When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  1. Hi All,

    I had a question, Overheard online that USCIS will take an additional 10-15% (perious years rejection rate) of applications on a so called wait list. No sure how credible this information is.

    Is it true? and if so, will the petitions on the wait-list be notified that they are on it. My guess is that, if they do have something like a wait-list, USCIS will not return the packet until all the applications have been approved/denied and then consider the wait-list
    Again this is just my assumption, none of the information here is from any credible source.
    I just wanted to bounce the idea off you guys…

    • I believe someone said that in 2008 they let applicants know they were on the wait list on May 18th. Could be wrong though!

    I was quietly following this forum and also doing lot of research on interent. I too have not received any updates on my H1B lottary, and this is my last chance to get it (5 yrs on L1 is about to over).
    Anyways, i don’t want to give anyone a false hope but i found this document from USCIS with the count of total cap H1B applications received and processed in past years.

    Based on this data each year USCIS generates receipts for around 10% extra applications (accounting the rejection rate of 10%). This data is my only hope, as i’m hoping that USCIS will pick around 93-95K applications instead of 85K.

    Also, i read on the CIR (immigration reform bill) 2013, that there is a clause in that bill that if the bill pass by congress before Oct’1 2013. Then H1B quota for 2014 will again reopen for approx 45K additional H1B 2014 slots. (This information is from the trusted site –

  6. I was quietly and patiently waiting for my receipt but now I am loosing hope.

    Is still CSC center doing entry and sending receipts. How long I should keep my hope alive?

    • data entry seems over. Most of what is coming through is PP waitlisted applications OR a few RP applications that has been selected but receipts had not been generated.
      Its more or less over now

  11. My H4 to H1 status change is in process (2014 quota). Next month I have a plan to go to Canada just for half day for lunch. I have 2 questions here
    1. Do I need Visa to enter Canada for a day?
    2. If I go to candada, Will that affect my Status change?

      I asked one attorney about your question, and he has told me that if your husband caught u doing shit in Canada, ur H4 and H1 both will be cancelled.

    • Besides all the hate posts, you will not have a problem entering Canada with a valid visa, but coming back to US, you have to choose from your scenario below

      1) You have a valid non-immigrant visa to re-enter US – No problem
      2) You are on F1/OPT – Need proper employment documents including offer letters and even then the border customs office may not allow you back in.

        • He is right though. I have the same issue, I need to travel under my J1 with my H1B pending and my lawyer said it is fine. If they take my I94 then it will cancel my COS and I will have to go back to France for the visa stamping but I will still be able to come back under my J1 coming back from my trip.

      On another note to answer your question.. It is not at all safe to travel right now as your h4 to h1 COS Application will be void once you are out of US when the application is under processing.

    I am AD/RP CSC. I got my receipt number on Apr 19th and on Apr 26th USCIS approved my H1B. I got email form the lawyer this Friday and USCIS I confirmed with USCIS website as well.

          • I don’t know what does notice date mean. Here is what my case status says –

            On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

    When you check your H1B status from uscis.gov website and if it says under post decision activity section that ” On May 2, 2013, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.”

    does it mean that my H1B is approved 100% or I need to wait until I see something under “Decision” section?

  15. So I applied through 17 consultants because my employer told me Indian companies would apply like crazy so this would better my chances.

    But I have not got one approved yet. I’m worried now!!!

    • You probably got rejected because you applied for 17 CONSULTANCIES!!!
      Duplicate applications don’t work anymore. They deleted 16 of your duplicates and only kept 1…. which I hope did not make it through the lottery because that’s an a*****move…

    At my workplace 3 packets have been returned today. Mine wasn’t one of them.
    I am ad/pp. I haven’t heard a word. Are other people getting packages back? Does it mean I am in waitlist?

    • If all the reports are true and that un-selected petitions are being returned, then I would guess that you are in wait list. Wait till the end of next week as USCIS is still processing selected petitions.

      in 2007 and 2008, USCIS made a formal announcement of the date on which they had completed data entry for all H1b applications. This occurred in the first week of June.

      I am in RQ/PP/VSC and waiting, all though at this point I do think that if my petition was selected, I would have heard by now.

  18. I heard USCIS received 124000 applications and out of those 85000 were to be selected..

    which means only 39000 to be rejected….. but also they keep some 10-15k in waitlist..

    so does it mean the chances are high for everyone to get receipt as final rejection list will have only 24000 applications….. and out of those 24000 many can be AD..

    so chances are good for regular ones… isn’t it….?

    • Your right. USCIS reject anywhere from 14-18% of H1B processed Visa’s. So they replace them as they go. My Boss called USCIS and they said if you get your packet back then it’s over. But some will be held back as a waiting list to cover rejections. My source is USCIS and USCIS data. Good luck

  19. Is he mail received by both attorney and employer or it can be received by either of the two?
    If both of them get it, is it in some particular order.

    My HR is on leave for entire month of May and the attorney is not much responsive. Hence the question.

          I saw in a article that the redundant applications are removed before the computerized lottery is done. I am not sure how true it its, if someone applied more than once, which one will they remove? may be Saurabh or someone can help us.

          Imagine, if a person has applied twice and both of his application is selected…that should not be case, right? you think that makes atleast some sense?

            They will remove the duplicate petition filed from same employer for same person. If two or more different employer files the the petitions for same person then it would be treated as different petition all together.

      • Here’s my story: AD/RP/CSC
        I never received a physical receipt from USCIS. I got the receipt number from my sevis [school I20]. It has been there since 16th april.
        Last week, when i was checking this receipt number, it showed that address was changed and hence the alarm. Finally our attorney decided to request for the checks sent with my applicaiton.
        On May 2nd , the receipt number was showing approval. Today my attorney mailed me the check copies which were encashed. Looks like it was encashed on 18th april. [ receipt number was generated on 12th april].

        Finally after a lot of wait, stress and trauma, H1B approved.

    Thank God. After a wait of so long, finally I got an intimation from my employer that I’ve been selected in the lottery. Mine is RP/RQ/VSC.

    However 1 strange this is, the intimation email said, we won’t be sharing the receipt numbers unless we want you to go for visa validation / stamping.

    Just wanted to check if this has happened to anybody else and if there is a way we can figure out what stage is the application in and how can we have further information about it.

      You’re going to have to ask them how your case is advancing. I remember someone on the forum with the same question and apparently they are not giving your number because they are afraid that you may use it to apply at another company and lose you as an employee.

    • WAC aand EAC are two different processing centers for West and East coast. So both are totally different receipt number. Use the receipt no what you got from the employer to track the status.

    • They are different receipts for different applicants. EAC gets all visa applications for jobs on the eastern side of the USA and labels them with EAC numbers. WAC gets all visa applications for jobs on the western side of the USA and labels them with WAC numbers.

      The receipt number is composed of all the characters including starting EAC/WAC. So these 2 are different receipt numbers and only one of them belongs to you. You need to follow that one.

    Today is great day for me because after so many days of waiting my employer mailed me that my application was selected in lottery….so happy for me…i am also in…another big waiting is there..hope for the best….so from my experience i would suggest to other guys please be patient u will surely hear a good news one days it may be a week or 2 weeks……….

    Is it possible to apply for an change of status from B1 to H 1.

    This yr an employer applied for an H 1 for me, am still waiting for the receipt,
    Mine was applied under RQ/RP CSC ,I am hopefully that I will get through as people still getting the receipts and we haven’t started seeing any rapid news on the rejection receipts yet.

    I am about to travel us in the month of July on B1 visa( business).

    My question is in case if my application didn’t go through in lottory, while I a m in us in July.can my h1 employer file a change of status from B1 to H1.

    Is it legal to do so.

    Please share your thoughts.

    • I am from India. Mine was applied under RQ/RP VSC, I am still waiting for my receipt. I do have a B1 visa but have no idea if we can transfer it to H1. I have been doing the same research myself. Possible. However, it is strongly advisable not to apply a COS from B1/B2 to H1B. There are lot of consequences and you will end up answering a lot of questions when you go for visa stamping the next time. Also, the chances of a successful COS from B1 to H1B is very less.

      • Waiting,
        This can be done only when the cap is open. If your H-1 petition gets selected, then you should go for H-1 visa stamping and then travel to US to work on H-1. If your petition doesn’t get selected, then it is of no use.

        Remember B-1 is not converted to H-1. Status changes from B-1 to H-1, but that assumes that you already have H-1 petition approved.

    Received the Receipt yesterday through the lawyer.

    How can I verify if the EAC number assigned is for my application?

    Please advise.

      Ask for copy of 797C from the employer. That will have the receipt number and the beneficiary’s name.

    • Did you receive the receipt number of a copy of the receipt?
      If you received a copy of the receipt then your name would be there in the “Beneficiary” box.
      If you have not received a copy, then either ask your employer else you have to trust your employer until your H1 gets approved & you receive approval notice & other docs.

      But to be honest, It could be in the ball park of 95 to 105 based on the past USCIS published data for cap subject H1b petitions. I lost the link but USCIS has published this data from 2009 – 2012 where the total number of receipts generated ranged from like 103K to 93K.
