When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  1. Friends my application got selected in lottery and I am from India. Need some info regarding current address change. As 10 days back i have changed my current correspondence address. How can I change the address that I am currently residing with USCIS. And also does this impact my backgroud verification that USCIS is doing for approval of any application.

  2. Hi All, Request to help on this Issue, Please…

    Right now iam on H4 and i have applied for H1 visa and still not received any receipt.

    But on other hand i have got job offer (Permanent Job) from US company and they are ready to sponsor for working visa. but as they are recruiting first time other than US citizen candidate, they don’t know which visa they have to do for me.

    As we know this year H1 visa quota is over, do any one know, is there any other visa through which i can work.

      H-1 is the only work visa as you are not eligible for L-1. Do you foresee your husband receiving EAD soon (if his GC has been filed)?

          Do you satisfy the following L-1 requirements:
          – worked for that employer for at least 1 year outside US in the past 3 years
          – work on employer proprietary tools/technology/skills/applications which are not known outside the employer

            Question on L1 individual.
            Is is tough as like L1 blanket? I have 3 yrs exp and not really specialized/expert skills though. How long will it take for L1 individual to process? What is the % that I will get approved? Can I do/prepare something to clear the interview? Your views would be helpful!!

            I don’t know about J-1 requirements but I do know it at times carries a mandatory 2 year stay in home country after completing the course/training (one can apply for waiver w/ USCIS though).

            L-1 individual is easier that L-1 blanket but you still need to satisfy the requirements. Talk to your employer is you have the necessary skills to qualify for it. As you are in US, you may be able to file COS and don’t need to go for stamping as long as you are inside US.

            Another option, your spouse moves to L-1, you move to L-2 and get the EAD.

          • Thanks Saurabh!! I work at MNC in India and not married. My H1B some how missed but my employer suggested for L1 Individual, so I am in dilema to wait for L1 Indvidual to process or to jump other company.
            I have some questions.
            1. How long does it take for a interview call after filing L1 individual? I know L1B takes lesser time but what about L1 Individual.
            2. What is the % that my L1 indivdual get approve if I dont have any special skills to explain.
            3. Is L1 individual for 3 years exp likely to get approved?
            4. What can i do to increase my chances to clear L1 Individual?
            5. If i get rejected for L1Individual, will it affect my future L1’s?

            1. L-1 processing can take few months and then you can appear for stamping.
            2. Chances are very less if your job doesn’t satisfy L-1 terms
            3. It’s not an important factor. What’s important is what kind of job you will be doing in US on L-1
            4. Satisfy L-1 requirements
            5. Not really if the rejection is not related to submission of false documents/information

  3. Hello Saurab/All,
    I was asked by employer to submit the required documents for H1B and many others. Now after lottery my manager says that I was not selected in the lottery. There were 20 applied but only 2 got selected so far. We suspect whether the employer has FILED OUR PETITIONS to USCIS. When asked, my manager said that he had filed my application but refused to give any reference/receipt number. I called USCIS as well, but they also require receipt number to check the info. I think 2 out of 20 is impossible in lottery. I suspect my employer that he had not even filed my H1B. How to know whether he had FILED my application or not? Please anyone can share their views that would be useful for me.

    • Katrina- Please Help!!!,
      If you didn’t make through the lottery, then USCIS will return the package along w/ a letter stating that you didn’t make through the lottery. Ask for copies of those documents. Ask for copy of LCA and filed I-129. It is possible that they completed these documents and still didn’t file the H-1, but it can still be used as a test.

      Did you pay anything for the H-1 filing? If yes, then how much did you pay and what did your employer return?

      • Saurab, If i am not throught the lottery, whether the I-129 form will show the applicant name on it. Please let me know. The shared I-129 form doesn’t show my name on it. Thanks in advance.

          I-129 is the form employer files w/ USCIS as part of H-1 filing process. It will contain your name. Did the employer share the entire I-129 form or just part of it?

          Irrespective of whether one made through lottery or not, I-129 would have been filed w/ your name. The ones who made through the lottery will receive 797C form which will have the receipt number or petition number.

          • Saurabh, All the employer shared is only the USCIS rejection letter (it indicating not selected in lottery message). do we find the name on the USCIS rejection letter. Pls help.

            I don’t know if rejection letter has those details or not. You can check w/ others who have received the letter back. Did you pay for H-1? If yes, then how much is employer keeping and returning?

        I work in MNC in INDIA. I did not pay anything. I asked my manager/company immigrations team to share the docs/file number if any but they refused to share anything. I tried my best to get something. They say its company policy to not share these information with employees. I and others doubt whether my manager/immigrations had filed out petition or not. Ofcourse 2/20 is possible butwe suspect a lot. Is there a way still to find out real story whether our petition had been filed or not? At least small ways any?

    • Ask for LCA. Most of the LCA’s are filed electronically by the employers. And then Labor department sends back the certified LCA to the employer or attorney. There is this web site

      Here you can check the status of your LCA.
      If your employer don’t wanna to give u that, then most probably he did not file. Since it’s required by law to give employee a copy of LCA. My employer did give me that copy.

  4. Question for Saurabh.

    Saurabh,
    I had a H1 denied last year. Now this year, my employer has applied for H1. During the filing process, I provided them all the information about the previous denial.

    My question is, if in case my attorney has missed capturing the previous denial information in the petition filed with USCIS, how it will impact my case. Will USCIS issue RFE for this missing information or they will deny the case?

    Note: I do not have direct access to the attorney to ask whether they correctly captured it or not.

    Your help is highly appreciated.

      I don’t think it will be an issue. They would know about the previous history. BTW, when you say denial, are you referring to denial during petition processing stage? If that was related to reasons attributed to your old employer, then it usually doesn’t impact the new processing.

    Today my employer got response Attorney. There are 3 interesting points, thought sharing extract of the email in this forum will benefit others.

    1)Not yet received receipt or pack. USCIS has indicated it could be as late as mid-June.

    2)There is also a good possibility that the proposed immigration reform would result in a large increase in visas-enough to secure one for him

    3)There might be one or two other options available

    I am fine with 1st point, but not very sure about 2 and 3. I thought the proposed immigration reform will be applicable only for year. Also apart from H1B, what other options do we have? I have 10+ yrs experience and possess niche skill set (my guess is that not more than 1000 people in the world has that kind of skill set ).

    Your opinions and comments would be greatly appreciated!

      2. A LOT needs to be done before the immigration reform can be passed. The latest news today was that House has theoretically agreed on the reform. But this bill is different from the one proposed in the Senate. So still a long way to go before both are approved and reconciled.
      3. I don’t know what he was referring to. Maybe higher studies. L-1 may not be an option if you haven’t worked for them outside US in the past 3 years. You can ask the attorney to elaborate.

    My H1B application got selected in lottery. However there was an issue. My last name was misspelled. I contacted my employer they sent a mail to USCIS. How log it will take to get update in the system? What is the procedure?

      You may not know until approval whether the name has been corrected or not. Your employer can follow-up after sometime. If the name doesn’t get corrected, then your employer will have to file H-1 amendment once the petition gets approved.

  11. I have a question. as per USCIS they will select only 65000 applications. I am sure all the 65000 applications will not be approved. so there will be some slots which will be wasted. in case for example we assume 5000 applications were rejected then will it be considered as only 60000 applications picked and approved or will they will have some applications in queue which they will not return the package until the 65000 count is met? can someone please answer this?

      Yes they will keep some application in Q to meet 65k criteria.

      and Generally if after that also some slots are open say 2 k then it get transfer to next year quota e.g if this year after accepting application from waiting list if 2k are still left to ful fill quota then next year quota will be 65+2 = 67k.:)

        Unused quota from 78.2k does not transfer to next year. Only the singapore/chile 6800 unused quota is transferred to general quota for next year.

    2. ITU…CPT First Day( California)

    3. Gold Beacom …. CPT First day ( Delaware)

    4. KSI ….CPT First day( Chicago)

    5. Infoserve ….Dont know ( NY)

    6.Globe ….Dont know ( minneapolis)

    7. UNVA….After one sem CPT ( virginia)

    8. Stratford…..After 1st sem i guess but please call them ( Virginia)

      Before going this route, do some thorough research:
      – CPT can be issued only if it is really related to the program. Diploma mills abuse this system. So do not use CPT if it is not integrally required by your program
      – If you do AD in such schools, you will be eligible for Masters quota only if the school is non-profit. Most of these are for-profit schools and do not qualify one for AD cap
      – USCIS and ICE have cracked-down on such schools in the past (read about TVU). If your school is closed down, you may or may not get the chance to transfer to another school.

      If you end up in one of such nonsense schools, then remember not to play the victim card as this would have been a conscious decision on your part.

        You are right but we already did one of the masters from good universities in USA. That master can be consider for CAP next year. SEE… anyway our luck is too bad… what worst can haapen now…. so this is another gamble…. 2 of my friends is currently doing masters from KSI(Chicago) and Sullivian university.. they were in the same situation last year… but they got there H1-B approved last week….. SO IT IS ANOTHER LOTTERY FOR US…. we have to take chances now…. we have no option.. ( return to india is there but still)….

          Usually when people are desperate they often do mistakes. If a person thinks that this is the only option, then its their discretion. By my previous post, I wanted everyone to be aware of the consequences they may face in future.

          I still remember everyone playing victim card after TVU shutdown, even those there was a member who was repeatedly telling them to stay away from that university on trackit.

            I don’t know this school, so can’t comment on it. If they are offering CPT from day 1 and that’s their USP, then my original general comments apply to this school as well (in my opinion).

      I do agree with him ,even i planned to do CPT which did looked like a good backup plan for me .but I realize its it would be a mistake.

      3.Even if i get approved for h1b next year , Visa officer will cleary know my intentions and there are high chances of denying VISA .
      4.once i get denied for that reason (abuse) , i dont think i will be ever get issued any type of usa visa ever.

      Its a big risk , the above points are my opinion . sorry if that hurts

  16. Hi Guys, i am following this forum for my wife h1-b but still we did not receive neither receipt nor packet back.
    But mean while i applied for my h1-b “Extension”. I got receipt #EAC1315450374 , my Attorney send it on 20th April. I can see that entered on April 23, 2013. when i checked one random receipt -EAC1315450369 which is received before mine that entered date was May 8, 2013. so how it is possible? but this is true. so we can’t say anything unless and until we hear from uscis via email or mail.

      The other petition is in RFE which was issued on May 8. It didn’t say that the petition was entered into system on May 8. Does that clarify?

        So this is wrong to assume display date is entered date. Again Thanks.

          That’s I-192 form. I don’t know how their logic works and what steps they follow during various stages. Can you point an I-129 example which works against the logic?

          • @Difficult to Understand – Both of them were entered on may 6th. They might be cap exempt applications which were received on different days but entered into the system on may 6th.
            The delay could be due to processing of high volume of h1b cap applications

            My guess would be this!

          • @SRB, That’s true, also it’s difficult to say , it is for either h1 or h4.

          • @ Difficult to understand: Display date is the date they received the application. It is not date when they entered the application details into the system.
            Sometimes date they received application might match the date when they entered the application details into the system.

    For the people who are rejected — wanted to know what are their plans now?
    Is there any other visa type that we can think of ?
    Or should we get back to studies and which university allows a shorter duration course or some shortcut plan ?

    • Nopes there arent any receipts generated.
      On 6th May all the rejections were sent in.

      So people will receive them max by today

      • @ nopes: If you have half knowledge keep that half knowledge with yourself but don’t give statements that panic others. May 6th is not the last date of all packets return. I have got my receipt on may 9th and still there is some hope for those who are waiting for their receipts.

  19. Just want to know that once you recieved a receipt number, is it still subject for lottery or I am already included in the 65,000 quota. Once your case is processed by uscis and fortunately you are approved,do you mean that we are still undergo by lottery or no more. For clarification only.

    • @Alfred: Once you get a receipt with receipt number on it, it means you are selected in the lottery . You do not have to worry about lottery at any stage after that.

  20. Employer is saying that my COS H1B (RP\RQ) application was sent to USCIS . However they have not heard from USCIS on my case.

  22. Hey All… Still there are hopes…

    This is to inform you that we are still awaiting the lottery status of your H1b application from USCIS . Though we started receiving the receipt for couple of cases, your case is still pending with USCIS. Since the lottery status is announced only in batches and as per USCIS we need to wait until July/August 2013 for an appropriate update. We will keep you posted on the status of lottery during July/August month or early (provided we have an update from USCIS) whether your application has been accepted in the lottery. Please note there will be no further status updates from our side unless we hear from USCIS.

      That’s a pretty long shot. Packages have already been started returning and asking for time till July/Aug seem improbable. I suggest working on Plan B now.

        It might be true. As their cases may be considered in waiting list which supposed to get clear by July/August.

          When did USCIS say that one needs to wait until July/August (as per original message). If the OP is posting something his/her employer got from USCIS, then there are other people in the blog who received conflicting information from USCIS ranging from data entry is over to wait until May end. So let’s not rely on what USCIS representatives are telling on the phone.

          Now if we consider that each rejected petition is replaced w/ a wait-listed petition, then there will be petitions pending for a year. Let’s assume a worst case scenario for a petition – petition remains pending for several months, then RFE is issued and finally it is approved. The person then appears for stamping and 221g is issued. After several months, it is denied and petition sent back to USCIS. USCIS re-evaluates the petition and finally decides to revoke it. One cap number becomes available and to accomodate for this a petition would have to remain pending for more than a year. Waiting till July/Aug means all petitions will be adjudicated by that month, which is not possible. So I have serious doubts about this time frame.

          Next, where does it say that lottery status is made available in batches. Their first responsibility is to inform people who made through the lottery and then inform others who didn’t. Now that people have started receiving their petitions back, it is time for plan B. One can remain optimistic until the petition is received back, but it will getting less realistic w/ each passing day.

          Just my opinion.

          • Yes agree with your thoughts but package is not return yet so I think we can wait till package is returned…this reply has come from MNC, I am not sure how much reality is there…. may be it is possible that they are keeping people on hold with giving some time line so that people not started working on plan B

          • Got an email on 15-May that there is no status update on my petition from USCIS, need to wait till July/August. Most of them have got email that their petitions are selected in lottery.

          • Accenture is yet to announce the results formally. Noone from my project here in the US have received an update. We should know by tomorrow.

          • Just got a confirmation from our onshore manager that the list shared with offshore manager doesn’t have any ours project members name:(. Is RMS sending by batches?

          • acc318 – Accenture will announce all the results together to avoid people speculating their results. Hence its taking so much time. I dont think lists are sent in batches. May be they just shared the list for offshore with your offshore manager. Which city / state are you in the US ?

          • Accenture’s US attorneys have said to wait till this month end (May31) So there are chances to get notification for some more petitions.
            And apart from it what I understood that many people has communicated to wait till July/August so their petition might be considered in waiting list.

          • I get this information from Mobility team. He told me this on May 15th noon and evening we received communication.
            So don’t know whether his information correct or not.

          • Raised a request to pmsd. They confirmed the lottery selection, but haven’t received any email yet

            I guess people hav either got an selection mail or a mail saying their case is pending with USCIS.

    • Yes….AIMS is updated with the Receipt notice on Monday. Also the GI helpdesk confirmed me on thursday last week. Still the receipts are coming. So keep ur hopes high, I ams ure u will get it!!!!

            try this number with area code 33554639 .When I tried during day time of IST none answered my call but when i tried in PST or after 9 pm IST the call got connected. Check just out 🙂

    My case status changed to RFE on May 1 st. then on 9th it said we mailed the RFE letter.
    Does it mean there are two RFE ? Or they just sent the first one late?

    And when it suppose for me to receive it? it is really frustrating :S

      Don’t get panic!

      They will not send multiple RFEs at a time as you confused. During initial review itself they will find out if they need any additional documents to process your case and send an RFE (Either 1 or more than one documents requested) on your mailing address. They will send again another RFE if and only your response to the first time was not fully met the requirement in the RFE that you have responded to. So wait for the RFE to come and respond it properly.

    I have been following this forum form day 01 . I do have Master degree and have currently 10+yr IT exp. My current visa is L1B and getting exp on Nov 13 . Have applied H1 but no news yet (reg,PP,VSC).

    My hubby is on H1 and he will stay next 3 yr in US and his GC already in process.

    For me going back to India is not at all possible and continuing my job from India too mean staying away form my family and that too not sure when i will get H1 again.

    I need really some help on F1 visa on califernia. Also when can I get work permit if I get F1 visa. Any help will be appreciated.

I myself got rejected. I am in the US since 2005 and ever since have been trying to get settled down. But no luck. So GOD is great.

  34. My wife got this message for her H4 to H1B COS. Status is in Initial review and the message is “your Alien Registration Number was changed relating to your I 129”. Her application was selected in lottery this year and we got the receipt on May 9th. but the message says “On April 25, 2013, your Alien Registration Number was changed relating to your I 129, PETITION FOR A NONIMMIGRANT WORKER”. so this message is from the starting itself. Anyone got answers for this sentence?

      If you didn’t travel outside of US recently, then ask your attorney to follow-up w/ USCIS if the status message doesn’t change automatically to something else.

  35. My H1B got rejected. Now I am in a bad situation. I am still on OPT for three more months. Does anyone have any idea, what to do now.
    Are there any CPT Schools where i can go once or may be twice a month and keep my CPT????

            USCIS sent the packet back in C/O the attorney on the 6th of May and he got it yesterday on the 14th of May and he sent me the email, the same day yesterday. Yes the letter was dated. The petition had ‘received’ stamp of 1st of April also.

          • Yes, this is almost what he told me, i am a little confused if he meant USCIS will dispatch information by 15th May or the petitioner will receive it by then, because it should be difficult for him to give the latter date.

            But he definitely mentioned that either receipts or returned package by 15th May

    I have a query related to my H1b and dependents H4 visa. As of now me and my dependents visa is getting expired on 30th Sep 2013. We are planning to travel in the first week of June. Considering I file for my H1B visa extension upon reaching USA.

    1. Do I need atleast one pay stub before I can apply for extension or paystub is not required?

    2. In case I file for my extension, then can my dependents travel back to India while the extension process is on and approval notice is awaited?
