Waiting for H1B Visa 2015 Petition Status Updates, Case Numbers ?

Over the past few weeks, many of you have been on the blog constantly refreshing our H1B Visa 2015 Pageor H1B 2015 Status updates page seeking information from one another on the status. Also, with our H1B Visa Tracker, there are about 200 cases that are tracked by our readers.  It is heart touching for us to read and empathize everyone’s situation. We wish we could do more…Let me share some thoughts on some misconceptions that I have noticed in the comments, just to make sure everyone are on the same page.

USCIS Processed 5000 H1B Petitions today ? 6000 Yesterday….2000 previous day at Vermont ? When is my case processed ?

I see some of our readers posting comments that USCIS processed so many ( 5000 , 6000 or 2000 ) H1B petitions per day at a USCIS service center.  They are randomly counting the petition numbers advancement at a service center and concluding that so many H1B petitions were processed on that day. The truth is that USCIS service center processes much more than H1B Visa petitions and the USCIS Case Number that starts with a WAC or EAC, does not explicitly mean that it was a H1B Case number. It could include other cases like Status Adjustment, Alien Registration updates, Address changes, etc.   So, the conclusion that a service center processed so many H1B petitions per day is NOT true, unless someone manually goes through each and every petition and does a tracking by case.   Bottom-line, do NOT get bogged down by the fact that USCIS processed so many H1B petitions per day and my case number is not received, so did I get in the lottery or not.  Try to be patient and do not put yourself into pressure by false conclusions.

Readers Posting questions like AD/PP/VSC  or RQ/RP/EAC …etc. asking for updates . H1B Tracker ?

I do understand, many of us are under tremendous amount of pressure waiting for the petition status update. Many of our jobs and future aspirations are tied to the US work permit…I have been there…I can imagine…It will be nice and helpful for everyone, if we can leverage the H1B Visa tracker and post your case status there…If you can, please try to avoid posting it on the pages and leverage our H1B tracker….

Do I have to receive H1B Premium Processing case number by April 28th

USCIS mentioned that they will start the processing of H1B petitions from April 28th. They did NOT explicitly state that you will get H1B case number by April 28th.  It is very likely that premium processing selected H1B Cases to receive the petition number by April 28th, but due to enormous number of petitions filed with USCIS for FY 2015, the online system that is used to track petitions may not be updated as fast as you imagine.  Check with your attorney or you can call USCIS service center as well. Just don’t lose hope and get nervous. You never know!

Did anyone receive Regular Petition Case numbers ? How Long will it take ?

Some of our readers have indicated in the H1B tracker that they have received the H1B Case number for regular quota. USCIS has started to mail out H1B Case numbers for regular quota as well.  They do NOT have a fixed time or SLA to send these petitions case number. It can take anywhere from couple of weeks to a month or so to get petition numbers… It will only arrive by USPS Mail, so it can take time…Do NOT just conclude, just be patient and wait !

Did anyone receive any H1B visa Petitions Rejection Notices ? NOT selected in Lottery results ?

So far, our readers have not indicated that someone has received a rejected petition, stating that it was not selected in lottery. Also, prominent immigration attorney sites like Murthy have indicated that they No Rejected H1B Petitions were received yet by them.  So, don’t lose your hopes folks. Life is what it is…be patient, if it is meant to be, it is what it is…Good Luck !

I can imagine it is very difficult time for most of you to be in the waiting phase, days seem longer and you cannot focus on anything…unfortunately, it is life and we do NOT control certain things…Just try to be patient and calm, spend time with your spouse/kids/yourself doing something fun…stay away from reading information that can cause stress….

    • I am still waiting. The chances seems to be very very less. I can see only 2 replies stating that they received the receipt number in July. Rest all were denied. So may be USCIS is sending out the rejection packages very late.

  4. Hi, I have received rejection letter with notice date as 07-May-2014 🙁

    Could anyone let me know, when my employer might have received the rejection letter based on the notice date in the letter.

    • My employer informed me last week and sent a scanned copy of the return receipt. It was dated May 12th. And my employer keeps everyone updated as soon they have some information. So as soon as their attorney received the return receipt, they informed me. So I think USCIS would have prepared the return package long back and sent it slowly. So normally it took more than 45 days in my case.

  5. Hi Every One.

    I got the Application Number from my petitioner, But there is no Name mentioned when we check the status. The Lawyer also do not provide me the acceptance letter and just provide me with the application number . So how could I know this is my Case Number which My Petitioner Sent me ? I am confused. Can any one guide me how to confirm this.

    • You have to trust your employer. There is no way you can check your name unless the employer sends you a scanned copy of the receipt.

        • No. I get receipt in late May. But all info is holded by my employer. Be didnt provide me any s aned copy but only convey ghat i get go thru and provide the recekpf number where there is n name so dont know its mine or some one else. Its on Initial review since i get this Tracking # which is appfox now 2 monghs.

  6. I still haven’t got any news, neither the receipt nor the package. I have decided to wait for H1 outcome before moving onto next plan. There are several possibilities until we hear anything about H1, so instead of panicking its better to take step by step. Good Luck !     I would appreciate if anyone can let me know their thoughts on my situation. I have not been selected in H1 lottery this year (no news though). I will have to go back next year in July to my country, my employer is going to file again next year for H1b visa but what are the chances if:

    I apply for premium processing and also get selected in lottery next year , will I be able to know the result before July 15? and if I get selected will I be able to stay in US or still will have to go back if visa is not approved by July 15?

    • It depends on your current status. What is your current status?
      If you can have an application for extending your current status pending with USCIS before July 15th, you can stay in the country for 120 days. If you can’t extend the current status, you have to leave if your premium processing result is not out before July 15th. As you see this year, many people who applied as a PP waited more than a month. It depends on luck. Good luck next year.

    I haven’t received the rejection letter yet. Any idea when does USCIS complete the formality of sending all the rejection letters. My employer has told me to wait and hope for the best. Is there any chance I get to know the lottery outcome now? Did anyone receive update of lottery outcome recently?

  9. I have a valid H1B visa and stamp but I am waiting for my employer’s call to fly to US and join the company in US for last 4 months. What are my options if my employer don’t allow me to fly anytime soon? Is it legal for him to delay my joining after visa stamping is also done? Is there anything I can do to get out of this wait situation? Is it legal for the employer to delay the joining of H1B employee for indefinite period of time? please help me. thanks

    • If you have a valid h1b visa,you can do the h1b visa transfer with some other consultants in usa. They can help you getting job offer in some other company/client and offer you with joining letter soon.

    • I too still haven’t received the rejection letter yet. Really frustrating. Mine is a regular processing petition. what are the chances of being in a waiting list? I know in 2008 there was a “wait list” concept said by USCIS itself.

    • I too am waiting, no news as of yet. Regular Quota/Regular Processing/California. Some lawyers are saying that everyone who got selected in the lottery must have gotten the result by now, but based on this forum’s update I doubt so. I think there is no other way but to wait.

      Y’day my husband’s colleague got his approved petition! he was not informed about lottery or receipt.. so keep your hopes up folks until u receive the rejection packages.

  11. I have received my Receipt Number 10 April 2014 ,Still my application shows in initial Review ,anyone going from same situation,before and after number both shows approved status.

  12. Yesterday, HR received my H1B Rejection Letter.
    Last Year and This Year: my H1B application didn’t pick up in the lottery.
    Next year, I won’t apply.

    A long wait has come to end. My employer informed me today that my application was not selected in the lottery.:( .. USCIS -will be back next year.

      I am told my company has 2 lists one for may and one for June, and it is still receiving mails for June lottery so not all hope lost.

  14. My Employer says , My h1b got selected but did not get the receipt yet.
    He says , the amount from the bank has been taken for your application but did not get the receipt yet. The money form the bank has been taken some one month back
    But Not sure why we did not get the receipt yet. Any Idea or in same situation ?

    • Hey,

      I am also in the same situation. My employer told me the money that he paid for my application has been deducted but he hasn’t received any EAC number yet. Apparently there are two more people who are in the same boat.

      It does worry me but I see that there is no other option but to wait!

    I got my receipt no. EAC 14 146 XXXX. however, status is showing Initial Review from the first day on which I received receipt no. Could you please share the details up to how much time will it be in the same status. What will be the timelimit in which i get the final status.

    • It can take any thing b/w 2-6 months. However general perception is, USCIS looks into cases sequentially. I am also in EAC14141*, and has not seen any action. I see lot of action on EAC14138* series right now, so anything b/w 1-2 month you should see some activity on your case. Good Luck to all waiting for receipts or Approvals!!

    • if you have neither received the receipt number nor the rejected petition, then you still have to wait, you cannot conclude that you were not picked in lottery. If you have not received the rejected petition back, you still have a chance. The chances might be less, but you cannot rule out. Unfortunately folks, it can be very frustrating to keep waiting for this, but there is no go…If you have applied this year and have not received anything from USCIS, make sure, you are working on a backup plan…just to be prepared.

  17. It’s been almost 2.5 months and a lot of us still don’t have answers from USCIS.. At this point I just want to KNOW. If it’s a lottery it shouldn’t be too hard to send an automated e-mail with the results as soon as they do the draw. Need to buy my flight home and its getting more and more expensive.

  20. Got below response today from HR. So I am out of race, good luck to you all.

    “I spoke with our attorney and they seem to think your H1B petition has not been accepted. They have not received an official notice, but they says if it had been accepted they would have heard by now. “

    Mine also same state. No news on my case status, rejected or selected in lottery. Spoke to my employer yesterday. Looks like even he doesn’t have any clue.
    This wait is a real mental agony. Praying to get selected .

    As far i understand we cant get a tracking number from USCIS until petition is selected. Can anyone confirm this please.

    Anyone in WAC-14-143 series got acceptance / rejection notification ? My sister who filed along with me with WAC-14-142 series got the acceptance notification this week, Mine (and my sister’s) is filed under regular processing. Approximately how much time still it takes for any decision ?

  26. Yes. I know life is hard, and failures are a part of it. But this is so miserable. All of us who are in PP category know it is over, yet we are waiting in hope. Rejection packages have started to pour in. Why does the USCIS make us wait for two months, after having paid 1,225 pp fee? Why can they now tell us as soon as we are NOT selected in the lottery? Such grueling torture and stress. I am AD/PP/VT still not heard anything. In anxiety since April 1. Two months of waiting only to eventually find out that I am not selected.

    Please if anyone out here has heard of anybody from AD/PP category who received positive receipt notice and got selected in the past few days, let us know. Is there a point waiting now?

    I hope the petition to increase the cap passes through senate.

      • No one is suppose to pay for their H1, it is considered fraud by the American government and if they find out, you’re in big trouble. Only your employer can pay for the h1

    This is to confirm that our office has not yet received either a receipt notice or a returned petition for your H-1B cap petition. As such, we are unable to confirm at this time whether or not your petition has been selected. As soon as we receive either a receipt notice or a rejected petition, we will be sure to update our system.

    We have started receiving a number of emails and phone calls regarding the status of individual cases. Please note the following:

    *If we receive a receipt notice for your case, our system will be updated to reflect the receipt number. You may click on the receipt number to check the status of your case with USCIS. Please note that we anticipate that it will take USCIS 3-5 months to process petitions.

    *If you do not see a receipt number listed, this means that we have not yet received a receipt notice for your case from USCIS. We recommend that you check the system periodically, as we update the system each day with the receipt notices that have come in. As mentioned above, it may take several more weeks for USCIS to issue all of the receipt notices for those cases selected in the lottery.

    Please note that we update our system with information regarding receipt notices received each day. Please log in to our system for any updates, as we will not be able to reply to individual emails regarding case status, or to confirm whether or not a receipt notice has been received.

    Once USCIS sends out all of the receipt notices, they will begin returning the petitions that were not selected in the lottery, and we will update our system with this information as well.
