have to need will not be genuine but I guess I dont have any other options, do you have any suggestions for me. I am also thinking to ask my NON-IT job manager to write something that I also worked in IT related job as well along with my NON-IT job. What would be a good option for my case, should I ask my manager to write a letter or should I get it from India. I did my masters over here and my opt expires in first week of OCT.

    I would really appreciate your help.

    My extension was filed in April and still pending. I will have to go to India this month. Will that impact the extension processing? Do I need to be physically present in the United States until the approval?

      797 extension will continue but I-94 extension will be abandoned. To return to US, you will have to wait for your petition approval to come through and will have to go for stamping if the current visa stamp has expired. What are the expiry dates on visa and petition?

  15. Hi Experts,

    My wife has applied H1B from some consultancy and as per them they haven’t recieved her packet back from USCIS. I am curious to know what’s the timeline for USCIS to return the application docket.

    Also as i heard that USCIS will keep some cases with them and will accomodate them if there are Rejection etc. (I just herd of this so not sure if that’s correct). If that’s the case, who can confirm on this.

    I am rolling on the See – Saw so just wanted your help.

      They should follow-up w/ USCIS. Yes, they keep wait-listed petitions, but my understanding is that they will be notified about their wait-listed status.

      Are you sure the company applied the H-1?

        Thanks for your reply. Yes i think so because they provided me Courier Details for my Wife packet and it was delivered on 1st April at USCIS.

        Any idea how to check that??? I also don’t have any info about it.

            Any idea how to check if the consultancy has filed it or not?? They have given me FEDEX tracking number for the courier which they have sent to USCIS.

            It was recieved by them on 1st April but not sure if it was her petition only. CONFUSED!!!!!

            Fedex tracking number and USCIS receipt number are two diff. thing. Packet received on April 1st does n’t mean that you are picked up in the lottery.

            I think you soon will get a receipt Notice from your company/Attorney, where your USCIS receipt number will be written. USCIS receipt number is a 13 digit number starting with either WAC or EAC.
            Like mine is WAC13135XXXXX.
            WAC is for californea and EAC is for Vermont.

    I have my H1b approved and my employer has received the I797.
    I wanted to scheduel an interview some time 2nd week of september and would like to take my wife and 3.5 year son for H4 stamping.
    PLease let me know:
    – if i need to set up an appointment now itself, if there any any slots available for 2nd week of september.
    – do i have to fill 3 DS-160 forms or just one mentioning my family members as well in that.

    Please let me know these details ASAP.

      1. You will have to check it online as availability changes daily.
      2. Each applicant needs their own DS form and fee submission. Schedule a date for yourself and towards the end convert it into a family application. You can then include other DS forms.

      The child is exempted from personally appearing for visa interview. You can carry his documents.

        • H-1B Transfer,
          The new employer can file the cap-exempt petition soon after the first petition is approved. No payslips are required from the new employer if this is filed prior to Oct 1. You will still need proof of your current visa status (which can be F-1, H-4, L-1 etc). If it is post Oct 1, then you need payslips for the period from Oct 1 to H-1 transfer filing date.

  19. Hi, I got H1B petition approved under 2014 quota as a new hire, it is not yet stamped. The issue is that requirement is no more valid. Should I go for amendment for different project with all the supporting docs with same employer or go for stamping with current petition. I don’t have Client letter for the approved petition as I was planned to operate from my employer’s office in US.

      Do not go w/ current project if it has ended. They may ask for client documents and then you will be in a fix. Get new LCA and H-1 amendment and then appear for stamping.

    I am in US on L1B. My Visa and I-94 both expired. Extension was filed before I-94 and Visa expired . My H1 is approved.

    I dont have any masters degree from US. Can I still go to Canada for H1 stamping if L1b extension is rejected?

      I’m in the same boat. Could you confirm whether your H1 petition was approved with COS or W/O COS? I’m assuming yours W/O COS.
      Also, when was your H1 approved and first few letter of series ? May I know the status of your L1 extension?

      I will suggest against it. They are pretty clear that one should go there if you done Masters in US or this is not your first stamping.

        Could you please explain the 180 days rule. As I said, My L1B and I-94 expired and On 1st Oct I will complete 180 days after expiration of I-94. I was thinking of going to Canada in mid september(for H1 stamping) to avoid staying in US more than 180 days after I-94 expiration, but now it does not seem to be a good idea. It seems that my L1b extension may get some more time as I replied RFE last week.
        Can you also let me know the best option I have.

          Its not 180 but 240 day rule. If an extension or COS is timely filed (i.e. prior to current I-94 expiration date), then you can continue to stay inside US for at most 240 days or denial date (whichever is earlier).

    My request for L1toH1Cos is in RFE response review status. Will there be a reasonable time between the approval and the visa status change ? For ex , is it possible that they approve the petition at september 25 and my L1 will be changed to h1 from Oct 1st ? Just checking to see if i will have enough time to change the employers .

      If the approval happens prior to Oct 1, then it will have start date of Oct 1. If it happens after Oct 1, then it will have start date as the actual approval date.

    • Hi…I am waiting for L1 to H1 also. Just curious if it is safe to leave your current employers prior to I-94 start date. Fro example if you get approval on Sept 10th, and you put your resignation in on Sept 16th to give you 2 weeks of notice period. What will happen if Employes senses you are switching to H1 since you can not really switch on L1.

      • Well Wisher,
        If the L-1 employer ends your employment prior to Oct 1, then you will have to leave US as you will no longer be in L-1 status and H-1 status doesn’t start until Oct 1. You should also consult w/ your H-1 attorney if this happens.

    RFE responded: July 11th
    Petition approved: July 28th

    He was lucky to get his petition moved from RFE to Approval in just 2+ weeks.

    I know,Minimum processing time is 60 days during this stage.
    My question is ,What is the rate of Success from this RFE stage?

    My case is a bit tricky. My OPT expired on June 17th. My H1B petition is in RFE response review state since July 18th when my lawyer submitted the documents to USCIS.

    I need to travel urgently to India in a few days. Can you advice what should I do? Should I wait for the H1B decision to come and then leave? Even in that case, can I come back on F1 status or do I need to get my H1B stamped?

      You are in cap-gap status right now. If you travel outside US, then you cannot return until you get H-1 visa stamped and even then return after Sep 20th. Your H-1 will continue to get processed and may get approved while you are outside US.

      You cannot return on F-1 as your OPT has ended.

      Remember, only employer/attorney can call them to get the updates. You as a beneficiary should not call them. And don’t even think about impersonating as someone else.

  31. My online status still says – “USCIS cannot provide you with information about your case…..”. When i called USCIS, they said an RFE was ordered on August 1 but it has not been sent out yet. Any idea why this happens? How much time before they send the mail out?

    1) Change of client within organization with new client letter would do good ?
    2) Change of company – Any good thing there,

    Please help, I dont want that approved petition I worked hard for to remain just a piece of paper.

      1. The employer needs to file new LCA followed by H-1 amendment
      2. The new employer has to file new LCA followed by their own cap-exempt petition

      Sticking w/ same employer or moving to a new one comes down to what opportunities you see w/ them in US.

    M H1b petition for 2014 got approved and I am planning to go for stamping interview next week.
    I am currently working for an IT firm as IT Analyst in india and have 8 years of IT experience.
    I have done my engineering (Higher education) in mechanical stream.
    Would there be any issue because of this?

      • minimal requirement for h1b visa….!! equivalent education for core people (refer:CS,IT,ECE,EEE) btechics or 3 years of equivalent exp for non core. hve 8 years exp. will be kool…!! All the best…!!

        Ya , maybe. I’m a RF Engineer. I have to deal with several RF optimization related Softwares. Maybe for that reason, USCIS asked for those.

        The Problem is, My Attorney did nt give the employment Offer Letter, Agreement letter at first.

  35. Dear Friends : My L1 and I 94 expired in June 2013. filed H1 from different employer and L1 extension from current. ( both are in RFE, L1 RFE has to be answer by Sept 23)
    should I go for stamping if L1 ext rejects after H1 approval ?

    • L1 to H1,
      If H-1 is approved w/ COS, and L-1 denial happens after H-1 approval, then you don’t need to go for stamping.

      If H-1 is approved w/o COS, then definitely go for stamping.

      If L-1 denial happens prior to H-1 approval, then also leave US and go for H-1 stamping.

      Keep your H-1 attorney in loop w/ your L-1 updates.

          L-1 denial doesn’t impact H-1 outcome unless it was due to submission of false/fraud documents and information.

        2. I think I can not work before Oct 1, even if H1 approved with COS and L1 ext denied before Oct1 ? Should I leave country in that case or I can stay here with approved H1 (with COS)

          1. You cannot stay in US b/w the L-1 denial date and Oct 1.
          2. Yes, leave country and return on stamped H-1 visa. Talk to your H-1 attorney as well if the gap b/w the 2 dates is very less.

  36. Hi Guys,

    Please help me out with this query.
    M H1b petition for 2014 got approved and I am planning to go for stamping interview next week.
    I am currently working for an IT firm as IT Analyst in india .
    I have done my engineering (Higher education) in mechanical stream.
    Would there be any issue because of this?

    • H1b Visa interview query,
      You should carry information on how you qualify for the offered position. Your employer must have submitted similar information to USCIS like education equivalency certificate etc. So carry that along w/ job description, detailed resume, experience letters etc.

    I got the below message when i checked my status today. It was in Initial review till last week.
    •At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information•

    I really could not understand the above message. Please advise how to react on this.

    • What happened baby? Why are you crying. RFE is common thing. Normally visa get either approved or denied after this stage. So keep you finder crossed until you reply to RFE and wait for RFE status review. cross check you document twice thrice. Allow it to be reviewed by all senior people/hr/attorney prior reply to RFE. Else it will be denied if you don’t follow my guideline.

      RFE common chiz hoti hey..Many time i have seen to buy out time USCIS people simple asks for RFE, which has no meaning. After all they are also govt people like any other govt of any other country. And you people know Sarkari kaam kaise hota hey.
