When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

Also, typically USCIS sets aside 6,800 visas  for Singapore and Chile Free Trade agreement filings, which is H1B1 Program. Also, read article All about H1B Caps – Basics Calculations, Lottery

 

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  2. Can any one ,based on the last receipt received can predict , How many application would have been processed ? Instead of Posting their receipt number , at least some guess on how much is already processed .

    • Just predicted , daily on average of 2900 applications are processed by combining both EAC and WAC centers . If the Regular processing started after premium processing ,i,e after 15-april-2013 , it expected close any time before 22 May 2013 , in worst case extended up to another Week. Till that …….. huh

    This is the status when I checked in USCIS.
    Initial Review

    On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

    So, friends don’t loose hope. We are still getting receipts.

    I have a differnt kind of problem here.

    It appears my employer mistakenly filed two petitions for me. Both are RP/RQ,one was to california and another to vermont.The worst thing is both of my petitions got delected in lotterly and got two recipt numbers WAC*** and EAC***.

    My question is will USCIS reject both of the petions or will the just reject one?

      People are crying for their receipts to come and you have applied with 2 Employers. Not fair bro…

        • If they will get to know (about two petitions from same employer) at the processing stage, they will reject both. They are strict about this. So, request your employer to withdarw one of the applications ASAP. USCIS has clearly mentioned that if the same employer has filed duplicate petitions, the will reject both and forfiet the fee.

          However knowing the rule, no employer won’t file duplicate two petitions for same employee. So, it seems that your employer is either a dumb or fool.

    • If you filed two petitions through different employers, then no problem. But if the same employer filed it twice, this is what will happen:
      . To ensure fair and orderly distribution of available H-1B visas, USCIS will deny or revoke multiple or duplicative petitions filed by an employer for the same H-1B worker and will not refund the filing fees submitted with multiple or duplicative petitions

    • AFAIK, this cannot happen.
      they already have mechanism in place to detect if one applicant is submitting duplicate applications from SAME employer irrespective of application centre.
      May be you should double check whether your employer has given you 2 receipt numbers by mistake!!

          • My employer forwarded me both the reciept forms I-797C and the petitions I-29 they submitted.I can see both the I-29 was addressed to Vermont.But the blunder was they sent one to vermont and another one to california. I don’t understand why USCIS provided reciept number for the petition sent to california as it was addressed to vermont.And my employer told they will withdraw the petition filed at california WAC**** and they told there will be no issue on the petition filed at vermont with reciept# EAC***.

      How can that be a mistake? Your employer and attorney should know this basic rule about duplicate filing. If both end up getting rejected (which looks like the case), then only your employer/attorney are to be blamed for this mess.

    I completed Bachelor of enginnering in computer science in 2012.I joined to a top MNC in august 2012.I apllied to H1B 2014 .I got selected in lottery.My client has no problem with me. So , my questions are,

    1) what are my chances of accepting visa with this much of experience(nearly one year)?

    2) Do you have any instances where in freshers or less experienced got h1b?

    I’ve been a silent observer since April 1st, but I think I can contribute today.

    Category: AD/RP/VSC
    Application arrival date: 4/1/2013
    OPT expiration date: 6/28/2013
    – No STEM available for me
    – No receipt as of 5/8/2013
    – No SEVIS update as of 5/6/2013
    – Check has not been cashed as of 5/7/2013

    Today, I called USCIS with my firm’s HR manager on the other line. To sum up, the representative told us that
    – No receipt number for me as the data entry for me was not done yet
    – USCIS is not done with processing and sending out receipts
    – There is no hard deadline on data entry
    I personally believe her story as she was able to locate the receipt numbers for my co-workers who have already got the receipts (all regular processing).

    After this call, we asked our lawyer to contact USCIS. A few hours later, he got back and told us that USCIS also told him that it is not done with data entry.

    Let’s keep our hopes alive!!!

    • I live in Vermont. Even I got the same reply from VSC. It will take 1-3 weeks to send all the receipts to the lottery winners.

        @RBSC: “No receipt number for me as the data entry for me was not done yet”. Does this mean you are definitely not picked in lottery(hopefully that is not the case at all) or does it mean that USCIS has not made “data entry” for all the selected petitions yet? What did you conclude from your discussion

          She could not tell whether my petition was selected or not.

          The way she put it was that USCIS has some kind of database – operator inputs the names of petitioner and beneficiary, then the system spits out receipt number if it has already been entered. When she entered my info, the system came back with nothing. She said this does not mean my petition was not selected through lottery, because they are not done with entering all receipt numbers.

  12. I did get an confirmation from my Attorney that my application was filed on April 1st 2013. USCIS had an

    My company’s attorney did file my H1B and I did hear back saying that my “I129 PETITION FOR A NONIMMIGRANT WORKER” was received by USCIS on April 8, 2013 and is currently under the “Initial Review” phase.

    What’s next? I am currently under OPT (expiring in 1month) and do have an option of extending my OPT under STEMS but, was not sure if I needed to do that.

    Also, I did contact my School representative and she says that she looked into my record and is not seeing the H1B application which is usually what is reflected into one’s record. I am confused.

      • Hi BMN,

        Usually your sevis should be updated if your application got picked ,in your case its not updated yet if u have a copy of your receipt send a copy to your school and ask them to check with uscis.As your currently under opt and your h1 in processing you will be automatically in cap-gap so no issues with your status until a decision is made.

    And this individual is a RP/RQ.
    This may indicate that RP is over now.

    Can we have more people post their returned package honestly.

    Do we have anyone in AD with package returned due to non selection in lottery.

    • RK, It looks your H1B application package sent back to your employer/attorney by USCIS. Normally, who’s applications not get selected in the lottery system…. those applications will sent back to employer/attorney.

    Rejections are also another factor which we all should consider to increase waiting time for more cases to be considered. Also it has been heard that Indian companies can face highe rejections in visa’s + General rejections. Can any one help all of us – what could be anticipated rejections this year ???

    I have received my receipt a week back. Will the petitions be denied in Initial review stage itself? If so, what could be the possible reasons. For ex: Issuing an RFE and rejecting/ denying could be a possiblity but in intital review how could a rejection happen possibly?

  21. I was checking randomly the receipt numbers today and do not see any I129 PETITION for received date 8th april but do see some PP with message as “On May 7, 2013, the 15-day premium processing clock started on your I129,PETITION FOR A NONIMMIGRANT WORKER.” .
    Keep finger crossed, hope all waiting people (AD\REG, PP\non-PP) who are waiting here in this forum as me should get.

    • At this point, they have entered everyone into the database.

      However entering in the database and adjudication are two different stages.

      Patience is pivotal to maintain your sanity.

    • The May 7 around dated petitions should be typically of those who might have converted their regular processing into Premium processing. The Regular Processing candidates can go for Premium Processing only when they have received the Receipt number.

      The applications for H1B visa for FY14 began in April, and within a week they touched 65,000 As per the initial data that has been collected, the H1B visa rejection rate for Indian IT companies has touched 60 percent, the highest that it has ever touched.

      The issue of H1B visa rejection has been on and the industry body The National Association of Software and Services Companies (Nasscom) has been taking it up since some time.

        This is a news which is more to generate sensation than to present the facts. Petitions are still processing and they have already treated the denial rate as 60%. What’s their source? What’s their sample data? But unless they quote a number like 60% who will read/listen to their news channel?

    Have been following this forum since 8th April 2013.finally after a month,lawyer informed me that she received my receipt today( 7th may 2013). I am yet to get a scanned copy of my receipt.Thank you GOD !! Next i have to wait for the approval.

    • Today is pretty much the last day for anyone to still receive a receipt notice. USCIS just started working on returning the packages for the unlucky ones, and this is expected to take about a month to finish (in comparison, it took USCIS almost 2 months to finish notifying H-1 lottery winners.)

      • Where are you even getting this information from? People have been saying for days, “oh this is the last day”, but then look.. There are people again today on the 7th receiving receipts. Honestly, unless you have some factually based source you’re getting this from, all you’re doing it freaking out everyone that hasn’t had a receipt and it’s not helping.

        • There is no contradiction between my May 7 posting “[t]oday is pretty much the last day for anyone to still receive a receipt notice” and your statement “[t]here are people again today on the 7th receiving receipts.” Thur May 2 was the last day when the receipt notices were still being sent out, and it’s USPS standard to have mails delivered within 3 business days; hence Tue May 7 was the last day for anyone to still receive a notice. In fact, the few May 7 morning postings of receipt notices almost surely were received on May 6 or earlier. The unlucky ones, this is not the end of the world, and you just need to accept the reality and make plans accordingly.

    I just received a call from my employer who informed me that they have received my receipt number. I am so happy 🙂

    I actually applied in Masters quota with premium processing through Vermont service center – my company’s legal team messed it up and forogt to sign on premium processing paper due to which USCIS returned my premium processing check and considered my case as regular processing. Yesterday – legal team signed the paper and sent it back to USCIS – hopefully will get the decision in 10 days or so.

    A quick question – I asked my employer to give my receipt number but she was reluctant and said since you have waited so long, you should wait for another 10 days for the decision to come. Is this even legal practise of not giving consultant’s receipt number to the consultant himself?

    Is there any other way I can get my receipt number? Would my DSO be able to give it to me?

    • For H-1, employer is petitioner and attorney is representing the employer. You are the beneficiary of the petition and the attorney has no obligation to tell you anything. Employer should have received a copy of the receipt notice and you may ask for a copy from your employer.

    How normal is RFE in L1 to H1 COS request ? Little surprised that my RP application has a status change really fast. Got the receipt only last week. What are things need to be worried now ?

      Some petitions will show quick movement, while others won’t. So its not surprising. Things to watch out for are the status updates on USCIS website. If it moves to RFE, you need to check w/ attorney about RFE details. If approved, you are all set.

    I saw many as PP but the receipt date\clock start mentioned as today, still believing as these are for H1 b 2014

    • i talked with the guys and they said that they are still receiving confirmations from USCIS but they will wait till they get the whole list and then they will publish the report. so we might have to wait another week or 2.

        • ISG has the habit of saying they have sent in the application where as they do not. Later on they will conveniently say, USCIS has returned the application. TRUST ME, it has happened to me

    • Don’t listen to the things you hear online. I read weeks ago that I’d missed out and turns out people were still getting packages. I have also heard that there is still a week to receive receipts. I have also not received mine. So just keep waiting. Don’t get upset but things you read on here, most are just opinion or rumor based.
