Waiting for H1B Visa 2015 Petition Status Updates, Case Numbers ?

Over the past few weeks, many of you have been on the blog constantly refreshing our H1B Visa 2015 Pageor H1B 2015 Status updates page seeking information from one another on the status. Also, with our H1B Visa Tracker, there are about 200 cases that are tracked by our readers.  It is heart touching for us to read and empathize everyone’s situation. We wish we could do more…Let me share some thoughts on some misconceptions that I have noticed in the comments, just to make sure everyone are on the same page.

USCIS Processed 5000 H1B Petitions today ? 6000 Yesterday….2000 previous day at Vermont ? When is my case processed ?

I see some of our readers posting comments that USCIS processed so many ( 5000 , 6000 or 2000 ) H1B petitions per day at a USCIS service center.  They are randomly counting the petition numbers advancement at a service center and concluding that so many H1B petitions were processed on that day. The truth is that USCIS service center processes much more than H1B Visa petitions and the USCIS Case Number that starts with a WAC or EAC, does not explicitly mean that it was a H1B Case number. It could include other cases like Status Adjustment, Alien Registration updates, Address changes, etc.   So, the conclusion that a service center processed so many H1B petitions per day is NOT true, unless someone manually goes through each and every petition and does a tracking by case.   Bottom-line, do NOT get bogged down by the fact that USCIS processed so many H1B petitions per day and my case number is not received, so did I get in the lottery or not.  Try to be patient and do not put yourself into pressure by false conclusions.

Readers Posting questions like AD/PP/VSC  or RQ/RP/EAC …etc. asking for updates . H1B Tracker ?

I do understand, many of us are under tremendous amount of pressure waiting for the petition status update. Many of our jobs and future aspirations are tied to the US work permit…I have been there…I can imagine…It will be nice and helpful for everyone, if we can leverage the H1B Visa tracker and post your case status there…If you can, please try to avoid posting it on the pages and leverage our H1B tracker….

Do I have to receive H1B Premium Processing case number by April 28th

USCIS mentioned that they will start the processing of H1B petitions from April 28th. They did NOT explicitly state that you will get H1B case number by April 28th.  It is very likely that premium processing selected H1B Cases to receive the petition number by April 28th, but due to enormous number of petitions filed with USCIS for FY 2015, the online system that is used to track petitions may not be updated as fast as you imagine.  Check with your attorney or you can call USCIS service center as well. Just don’t lose hope and get nervous. You never know!

Did anyone receive Regular Petition Case numbers ? How Long will it take ?

Some of our readers have indicated in the H1B tracker that they have received the H1B Case number for regular quota. USCIS has started to mail out H1B Case numbers for regular quota as well.  They do NOT have a fixed time or SLA to send these petitions case number. It can take anywhere from couple of weeks to a month or so to get petition numbers… It will only arrive by USPS Mail, so it can take time…Do NOT just conclude, just be patient and wait !

Did anyone receive any H1B visa Petitions Rejection Notices ? NOT selected in Lottery results ?

So far, our readers have not indicated that someone has received a rejected petition, stating that it was not selected in lottery. Also, prominent immigration attorney sites like Murthy have indicated that they No Rejected H1B Petitions were received yet by them.  So, don’t lose your hopes folks. Life is what it is…be patient, if it is meant to be, it is what it is…Good Luck !

I can imagine it is very difficult time for most of you to be in the waiting phase, days seem longer and you cannot focus on anything…unfortunately, it is life and we do NOT control certain things…Just try to be patient and calm, spend time with your spouse/kids/yourself doing something fun…stay away from reading information that can cause stress….

  1. I am currently on H4 & got my H1 B approved this year. So would like to know from when can I start applying for my Job interviews. Is it only after oct 1st or can I do it in before too..if so what reasons should I tell to the employor.(I mean should I fake reason that I am currently working…)

    I would be really appreciate f someonie who knows or faced this situation can share your experiences.

    • Didn’t you already have a prospective job in hand at the time of applying? The whole idea of H1 is that the employer has work for you and ready to take you on board and give you work from 01-Oct-2014.

    • The current system is horrible. It allows people like to compete with those who have a genuine job with a company, and some of the genuine job holders have to abandon everything and go to their home country.

    • Perhaps @Sruthi may have left out some key details which would hopefully clarify the case. I hope that the details can be provided so we all can have an insight into the range of issues/circumstances around which H1s are being issued and it’s not what we think it is.

      That being said, there seems to be almost a dichotomy here, and in general, of people and cases where visas are issued; where on one hand we have those who will go at whatever lengths are necessary to obtain what they want and those who will go to lengths within their known ethical and moral limits, i.e. by doing it the “right” way. This speaks to the bigger motif of the inherent ethical and moral forethought involved in getting that elusive H1 and by extension, that American dream.

      Personally, I have been offered an H1 sponsoring job and flat out refused because they asked that my resume be falsified to hand out to clients. That’s not the way I want to do things and to start building my foundation in the US (karma and all that). I’ve also had run-ins with those would would like to take 20-30% off my salary, which again, is just not my style. Here I am now, 98% sure I didn’t make it through (AD/PP, have not received rejection package), even though I did it the right way.

      In the end, I cannot blame the opportunists because they were going after the same thing I was going after. They perhaps, are just going about it a bit differently (multiple applications, body-shopping, etc). Perhaps they have different situations that warrant their tactics or maybe, their ethics are skewed. As we know, ethics and morals tend to be subjective based on our own experiences, culture and instilled values.

      The point of this rant is as follows: Every where in the world I’ve been, I’ve seen this greed, selfishness and the willingness to use others as rungs on a ladder. The usual justification is that “this is the game, i.e. don’t hate the player, hate the game.” While it upsets me and it makes me furious, it reminds me that life is just not fair. It is up to us, as individuals, to *choose* to do the right thing at all times and just do it. And why should we do this? If not for yourself then think of the 172,499 others: the actions of one can affect the dreams of another. In addition, suppose if USCIS wakes up one day and says “you know what, people are abusing the system. Let’s make it more stringent for certain demographics when applying for H1s”

      It heartens me greatly, however, to know that all is not lost. Not everyone is like that and there are those out there and right here in this forum who are willing and have chosen to do the right thing and do things the right way. To you, I wish you sincerely all the best whether selected, approved or not and I wish good things will always come your way. Keep Walking with your head up always and be proud. To the others: this does not make you a bad person, but may this instill in you some thought as to how you can make better choices in the future that will continue to mold you into excellence.

      You better find a project before October 1.
      I know many H4 got H1b and still looking for a real employment.
      I myself Ad/ rp / vt not selected.
      I feel violated when you get lucky and don’t even use the opportunity properly.
      I hope you have real capacity to hold the job that you get.

  2. Hi I Got receipt on April 20. Still my case is showing “not found” in the USCIS system. My receipt number starts with EAC14132*** . Does anyone else has the same problem? Please reply.

  3. What I dont understand is, why USCIS is not sending rejection packages yet. Does anyone know anyone who has received a rejection package?

    • USCIS has started sending the rejected packages from May 6. some of them have already received it but not all. I think we will have to wait till this month end.

          Haven’t yet seen any reliable person posting that he/she has received a returned application packet. I’m sure this event, whenever it happens, will be corroborated by multiple parties….just as the receipt notifications, etc were in mid-April.

    I would like to know when will I get my approval notification. I got a receipt number on April 28th , it shows got noticed on April 10th. My company applied for me RP/Non -AD/California center.

I received my receipt number on 25th April but till now status is showing as Acceptance, not sure why it didn’t got processed till now as it was filed under premium category in California centre. I am not getting any clue as even the USCIS customer care nor telling anything, saying they will disclose only to employer if they call.

  8. I know this is not applicable for this blog but I will say …So HAPPY for BJP Victory Way To Go MODI… its already awesome but still my country is going to be of way more incredible soon. Suddenly I feel going back will be fun now, even if I will not get selected for H1 🙂 LoL .
    My country will get back on track very soon now .. Happy Future Positive Future…I am sure even if I will get H1 acceptance email today ( :p ) I will still be more happy because of MODI’s victory.

  9. I got the reciept notice from USCIS for my dependent’s I-539 application (H4 visa) which was filed with my H1B visa 2015 petition however, i haven’t received my receipt notice for my case.

    Is my application selected in the lottery selection process? or not. Pl. let me know.

    • My employer informed I didn’t make it to the lottery, although I don’t know if he received the rejection package or not.

  10. Guys am working in India for About 1 year and 2 months…..is dee any chance for L1 visa sponsorship…any minimum requirement for it? and what abt wage? is der any filing period for it like h1b? or can we file at any time

    • L1 category is for specialized skill, for example a product developed by you or your company for which no skills are available in open market. If its a easily available skill such as .Net Java then chances are slim of approval.
      H1b filing starts every year in April only and you will get your visa stamped in sep end/oct only.

          • You would apply for L1-A , i believe this has a “relatively “better chance, they would ask your position in org chart, number of juniorsand also why you cant perform the functions from india.

          • Just to add to what Vincent is saying (in which he has done a good job of encapsulating the issue):

            There are two types of L1 visas: L1A and L1B.

            The L1A – Intracompany Transferee Executive or Manager is, as the title implies, a transfer visa granted to an individual in an executive or managerial capacity in a company abroad to perform the same or higher functions in the company’s US based offices/operations. The stress here is on “Executive or Manager” so as Vincent said, org-chart, number of people managed and reasons as to why you need to be an executive in the US and not India would be pertinent to making the case for this visa. Typically I’ve heard of this situation with banks or chain hotels with global reach bringing over their director of *xyz* or senior VP, etc etc. But this is a generalization. I’m sure each specific case is analyzed by its merit.

            The L1B – Intracompany Transferee Specialized Knowledge, which is what I’m assuming the OP had originally referred to is a transfer visa granted to an individual with highly specialized knowledge in a company abroad to perform the same or higher functions requiring the same degree of speciality. What is specialized knowledge?

            Basically you have to possess knowledge that considers you to be “key” personnel, knowledge or skills that not many people would have at all and is almost unique toward the business that the company is in (proprietary knowledge/skills), not the overall industry that you are in. So as Vincent said, SAP consultant: probably not, as that’s not really proprietary and highly specialized or a unique skill set, although it is a good occupation/skill set to have.

            PM with DataWarehousing? Again, maybe not. I’m sure I can throw a stone in this forum and hit someone in the head who is PMP certified and has DW experience. Maybe not specialized enough, even though it sounds that way.

            But please don’t take this to mean it’s not possible. As I stated before, it’s really about how you make the case. If you are invaluable to your company because of a unique combination of skills and experience, that only your company could really reap the benefits from, then it’s a case worth pursuing and probably with success.

            In your PM with DW example: if your company had a proprietary PM framework (let’s say a hybrid PRINCE2, PMP mashup or something that only your company uses) and you’re the go-to guy in your company over there that starts and closes projects as second nature, well this is a skill/experience that’s really unique to the company. If you had DW experience that’s specific to the company and really, can’t be found anywhere else easily, that’s another example.

            I’m sure there are many other ways to slice and dice this, and this is already lengthy as-is. I hope you, or anyone else reading, find the info useful. If not, please Keep Walking and all the best.

    • is the decision approved? If yes, congrats. Post decision is for getting cards, etc. E.g. if you apply for OPT, they will first approve the petition, and then it will go into “post-decision” which means they will physically make your card and send it to you.

      • got to know the receipt in mid of Apr, and the wesite showed post decision with approval on Apr28, have been waiting for the approval notice mail since then….finally finally got the notice two days ago…..i’m a big follower of this site…..decided to post this info so that it might be helpful.

  16. I am AD/PP/VT and I just got a receipt #. My lawyer is intentionaly holding the news from me and he said he had a strong reason for doing that (I don’t know why). Don’t lose hope!

  17. My employer send me mail that your application is through the lottery but it also said this doesnt confirm your petition has been approved. they said you will be getting direct mail from USCIS but i have not recieved. few guys have recieved that.
    I am sure i have been rejected. 🙁

    • my employer also told me the same. If you get selected in lottery and no RFE generated , you will be approved by 2 months. Normally they do not reject directly. Have u got the receipt number?

      • My Employer said they have received my receipt. but he also said other candidates which were filed they have in fact received approval for petition directly by USCIS which I should have also got.
        Really cant understand what going on.

    Dont Jump in and say this is old news. Smart people will always be able see the difference in the old and new news.This is just a proposal not law.

    Still case not found… has anyone got any updates on EAC-141345XXXX. I received this receipt on April 14 but I am sill not able to track the case on website. The website shows that case is not yet found. Really getting nervous now.
