When will H1B Visa filing season start for Fiscal year(FY) 2014 ?

H1B visa filing season for fiscal year 2014 starts from April 1st, 2013. USCIS did a press release confirming the same.

Why do we call H1B Visa 2014, when the petitions are filed in 2013 ? 

USCIS operates on a fiscal year basis instead of calendar year ( Jan 1 to Dec 31st). Its fiscal year starts from October 1st and ends on September 30th. On that lines, USCIS’s fiscal year for 2014 starts from October 1st, 2013 and lasts until September 30th, 2014.  So, though we file H1B petitions in April of 2013, they are counted towards H1B visa fiscal year 2014 and everyone calls it in short form as H1B visa 2014.

What is H1B visa 2014 Cap count for Regular quota and Masters Quota ?

If you are not aware of H1B cap count, it is the congressionally mandated numeric limits for H1B petitions based on category. Regular quota is for anyone who meets H1B visa requirements and Masters quota is specifically for students who have a Masters degree from US University. Typically, below are the numeric limits… ( we had these H1B cap limits set in 2004, if any changes by USCIS, we will update this page)

  • Regular Quota Cap – 65,000
  • Masters Degree Quota Cap – 20,000

H1B Visa 2014 filing deadline – What is the last date ?

Well, there is no set deadline as such by USCIS. They start to accept petitions from April 1st, 2013 and will continue to accept H1B petitions until the H1B cap (85,000) is reached. It can vary based on the H1B visa demand.

 

Will there be Lottery for H1B Visa 2014 ?

This is most commonly speculated question by many H1B seekers. Due to very high demand and hype for H1B workers, we had lottery in some of the previous years. But we do not know, we just have to speculate based on past data and economic conditions. As done in previous years, here is our analysis:

What will be H1B visa 2014 filing fee ? Any changes ?

There has not been any changes to the filing fee for the fiscal year 2014. Check out the article : H1B visa 2014 filing fee – Who Pays for what ?. In general, it can range from $1,575 to $4,325 based on the number of employees ( this does not does not include attorney fee and premium processing fee).

 

International Students  – Can we do Change of Status ( COS) from F1 Visa to H1B visa for FY 2014 ?

Yes, international students pursing their Bachelors, Masters or PhD programs from US Universities, who may be working on OPT, can file a H1B Visa petition to USCIS with Change of Status(COS) option.  The advantage of COS from F1 visa to H1B visa is that you can continue to work after OPT expiration starting from October 1st, 2013 without leaving the country.  You have to do the COS before your OPT expires to maintain legal status in America.

 

How soon Can I start working, if I file for H1B visa 2014 fiscal year ?

One can start working from October 1st, 2013 , if you have an approved H1B petition. You may need to get H1B visa stamping done, if you file your petition from overseas and wish to come to America on H1B visa.. Unlike, if you are filing for a COS by staying in US, you can start to work without leaving US for H1B visa stamping.

 

What is current H1B visa 2014 cap count ?

The H1B season for FY 2014 will begin on April 1st, 2013. We will keep track of the USCIS cap count updates with analysis.

  2. My application as part of RQ/RP. Today I got email from my employer that my application is selected in lottery and I got the WAC number also. WAC number belongs to California or Vermont Centre ?

    When I check the status on USCIS web page , it shows me the status : Initial Review. Does it mean that Satatus : Acceptance is already passed and done positively ?

    Getting WAC number means Acceptance is already done right ? Which is the next status for which I should wait after Initial Review.

      Can you tell me first 5 digits of of your notice number after WAC??
      Also, please tell me the recieved date you are seeing on USCIS

      • Received date is 8th Apr, I am informed about REceipt number yesterday so 2nd May.

        Notice Date is 26th Apr. Can you pls tell me what this dates are ? Applications were accepted till 5th Apr. So, how the recevied date can be 8th Apr ?

        Next step is Decistion. But how much time it takes to move the status from Initial Review to Decision.

  3. So our Accountant did the math for us according to USCIS graphs and numbers. So taking rejection % from 2009 through to 2012 it looks like an average rejection rate of 20% of Visa’s chosen to be processed will be rejected this year. Now this of course could be lower or even higher. So with that 124,000 application only 85,000 were picked. that leaves around 39,000 left out. So if 85,000 -20% rejection =68,000. Which means 17,000 rejected application need ing to be replaced from the 39,000 left over. Which means from the 39,000 an additional 22,000 will need to be pulled to fill those visa spots giving those left out from the orignal lottery a 56% chance of being picked still. I hope I got this right.

    • Hi H1b Scotland, are you 100% positive they will replace the rejected application with the left over cases? I read an article last year which basically saying if there is a lottery process and you are not picked, you are done. The quota is 85,000 and USCIS may reject 20,000 of that which means only 65,000 will get their H1b that year. USCIS won’t pick from the left over. Again, that’s an article I read last year, not sure if it is from reliable sources.

      I am pretty sure I didn’t make through the lottery process. But if what you are saying is right, I still have hope.

      • My boss called USCIS I myself did not get picked in lottery, USCIS said they will pick from those who did not get in from the first lottery for their wait list.

        • Sigh. Same here. My boss said he’s gonna cry. My attorney called me yesterday and told me almost out of hope. The check is outstanding. I think that’s it. Bad luck and I don’t know if I should back to school for a second master or not…and I can’t stay in the company anymore. 🙁

  6. So far what we know is that USCIS stopped processing in California center and Vermont center on Friday of last week. There may be one or two that pop in but 99.99% are done and being sent out. So all this week and next we will hear of people getting in bu it has stopped. My company called USCIS on 5/01/2013 and found out I was not in their system and so I was not picked in the lottery. Packages are being sent back but he could not say when. Now here is what I found out by doing some independent research on the net(not USCIS).

    USCIS rejection rate is around 14-18% of processed Visa’s. I got this info from various sources. So that means that they may keep around 15,000 applications if the math is right to cover those rejected. But the rejection rates may be higher this year as USCIS clamp down on the abuses that take place with the H1B Visa(which I have heard from three different law firms). I spoke to a Lawyer friend in the Bay area who said that anyone who submitted an application without a letter from their future employer was being rejected even if it was picked in the lottery. So if you were applying through a consultancy firm with no ties to a company then they were rejecting them. The consultancy company must show a letter of Job offer from your employer so that USCIS knows you are coming over to a secure job. This may be one of the reasons we are hearing such high numbers as 60% being rejected. take it for what it is worth. Now as to the 60% it is shady at best as information. But for those who are still hopeful of a chance of getting past the wait list. I heard that the companies that got 60% of apps rejected place over 30,000 visa this year. We don’t know how many of that 30,000 made it through the lottery but I have read that The big four Indian IT company’s were informed of who was picked and are holding onto a master list until they get a final count and then release them all in either batches or all at once. So maybe this 60% is coming from this sample of lists.

      • I have heard they will let people know by the 15th of May. But when my boss spoke to USCIS the rep didn’t know if that was true. He made out that this would be a take an application as they needed it.

  7. Is uscis all done generating receipts? Are you sure? I had lots of hopes…looks like they are all shattered…even my husband had applied and did not get any info on his h1b as well…no hopes no hopes

  8. Just received word from my consultant that my petition has been accepted by USCIS.
    Regular Quota – Regular processing – No Premium Processing.
    Very much relieved. It also suggest not to loose hope as I am so much not lucky in the lottery or anything which involves luck.

    • Hi H1b Scotland, do you mean there will be around 15,000 on the waiting list? If that is the case, with 85,000 selected cases plus 15,000 on the waiting list, the chance any of us get picked is (85,000+15,000)/124,000=80%. Is that right?

      And for those not been picked by lottery process, the chance of being picked for the waiting list is 15,000/(124,000-85,000)=38%.

      Correct me if I am wrong, but that’s my understanding of your post.

      • From the research I have done and the number I have gathered from USCIS graphs in 2009 the rejection rate was 35% it has fell now and is around 17% in 2011. The rejection rate is from people who got processed. So subtract anything from 14%to18% off of the 85,ooo and you have a rough number of what may be on the wait list. Again with politics in play this year the rejection rate may be higher.

      • The only thing I could not find out is did they pull through the wait list people through the lottery system as well. for example when pulling in 85,000 to cover the visa quota they also picked an additional 15,000 to cover the rejections. So if that is the case then Some people will being getting packages back while others may still be waiting around to see if they made it through the wait list. Not sure how this is being done.

  13. So my check has been cashed.
    My status says “Initial Review”

    On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

    During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant’s/petitioner’s criminal history, determines if there are national security concerns
    that need to be addressed, and reviews the application/petition for fraud indicators.

    What does this mean? Does this mean I have been selected in the lottery?

    I have a question which is eating my brain 🙂

    Some news sites are reporting that there is 60% rejection rate this year. The Doubt i have is, it has been only short time since the H1b processing for this year started. And at the max USCIS would have raised RFEs and people will be replying to that. There is very bleak chance of RFE’s getting replied and then USCIS denying them in 15 days!! (from Aril 15 to date).

    Can you please throw some light on how these news agencies are coming with this data.

      This was discussed in another conversation w/ a poster some days ago. My opinion is that the article is factually incorrect. USCIS has processed only PP petitions until now and have just started looking at regular petitions. Most of applications from Indian IT giants is regular processing as they hardly like to spend those $1225.00 extra. So quoting a number of 60% rejection so quickly in the fiscal year is incorrect.

      If they are basing this on sample, then the news agency should disclose their sampling method. Did they check w/ 5 applicants or 50 or 500 or 5000. Smaller the sample, the greater the chance of sampling error.

      In the end, I am not saying that rejection rate cannot be high, what I am saying is that putting such a number in April is just sensational news and nothing else.

        This makes me feel better, but how do you know that? Someone below said their employer had called up the USCIS and had been told that they’d finished processing and if you don’t receive your receipt in the next couple days then you missed out.

        I am having a hard time reading all this conflicting information, hopefully you can shed a little light on this? Thanks so much in advance.

          With PP, USCIS has a contractual obligation to resolve it within 15 days from the filing date. As the filing date was April 15th, they are supposed to adjudicate all PP applications by 30th. This is why I have more confidence that majority of processing has happened for PP applications. Few non-PP applications may also have been adjudicated but that number should be low as compared to PP ones.

          When the USCIS operator said they are done with processing, s/he may be referring to generation of receipts and not actual adjudication of the petitions. In general regular applications can take up to 6 months to process.

          When I refer to “process” I am referring to the approval process of petitions that have made through the cap. When the operator was referring to “process”, s/he was referring to the data entry of selected petitions into the USCIS system. Two different things.

          Hope that clarifies.

            The 60% figure was mentioned on one of the Indian news portal (My suggestion, never believe Indian media in a first round). The news article mentioned the 124k petitions received & 60% got rejected out of the 65k required (here they did not mentioned that it was because of the lottery).
            They just posted this article to increase their viewership & just create a fuss.!

            I see your point. Creates sensation and to top that they mentioned that this 60% rejection is w/ Indian companies.

          • May be the numbers are incorrect. But that 60% rejection rate is for Indian IT companies as mentioned in the article. Lottery was completely random. Do you have any idea, how many H1B petitions were there from Indian It companies ?

    I am on L1B visa with compny A and applied H1B visa with company B in RP and it is already got selected in lottery.
    Due to some emergency i need to go to USA and also get my l1B visa stamping(extension happened last year).

    Question is going out of USA will just cancell the COS(L1B to H1B) that’s it right??
    when i again come back to USA in 3 weeks from INDIA then company B can again file COS after approval??

    Do you see any complication apart from filing extra COS.

      After the case is approved, USCIS will send out approval notice (797) to the employer/attorney. They can then send all the required documents including 797 to you for stamping.

      Stamping process varies from country to country. In India, the process is outlined on the US travel docs website. In general, it involves submitting fees, taking biometrics, completing DS-160 form and appearing for interview on the scheduled date. If approved, you can travel to US as per the start date. If you are put in administrative processing, then it can cause some (minor/major) delay.

            why is it taking so long to inform… is the delay from company or from uscis?

          • Infy have got almost all the results..100% reliable information…but they’re not disclosing it..I don’t know the reason…

            And I have read few comments that few people called USCIS and they said they are already done with sending receipts.. don’t know what Infy and any other company are waiting for

          • One of the reason (might be a rumour) that I heard is that they will kill another 3-4 weeks before they will disclose the result so that ppl not selected in lottery should not start switching companies as its the peak time of the year to switch. Secondly to give managers some time for alterrnatives 😉

          • @True : you’re right..it’s NOT a rumor it’s a FACT.. they’re not doing anything but just killing time to make people stay for 3-4 more weeks. they’ve all the lottery results.

    • u r right Ravi. USCIS is sending the Receipt numbers to the big companies but they are not releasing the list until they receive all the numbers. probably it will be a week or 2 by the time list is ready for distribution

    • As it has been pointed out by those who have called, USCIC has completed data entry for all those selected. This is reliable info as many people here who have called have been told same thing.

    • My Boss called the USCIS today and I was not in the system which means I was not chosen in the lottery. The officer or rep told us that all receipts for lottery people have been sent out. They have finished processing lottery picks. He then told my boss that the only way to know if you are on the wait list or not is if your checks cash or the package is sent back to you. This is info is straight from USCIS I sat in and listened to the phone call that took place with my boss.
      So over the next few days some people will get receipts but this is from snail mail. NO NEW RECEIPTS are being done for lottery winners. Unless you get on the wait list good luck. I am one person now moving onto hoping I have made the wait list.

    • Finally-H1,
      If USCIS do it correctly, then you have made through the cap. It makes no sense to issue H-4 receipt unless H-1 makes through the cap.

          It happened same as you to me. I got I-797C for my depenedents( L2 – H4) through regular mail and next day i got my receipt # from my employer. I am sure your petition has been picked in the lottery. 🙂

    My application is RP/RQ. Today i have received the conformation from employer saying that “Congratulations!!! We got a confirmation for your H1-B application that it is picked up in the lottery.

    But yet to receive receipt number.

    My current status is J-1 (intern) / SEVIS is I-901
    I just checked SEVIS status from USCIS website and it says I-797 receipt status : sent

    What does it mean ???? am I in ???????
    as I know, I-901 is for J1 visa holder & I-797 is for H1 visa holder.. why I-797 status is on my SEVIS status ????

      I think thats the expected behavior. Once the petition has been picked-up, SEVIS record gets updated to mention the same (similar thing happens for people on F-1). Once your H-1 gets approved w/ COS, your SEVIS record will get closed. I don’t see any reason to worry.

        • Where is my post,
          Yes, you have. COS stands for change of status – an option filed by employers when the employee is already in US at the time of filing. If approved, your status will change to H-1 from Oct 1 or H-1 approval date (whichever is later) and you can start working on H-1 from that date w/o needing to get H-1 visa stamped first.

    What does it mean ?????? my current SEVIS form is for I-901 (for F-1, J-1 etc…) why the status shows about I-797 ??? Am I in ????

    • It looks like it is showing sent for people on F1 and who did not apply for H1b too..
      one of my friends who is still in school, checked this website and it showed i-797 receipt status as sent…

  25. Hi,

    My wife is on L2 and currently working in USA on EAD. My company has applied H1 for me and it looks like it got picked up. I am not sure if my company has requested H1 B (Without change of Status).
    Is there way to do any amendment now to make it without change of status (Wihout COS) so that I can continue on my L1 even after 1st October

    • Shweta, Only way is if you exit US before your H1 is approved & come back again then COS would not be valid. The purpose is to make your current I94 finish & when you come back you get a new I94.

        In addition to above suggestion, if your H-1 is approved and you travel out of US and then return on your L-1 visa after Oct 1, then you will remain on L-1 and not move to H-1. If the dependent’s L-2 to H-4 COS was also filed, then they also need to follow the same thing.

        • Saurabh, correct me here…If the L1-H1 COS is approved & the person is still in US, won’t it mean that you are no longer on L1? If one exits US after the approval of L1-H1 then he/she has to enter US only after stamping? The COS takes into effect strongly until the person is in US.
          I may be wrong, but the above is upto my knowledge.

            The H-1 COS is always approved for a date of Oct 1 or later. This means that the person remains on L-1 status until Oct 1 and move to H-1 from that date. This also requires a person to be physically present inside US on Oct 1 for COS to go into effect.

            So if the person leave US prior to Oct 1 and is not present in US on Oct 1, then COS will not go into effect. The person can then either return on stamped L-1 visa or stamped H-1 visa (after Oct 1).

            Does that clarify?

  26. EAC1315050870 to EAC1315050874 are all premium receipts that was generated today . But is there a way we can find out if they are all fresh petition or extentions/transfers ?

    • there are lot more than that , i see around 20 more PP cases processed today after the number which you quoted above. so looks like waiting list is getting cleared starting with PP first.

      • The received dates have to be the 8th of April. If they are some other date then they can be ext h1b or even possibly wait list people from Lottery (not sure about the last statement). My Boss called the USCIS today and I was not in the system which means I was not chosen in the lottery. The officer or rep told us that all receipts for lottery people have been sent out. They have finished processing lottery picks. He then told my boss that the only way to know if you are on the wait list or not is if your checks cash or the package is sent back to you. This is info is straight from USCIS I sat in and listened to the phone call that took place with my boss.
        So over the next few days some people will get receipts but this is from snail mail. NO NEW RECEIPTS are being done for lottery winners. Unless you get on the wait list good luck. I am one person now moving onto hoping I have made the wait list.

          However, I think the receip tdate will only be 8th for those chosen in lottery. For those in waiting list, it will be th date the application was pulled from the stack to replace a rejected one. It makes more sense this way.

          I’m in the same boat, application arrived at USCIS on the 1st but no word as of yet, my boss rand last week and I was not in the system, i’ll ask him to ring tomorrow but not in any way hopeful…

  30. Is there a way to find out if my application made it to the lottery or not? My employers says without receipt number, USCIS wont tell any information.

    • All, My employer has just updated me(employer called USCIS customer care). I have got the receipt number. Regular processing/Regular quota/Vermont. Receipt had generated on April 29th. Receipt notice is yet to reach employer. Check has not been cashed yet.

      Please keep your hopes on for another 2 weeks.

    So it is just wait and watch…. Either for a receipt number or the packet.

  32. Employer just called and USCIS said my name in not in system. All they asked for is my name…. I’m pretty desperate now because I feel like they are almost done inputting the applications. I feel like I did not get selected.
    Anyone else in the same situation – where they have called and they were not in the system?

    • Same with me. Does that mean we are not selected?

      I see one more guy on this forum faced the same issue when he called USCIS and he received the receipt the same day.

      • Well, I think it looks pretty grim because looking at Vermont’s output… today there are under 900 receipts generated and only a few are for I129. Right after the lottery, the output was closer to 5000. So they are almost done and apparently I am not in their system…

        However, I am not sure they are trying their best to give us an update. The guy only asked my name and reluctantly said I am not in the system and I should wait one more week. I wonder if he even bothered to check. Maybe I am just in disbelief so I am lying to myself but maybe he didn’t even try.

        Bottom line, it looks pretty bad I think… but it’s not over till we get packages back…. and no one has gotten their package back yet I believe..

      • God please,
        This is not the perfect way of knowing whether one is in the system or not as there can be others w/ same name etc. The better pointers are cashing of the check, physical receipt notice and SEVIS record update (if applicable).

      • I also got H4 recipt first at home and H1 by empoyer after 3 days 🙂 … — What is the received date ? it should be April 8th ( Considering attorney sent H1 & H4 at same time–99.9% they do if requesting/applying at same time)

    My attorney has just emailed me the petition #. He got it from USCIS today morning. I just saw the status and It is in initial review. Hope 4 the best. Hopefully i will get approved within todaya or tomorrow as i heard the same from a lot of people from within this forum.

        • Date is of today. Both the dates are same. Don’t loose hope. People get their #’s and just don’t update, once they get their NO. So have patience for one more week and then likely game is over….

        • My employer told me that even if they call USCIS, they will give information about the cases which got receipt#. So I am not sure if this is possible without receipt#. Unless someone confirms that they got the status update without receipt#.

        • Just call them, after 2 – 3 minutes a customer rep answers and asks if u are the beneficiary or petitioner. You tell them u are petitioner and then he will put u on hold for around 40 minutes – 1 hour depending on the call volume. After that time immigration service rep will answer to ur call and ask u some questions:

          Employer First and Last Name
          Company’s Location
          Company address
          Beneficiary name
          Beneficiary’s DOB
          They may ask lat 4 of SSN of the beneficiary, but they may not ask.
          FEID, employer Tax ID can be found out through W2 or the LCA filed by the employer.

            If you are the employee then you are the beneficiary. By claiming to be the petitioner, you are impersonating your employer. Not legal!

          • We called and my record was not updated and they said for premium you have to call a different number . But we are unable to get hold of anybody in that number .
