Why do we call H1B Visa 2014, when the petitions are filed in 2013 ?
USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014. So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.
What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?
If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)
- Regular Quota Cap – 65,000
- Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?
Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.
- For H1B Visa 2012, the cap was complete on November 22nd,2011
- For H1B visa 2011, the cap reached on January 26th , 2011
Will there be Lottery for H1B Visa 2014 ?
This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?
There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).
International Students – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?
Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option. The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country. You have to do the COS before your OPT expires to maintain legal status in America.
How soon Can I start working, if I file for H1B visa 2014 fiscal year ?
One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.
What is current H1B visa 2014 cap count ?
The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

If you will carry B’s documents and B will be vouching for the project, then you should get new LCA, then H-1 amendment and only then appear for visa stamping.

When you say company is same – you are referring to the employer, right (as you mentioned client is changing)? If the state changes, then new LCA is required followed by H-1 amendment.

I have received a RFE mail from USCIS today stating below information:
” Statement of Work. Please provide a copy of the 3 most recent Statements of Work (“SOWs”) for the project to which employee will be assigned in the U.S. All SOWs must be signed by the end-client and the current SOW must be valid.”
I am not getting what SoW is because this is the first time i am going to US and I have clearly mentioned in the H1b docs that this will be my first client.So I am not getting what they mean by 3 most recent Statements of Work considering the fact that the project where I am going is Ist project of mine and i will be working there as a long term ( meaning all my 3 years )

The SOW will be given to you by your manager.
Ask him/her for this document. You dont have to worry for this.

If the project was already in place b/w your employer and client then old SOWs will exist (not necessarily for you). Your employer should provide you the SOWs.

I am in a precarious situation… my h1b is still in IR… trying to move it to PP.
Though i have a valid i-94 until aug 2016, for some reason my current employer wants me to take a new project back in india. My L1 petition expires in Sep this year.
Now my question is if I put down my papers and stay here after serving the notice period and a couple of days falls short till I get my approved H1 petition, will there be any problem ??

Once your case is changed to PP, it would take 15 calendar days for the decision(Approval or RFE) to come.
Scenario prior to Oct-1, if H1 not approved:
If you put down your papers & your employer relieves you, your L1 is no longer valid, in which case you have to leave US immediately.
Scenario prior to Oct-1, if H1 approved:
You cannot stay prior to Oct-1, in-case you are not an employee of your L1 employer. You can start staying around a 7-10 days prior to Oct-1, that is just for settling purpose but cannot work. Starting Oct-1 you are on H1.
My personal suggestion, first get your H1 approved & then put papers.

You leaving the US will not effect the H1 processing. If you had applied for H1 with COS, then the COS would not be in effect once you leave US, means if your H1 is approved you need to have H1 visa stamped on your passport to re-enter.
There will be no pitfalls if you change to PP.

This year 2013 i applied for my h1 visa and got approved and my start date is oct 2013.
Since i have a traditional function in india, i am planning to travel to india around december2013.
My query is whether i have to go for H1 visa stamping? and in worst case if my H1 gets rejected during visa stamping, can i travel again to US in my H4 visa which is valid till june 2015?
After entering US can i file change of status (COS) from H4 to H1???

When you say “RFE went it” do you mean RFE was responded? If yes, then status should change to RFE response review within 2-3 days of USCIS receiving the docs.

My employer applied for H1 this year and I got my packet back couple of days back. Now I am in search for universities to enroll from Jan 2014. Few universities are offering CPT from 1st semester and few universities are not offering, until we complete one full academic year. If i can’t get CPT then I won’t be able to apply for H1 next year also. If i chose an university that offers CPT from 1st semester then would that be a problem if I apply for H1 next year.
All the unviersities which i am referring to are accredited.
Please provide me your valuable suggestions.

If you don’t get CPT, you can still apply H-1 next year. It is not a requirement to be in CPT at the time of H-1 filing.
Even though universities are accredited, you need to be careful when going w/ those offering CPTs from day 1 or 1st semester. I have seen lot of RFEs this year related to:
– proof that CPT was indeed integral part of the course and required
– proof that school is a non-profit as for-profit schools are not eligible for AD cap
– proof that person attended classes in person and remained full-time student even when working on CPT
my attorney replied back to an RFE with all necessary docuemnts on 22nd July. Does anyone know how much time it will take now on to get final decision ?

Most RFEs are adjudicated within 60 days. But some can take longer as there is no SLA.

Day 1 you get your finger printing & photograph done at Nehru Place office, Day 2 you get your interview done.

1) Will Minor less than 2 yrs of age is required to go for Finger Printing and Photograph on 1st day and 2nd day for interview.
2) Online appointment is scheduled for Day 1 or Day 2 process. Suppose it is for day 1 then for 2nd day How would I know what is my interview number at what time.

1) I am not really sure whether a person below age 2 requires finger printing or not. You may check the same at US Consulate site.
2) You would need to schedule appointment for biometric & interview at consulate website depending on which day is available for biometric/interview. Generally it’s back to back but may vary on availability.
Taking kids (less than 2 yrs) is optoinal. Their finger prints will not be collected , you just need to take a photograph. But with my personnel experience if you take kid to interview your process will be fast and even our interview went quite well, not much questions 🙂 .

Typical processing time is within 60 days from RFE response review to final decision. However, as there is no SLA for RP, it can take more time in some cases.

Hi, am not sure. But I’ve heard people saying “Premium processing clock” starting, ticking & ending. Just check the status in USCIS site whether you get any info like this in case status.

It can be upgraded to PP even after RFE response has been submitted. Like mentioned by other poster, the status should change to something like “on xxx we received request to upgrade to PP” etc etc.
It may go back to Acceptance status, which is ok. As long as it doesn’t reach RFE, Approval or Denial within 15 calendar days, you should not worry about the immediate status.

A quick question. My H1 has been approved and I’m planning for getting a stamping date sometime in the first week of August. I wanted to quickly check on the Visa Stamping process.
As per some of the articles here, I found out that the Visa Stamping process has been split up into 2 days, where on the first day I’ll need to go for giving finger prints, and on the second would be additional finger prints process followed by Visa interview. Is that correct ?
Do we need to schedule 2 days from now onwards for Visa stamping process, or can it be done on the single day as before ? Please assist !

It has been broken into 2 days – biometrics on day 1 and interview on day 2. The days don’t need to be consecutive.

some of them were worked on by may 18 i am assuming they were premium processing.
them they touched some around june 10-20 and they left others.
Looks like there is lottery within lottery and they randomly pick an application.

I have a theory that for small or new companies who have not been issuing H1B more often are been thoroughly inspected. Big companies who apply thousands of H1bs every year don’t need the inspection and only assessment of the employee is being done. This logic just came up in my mind not that I read somewhere.

Hi – Mine is also still in IR, EAC1314451***. I think EAC-13143, 144, 155 series are not actively worked by USCIS. I do have Valid L1 and applied for H1 waiting for approval.
Receipted on April 8th and Status is IR.
Probably we will get updated by this month end or August first week as per my analysis with the EAC series.

RFEs do carry a deadline for response. It is either 60 or 90 days. Yours will be mentioned on your RFE notice. USCIS is not adhered to resolving all petitions by Sep 30th.

2000 public law fee is applicable only if the employer has more than 50 employees and at least 50% of them are on H-1 or L-1.

1. Is it possible for a petition to get rejected directly from Initial review without getting a REF.
2. As already 3 months have passed since notice date, what are the chances of the approval?

1. No. They usually issue RFE before denying it
2. Delay doesn’t impact the outcome. Your chances of approval are still the same as they were on April 1.

Don’t worry. my receipt number is EAC131385XXXX also in this series only and on 19th July my case status has been changed from IR to post decision activity and petition is approved.
USCIS takes around 1 to 4 months of time to process H1 B petitions.Don’t lose hope.

I had some questions,
1. I have a passport which is valid till 31st december 2014. Can people let me know when and how can i get my passport renewed. Can i renew it in US once i land there from indian embassy, is it possible to renew in the US embassy?
Or can i do it now before my h1b stamping? Renewing passport before h1b visa will not create any problems when i go for stamping with my renewed passport?
When should i go ahead renewing my passport?
2. Also as my passport is valid only till december 2014 will they approve my visa only till the date my passport is valid ( i.e, in my case its approx 1 year ) or the h1b approval will happen for the number of years my employer has applied for. For an example if my employer has filed my h1b visa for 3 years in my case will i get a visa for 1 year or 3 years?

1) Renew it in US as it is easy process. Do not take chance to renew it in India. You never know bcoz of Indian Government crooks your passport might stuck somewhere in between for long period.
2) Yes, I think you will get your visa till your passport expiry. Anyways after getting new passport always you can stamp on new one for frther period.

So you mean to say i will have to go through the pain of reapplying the h1b visa or apply for an h1b visa extension? this could be a laborious process right where the employer should initiate it if he is interested?

You will get your visa for 3 years and not till your passport expiry. Visa can never be depend upon passport expiry.
I have been granted 10 Yrs B1/B2 visa, even though my passport was valid for 1.5 Years. No need to re-stamp on new passport.
Whenever you renew the passport, new passport must have your old passport number mentioned in it. Just you need to carry both passport same time. Visa has it;s own expiry date.
Point to Remember : Any visa to be stamped on passport, your passport should have valid atleast for 6 month from the date of stamping. In your case its 31 Dec 2014 so no issues ..

I have 2 H1B s approved in 2013 quota. I got my visa stamping through my present employer ( Indian MNC ) and entered US in November 2012 and continued to work with them. My second H1B is through an Indian consulting company in US. Now i got an job offer to work on corp – corp. So can i use my second H1B activated now for corp – corp job? is it still valid?

If your 2nd H-1 petition was also approved, then you can enter US to work for that employer on their approved petition. Although stamping is not required as you already have your visa stamped, but still check w/ other employer’s attorney about it.

I am on OPT extension period right now and my H1B is already approved but my Wife’s H4 is still pending and not been approved. My wife wants to travel to India in 1st week of august and come back in 1st week of September before October 1st 2013. Also My Opt extension ends on September 27th 2013 and Cap-Gap Kicks in for 3 days.
Could she travel to India and come back within this period? Also does she need to go for Visa Stamping?

I am working with an MNC for past 7 years.
My L1-B visa got expired on July 12 and I had applied for extension and which got into RFE.
I also applied for H1-B visa which went to RFE too..
My employer is yet to reply for both RFE’s..
And also would like to know if I can proceed with both and choose one.. As I am mainly interested in H1 , can I ask my employer to reply for L1 RFE too so as to buy time as I would want to stay here till the H1 petition gets approved ..
Now as my visa is expired, please tell me the options I have .. I prefer staying in US than returing to India although for a short time..

You should let both of them proceed and reply to their respective RFEs. If L-1 extension gets denied then you need to leave US unless it is past Oct 1 and your H-1 has been approved w/ COS. Does that make sense?

I am in the same situation. The only difference is that my L1B and I-94 both expired. Extension filed before I-94 and visa expired.

Yes, you can continue to wait for your L-1 extension to process, and leave US if it is denied prior to Oct 1 or after Oct 1 (if H-1 is still pending or denied).
