Why do we call H1B Visa 2014, when the petitions are filed in 2013 ?
USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014. So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.
What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?
If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)
- Regular Quota Cap – 65,000
- Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?
Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.
- For H1B Visa 2012, the cap was complete on November 22nd,2011
- For H1B visa 2011, the cap reached on January 26th , 2011
Will there be Lottery for H1B Visa 2014 ?
This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?
There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).
International Students – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?
Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option. The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country. You have to do the COS before your OPT expires to maintain legal status in America.
How soon Can I start working, if I file for H1B visa 2014 fiscal year ?
One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.
What is current H1B visa 2014 cap count ?
The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

Someone in this forum said the USCIS are almost done with processing petition for H1B & approvals and now the remaining ones will get denied. Is that really true ? Can someone please based on their prior experience throw some light on this ? Mine is still in initial review phase.
Wrong news. I dont know if your “somebody” works with USCIS otherwise its hoax. There are many series like EAC13137***, WAC131400, WAC13141** etc which havent been processed yet so stay tuned and be patient!
Wrong news…remeber USICS site says 2 to 6 months…processing time..so have patience..few are lucky who got processed in 2 months or less…Enjoy life king size..cheers…

I need some help from you.. I am actually on H4 and my husband applied for H4 extension, I applied for my H1 this year (april 2013) but I didn’t hear anything from USCIS yet and I am already done with my Masters (CS) a while ago .
I want to do one more masters as I have very less chances to be picked into lottery.
Can you help me with your suggestion.. let me know if it a good move to do masters(F1) while waiting for h4 extension as well as my H1( applied in 2013).

If you want to do Masters then go for it. Enroll in the school and start your studies. Your H-4 extension can happen in parallel. If H-1 gets approved, then you can move to H-1 status by filing COS. Your school will be able to tell you more about what kind of documents are required for enrolling w/ H-4 extension pending.

Finally i got RFE for my petition after long wait of 15 days today..Earlier my status was

Im constantly observing that…13138* series people are getting more RFE and more approval from 13137* series people. Bad luck for 138 series people. The officer may be hard enough for this series. Your employer/attorney will receive the RFE message containing the information/documents required by USCIS. They will have to submit that information to USCIS and then review will begin. Be in touch w/ them about the RFE details.

My H1B petition got picked up in the lottery, then I received an RFE and eventually the petition got denied due to the lack of client letter. I have applied for COS from F1 to H1B. I am currently on 40 hr CPT and can continue to work. My question is, is there a way to transfer this denied petition to another company? To do this successfully, I am planning to change the project, where I can get a client letter and then apply for the transfer, so that at least the transfer of the denied petition would be successful, what do you suggest??

IMO, as you don’t have any approved petition, another company cannot file a cap-exempt petition for you. However, there was another member who posted some comments by an attorney who said that it can still be filed. Their opinion was that once the person makes through the lottery, they are eligible for cap-exempt even if the petition gets denied. That case is still pending, so I don’t know what was USCIS’ take on it.
So my suggestion will be talk to an attorney and get their opinion on it. Also, let your DSO know about the H-1 progress so that your SEVIS remains active until the correct time.

If you know about any rejection/denial please let everyone know the reason.

MTR processing time can vary from 1 month to several months. Also, the chances of approval can vary from case to case. Your attorney can provide a more accurate answer based on the documents you have.
Remember, your H-1 is considered denied until MTR is approved. So you have to maintain your F-1 status (including SEVIS record) while MTR is in progress.
Having petition approved for H1B means a person will get their visa approved during stamping ? Chances of rejection during interview will be less ? What sets of question will they ask during visa interview !

Having your petition approved doesn’t guarantee one’s stamping. There were cases where the visa has been declined during/after the visa interview. They meant to verify all the documents physically and approve only if they are satisfied with them. I have never heard of a H1B visa got rejected during the first interview unlike B and F visas. They would give some time to provide the evidence that they need to process the case, failed to supply those info/docs will likely to get a rejection. Visa interviews are always crazy. They are pretty hard to guess. They usually ask about you and your employer. The questions may be related to your job, salary, location, client letter..etc. You can google for various types of questions during H1B interview. All you can do is get all the documents in place and give your shot. All the best to everyone who are waiting for the approval notice and attending for interviews.

During interview your confidence matter. Even if you are telling lie, then also try to be confident. These VO officers are their to issue you visa. They are tested lie detector.
So be bold and confident during interview and stamping don.

Scenario:
(Me and my Husband are both in India)
* My husband’s H1 stamping was done last year for FY13 and he is travelling this year in sep 2013.
* I am going for my H4 stamping this Friday i.e 12 Jul 2013.
* Also my current employer is going to apply for my L1 visa at the end of sept 2013.
Concerns:
* Would there is problem that I went for stamping for H4 and then L1 within a span of 2 months?
* What questions would the visa officer ask me during my L1 stamping in Sep 2013

1. It should be ok
2. You will be asked general questions about your L-1. They may ask about your H-4 visa stamp as well. You will have to reply truthfully that you got dependent visa to accompany your husband, but now need to travel on L-1 for your current employer.
There is a possibility that they will cancel the H-4 visa stamp while approving the L-1 visa stamp. You can still go for H-4 visa by filing COS from L-1 to H-4 once you are in US on L-1. If L-1 is denied, then they shouldn’t cancel the H-4 visa stamp.
Does your L-1 employer know about your H-4 visa stamp?
Here is more interesting stuff. Checked the number between eac1314654450 to eac1314654489, around 40 of them. 80% of them are either Post Decision or Decision. Good news on the way guys!

Found something very interesting. Just scanning through the numbers and found that eac1314855004 could the entry in the database for fy14. Did not see any/many petitions with 8-Apr as filing date. *148* series could be the last day on which USCIS might have finished data entry, which turns out to be 30-Apr-13(guess). Not sure though how the processing is being done, it looks highly random. I see approvals in *148* series while IR in *135* series.

Processing is done as per requirement. The petition which are not even touched are more vulnerable to be denied in coming days..! So just wait and watch

“The petition which are not even touched are more vulnerable to be denied in coming days” – That is NOT true. They cannot process all the petitions at once and it takes time. Historically petitions have taken 2-6 months when lottery happens. Interpreting delay as denial is not correct.

Two days back it was showing “Post Decision Activity” and now it changed back to “initial Review”
what does it mean ? Any similar cases.
hehe..again it will go back to acceptance and then lottery and then filing and then applied and then lca approval and then nothing ..hehehe. Don’t take tension buddy, it is approved…im cent % sure. Only the compter glitch causing this. The tier 1 and 2 support of USCIS whoes duty is to update status are not that much seriously working.
Mine status also fluctuated many time. But finally settled on : Post decision activity. So don’t worry and enjoy.

Yes buddy mine approved on 1 july. Many other people of EAC got approved between 25 june to 5 july 2013. Many cases directly changed from initial to post decision jumping decision and RFE section.
If your case still shows initial review, then its good sign. Someday you will login and u will get Post Decision activity status directly..

1. can i jump to other company immediately after reaching city A ..or …are there any rules like i have to work with my company C for minimum period before looking for other options.

Very cleaver guy. Why you are thinking of jumping company?? You company paid for your visa, so its your moral duty to obey and be trustworthy towards your company.
I know H1 has no restriction, that is the reason many people simply using it to jump company. If it would be L1, then you would not have got chance to think on that also. So be loyal and pay your company the due credit for issuing you visa.

1. There is no minimum work tenure requirement. Legally, you can change the employer the very next day.
2. If you change employers, the new employer will have to file their own cap-exempt petition. Once USCIS approves it, it will have it own tenure which can be longer than 8 months. In others words, if you plan to change employers, then transfer includes extension.

WAC138 series has started. Is there anyone whose status has changed?
How can we know that which series is in progress ?
They are just looking status at USCIS website 50#s above and below their WAc or EAC# to see status. For eg: if my no. is EAC13138445## then search status of all numbers from EAC1313844500 to EAC1313844599 … If any I129 is approved means someone is working on it…. Too much patience required for this I must say…
U just need to spend some more time on this blog. I saw few posts where fellows have posted their approvals for 138 series.

Still in “initial review” status. However message is changed as

Anybody has similar cases ?. What may be reason for this message change.

Yes its started from 20th june 13. Mine got approved on 2nd july 13..hurrey.

My notice date was 22nd April 2013. Nearly 70 days has gone. Not my case is in “Inital review”

Normal processing time in such petition heavy years is 2-6 months. So 70 days is not something unusual. If you want the quicker processing, you can opt for PP.

Please let me know if you have any update reg the Vermont processing this year. I mean whether they are following any order. Approval numbers. I saw California petitions have been approved more than vermont.

Even my petition was near to 90 days old belongs to Vermont and still showing initial review.
By the way why ur petition no is EAC-13-142-5****, according to me its 2nd April 2014.

Historically, CSC has been faster than VSC. However, there have been no updates provided by USCIS on the specific center. You will have to wait or upgrade to PP.

You mentioned that CAlifornia is faster than VErmonte. How can you say this ? Based on what you can see this ? I assume CA means WAC and vermote means EAC .. Pls correct me if I am wrong.
Ravi, even many petitions starts 138-5**** are in Initial Review, mine is still in initial review, close to 90 days.
But i really hope it will turns out to be good.
By the way how ur petition no starts with EAC131425****, as per my knowledge it shows 2nd aug 2014 .

Yes, you need to know that. You should also have the approval notice w/ you when appearing for the interview.

I applied premium processing on 21st June. Yesterday my status showed up USCIS cannot found your case. Today morning it is showing Initial Review and the clock has stopped. What does that mean? My Receipt number EAC131365****.

It can either be RFE or approval. Your employer/attorney should receive the notification soon.

Koi dushri country ke visa ke liye itni mara mari nahi hoti, jitna US ke liye..phir bhi log wahan jaten hain.. Inke hazar type ke enquiry hoten hain…Kyon?? I went to UK and mhy visa was ready in 15 days regular processing. Also i earned more money also. I would say leave US try for Europe and UK.. The other thing we can do is to develop our india like that, so that US people stand in Q for our country visa.

Valid period,
It can vary from 1 year to 3 years. It depends upon what your employer has requested and what USCIS seem appropriate based on submitted documents. You can go for stamping anytime during the petition validity period or at most 3 months prior to H-1 start date.

1.If a person selects in lottery,do the employer has to pay entire amount towards processing H1 at the initial stage itself? if not wat is the steps for each level
2.If i person gets request for evidence ,is that possible to get to know from the USICS ppl rather waiting for attorney to know about the evidnces required,will they answer us?
3.Post rfe wat would be the waiting time,again is that the random process or based on any criteria

1) Employer has to send the check along with the application. Any application with out the full fee amount will be rejected.
2) No, your attorney will get the full details of the RFE. if they need any documents from you, they will ask you. if not employer and attorney will take care of answering the RFE. you no need to worry about that.
3) you can upgrade to PP once you get your receipt number.
3) if its a PP your 15 day processioning clock will start, once USCIS receives your packet. if its a RP it may take time. no one will know how much time it will take .
My case number is EAC1313952XXX. Today when I checked the web site, it said as of 02-July-2013, they have raised an RFE. I called my Attorney and he said he would know the details in a week. Thanks

I can see all the petitions between WAC13136XXXX1-10 getting approved. Mine is WAC13136XXXX5 and it is still in Initial Review.

God knows what going on. Mine is WAC13135512XX. i saw most of in this series 01 – 99 got approved or RFE and some are still under initial review including me. Don’t know in which order they are processing, and 136 – 143 days are getting approved ..
How can you say that 135-143 days are getting approved ? any confirm news ? Mine is wac13143 … but still waiting and I dont see any approval in wac13143 series ..
I have many post from ppl saying that even for 145 & 146 got approved. Not all but atleast started within this series and some even in 135 & 136 is still pending (IR) ..

Has the series EAC13142**** started processing? I see its really slow and when I checked, in this series, only 2 or 3 petitions are either in RFE or approval mode. But the series beyond ie., EAC13143, EAC131345 seems to speed up. Dunno whats our fate!!

Now actually my DOB is 6-May-82 but here it is 06/05 means 5 June?? Am I reading it correct?
Now I have already asked my employer to do followup with uscic for same but can you suggest if I am actually having issue and what should be solution?

2 things can be done:
1. Your employer can submit a letter to USCIS now telling them that DOB is incorrect (yes it is Jun 5). This should be free
2. Wait for petition to get approved. Then ask employer to file H-1 amendment to update the DOB in the petition. This may cost money
Let your attorney know about the typo and ask them their preferred option.

I got a RFE saying that my bachelors(Industrial Engg) is not related to the work (Business Analyst) I am doing. I did MBA from US and working in a bank now and USCIS is asking me to provide a proof that Business Analyst jobs requires MBA degree.
How can I answer these two questions?

One of my friends visa got rejected saying that his bachelors (Biotech Engg) is not related to his work.
This is weird. I know many people who are working as Business Analyst after MBA. One of my friends is working as database administrator after MBA. He didnt have any problem while he applied for H1B two years back.

I know its weird but nowadays USCIS is scrutinizing every application. They have asked me to provide evidence to show that MBA is required for Business Analyst position.
What did your attorney say? Did he tell you what kind of evidence is needed to prove that? like client letter or anything else?

USCIS often requests the evidences that are practically possible to submit to them. Every Request MUST have a solution and same with your case. The denial takes place only when the petitioner could not provide the expected evidence or its doesn’t meet their query.
Talk to your attorney first then you will get a solution. If you still don’t get it let me know.
PS: I am into same consulting business since several years and aware of such issues which encounter most of the time.

1. Find online openings for similar profile which state MBA as one of the requirements.
2. Submit other postings made by the employer for BA role which requires MBA. If there are other people in company in BA role w/ MBA degree, then submit their information.

If the employer has not received any response from USCIS, then they should follow-up w/ them. Chances of making through the cap now, is pretty low IMO.

Did you submit education evaluation certificate along w/ the petition? You seem to have enough experience to compensate for the missing years of education. So it should be ok. Beside, your attorney would have looked into this and submitted appropriate documents to USCIS.

yes my attorney done education evaluation , in fact they charged more for it ( i haven’t paid though ). i submitted all my certificates , mark sheets and experience letters at the time of evaluation .
Since it is an internal transfer on h1b , we did not submitted client letter . we submitted sow , itenary ,offer letter , employment agreement . do i have good chances of getting petition approved ?

You can submit the docs you have and then hope for the best. It is not possible to guess the chances of success.

Just a quick question. I am student with advanced degree quota. I filed my H1B this year which got picked. I got RFE on June 11 and USCIS has asked for tons of paperwork and given a deadline for Sept 6. My company people are trying to gather all the documents. But i am little worried as it has been 1 month and my company did not send them information. Will it affect my H1B decision? My company has filed for many people previously and all got approved but this year its just me. Let me know what you think? Thanks.

As long as they submit the information prior to Sep 6, USCIS will review the application. If it is delayed beyond that date, USCIS may not accept the RFE response. Chances of approval will depend upon what they are asking and what your employer is providing.
