When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  1. I am under 1 year OPT now and my OPT expired December this year. Now I am applying H-1 and got approved last month. I want to go back to my country for two weeks (vacation) on October. 1. I know that I need to go to US Consulate for visa stamping. But the problem is I also had green card application under F-2B (family based for unmarried child over 21-my dad sponsor). What is my chance for H-1 interview? If I stay in US and keep working, do I need visa stamping? Thank you very much.

    • as far as i know. you don’t need to get stamping done as long as you don’t go outside US. you can keep working and still maintain legal status . however once you go out , you need stamping to come back in.

      chances of interview depends on the person asking you questions and what he infers from your answers.

      H-1 is a dual intent visa which allows immigrant petitions to be filed. So it should not be impacted by the pending F-2B petition. Reply truthfully in your DS form where it asks about immigrant petitions.

    This questions seems to be rediculous. But asking and would like to know…Just in case in Visa interview somehow person doesnot able to reply the correct answer and VISA got rejected :-(, so in this scenario since petition is approved, so when can one can attend for VISA inteview once again. Or is it possible to attend VISA interview once again. Just out of my curiousity would like to know this.

      I am sure, you can apply three times, even when you come out from embassy, you can apply again at the same time, while going back to home. But let me come someone with authentic answer. but I am sure at my end.

    • Don’t take much tension bacchu. you should do your homework before appearing for interview. This is expected from you. simple. Do some interview session with senior people.

      I was there for a L1 interview. All question answer i answered confidently. Many time i did some mistake, but that mistake also i said confidently. Finally my L1 visa got approved. H1 visa me to interview naam ka kuch hota hi nai hey. Ek baccha bhi jeet jayega.

      One thing you should always know, don’t raise any red flag during interview. The VO are tested lie detectors. So don’t try to outsmart them. Though they are not that much technical, but if they catch any loose point of yours, they will make you loose. That you should know.

        • Denial chance increases only based on your total experience, work relevance, number of employee your company has, if your background verification they found something wrong, If your name has muslim title.

      You can appear for stamping again as long as you have valid petition and employment. However, when reappearing for stamping, make sure you address the original rejection reasons, or it may meet similar fate.

    My case is bit strange. Please clarify my doubt.

    My employer has filed H1B for me. I through in lottery and currently my H1B is in approved state. However, Due to personal reasons, I have resigned and my employer has requested USCIS on 07/18 to withdraw my petition . But Still my petition is in approved state as of now. At this state can my empolyer request USCIS to take back the withdraw request and proceed with stamping for me ? incase if they want to. My manager is ready to provide long vacation for me and asking me to get the H1B first. But immigration team has aleady sent the withdraw petition to USCIS. share your ideas. Thank you.

    • You are gone baby…these type of people are called fool. No matter watever the personal problem, after your visa approval you should not have resigned. Just think that you reached to that visa approved position after passing through loterry and loterry it the biggest challenge. Many needy people didn’t even crossed that point…but you got through..think yourself the much-much luckiest person. This year it was tough to get H1B visa. Next year it is going to be much-much tuffer to get H1B visa due to all sorts of amendment and price rise. Since the withdraw submission already done, so now it cannot be withdrawn. You dream washed off forever now.

      You are nowhere. Neither to company nor to visa nor to switching any other company taking the approved visa..

        I completely understand.. I am working for one company, which would offer H1Bs to thousands of employees, actually there is no project requirements in US.However, these guys process H1Bs and ask the employees to sit in project till reach VISA expire date is near, then release from the project(By this time at least one year would pass) and send to US for VISA extension. Many Indian based top MNCs playing this game… Just by showing H1B as card he is stopping me from last 2.5 years.. which is really a painful period in my life…now management is demanding me to almost die for the stupid project and telling we are giving H1B to you…. I know which is an opportunity lost for another candidate.. But I really hope that USCIS should come up with rule like after H1B is granted, from that date with in 3-6 months person should be in US.. Then only the really required people will apply for H1B and these Stupid Indian based MNCs games can be stopped…Anyway.. of course US is my dream of many like me… thats washedway now… I am going to some other country.. escaping the clutches of VISA stamping, expire.. dependent work visa.. All the best for your VISA.. hope you should be in US ASAP..

      After all the not-so-serious responses, here is a serious one.

      A new employer can file cap-exempt petition for you which is not subject to cap. They can do as long as you have copy of the approval notice or know at least the receipt number. This can happen even after current employer withdraws their approved petition.

        If the H1b petition is withdrawn before OCt 1 , then i dont think he can file a cap exempt petition in future.

          If the petition is approved, then it doesn’t matter whether it is withdrawn or not.

          If the petition is not approved and is withdrawn, then it cannot be used irrespective of whether it happens before or after Oct 1.

          Having the receipt number document is enough. Take a print out of online status showing that receipt number as approved.

    • Visa pane ke liye log saalon saal kam salary me company me kaam karte hain. Manager ke aage piche ghumte hain. Company ko sak na ho isliye loyal bane rahten hain.. Kyon?? Its only for visa and that also a heavy visa i.e H1B. And your type of fuddu people only resign once got visa approved after passing the lottery hurdle. Think that many people not make to it, no matter they are much much talented then you.

      Ab kuch nahi ho sakta tera. Ghar jao aur chaddar odhkar so jao aur apni murkhata par aaanshu bahao aur koi sad song suno…hehe

    • Abey agar tere ko resign karna hi tha..you should have waited till the stamping done. Later you should have took 3 month salary of this company and resigned. Later joined other company and should have asked other company to file cap exempt for you.

      Sab kuch sahi hota. Kist G@@ndu ne tujhe ye dimag diya resign karne ka??

  8. There are only 9 Cases are still in “Initial Review” for 100 cases from EAC1313954600 to EAC1313954700. Among the other 91 cases, most of them were RFE and few of them have got approved. Only 9 cases are still pending. All the 9 petitions are dated April 08. Those who fall under this category and active in this blog reply to this message and make a chain of 9. …Hopefully there should be an update by end of Aug for sure. All the best!!!

      Are you asking if you qualify for H-1 visa? Do you know if your employer submitted education evaluation document? If yes, then your employer has submitted proof to US that you qualify for H-1. You have posted this question on multiple pages. I am going to ignore other posts.

    I checked for the first 200 cases in EAC1313952XXX series starting with EAC1313952000 and found that out of 200 cases 37 are not for I129 Form. Out of remaining 163 only 60 has got approved, 23 has got ref and remaining 80 are in Initial Review. This series is moving quite slowly. Hoping for the best and best of luck to everyone still waiting.

    I have been observing the blog and i could able to find out only the people, who have minimum 2 years experience,are clearing the stamping interview successfully .

    Is it difficult for the less experienced people like 1 year?

    Is experience matters much in the interview?

    Anyone who went for stamping with less experience?

      If you qualify for the offered position, then there should not be an issue. Obviously there is an issue if you are under-qualified or over-qualified.

    When i checked my H1B status today, it says “Post Decision Activity” and approved as on Aug 1st.
    I am working currently in India for my client. My client wants me to travel to US on B1 visa for 5 weeks and am leaving tomorrow night and back by firs week of September. The invite letter provided by my employer says its “Training”.
    What i wanted to know is its ok to travel on B1 even if i have my H1 B approved. The thing is its for the same client i will be working once my H1B is stamped.
    I have all the needed docs that i am carrying while travelling to US tomorrow on B1 – like return travel tickets, invite letter e.t.c

    Please let me know if there will be any problem while i go for stamping in India once i come back (i need to come back because i need to take my Wife and Son for H4)

    • Better to avoid this trip, as there is a high chance that they cancel the tickets at the last moment and ask you to continue on with H1 petition until and unless the company policies are stringent.

      This might be a way to avoid stamping for your family members to company until another 6 months or so.

      Think before you start.

        So if i come back by september first week and then go for H1B stamping along with my family in India it should be good right?

          • This can be highly risky.. the VO might even cancel your H1. Other risk is getting arrested at port of entry in US. They might throw u in jail where u’ll be lurking for rest of ur life….

          • I DoNt understand why I will be arrested.
            I have a very valid reason why I am traveling on B1 and its pure training which was well planned before. I have the invite letter which say so.

    • H1B waiting to Approved,
      If you have valid reasons to travel to US on B-1, then go for it. This can be done even after H-1 has been approved. Do your thing for the 5 weeks and return to home country for H-1/4 visa stamping. During H stamping, you may be asked about this B-1 trip to ascertain that you didn’t misuse the visa and didn’t do any productive work.

      So just be careful what you are doing in US on B-1.

    My H1b got approved last month but one of my friend from the same company with same job title (System Engineer) got denied, which is very unfortunate. He is currently in STEM OPT extension (MS in Computer Science) which will expire next year July. Could you please provide some insight answering following questions?

    1. Company is willing to file a GC immediately to keep him in the company. His country’s GC date is current. Can company file GC through EB2 while in OPT?
    2. If the GC petition got denied and/or in processing until next year April, can company (or another different company) file another petition for H1b next year?
    3. If GC can be filed, can he include his wife in the petition? His wife never came to US before and does not have any VISA yet.
    4. Is it possible to travel while GC is under processing? F1 visa is valid until next year.

      1. They can start the GC process. Even though the dates are current, still the process can take up to a year (PERM, I-140 etc). I am not 100% sure if AOS can be filed while he is in US on a pure non-immigrant visa like F-1. His attorney can confirm.
      2. Yes
      3. His family can be included when I-485 is filed. Until then the family needs to maintain their own visa like F-2 (and he has to maintain his F-1).
      4. I don’t think he should travel during PERM phase as I-94 number will change. He should also not travel during I-485 processing phase, but not sure.

    I mean on what basis some get 3 years while some 2 or so ?

    • Aks,
      It depends upon:
      1. What your employer has requested
      2. What USCIS officer seems appropriate based on submitted documents, information etc. So for small consulting companies who submit SOW/contract of 1 year, officer may approve for just 1 year.

    I posted the below query in the blog chain:

    “My residence address while H1 filing was Gurgaon, which comes under Delhi consulate. My employer says the approved visa is ONLY for Delhi consulate & I cannot go for visa stamping in other cities. Please clarify if this is true. I am currently in Chennai & wondering how to handle this.!”

    I just received my I-129 & found the below details under Part 4. (Page-3)

    Part 4. Processing Information

    1. If the beneficiary or beneficiaries named in Part 3 is/are outside the United States or a requested extension of stay or change of status cannot be granted, state the US consulate or inspection facility you want notified if this petition is approved.

    My H1B Visa got approved today(01 Aug 2013)

    Here is my case:

    First time H1B(FY 2014), 6 yrs work exp in India with a MNC company.

    Visa Experience: Hyderabad 10:00 AM

    OFC : done on 26-Jul-2013 in 3 mins flat.

    Interview on 01-Aug-2013

    entered the consulate at 9:45 AM had to wait till 10:50 AM for my turn.

    VO: Passport and I797 please…
    Me: gave
    VO: Which company
    ME: XXXX
    VO: Who is your Client
    ME: XXXX
    VO: your Visa is approved.

    Advice: Guys planning to go to Hyderabad consulate apply ASAP. This Monsoon it is raining Visas:-)

    I would like to share my experience in this forum.

    My pettion was filed with USCIS on 8th April
    Petition approved on 10th May
    Stamping done on 22nd July (At London consulate, as i am currently working in UK)
    Got the stamped passport on 26th July.

    The entire process has been very smooth.

  23. Hey Guys,

    I am one of those guys who are left in IR and series after them are getting approvals. For a while I have been trying to find a pattern that can help me figuring out when USCIS will start processing my case.
    My case number is 8th in a series so I checked 200 cases of my series and the next hundred e.g WAC13135 50001 to WAC13135 50100 and WAC13135 50100 to WAC13135 50200.

    I made a list of all the cases that were in IR and checked them on daily basis. You won’t believe what I found out. USCIS was processing 1 case daily from both of these series. Means they are picking a case they left from each 100 cases and processing it.
    Now there are 9 cases left in my series which means in next 9 days I should see some changes in my case status. Hope this help!

      Good point – i am also doing similar activity. Mine is one of the 31 cases left in IR between EAC1314253600 and EAC1314253700. there were 40 cases in IR on last friday, on an average 1 or 2 cases handled per day. hoping to see that in next 15days some change may happen.

      • Good catch guys. Me too was doing similar activity. Not sure why the petitions are being randomly picked. USCIS claims that the wait time is 2 months but its been more than 3 months my case is still in IR. Series: EAC1314252*.

          I did some digging on the same series thing , what i found was that between WAC1313654001 and WAC1313654100 , there are only 2 IR one is PP and other one is mine in the 20th serial. So hopefully something comes up for me in coming week , fingers crossed. I really don’t know how these guys pick up the case.

    Got RFE on my H1B application. They have asked for Project Statement of Work (SoW) etc.

    For SoW they say:

    Please provide a copy of the 3 most recent Statements of Work (“SOWs”) for the project to which employee will be assigned in the U.S. All SOWs must be signed by the end-client and the current SOW must be valid.

    I am a little confused about the explanation for SOW. Could anybody help me out to understand what is required in this case.

    • Hi,

      Dont worry about this document.
      It has to be provided by the Organization. Its document signed by the Vendor and the Client at the time of any project signing or extension. You can work with your manager and get the document from him.

        The issue here is that I am a new entrant to this project. There is no offshore team and the only team which is there is in the US. Last 6 months, this client has started a new trend of mentioning the Associate’s name on the SOW (I know this is kinda weird. Even I have heard something like this for the first time). Since I am new entrant to this project there will be a new SOW for me which is not an issue. But since the USCIS has asked for 2 previous SOWs, it makes me a little apprehensive about this.

    I wanted to ask you a question. I have hear rumors at work and also some of the comments on blog this suggests that the petiotions that are still in IR status will be denied. Is this true?

      So dont worry they have lots of work to do and they are slow.

    • Thats all bull shit !!!!. My case was in IR since long time but my empoyer told me that your case is very strong and there is no chance of denial, so i was waiting for long to see some movement.
      Finally it directly went to post decision activity with approval. So be patient and wait for your turn. They are processing case randomly and you must be receive positive news on that.

    I was on L1B and then we applied H1B from the same company with COS. Before H1B get approved i went to INDIA and came back but my COS got rejected.

    In the approved I797 there is no I94 and my attorney is saying me to go to India and get it stamped and come back.
    I think we can again apply Change of status from l1B to H1B and can still work in USA without going out for stamping??
    Please suggest.

      That is correct. They can file for COS or you can enter on stamped H-1 visa. Talk to your attorney if they can file COS or H-1 amendment to change from consular processing to COS.

      It takes almost 20-25 days to change the status to post decision activity. on 8th July my status changed to RFE response review. on 26th it changed to Post decision activity with petition approved(WAC13136xxxxx).
      So have patience and all the best.

        I checked VISA status today, it is issued.
        I know all of you are smart and deserve VISAs. I think being confident, to the point answer are probably the key.

      There should be some sort of communication from USCIS about the filed case. The best course of action is for your employer/attorney to follow-up w/ USCIS. Maybe they sent something which was lost in transit or undelivered. So they should follow-up.

    Got a mail from my employer that my petition went into RFE. They have asked for following documents:
    1. Client End Letter – Please provide a letter that confirms the ongoing professional relationship between the end-client and my employer. The letter must be printed on the end client’s letterhead and should confirm the details of the employee’s placement at the end client’s worksite.

    2. SOW – Please provide a copy of the 3 most recent Statements of Work (“SOWs”) for the project to which employee will be assigned in the U.S. All SOWs must be signed by the end-client and the current SOW must be valid.

    3. Project Organization Chart – Please provide a copy of the organization chart demonstrating the employee’s supervisory chain at the onsite work location.

    Could anybody explain about these documents. I am a little confused about the explanation for SOW.

    Also, how much time does it take for the decision on RFE after submission of response.

    One menacing doubt – What exactly does the status ‘Decision’ mean in USCIS site? It explains like ‘Withdrawal of the application’. Does this imply the petition is denied? Also is there a chance for the petitioner to reopen the case immediately for the same year FY 2014. Pl clarify.

    my h4 is still 30th sep.If my husband’s company applies for an extension effective start date for both h4 extension and new h1b will be oct 1st. In this case how will the last action rule be applied? please let me know as i am very confused 🙁

      If both have same start date, then the petition which gets approved later will be the one in effect. To avoid this, you can upgrade H-1 to PP so that you can then decide whether to file H-4 extension or not.

    Is it possible i can extend to another year..Does these reflect anywhere in SOW/ somewhere else??
    Reason being asked this question is..if we kept between oct 1 to dec 2014,the duration of visa will be offered only a year????

    • Anu,
      The exact time is mentioned in RFE doc, but it is typically 60 or 90 days. At times, the petition duration is same as the submitted client letter/project. If you can get extended letter, then submit that. Else go w/ what you have currently and then file for extension when the time arrives.

    My SEVIS has information about my previous employer that I have been working for almost two years in my opt +opt extension period ( left this job about two months ago). I have not updated my SEVIS, one of the reason I did not update DSO is because I have moved to IT and I do not have IT background and I think my university will not accept to update the SEVIS with IT job as I have masters degree in non-IT filed and I have been working in my area of expertise from past two years. The company B who has filed my H1b is also in IT and he filed as a future employement from october where my opt ends as well. Not sure if my university would accept with my current IT job. Do you think it will be a problem if I dont update my SEVIS with my current IT job as my SEVIS is still active with my non-IT job that I left about two months ago? Thank you so much Saurabh, I hope to hear from you again. (FYI- I am currently working for a company A in IT field for a little while and my opt extension expires in october. My SEVIS is active with my previous non-IT work)

          • Received RFE on July 10th, my lawyer responded on July 15. Went into RFE Response review on July 22nd and was approved this afternoon. July 30th. My application is RQ/RP and EAC13144 series.
