When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

Also, typically USCIS sets aside 6,800 visas  for Singapore and Chile Free Trade agreement filings, which is H1B1 Program. Also, read article All about H1B Caps – Basics Calculations, Lottery

 

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

        It generally takes months (1-3) for an application filed under regular process to reach to post decision stage. Also, even if you get your application approved, u can start your work in US only by October ’13. So be patient , it will get approved sooner 🙂

        Received Date : April 8
        Notice Date : April 18
        Now, in Initial Review stage.
        I’m also looking for an answer. but I believe, It will need not atleast 2 months(+/- 5 days).

            Does it take another 1 month? Initial date is Apr 8 ,and by now june 8,which is close to 2 months ,as per the processing time the california/vermont centee takes 2 months..

    Receipt date 280th April. Approval 15th May. Mine was under Initial Review for a 15 days and then it directly jumped to Post Decision Activity by the time I saw it.

    Really thanks to god and I am really luckiest person in this world.

    Pls someone give steps to know abut the Initial review to Acceptance stage in H1..
    wat do they check? & Y do they take 2 months to verify? ..

    If i m right,all these steps are going to be done from some agencies/third party..EX: Vermont centre/California centre/any centres ,each may have volume of 10-15K applications.
    Wat would be the max waiting time to hear from them?

    This is fro regular processing/regular quota.

    • My case status is also initial review. And receipt number is 13143XXXXXX .. Can you pls tell me wt is the first 5 digit of yr receive number. And any clue if they r procession all the receipts in sequence of the numbers or not.

Me too still waiting for lottery results..Company not ready to disclose the outcome….Now i have started doubting if the company is secretly revealing the outcome to only those candidates who got selected in lottery…But how will I confirm this?..I have one question..do we need to submit any documents once our application gets selected in lottery..?

  6. Hi All, I haven’t heard anything from my employer regarding my selection in the lottery. First he asked to wait until end of may, but now its june and still i dont hav any news.
    Is there anyone who is still waiting for the lottery result ?

      • I am not waiting for lottery result. but let me tell you this…

        I work for an Indian IT Company. my employer had received the result long time back but they only informed employees on 27th May and still they haven’t given us receipt number citing company policy. so don’t loose hope.

        No news is good news.
        Hope you both get your receipt numbers soon.

        • @Hopes – Yours is a different case. In my case, the employer himself has not heard anything from USCIS. Its nothing to do with the company policy.
          On a different note, Is there anyone else who is sailing in the same boat ? just want to get a rough estimate.

          • Finally, I got news from my employer that my package has been returned back. Fortunately I had a plan B , I got my Australian PR a week ago. So now I can channel my energy completely towards plan B.

            Lottery really sucks!! I feel sorry for all the people who lost in lottery.

          • Finally, I too got news from my employer that my package has been returned back. They received my package back more than 20 days back, but they were disclosed it only on friday that too after continuous follow up with them.
            Now I am feeling some what relieved from knowing my status ( rather than waiting for months with hope ). Now i can plan on my next step.

            If any one of you from CTS – then goto MyVisa portal & check the Expiration flag on your case details – If it is marked in Red, which means that your package returned back & they marked your case as expired (inactive ) to remove from process.

    I applied in REG/PP/VSC and I had the hope that I was in waiting list.
    But my employer told that my package got returned strday afternoon. Im still not able to accept this news. However I have a few questions to saurabh and team:

    My HR told that attorney will take their fees and return the rest to me. Usually how much will be returned to us when we are not selected in the lottery.

    What is the good option for software professional other than USA?

      Depends upon how much the attorney is charging. It can vary from few hundred dollars to few thousands. It would have been better if you could have got the break-up of expenses from them at the time of filing the petition. Still you can ask for the invoice from attorney to know how much they are charging.

    Quick question for you. I already have my approved H-1B petition (arrived yesterday). Currently I am on OPT first year-expiring in February 2014. I wish to leave the country for 3-4 days in July. Since I currently have valid F1 visa, will it affect my travel in any way if I am returning before Oct 1st? Do I need to look into any special thing?

    Kindly advise.

    • H1B Aspirant – Petition Approved,
      You should be fine. Just carry OPT and employment documents and return prior to Oct 1. You will still be on H-1 from Oct 1 based on current COS approval.

      One thing which I am not sure about is how I-94 will work w/ the new automated system. So its better to check w/ your H-1 attorney about it, so that your current I-94 still goes into effect from Oct 1 and is not impacted by your travel.

    • Do not try to go on J1.
      After geting J1, you need to get J1 waiver before filing H1 and I485. Avoid this pain.

            We both are in Regular Quota/Regular Processing (now on L1 with same company)

      • Its means VALCONUSA making fool…. I think they have all the details… How it is possible t hat for three candidate’s result they are waiting. Yesterday they were saying out of 4 cases they are only waiting for 2 results…

          Actually they are not replying to my mails.Ever day iam sending mail to ValconUsa for getting updates. When i called them only they will providing some information’s like two cases are pending ,others packets returned,out of 35 19 got receipts etc ..
          I am not sure they will provide correct information when mailing also.

    Some of the petitions would be marked “wait-listed” by the USCIS and those petitions were also selected under the lottery. These wait-list petitions may possibly replace petitions selected under the lottery for Fiscal Year 2014, but are subsequently denied, withdrawn, or otherwise found ineligible. USCIS will retain these petitions until a decision is made whether they will replace a previously selected petition

      In the link “My” refers to the entity that has filed the petition. So if the employer/attorney has filed it (you can never file it), then they can call USCIS to follow-up on the case. If an individual files a petition (for e.g. COS for dependent etc), then they can call to follow-up on the case.

  24. My L1B and I -94 expiring on June 9, 2013. H1 B is in processing (initial review stage). My current employer is not filing L1B extension, till today he was saying Yes but now giving excuses. What options I have left to stay here at least till Oct 1, as H1 B will be effective after Oct 1st.

    • Tensed,
      You have no options except to file for extension of I-94 for L-1. Another option but a lot trickier is to file COS to B-1 and then file COS back to H-1. However, this can run into issues as you will have multiple COS filed and B-1 is a pure non-immigrant visa unlike H-1 or L-1. You can also leave US and return after getting H-1 visa stamped from a consulate.

      Note that there is a good possibility that USCIS will not approve your H-1 COS as your current I-94 expires prior to Oct 1. In this case, you will have no option but to leave US and return on stamped H-1 visa.

Actually they are saying I am directly reporting to Client manager and not to employer’s manager. unfortunately I don’t have any employer’s manager at my client location. it is single person account.
        If they don’t agree then no luck 🙁

          • Hello Tensed,

            Looks like no, but still, have you ever had any H1B filed earlier; Later than 2007? If no then in that case yours is a first time H1B, and will have to be through lottery process. Also, your L1B dates counts into your current H1B; Meaning, let say your L1B was filed first on 10-June-2010, and if you have stayed for 3 continuous years till 09-June-2013, then probably your H1B when stamped will be for 2 years instead of 3 years, as the maximum amount of period for H1B+L1B is 5 years (if currents status is L1B, else, if current status is H1B then after 5 years you can file for maximum 1 year extension). So, if you are looking to stay in USA, would recommend to file for GC as you comoplete 1 year with your employer sponsoring your H1B. Even if you didnt stay continuously in your tenure of 3 yers of L1B VISA, the amount of period outside USA shall be considerred for extension of H1B after 6 years of VISA period (L1B+H1B). If you want to nullify the effect of L1B+H1B, you have to stay for a year outside USA before you resume on your H1B, meaning exit USA on or before 09-June-2013 and return to USA on or after 10-June-2014.

            Now coming back to your question, NO, you can neither work nor stay in USA with an expired VISA/I-94. I would recommend to save some dollars in bank till and come back on 08-June-2013, and according to your notice period resign and prepare for next onsite assignment. If am not wrong, you might be working for Indian MNC and if you resign from onsite there might be huge expenses (bond amount); remember you need experience letter/certificate for GC, so be patient. And as far as your current investment (Furniture, Cars etc) is considerred, if your new employer is placing you in same city, keep those distributed at your friends place till you come back, else start selling it off. Am not sure, but in case if you have to break to apartment rental lease, then keep those payment receipts handy as you might be able to claim those with you Indian MNC 🙂 ; check with your HR for such policies.

            my first L1 stamped on July 2010, expiring on June 9, 2013.
            This year first time I filed H1 (other employer), picked in lottery and is in Initial stage.
            current emplyoer not file L1 /I-94 extension now.
            Can I take admission in some school and stay back here for 4 months (June to Oct, * if evry thing goes fine with H1) ?

          • Even if you company applies for extension you cant stay in US and move to H1 until and unless you extension gets approved.
            If you want to study then you should move to F1 whih takes around a month or so and it should happen before your I94 expiry, so you have veryless time to make it.

            I thought irrespective of I-94 extension decision (it may take 2-3 months for decision) I can switch to approved H1 after Oct 1, 2013.
            If this is not the case, then even if extension get filed and rejected after oct 1, 2013, then too I need to go for stamping.

            still I am talking to my manager if he can help to file extension. They are going to loose business(current and future) for this one person account by sending me back but due to their fake reputation they can not alter their words. my bad

          • Yes you can go out of US an come back but since you have very less visa validity chaces stand high to not give any I94 extension but you can try your luck.

            You move to H-1 status from Oct 1 only if H-1 is approved w/ COS. Going by the rules, USCIS should approve COS only when they have proof of I-94 continuity until Oct 1. This means, USCIS will need proof of L-1 extension before approving the COS.

            If COS is not approved, then you need to go out of country and enter on stamped H-1 visa.

            Like mentioned by me and earlier, you can stay beyond L-1 I-94 expiration date only if the extension is pending. It’s best to consult your H-1 attorney as well.

          • Hey Hi,

            You can try going to Canada/Mexico and re-enter. You might get lucky to get a I-94 valid for another 3 yrs. I did the same thing, but I wne to India for a short vacation and my attorney gave me a supporting letter in which a request was made to CBP officer and there’s some law by which he requested for a 3 yr extension and the CBP officer accepted that letter and granted me an I-94 valid for another 3 yrs. Although he did mention that when I complete my 5 yrs I should leave US. So from my experience if you have a no option then try doing this and tell your current employer that you would like to stay back in US and work for some more time and allow you to try this option. Hope this helps.

    • Today we got latest updates from VALCON USA.Previously they told they were waiting for three cases to receive.But today they informed it was their mistake ,actually there was four cases.Today they got two packets back and it was rejected.My packet was not there.They told this weekend they got complete updates from USCIS and waiting for two cases.What did your HR told?

  30. My employer just notified me that they received my package back and my application is not selected in lottery. I wanted to make sure he is not lying, as there is no name on NOTICE OF ACTION receipt and fedex receipt that he has emailed me. Is there any way i can find out ?

    In the NOTICE OF ACTION receipt that he emailed Applicant,Receipt Number,Petitioner and all other fields are empty and i dont have any proof that he has applied for my H1.
    Notice Date May 6 2013

    • I traveled last year on OPT (didn’t have H1 approval in-hand at that time) and came back into the country without any issues. I had a job in hand related to my field of study upon my arrival. If you have a job, there shouldn’t be any problem.

    • All depends on when you intend to return back to USA. Assuming you have a work authorization till 31-Aug-2013, I would recommend you to NOT TRAVEL, but since this might be an emmergency which is unavoidable would recommend to return back with atleast a month before expiration.

      Am not sure, but in case you are on CAP-GAP, then the answer would be NO unless you want your H1B denied. As per USCIS, student travelling during CAP-GAP might lead to denial of H1B. Link: https://help.cbp.gov/app/answers/detail/a_id/1246/~/student-travel-during-cap-gap

            It should be ok. Carry documents related to your OPT and OPT employment. I think the DSO marks the OPT card for travel, so check w/ them about that.

            Your travel will not invalidate the H-1 approval. Your H-1 came w/ an I-94 attached at the bottom of 797, correct? Keep that I-94 stub w/ you as it will become effective from Oct 1. Return the one you have in the passport when leaving US. Also consult your attorney for any other precautions or things to keep in mind.

            Agree with Saurabh. Best would be to carry all your documents OPT/EAD/H1B but return by 15-July -2013. When you go to India, just see if you could get your VISA stamped; CONSULT with your employer’s attorney. With documents in hand and proof of employment, you should not have any issue at POE; Since you are returning before your VISA expires and are not in CAP-GAP with valid EAD and employment proof, shoud be good.

      Processing for different petitions can take up to 2-6 months. It has been 2 months since petitions were filed. So still a long way to go for some of them.

    I filled the H1B this year and got selected in the lottery… and I am currently in India and i transferred to different city recently. The questions is about the Passport Address updates … My passport still contain the old address ….. As i am in the new address and plan to make this as my current communication address. Can i apply for the address changes now? Will it make any problem during my H1B visa stamping or what is the best practice?

    • Not a problem. Also do not go for Address change. In india if you are lucky you will get the new passport with new address with in 15 to 20 days or else it may take months. Indian passport system is not good. Police verification and othe rprocess take time. And also on new address police verification they require 2 persons with id. If your neighbour will will not do your verification or for any reason verification is not done properly, you will not get the passport. Only in case of date renewal go for passport renewl and address change otherwise not required. Hope this helps. 🙂

      • It has passed Senate Judiciary Committee.. but it has to pass both full Senate and then followed by House, otherwise the bill will get killed. Long story short it’s very early to count on the bill. Wait till July..

      • First the bill has to be passed, and then it will become effective. If it gets passed by this year end, then it will be effective from next year onwards. Dont hope for any changes this year, as this year quota is over. Any new changes that comes in will be effective in new quota not existing.

        Well, honestly, I hope am wrong, and this bill is effective this year and hope that new quota opens up, but that would be a false dream. Am in the same boat, awaiting!!! But cannot cling to false hopes, so accepted the fact and moved on. But, I do hope that next year quota is more so chances of getting in is more! Amen!

        • Agree w/ ‘H1B Aspirant’ comments. Just want to clarify “year” means fiscal year and not calendar year. So if it becomes law before Oct 1, then it will impact current filings. If not, then it impacts next filings (which start on April 1, 2014).

    Currently, I am on H4 visa and I have my H1B petition pending with USCIS for FY 2014 (H4 to H1 status change). If I leave the country before the petition approval:
    1) Would my complete H1B petition be void or just the change of status application?
    2) If the petition won’t be void, would I be able to enter back on H4 and file for a change of status again?
    3) If I can’t file for a change of status again, I guess I should be able to go back and get it stamped before starting the job after Oct 1, 2013?

    could you please through some light on the rejection rate from the past, i.e. how many applications get rejected by USCIS after the application gets accepted ( in lottery, quota etc),
    is it something substantial and based on luck or if all docs are good than its almost sure ?

    • Almost all.companies by now have recieved the list of candidates selected/rejected in lottery. Now it is up to the HR to publish that list in the company. So u guys should pressurize ur HR to disclose the outcome to u

        • There is an all time hit ..famous medicine to your problem… Threaten to Resign(or actually resign)…
          Even I was getting the same answer from my HR for past many weeks… I used the above medicine and guess what… the list suddenly appeared that same evening(the list was already there with the company…only thing they were reluctant to disclose it) and the outcome was right in my mailbox stating I was selected in lottery 🙂 🙂 🙂
          This is what I mean when I say.. “pressurize ur HR” !!! Hope u got it right….. 😉
