When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

    My employer informed that I am not selected in lottery. He told me that my packet has returned. I know he is speaking lie.
    Can anyone tell me what I should ask exact thing if really my packet returned. I should ask any receipt number/LCA?

  2. My clock started after responding to RFE on 6/17/2013 evening and stopped on 6/19. and got approval exactly after 24 hrs. I saw in many online forums saying that after 6-7 hrs if you don’t get status changed you may end up with RFE. That’s not true in my case it took 24 hrs to get acceptance. Just want to let you guys know.

  3. Does anyone know if the Immigration Bill be passed this year before 1st Oct 2013. If this happens will the quota opens up again?

    • Even if the bill is passed in senate it still needs to be approved in senate and signed by the president to take effect. This process takes till the end of the year. So who lost h1bs this year need to wait till next year to apply . Better to have plan B

  4. Hi Friends- Congratulations to all who got visa approved notice.
    Mine is still in Initial review EAC13144***** , petition received date was 8th April .
    I am also able to see in the USCIS status page down below there is a mention in red
    OMB control no. 1615-0080
    Expiration date 6-30-2012

    Do i need to react for this ? Did anybody faced this situation.
    Please advise.

      I also have same EAC13-144-xxxxx, still in initial review, and I also have same dates as you. I am expecting the state change near 26th of this month. I have seen one case below in blog, saying 13-144 approved. So wait for turn. (Again its my assumption, so that no one say me stupid people :), because someone called someone stupid is last days 🙂 in this blog)
      the expiry date and # you mentioned, its on all pages, it has no concern with us, its their own use. (Again its an assumption…)

      • Hello Anybody from Infosys . My Wife’s H1 Visa was applied . Her manager told her that she got selected in lottery.When she Checked the status in Portal (AIMS) in Infosys it was showing ready for printing.She is not sure where to check this recipt number.

        Can any body tell where exactly the recipt number is updated . Is it anywhere else apart from the ready form printing where she Can Check the status

        • If the petition is selected in the lottery you will receive an email from VISA cell that the Application is received by USCIS. Receipt number is updated in AIMS.
          Check with VISA cell.

          • She didnt receive any Email. On Opening AIMS there is a hyperlink against H1B.She said when you Click the link “Ready for printing” Comes. I am thinking that may be she’s not properly able to see where that recipt number will be exactly shown.

            She says there is a number next to Hyperlink. Can that be her Recipt Number.

    I am silent reader this web site and helpful for me a lot to sit confident through watching this website posts, I want to share my query wiht you all.

    My H1B approved and my employer told me schedule the interview july 2nd week and let him the date of appointment, then they will send me the required document like I-797, LCA,Client letter ex… like they were saying.

    My doubt is : Is it the good way to attend the interview july 2nd week, Normally every one will attend after Oct 2013 to 2014 . Is their any benifit for me attend the inetrview before Oct. What is the chance to get the VISA , if we attend before Oct 2013.

    Please share us your valid inputs and let me know who ever attaend the VISA interview recently ?

      You can attend the interview in July itself. In case your stamping runs into issue (221g delays), this will give you a head-start. Otherwise, you can go later as well anytime during the petition validity period.

    Today I got RFE for my H1B case. I am here on L2. My spouse’s H1B is approved and will go effective from 1st Oct, 2013. I have EAD valid till 2015 but after OCT my L2 will not be valid after 1st Oct.

    Since my H1B (COS) is pending, so can I stay in US and work..

      You are considered on previous status until COS gets approved. This means, you will remain on L-2 which will no longer be valid. My suggestion would be to upgrade the petition to PP so that you know the outcome before Oct and can decide to file H-4 or not.

        • Also would like to know, I would like to process Dependent visa also for my spouse and child. So will this be processed at the same time with my H1B Visa interview or what is the procedure for dependent visa.

    Still my status is in Initial review.I don’t know still how many days it would be?
    The more the waiting will it be a different status..I m really in bad state now.

    I see before and after some more number got approved status or atleast change of status.There are few numbers left in the series.

    Mine is WAC131365**** .Does anyone in this series still waiting for any status change?
    Day by day i m getting fear.God need to be kind on me to give an approval status.

  10. After 1 and half wk, finally my case status converted into a RFE.

    Last 1 and half wk, my status was showing –

    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    Now, received a RFE. 🙁 .

    How is the chances of getting rejected from this RFE stage ???

    I had a question.. I got my H1-B (new case) approved a few weeks ago, with a start date of Oct 1, 2013 (My OPT cap-gap is valid till Sep 30, 2013). I am about to interview with a legitimate non-IT company on Friday, who aren’t familiar with the H1-B transfer process. I want to know what it would cost to port my visa (Company > 25 employees + Premium Processing + Attorney fee estimate). Also how much time would it take to get my receipt from the day they make an offer (if that happens)?

        The new employer will be filing a cap-exempt petition for you based on previous approval notice. IMO, this can be done prior to Oct 1, but the start date will still be Oct 1 or later.

      Cost would be around 3000 USD + attorney fees. They will have to file the LCA followed by H-1 petition. USCIS will then generate and send the receipt number. So it depends upon how fast they act. LCA processing takes around 2 weeks and receipt number generation takes 2-3 days.

    so what documents should my employer have to give me ?

    Also my wife is in india and i am planing to apply for her Dependent visa next month

      Your employer/attorney should receive the 797 within a month. They can then share the same w/ you. If they want, they can send you copy of filed I-129, LCA and other documents they submitted to USCIS.

    What is Administrative Process, the interviewer took all my documents including my passport and Gave me LCA and 221(g) checklist, in which he only asked for some additional documents that were related to my employer. I already have provided them all the documents that they asked for… now my question is that what they do in AP is that security checks? or what? what is the meaning of keeping all the documents with passport? Is that approval? he didn’t give me anything else accept these two docs. He also asked me that Please email these documents at your earliest to continue the visa processing on your case.

    • You got 221G means your case is suspended mode, You can take it like RFE. It might be case that you have already provided all your documents but still email them all again as listed in 221g slip.

      Then you have to wait for 1-4month,mine was same case and I got approval in 45 days exactly.

  22. I got my package back a while ago. Not sure what could be the next step for me? Need suggession.

    1. Should I go back to school as a full time student, find a job next year and apply for H1B next year again?
    2. or should I join the school who gives CPT starting from 1st day? Is it legal to join these kind of university? Will I have issue with my H1 next year?
    FYI: My STEM extension is expiring soon.

    • Any Hope?
      CPT from day 1 can be issued only if CPT is for work related to your course and is integral part of the course. Diploma mills are more interested in enrolling F-1 students and getting their fees. So they can issue CPT even when they are not supposed to. If a school is ready to issue CPT from day 1, then ask them to give in writing that CPT is indeed an integral part of your curriculum.

      (1) is a better and more legal option than (2)

        I am not sure if it’s a valid question to ask, but I am so desperate to know….
        My employer applied for H1: PP/AD/VERMONT
        But we did not hear back from uscis, nor received the packet yet.My attorney called uscis 2 weeks ago and they did not disclose any information. I called up my univ, sevis has not been updated yet. Can I still hope for positive result or do you think my packet is on the way??

  24. I dont see any order in processing. My colleague with EAC13140***** got RFE and I am with with EAC 13138**** with no action and still Initial Review.

    Some one rightly said long time back patience is the key to success. So keep waiting, first for April 1 so they start taking packets, then for lottery results now for any updates then for interview dates. and again finally for the final date of travel, So yeah long way to go….

      • EAC13134 and many of my friends in same range..

        USCIS clearly states that average processing is 2 months. So it can be 10 days upto 6 months….I am shocked to see ‘so called’ educated guys in this forum (not you) starting the bull shit again and again, that we will get visa decision in 2 months..

        Srsly guys? Lets have some patience. We will get it. If you want the decision early do a premium…end of story

        • it is not bulshit, it is just assumption, also they mentioned in processing time as average 2 months. but yes this time can be 2 to 6 months. there is no rule SLA for them to complete in 2 months. shut your mouth, tell me did you check your status online on USCIS …if not even a single time till you get receipt then i will accept that it is bulshit otherwise shut your mouth…

          • Ok CRYBABY…Do a reality check, it might help.
            And Yes I Check my status once in a week as I have created a notification on the USCIS site. They will email and message me once there is a COS.

            Also, create an account with them, add your case to receive a notification. Now check the last updated date there. If it is been updated your case is been picked for processing. If not, it shoud be the date your applcaition was receipted.

            And yes as you say, I will shut my mouth now. Peace out.

          • yes i want this answer from you…it means some how you are also checking your status. why can’t you wait for physical copy. everybody has its own way to check. so don’t complaint to others.

Hi – My H1 receipted on April 8th, current status is initial review.I am currently working in a software firm in India.I do have valid L1 with my current company.At this point, if i make a switch over to other company will that impact my H1 stamping process.Can any one guide me on this situtation how to go with.

      • Mark – Let me be more clear. My H1 was receipted through other company(say AA) in US. But I am currently in India with a software firm(say XX) through which i have Valid L1 till 2014 April. Now i wanted to switch from existing company(XX) to other company (say YY) in India , will my H1 processing through company AA will get impacted?

        please guide me in this situation.

        • Why USCIS would care if you change jobs in India? About L1 visa, I don’t know. If you H-1B application get approved and you decide to go to the US to work for company AA, you will get a H-1B visa stamp and all other valid U.S. visas will be cancelled without predijuce.

  29. I think we need to count 60 days from the Notice receipt date but note from receipt date , Here For EAC13136 xxxxx: Receipt notice date is 15-April
    For EAC13137xxxxx: Receipt notice date is 16-April
    For EAC13138xxxxx: Receipt notice date is 17-April
    For EAC13139xxxxx: Receipt notice date is 18-April
    For EAC13140xxxxx: Receipt notice date is 19-April
    For EAC13141xxxxx: Receipt notice date is 22-April
    Not this 13141 and 13142 have same receipt notice date because they were working on 20th-April which is Saturday.
    For EAC13142xxxxx: Receipt notice date is 22-April
    For EAC13143xxxxx: Receipt notice date is 23-April
    And so on.
    For EAC13136 maximum cases are approved while it will be 60 days on 16-June. So I assume they are processing on time except for some cases.
    If anybody has different calculations please let me know.
    I want some light from Saurabh on this

    • I agree with your calculations. Mine is EAC13144xxxxx and its notice date is 24th April. 60 days period is also right. So I was saying to wait till June end, most of the cases will be resolved.

    Still i am waiting for receipt number. Packet not returned back from USCIS nor cheque got encashed. Is there any hope?

        i am in the same state as you are, i dont even know what is going on
        with this, i am seriously questioning the my employer. ( i mean in a state like this all wrongs sorts of stuff is coming to my mind).
        There could be multiple options, like the packet got lost in transit (which i highly doubt)
        the employer took the money and did not apply for h1b.
        The uscis got the packet after 5th of april, which was the cutoff date.
        Drawing info from previous years, it seems that they are going to hold x mumber of applications, against incomplete, or with a same names or applications which get rejected.
        there is no number anyone has as to how many applications are invalid, so the applications which have been kept with uscis is clueless.
        i dont know whats up with the situation we are stuck in…..

        H1b is not the end, life keeps going on with more and better opportunities to come….

    Any idea how much more time it will take for another status. Did someone from this series, from India got the status change to any other status.

    • Wait for you series to come under process. Don’t take tension. Few days back, I have seen that 13136 is processed, now you are saying that your friend case 13142 is processed and approved.
      my case is 13144, so I am also waiting for the turn. What are your first five digits? Just guess that your where your series in turn.

            I dont think they are processing in serial ordar
            All this approval process should take long time, I belive by July end we all should receive an update on those. It is my assumption only.

      It didn’t pass any House/Senate. What Senate has passed is approval to discussion on the bill in full Senate. Once the discussion is done and all amendments done w/, it will be put to vote in full Senate. After that it can be considered as passed in the Senate. It will then proceed to the House of Representatives.

  38. From where we can find the Notice date for H1B Visa petition as online I am able to see only below mentioned text:-
    On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case.

    Mine is RQ/RP/WAC1313651***. Petition is in Initial Review phase only.
    Applied from India through IT Firm.

    Any help will be appreciated.

    Last 2 months , my status was at “Initial Review”. From last Friday, Its showing

    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    I already informed my Attorney about that but she hasn’t reply me yet. Now, Should I call ? Why is this msg showing ? Is it a symptom of getting a rejection/RFE ??
    Have you guys ever faced this kinda situation ??

    My Case is –
    WAC13136XXXX , RQ/RP
    Recieved Date : April 8
    Notice Date : April 18.

    Can anyone pls help me ?

      Mine was like that too. Then showed that exact message. What I thought was then only they started reviewing the application. That’s why we cannot check the status. After couple of days it turned to Request Evidence status.

        What are the evidences usually USCIS look for in RFE stage ? and what is the percentage rate of success from the RFE stage ? Any idea ?

          No idea what they asked. I asked my lawyer let me know what they are asking. They never contact or told me but have sent the requested information and now it says received requested evidence and on Request Evidence Preview stage. I hope there’s nothing I have to do or present as evidence. I am curious too.

  40. My L1B expires in 2012 but I94 valid till Sep-28-2013 and my same employer filed for H1B with COS this year that got selected waiting for final approval.
    What are the chances that case will be considered as COS (L1-H1) with I94 new start date as 28-Sep-2013 to maintain legal stay for 3 days and work authorization as 01-Oct-2013. Or it will not be considered as COS rather as CP in that case go out of country and come back with stamped work authorization start date as 01-Oct-2013 ?

    But some blogs says that if you are out of country and applied for New H1B; you are allowed to enter US 10 days prior to 01-Oct and stay for 10 days with no work. But not sure about the case if you are already in US till 20-Sep and applied for COS and if approved; Will the 10 days stay still allowed without work prior to 01-oct of validity ?

    • L-H COS,
      Someone else posted similar case where L-1 I-94 was expiring on Sep 23 and his/her COS got approved from Oct 1. So it may get approved in your case as well. You should still check w/ your H-1 attorney if you can stay in US for those 3 days or not. As it’s just 3 days it may not be a big issue in the long run, still its better to know the legal implications.
