When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  2. My son had already received his receipt number and waiting for the decision of USIS whether it is approved or rejected. Actually, my son came to America as tourist visitor and was granted by the immigration to stay up to six (6) months or it will end August 2, 2013. My problem is what to do when his HIB has no decision yet on August 2, 2013, will my son return to our country or will ask some extension from the immigration. How many months will it take to process the HIB. My son applied last April 1, 2013 and received his receipt number on the last week of april/13. please help me what to do?

      • It will be illegal to stay in US until Oct 1st though his H1B gets approved. Your son may have to leave US immediate after his I94 expires and get his H1 VISA stamped and come to US if his H1B is approved

    I got selected in the lottery.But at the time of applying H1b ,i did nt send the degree certificate.After 15 days I submitted the degree certificate to employer.Does this leads to RFE?

    My h1b filed for 2014 cap and my status says: your alien registration number changed for i129 for non immigrants worker. It is L to H COS but i don’t understand this alien number. Can you pls help me to understand this?

  7. I called USCIS today and after waiting for an hour, he checked my status in the system. I was not on the “system”, not sure what exactly it means. So, i asked if it means i am not selected in lottery and the answer was no it does not mean that. He said by 15th may your petitioner would either get the receipt or the package returned. Not sure if he meant that receipt would be generated till 15th or not.

    If someone else also got a similar reply, please share the same

        Last name
        First name
        Date of Birth
        Company name

        Also the IVR prompted me for the EIN(employee identification number) before i could talk to the representative.

    My h1b was filed with RQ/RP/VSC. But h4 has same regular message. like received I539 application.

      So if I don’t reply (that too within a day), I am not given the benefit of doubt that I might be busy w/ my real life, but assumed that the answer is not known. Hmmm interesting!

      Anyways, here is the answer to your question. This message typically comes up when the person has traveled outside US while the petition was pending. If that is not the case, then it should be an error and your attorney should follow-up w/ USCIS.

    Unfortunately, my application was not selected in the Lottery process this year. I am an Indian resident working from Mexico currently as I dont have the USA work Visa. Can I apply for L1B from Mexico and get the stamping here itself instead of travelling to India? I have heard that the stamping should be from the Home country. Please let me know.

    • You can get stamping from Mexico. Many people do this. Only reason why people hesitate to get it from Mexico/canada is if it takes longer (4-5weeks) for security check then it is not affordable to stay there. But because you are living in Mexico it is better for you.

    • It covers new petitions for H-1B, H-1C, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1.

      This is my understanding though !

  13. Hi, I got my receipt notice number WAC-13-135-51XXX, and its current status is Approved. This was filed by Employer A. Now I got an offer from Employer B, who is giving a better pay and also willing to file my GC at their cost, hence would like to know, will it be possible now to switch to Employer B ? Am currently in India, and had filed through Employer A for this year quota; This is the first time I had applied for H1B. Also, am yet to get the VISA stamped.

    What are my options?

        • @A and @DK, GC will be processed once am in USA working for Employer B. Usually Employers (direct positions) charge the attorney fees and some extra fees for processing GC which is nearly $6000-$8000, else the GC processing expenses are shared in a ratio, mutually agreed by the employee and the contracting agency. In my case Employer B is a direct hire. For me this fees will be waived off, if I join Employer B, alongwith slightly higher salary.

            Hi, i am on H1-b and working on h1 since last 4 yrs. this blog i am following for my wife’s h1-b. What about your employer’s company size? here is so many “Desi” employers . If it is direct client and client wants to file your GC then good. but employer offered then you have to think.

            GC Cost is not more than 10000$ with attorney fees. you have to pay all money in time interval. but once you start your GC process with employer then it is not advisable to change employer before getting I-140 approval, ideally till i-140 process will take 1.5 yrs. so i advise you first come to USA , work with your employer few months they you know the how your employer then you take decision , once you are here then you can find easily full time offer as well as big employer .

          • @DK Thanks for your response. Yes, I agree with you. I have a fresh H1 for first time with no prior history, so am good for next 6 years (assuming normal extension is approved). But, still my dilemna remains: Do I have the option to switch to Employer B now, considerring my H1B petition is approved for Employer A, and yet to get VISA stamped and yet to start working with Employer A while am in India ? How to make this possible?

            I am not sure, as per my knowledge you have to transfer your h1-b with one employer to another then you need last 3 paystubs. because on your h1-b visa stamp , there is your employer name. so again i told you , come here look at in to market for better employer and company. i don’t know how much your employer is going to give but every “Desi” employer have 30 to 40% cut in your hourly billing. for your information, if you have actual 5 yrs experience and good employer who has direct client then you should get mimimum 70,000$ salary per anum.

    • Don’t forget that you have got your H1 by your employer A, follow some ethics and stay with your employer A only. It is not recommended in switching to other employers very frequently.

I understand your concern, but honestly, once you cross the line of getting selected in H1B lotterry and petition getting approved, one starts thinking for better option; Am a normal human, and thinking towards betterment is just humae nature, am not justifying my intent.

        I think with responses so far and from discussing with my colleagues and friends in USA, I feel that it would be a wise decision to first get H1B stamped, enter USA and work there for couple of months, get an overview of how things work, then go ahead with switch if its a feasible thing. Majorly this desicion is based on suggesstion that its very very difficult to enter USA if there’s any issue with H1B stamping, but once its approved and stamped and you have few months of work ex, it becomes very very easy to switch while in USA.

  15. Its irritating really ! I got info that my petition has been selected about 10 days back but there has been no update yet in AIMS. Called up the helpdesk but I guess they have stopped taking calls now. God knows when this update is going to happen!

    Hi, This is Siva from TCS. I have Selected in Lottery. Got an email.
    They are releasing the Lists on weekly basis it seems.
    Till now 3 lists are announced & there are 2 more lists are there. Dont worry.
    This is correct information.
    Please wait until the end of June.
    Dont forget that in 2008, when H1s are closed on April 1st only &
    RQ receipts are generated till June 2nd.
    So, there are more coming.

    • It seems that TCS people got selected .. If you apply 5000 then as per 60% selection.. 3000 will be selected.. So huge people from TCS, Infy, HCL etc.

      IBM is a US company. Still there is no news of selection. Its surprising!!

      Case managers have already started sending receipts… two of my friends got the rcpt#s 2week and 1 week ago and both on Friday. I am not sure if they are sending mails only on Friday or on particular days of week.
      BUT YES CMs have already sent receipts for many…

    I had applied for a H1B with my employer based in CA.
    REG/NP/ CSC
    Application arrived at USCIS at 9.15 on April 1st by fedex.
    My application was returned today (unopened) to company lawyer, the letter from USCIS only detailed that there was a computed generated lottery and my application was not among those randomly selected for processing and inviting me to apply next year for FY1015,

  22. I just spoke to my Friend who works in California. He said his law firm just recived 15 packets back in Brown Priority envelops with rejection letters. I asked him to scan one and share it with me. I am still waiting as of today still no application sent back. Good Luck all.

  23. Hello Everyone, I received a notification from my employer that they received my receipt number. I tracked online using my EAC #.

    Today they updated my case and wrote the following:

    Initial Review

    On May 13, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.

    During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant’s/petitioner’s criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

    If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.

    first raise question about ” when will we get receipt number” , After receiving receipt # , question is “how long it will take to approve h1 ” and now question is Is “it possible for me to change employer before October, 2013″ . and in feature they ask ” do you guys know how long it will take to get Green Card, i bored with employer, he will take more percentage from my billing”

    • Same here. AD/RP/VSC. Still waiting for the attorney to contact me if they get any return package. Finished my degree here and finally find a company that is willing to sponsor, then this. Life is tough, I started prepare for plan B, and I keep wondering if I made the right choice to stay in US… 🙁
      Any my boss is even more depressed than me. The company did so much for me, and that’s how it ends.

      • its not the end. if the company already invested in you alot, why dont ask him to sponsor green card. Mine got rejected today, but my company proceed green card and H1B as the same time. I didnt make it thru lottery but Im waiting for green card. Talk to your employer. Dont lose hope

          • Jenny, I dont think this is possible, you have to be on H1b status to even apply for GC. I think your employer has given you wrong information. if that was the case why would anyone even apply for H1b rather just apply for GC.

        • Jenny, how can you jump from F-1 to GC? I asked my employer and he told me that F-1 is a non-immigrant status and he cant apply for GC unless I have H-1?

        • You don’t get a rejection notice, just a letter explaining that there was a lottery (who knew??) and that your application was not one of the randomly selected applications. It also details the FY2015 dates etc.

          • That is called a notice of action (a.k.a notice) from USCIS. It does not have to bear a notice number.

        I really appologize if you guys were hurt by this action of mine. But FYI I have seen a lot of people commenting here about their approvals .

        And also please stop the F****** words use here. I also know these words and much more than these words. It is no ones fault if you are still waiting for your results. Life is like that and try to accept how life comes to you. If you cannot handle seeing people get their approvals and acknowledge this fact…..you better not open this forum and try concentrating on your future.

      @Harry, I believe you can transfer the petition, I know couple of my frn had done the same but get the h1b documents before hand from your employer (like petition and other docs) . This is just my opinion

    Hi, I have a question. I was on H4 and applied for H1b for 2014. The application got approved. I live in CA and my H1 has been approved from IL.. Now I have another job offer from an employer in CA. So my question is if I can apply for an H1B transfer without working for the initial H1B. Is it legal to do so.

    And one more question…..Can I apply for a Social security number now ( my start date is october 1st )……..so will they give me Social security number based on my approval right away or do I have to wait till October for that.

      • What did you get with that package? There should have been some sort of notice attached and if you can share that information, we can validate your statement.

        I am not trying to provoke anyone here but a lot of people are posting false statements about “package returns” just to gain jolly of everyone else’s misery.

  36. I am also waiting RQ/RP…………… My petition was filled by VALCONUSA company….
    Whenever I called him they always say for waiting….

    Dont know what is going to happen……….

    • I am also waiting..RP/RQ/Vermont…I am from India but my company filed from the US. Whenever I try to contact, they respond with only one reply “WAIT”..Is the lottery process complete? I don’t find any positive posts past 1 week. Any idea. Plz respond.
