H4 Extension Biometrics Experiences – USCIS – H1B + H4 + EAD –Docs

In H4 Visa by KumarUpdated : 3462 Comments

As many of you know, USCIS changed the form I-539 for Extensions, added Biometrics, which delays overall processing of H4, even if it is filed with H1B in premium processing. Many are waiting for experiences and wanted to have a look at sample Biometrics Notice as well. One of our awesome readers, anonymous for privacy, shared a copy of the Biometric Notice as part of the new H4 and H4 EAD processing and shared his timeline. Thanks a lot to him for taking time to share his experience. We also have many users, who shared their experiences in the article, they are further down in the article and in comments.  In general, biometrics is not required, if you are  applying for H4 EAD only and not using I-539 form for H4 Extension.

Background of H4 Extension with New I-539 form filed with USCIS for Biometrics:  Applied for H1B, H4 and H4 EAD together in Premium Processing at Vermont Service Center.

H4 Extension with USCIS – New Biometric Process

  • You file the H4 application with New I-539 Form that includes additional fee for Biometrics
    • Most of the cases, you file along with H1B. If H1B is filed in premium, you will get the H1B approved, and then H4 processing happens as it needs biometrics. USCIS guidance is that they will adjudicate it soon after biometrics are done.
  • You get H4 Application Receipt along with H1B and EAD receipts
  • You get the H4 Biometric Receipt physical copy in snail mail to visit Application Service Center (ASC) that has date and time
    • If you cannot make it on the given day, you can request for re-scheduling.
  • You visit ASC on the given day and time and give Biometrics.
  • Your H4 Biometrics may go through criminal history check of FBI
  • Decision on your H4 application with USCIS
  • Physical copy of H4 Decision Notice mailed to your address.

The process is as it stands today, we will update it based on general users’ experiences as we go along.

H4 Biometric Documents Required at the Application Support Center :

  • The Biometric Appointment Notice sent to you by mail
  • Photo Identification Document issued by Government like below
    • Passport
    • Driver’s License,
    • National ID
    • Military ID
    • State Issued Photo ID.
    • If you fail to get Photo ID, you will not be fingerprinted / allowed to take biometrics.
  • It is recommended that you review that H4 I-539 application form that you submitted or sent to USCIS, so that you can confirm, if all the details are the same.
  • Any additional Biometric forms : USCIS does not have any special biometric forms and there is no need to fill out any separate forms related to Biometrics to visit the ASC.

Experience of Giving Biometrics at Application Support Center

Giving Biometrics at ASC by H4 applicant is a very straight forward process. As mentioned above, you need required documents : Government issued Photo ID and Appointment letter. Below are the high level steps at ASC for biometrics

  • Step 1 : You are given a Token Number and will be asked to fill a basic form
  • Step 2 : You need to fill the form Applicant Information Worksheet (AIW), given to you, where you need to fill in information like Name, Date of Birth, Eye and Hair Color, Height and Weight, etc. Below is the sample shared by another user. Thanks to the user (anonymous for privacy) for sharing the form with the community.
  • Step 3 : Your token number is called and they will take your Photo and Fingerprints
  • Step 4 : They stamp your Biometrics Appointment Letter after the process is complete. The stamp indicates that your biometrics are taken proof that you visited the ASC. See below sample of the stamp given at ASC. Thanks to our user for sharing the stamped letter at ASC. At the end of article we have the full receipt notice with stamp as well for your reference on how it looks.
  • Step 5 : Wait for the decision from USCIS. Your Biometrics status is may or may not reflect on the USCIS status. Sometimes, you will continue to see the status “Case Was Received” , which is the status before  giving the biometrics.
    • Update : One of our readers shared that they have seen a status update on USCIS that says ‘Fingerprint Review was completed’. So, some of you may say this status
  • Step 6 : Decision from USCIS [ waiting for it. ]

What will USCIS do with the Biometrics given by you ?

USCIS may use your biometrics/ fingerprints to check criminal history of FBI. You may request a copy of your own FBI identification record using procedures listed at Title 28 C.F.R., Section 16.32. You may also get it corrected or updated as outlined within the same Title 28 C.F.R., Section 16.34.

H4 Biometric Appointment Letter from Application Support Center (ASC)

Even though some of you may know the standard Biometrics Letter from USCIS, it is good to re-confirm the same and have a look at the same ASC Appointment Notice . Again, thanks to our reader for sharing the Biometric Appointment Letter. See below screenshot at the end of article. It has the below details  on the same

  • H4 Petition Tracking Number
  • Name and address of the applicant
  • Application Support Center (ASC) Address
  • Date and Time of Appointment at ASC

Key info from the Biometric Application Support Center (ASC) Appointment Letter :

It says that you to process your H4 application/petition with USCIS, you need to appear at the Application Support center  of USCIS at given time and date and give biometrics. If you do not show up at the ASC, then your application/petition will be considered as abandoned.

Can I reschedule my H4 Biometric Appointment with ASC ?

Yes, you can request to reschedule your appointment, if you cannot make it to ASC on the specified data and time. The process is simple, you make a copy of the Appointment letter for your records, check the box as listed in the ASC Appointment Letter and mail the Original letter to  below address:

  • BPU, Alexandria ASC, Suite 100, 8850 Richmond Hwy, Alexandria, VA 22309-1586

Also, if you have open wound or bandage/casts, when you appear for appointment, USCIS may reschedule the appointment if they believe that they will interfere with taking the biometrics.

What if I am outside of the Country ? H4 Biometrics with Travel and outside of USA ?

USCIS H4 Biometrics - Travel and Outside of the country

As per USCIS guidance, on their I-539 form instructions (page 12), you should call up the nearest US consulate/ embassy and arrange for the biometrics. It says “If you are currently overseas, instruct you to contact a US Embassy, US Consulate or USCIS Office outside of United States to setup an appointment “,  see below screenshot.

What are not allowed at Application Support Center for Biometrics ?

You cannot carry Cell Phones, Cameras or any Recording Devices to the Application Support Center (ASC), when you go for giving biometrics.   Also, due to limited seating, they suggest that only person giving biometrics and who are necessary for transportation or helping with biometrics should be entering ASC.

Any questions on the H4 Biometrics Application Receipt or process – Customer Support ?

You can call the customer support at 1-800-375-5283, if you have any questions around your Biometric appointment Notice or any of the details around the same.

Can you Travel outside of Country, with H4 Extension/ COS Pending with USCIS ?

Yes, you may travel out of US, but if you travel, your pending H4 Extension / COS with USCIS will be considered abandoned.  There are few scenarios with H4, H4 EAD and travel, read Travel out of US with H4 Extension, COS or H4 EAD Pending ? Options ?

Can you continue to work on H4 EAD, with pending H4 EAD Receipt Notice ? Do you get 180 days automatic extension ?

  • Couple of my observations:
    • Receipt Numbers generated by USCIS is not exactly in the order of application received date. Some of the receipt numbers before mine were from April 18th while my receipt date was for April 17th. This gives us an impression that some how April 18th applications are approved and they might have skipped some of the April 17th applications.
    • My status got updated on Aug 22 at 3AM Pacific time. Probably some cron job updates status in bulk. IMO your case might have been already approved but it does not reflect on the website.

  • I did raise an expedite request through USCIS and Congressman, both of which got denied immediately. Finally logged another request on August 30th stating that my EAD was going to expire in 4 days. I received a mail stating that the case is already with an officer and there is no need to expedite it.
  • Also when I called USCIS to raise the expedite request, they told me, NSC received Bio-metrics for my case on August 21st. This was not updated on the online portal. So that might explain why a lot of people are seeing ‘Fingerprint review complete’, because NSC started to get actual bio metrics information in third week of august (smh). I hope this is a sign of the process getting streamlined and hopefully this will trigger faster approvals for everyone who are waiting.

  • May 30- H4+EAD filed with H1B PP at CSC
  • June 6- H1 approved
  • June 17 – completed Biometrics
  • July 20 – Had to travel to Canada. I had expired visa but valid H4 i-797 upto Oct 2019. Asked many forums, company attorneys, even called USCIS and was told I am eligible to travel under 30-day rule, automatic visa revalidation. USCIS said my applications should not be affected since I would not get a new i-94
  • July29 – Returned from Canada. At vancouver airport, the visa officer first denied entry. Then a senior officer in back office gave me entry but issued a new i-94 and online i-94 showed F1 status.
  • Aug 10 – CBP i-94 correction office corrected the status back to H4 but was stuck with new I-94. Didnt know what would happen to my applications. Company attorney said if RFE comes, we will address it.
  • Sep 5- EAD application changed to “new card is being produced”.
    • H4 / EAD Approved in 99 Days after filing
    • H4 / EAD Approved in 81 days from Biometrics
  • Sep 6- EAD I-765 was approved
  • Sep 10- EAD mail picked up by USPS.
  • Sept 11- Called USCIS why H4 was still “case was received”. The rep told me they mailed the H4 I-539 approval also on Sept. 6th itself.
  • Sept 12- Received the EAD card and H4 I-797.
  • I have same experience as many users that online status of H4 did not reflect the approval. I was super worried that I would be given EAD up to Oct 2019 and my extension would be denied because of my new I-94 after Canada trip. But Everything worked out finally. Got EAD and H4 approval for 3 years upto May 2022.

  1. Shilpy

Hi, Can anyone tell me how much time it takes to get the EAD card after it says new card is being produced? My Ead status changed to new card being produced on September 7th and H4 extension still says fingerprint review completed.
I called USCIS today and they said that H4 was also approved on the same day and both H4 and H4 EAD approval notice were mailed yesterday but the officer said the EAD card is still in production.

I am waiting to Join back my job, if anyone is in same boat or have any information on how many days it takes for the card to be mailed after it goes in production then please share, it would be really helpful.
    Thanks

    1. Ay

You can join your job if it is approved tell your employer that you will get it within a week he/she should be okay it only took 2-3 days maximum to get my card the last time I applied

      1. Shilpy

It says everywhere online that you need to have physical card in hand to start employment. I am confused. Even uscis officer said that i need to wait for the card to join job???

        1. Ay

It does say that but it’s kind of a grey area your start date will be when your card is produced you can take the chance and join if you want to that is my opinion rest depends on your employer

    2. AKB

      Hi Shilpy,

one quick question regarding your job, once your card expired, whether you got terminated from the job or whether you took unpaid leave or something else? Could you please explain the procedure. Did you get any opinions from somebody. Mine going to expire 18th, I am not sure whether I get approval or card before that. So I am not sure what I want to update my employer.

      1. Shilpy

My employer had to terminate me as the company lawyers said that it is not legal to keep me on unpaid leave and I-9 needs to be terminated.

They have to rehire me now.

        Thanks!

  2. larabara

So how do you guys expedite the case? I called USCIS. They kept me on hold for about 30 minutes and at the end of it, they told me that my EAD processing time is within the 5 months period at Nebraska so they cannot raise expedite request. ( Its in May beginning so makes sense). But how are they taking expedite request for others( which are eventually rejected)? Is there a different number we need to call?

Side note: Be positive about H4 EAD scenario. Do not panic. Everything will be alright. Stay positive.

    1. ds

      Hi Irabara,

They just changed it to 5 months from 3 months, let them know that when you filed the case it was a 3 month time period, share with the representative the urgency of your case, tell them if you an emi to take care of, or losing job would impact your finances, sharing everything you feel would go wrong if you lose your job because of the delay and then just pray and be ready for a denial and then try again , I know how stressful it can be but we can do only what is in our hands.

  3. wes

Fingerprint review completed on Auguest 24th. Called USCIS today for my H4 + EAD, was told that my case is already assigned to an officer.

Does anyone knows how long it takes for the officer to process my case if it’s already assigned to him/her?

    Thanx

          1. wes

asked my congressman to follow up but it was denied. one week later my status was changed to fingerprint review complete. don’t think it’s related because a lot of people see their status changed to this during aug 21 – 24

          1. wes

no the case still says fingerprint review complete I called and ask to expedite, they told me it’s assigned to an officer so they can’t expedite it any more

In between tried to expedite a few times by calling USCIS and also working with our Congressman, neither avenue succeeded and we didn’t get to submit any documents either.

However, the status on the EAD got updated on 08/16/2019 to say that they have received documents that are being reviewed by the officer

08/21/2019: H4 status said Fingerprint review completed
09/03/2019: EAD status said New Card is being Produced
    09/05/2019: EAD card was shipped
09/09/2019: EAD card received in the post with I-797 approval for I-765
09/09/2019: called USCIS about H4 status since no change was observed since 08/16 and were informed that H4 was approved on 09/03/2019 as well, but has not been shipped yet. Moreover, they said that the applicant is allowed to rejoin work (old EAD expired on 08/23) on the basis of the approved EAD card
FYI we did not participate in any litigation

Just can’t thank this group enough.

      1. Divya Sarin

No, I will keep expediting, the uscis representative whom I raised my request was extremely understanding and the message for denial which I received was this

The status of this service request is:

We cannot grant your request for expedited processing of your case.

Although your situation appears serious, the explanation given does not provide enough information to qualify for expedited processing. You must demonstrate you meet one or more of the criteria listed at the following link: https://www.uscis.gov/forms/expedite-criteria

All expedite requests are reviewed on a case-by-case basis and are granted at the discretion of the Director.

I am so stressed and will keep expediting the request. Any one received any approvals from the month of June, please advise?

        1. AJ

I am sorry to hear about the stress and uncertainty you and family are going through. Currently it seems NSC is processing mid April applications. It should take another 30-45 days for them to get to June applications just based purely on current rate – unless something changes.

        2. Ay

          Hi divya

I have tried expediting so many times they don’t listen and lady on the phone was nice to me also but I think yes we should try every route

      1. DS

        Hi H4-NSC,

I called the uscis , wait time was 30 minutes to be able to speak with the consultant, when I was connected, I explained my whole situation, how losing job would put us through financial strain, the lady was very understanding and heard my plea for good 10 minutes, she said a visa officer would reach out for further documentation if needed, I never was requested any documentation and my expedite request was denied with the above message. So I don’t know what documentation they might need.

        1. H4-NSC

          @DS
Thank you for letting me know. I am asking about the expedite request through congressman.
Did you already submitted any docs for the expedite request through congress?

Guys, after the EAD card expires, can we go on Loss of Pay leave or should be terminated?
I just had a meeting with my employer and they said, it is not legal to go on unpaid leave and they have to terminate the job?

Please let me know you experiences or any information you have.

    Thank you

    1. Argos

What your employer said is right. There is no unpaid leave when your I-9 expires, they have to terminate you and rehire you. I have been terminated from my job on Sep 05, once i receive the card on hand then they have to re hire.

    2. Neer

I can empathize with your situation. My wife’s job was terminated too. You can ask if they can hire you back once the EAD arrives.

It is true that employers cannot continue employment because the form I-9 has to be valid. All the best

    3. Amrutha

You can be placed on unpaid administrative leave if your employer agrees to it, refer to this article:

  11. Rajesh

Filed for H1/H4/EAD COS on 04/26 in California. H1 got approved within 7 days. Still waiting for my H4 & EAD after my biometrics. Expedite denied all 3 times. Is there anyone else whose H4/EAD is pending since 04/26. I see applicants whose date is in may getting approved before April date. Anyone?

      1. May22_CSC

Mine is May 22 at CSC. Here’s the time line

May 22 – H4 and EAD received at CSC
June 6 – Name updated on EAD
Aug 24 – Fingerprint review completed on H4

No updates after that. My current EAD expired Sep 30

  12. Neer

    H4 H4EAD approval
    Center – Nebraska
    April 8 – Receipt date LIN191435xxxx
    May 2 – Biometrics
    Aug 27 – Case approved
Sep 4 – I-797C copies received in mail
Sep 5 – EAD card in mail

Delays have cost us dearly in terms of job loss and emotional well being. Would encourage everyone to apply asap.

    1. Ag02

      Hi,

My H4 receipt date is 25th March at NSC. It was filed in normal processing. I am still waiting for approval. My case has already passes normal processing timeline. I have raised an SR but it will take 3 weeks to reply.
I need to travel to India next month.

Can someone suggest what could be done? Anyone else H4 also pending frm March in NSC?

      1. Ag02

        Hi sk,

I called the uscis helpline no and asked them to raise expedite request, but they said since its already outside processing timeline, they cannot do it. It has already been more than one week since I raised a SR for my case, but still no update in status.

  13. Shilpy

H4 EAD Status changed to New Card is being produced (NSC)
    My case timeline:
    H1/H4extension/ H4 Ead in PP
    Receipt Num. – lin1916050***
    Receipt Date – April29th
    Biometrics: May 20th
Raised 3 expedite request in August, all were denied the next day without asking for evidence. Last expedite request was raised on 08/15.

August 21st- Status Changed to fingerprint review completed.

Sep 7th- H4 EAD status New card is being produced

H4 Status still says fingerprint review completed on August 21st

Good luck to everyone who is waiting.

Can anyone share their experience where H4 extension still says fingerprint review completed and how much time it takes to get both the approval and physical card? I am waiting to join back my job my previous EAD expired on August 26th. Will appreciate your responses. Thanks

    1. Ay

      Hi

Same happened to me they never sent me an email asking for documentations I am going to loose my job too what time did your status change ?

      1. Shilpy

Called USCIS customer service but I do not think the expedite request helps as all three were denied the next day without asking for evidence.

      1. Shilpy

All three requests were denied the very next day I raised them. I was not asked for any documentation or evidence so i do not think that expedite request helps.

    2. AKB

      Hi Shilpy,

My question regarding your job, once your card expired, whether you got terminated from the job or whether you took unpaid leave or something else? Could you please explain the procedure. Did you get any opinions from somebody.

  14. May3rd

My EAD is expiring this week. Hope i get approval this couple days. Last expedite was denied in august first week. Not sure if expedite or just wait.

    Anyone get any approval today?

      1. AKB

Oh April 25th case not yet approved. I loosing all my hope. My case is on May 8th and my EAD going to expire on 18th. Going to loose the job 🙁

I have seen few people got approval for May RD

        1. Amrutha

My EAD is going to expire 13th and my receipt date is May 7th from NSC, really wishing it gets approved this week but losing hope after my expedite request got denied last week.

          1. Finally.....

I was in a similar situation. EAD was going to expire on Sept 1st. I logged an expedite request on August 29th. I told the call center person that I will not be able to work after Sept 1st. They created an expedite request. On August 30, I got a mail saying that my case is already with an officer. On the same day, status changed to ‘New Card Ordered’.

So I think try expediting again a couple of days before your EAD expires. Not sure it helps, but give it a try. Good luck!

  15. Naga

    Hi,

My RD date for H1+ H4+H4 EAD (PP) is May 15th.
    H1 RFE – May 29th
    Biometrics done – June 6th
Finger Print review completed – August 24th
    H1 rfe response received – Aug 26th
    H1 Approved – Aug 29th
No updates on H4 or H4EAD.
i am trying to raise a SR at
    https://egov.uscis.gov/e-request/displayONPTForm.do?entryPoint=init&sroPageType=onpt

I am getting “Your application or petition is currently within the posted processing times. An inquiry may not be created at this time. Further information about recent processing times can be viewed on the uscis.gov webpage.”

Is this the correct url to post SR’s?

    Thanks,
    Naga

    1. Sonali

None of centers are now accepting SR for May 15. Find your centers last receipt date when you can raise an SR
      from here
      https://egov.uscis.gov/processing-times/
You can only raise SR when you are past their posted date.

      1. Naga

Thanks Sonali. I see lot of people here posted they raised SR even though their RD is in june and july. So was wondering if i am wrong with the url.

        1. Sonali

That’s not SR, that’s expediting. You can call USCIS and ask to raise an expedite request. In most cases I guess it was pretty fruitless. But no harm it trying. Good luck. Call and tell them and be ready to explain your reason why you think they should expedite. I guess you need to send some documents as well. Check other experiences too.

    2. Ay

      Hi

People are not raising SR they are expediting those two are different things you can cell them and request to expedite their are chances that the expedite request will get rejected but you can give it a try

    1. Saloni

My RD is Apr 08 and application is with CSC. Status changed to Fingerprint review completed on Aug 21. No update since 🤷🏻‍♀️

      1. Sonali

Thanks guys for responding. Your cases are even earlier than mine, hope they bring some order to this chaos soon. You can probably raise an SR by next week. Fingers crossed!

  16. ETBT

My timeline for the benefit of others here
    CSC – WAC1922xxxxx
    6/11 – Receipt date for H1, H4, H4 EAD (premium)
    6/22 – H1B approved
    7/1 – H4 Fingerprinting
7/10 – Expedite request raised (was rejected in less than a week on insufficient proof)
8/26 – Status changed to “Fingerprint review completed”
9/6 – H4 Status changed to “Name was Updated” and EAD status shows “New card is being produced”

Now waiting for card to come by mail.
    Hope this helps.

        Hi Kumar,

Can you please add a link or button in the beginning to go directly to the comments section. Every time i have to do long scroll down to view the comments.

        Thank you in advance.

  17. Redbus_Follower

Firstly Thanks @Kumar, there is no better forum for us !

Finally H4 and H4 EAD both approved –

It’s been a very anxious and stressful phase with this entire process, there are many of us in the same boat.

The trick is to hang in there and be patient – and of course try to be proactive and bring your case to attention from all angles.

Have tried Expedite request, Congressman + Senator, Ombudsman review and finally even Litigation with RN Law , practically every possible method.

Eventually you will never know which one worked, but try every which way you can and don’t lose Hope !

    Here are my timelines :
    receipt number : LIN19182***

    May 26: H1 + H4 + H4 EAD Premium Processing

    May 28: Received Date

June 10 : Biometrics Completed by Walkin

    June 13: H1 approved

June 27 : Raised an Expedite request through Attorney , same day it was assigned and denied

July 2: reached out to congresswoman, provided documentation for expedite

July 3: reached out to RN Law, but was too late to join the July 06 lawsuit

July 10: attorney reached out to Ombudsman with required documentation from employer/Doctor/Personal Letter

July 10 : Congresswoman office received response stating the Expedite request was denied

July 19 : Part of Litigation Lawsuit that was filed against USCIS

Aug 30 : Raised another Expedite by calling USCIS , the case was assigned to an officer – status said wait for a response/follow up within 30 days

Sep 06 : Both H4 and H4EAD case was approved

Sep 07 : Waiting for Card, and hoping Life wont be this stressful going forward

    1. H4 EAD

When did you get the approval ? I mean at what time,
      My RD: may 23
      H1 approved: may 29
      Biometrics: june 5
Filed 19th july litigation still waiting for approval.
My h4 status is expedite req denied
H4ead status is Request for Additional Information received and assigned to an officer.
      Stress is literally killing me.

      1. Redbus_Follower

Did your status change to Fingerprint review completed anytime in August? Call USCIS and state a strong expedite reason. Call them up often to find out what’s happening on your case.

        1. H4 EAD

Yeah, it did change in aug 21st .
Right now h4ead status is assigned to an officer, even if i call them to expedite they would say that it is already under review right, did you status change to req for add info received anytime before an approval.

          1. Redbus_Follower

Yes, same status. Got the approval within a week or so after that.
You should see it soon , dont worry.

        2. H4 EAD

After your status changed to Request for Additional Information Received, did you call uscis again to follow up to get it approved soon.

      2. AJ

Any update on your case? July 19 litigation is nearing 60 day mark, rnlawgroup has not been very transparent about the status of approval from July or August batches. Wondering if they are hiding some facts.

    1. Ay

      Hi Neeru

Your case is exactly like mine my ead has already expired and I am eagerly waiting for it contacted everyone several times no one has been of help so do you think ombudsman helped in your case ? What was the response time I have contacted them and they said they will contact USCIS and let me know
      Please let me know

    2. Patty

Thanks for sharing this information Neeru. How did you contacted Ombudsman ? Meaning which department particularity. I was going through Ombudsman for my state and found links for Environmental Protection and Public records. Nothing specific to government agencies. Thanks in advance for your response.

    3. H4-NSC

      Thats a good news!
Can you let us know what documents you submitted and also little bit about the process on how you got the ombudsman contact and how much time it took from the time you spoke to them and you got your case approved!

      1. Neeru

        Hi

Here’s the email and ph number to reach out to Ombudsman.
        [email protected]
        202-357-8100

Im not really sure if the request from Senator helped or Ombudsman, but i pretty much believe that Ombudsman really helped.

Junior Senator submitted the documents last week and Ombudsman submitted it this tuesday. We need to reach out to Ombudsman after reaching out to USCIS, Senator and Congressman.

        Thanks!

        Thank you Prakruti,
My H4 not approved yet and even don’t know how long it takes.
        My Question is
        I am I eligible to work ?
        Does anyone know..

        1. Patty

You are eligible to work in United states until your EAD (Employment Authorization) is valid. Once it expires, unfortunately you are not legally allowed to work in the US. But you can also consult with your employer regarding their immigration policies. There are companies which gives leave of absence of one or two months while you wait for approval. Hope this helps.

Whether you tried to expedite the case? or whether you did any further action on top of the case. Why I asked, because I didn’t see any others approvals who filed even on May first week.

  25. Another H4 EAD User

    Hi,
    Here is my scenario:
    H1+H4+EAD in PP at CSC
    RD– 5/20/2019
    Fingerprints–6/3/2019
    No status updates since then
8/8– raised an expedite request with USCIS mentioned abt job and financial loss
8/9–got email from uscis for more evidence
8/12–submitted docs for financial loss. Letter provided by employer
    No updates after 8/12
All of a sudden on 8/21 –Fingerprint review completed on USCIS website
    8/23–Requested senator for assistance
8/26–Senator contacted uscis, but uscis asked for same details when I called on 8/8
8/29– contacted uscis again for status updates. they said no updates except an inquiry on 8/26
8/30–H4 EAD status changed to New card produced
9/4–H4 EAD card being mailed to me
    9/5–Added usps tracker
H4 status is still case received
    9/11–old ead expiry date

I have been following this forum and at one stage I thought of going with RN law but later decided to wait. My expedited request status is still not updated and congressman request was not fulfilled by uscis. But I felt like raising awareness to uscis on our case is helping .

Good luck to all of us.

    1. Sindhu

      My case CSC:

H1+H4+EAD in PP filed on– 5/30/2019
      Fingerprints–6/17/2019
8/12– raised an expedite request through senator with USCIS – job and financial loss, my future employer Microsoft gave a support letter too. Status changed on H4 and EAD changed to “expedite request received”
8/13– but expedite request rejected on email but no status change after that.
9/5 – EAD status changed to “new card is being produced”. H4 status is still case received. So n

      Waiting for card now.
Hope to receive it soon and start working!
All the best to everyone waiting out there. Hang in there

On 9/3 I contacted RN law to join their 13th September litigation but before I made the payment, my EAD status updated. Saved me the 2800+600!

  26. MAY WaitingNSC

    Hello Everyone,

    Any approvals of MAY RD?

I am waiting for long time but still my application is pending

My H4 an d H4 EAD received date May 13th

    1. May1_NSC

My RD is May1 (NSC), raised ER which is not yet assigned to officer. Biometrics-May 20, Fingerprint review completed-Aug24. This wait is so frustrating.

    2. NoOne

      Center – NSC
      May 10 – H1-Ext, New H4 & EAD filed in PP
      May 23 – Biometric completed
      May 17 – H1 Approved
Aug 12 – Senator expedite request denied on grounds of lack of evidence for urgency
      Sep 05 – H4 and EAD approved.
      Case series LIN***695****

It is taking 4 months at NSC to get H4 approvals on average. I have been tracking the cases for quite a while now.

Didn’t file R&N litigation as we could wait and had that option. You might want to if you are to loose your job but I feel R&N are monetizing on this unfortunate circumstance of H4 spouses.

      1. MAY WaitingNSC

        @NoOne

        Congratulations…

        When did your status update?

Please let me know first 5 digits of your receipt no if you don’t mind.

        Thanks

      2. MayRDNSC

I agree with you. I’ve filed litigation with RnL .My EAD is expiring next week and I dont see any signs of it being approved before expiry. RnL is saying you can expect response from USCIS within 10 to 60 days after litigation was filed. Which in my case aligns with NSC average processing time. So i am not sure if litigation helped me in anyways. If i just have to wait to get the approval i could have done it without paying money to RnL.

          1. AJ

Thanks for sharing. I wonder if July 5 and 16 batches have received 100% approvals or if USCIS is willing to fight back on APA case in court. Assuming there is 100% result from July 5 batch (which may not be right), you should expect approval in next week or so?

          2. MayRDNSC

Even if July 2nd approval is 100%, that might be because 60 days for that lawsuit ended this week. My 60 days will be over at around 10/2. Which is 4 months from case RD. Considering current approval rates and duration I should get my approval by that time even if I would have not gone with lawsuit. My primary reason for going with RnL was to get early approval and not have employment gap. Still have 1 week so lets see..

        1. MayRDNSC

Got approval yesterday. Received an email at around 11:30 PM ET since I’d signed up for email alerts on status change. Here are my timelines again.

          5/31: Case received for H1+H4+EAD – LIN19186****
          6/6: H1 Approved
6/21: Biometrics done on appointed time
8/2: Litigation filed via Reddy and Neumann
8/8: Government was severed for class action
8/16: Submitted Expedite request to USCIS via call for H4 and EAD in morning
8/16: EAD Expedite request denied n evening
          8/20: H4 expedite request denied
8/22: Submitted inquiry/expedite request via Congresswoman
8/24: H4 Status changed to Fingerprint review completed
9/4: Received response from congresswoman office stating the request was denied by USCIS
9/9: Submitted request to ombudsman in evening but same day got approval emails at 11:30 PM

In nutshell not sure what worked but i think litigation might have played some role in expediting. Because i saw one approval earlier for RD-5/28 and that was also part of litigation. My previous EAD/H4 is expiring on 9/14 so I barely made it, pheww.. life had become a roller coaster ride. I wish you all very good luck.

Thanks a ton Kumar for maintaining this forum. It has helped me a lot . A funny way to put it – the site/forum was my seat belt during this roller coaster ride 🙂

I have raised an expedite request stating financial loss. What documents if they ask can we provide?
And how soon should I expect a reply and see it on my case history?

24th August- h4 updated to fingerprint review.

Thanks for the admin maintaining this forum and helping people. It is unfortunate and painful to see so many of us waiting for the approval, losing jobs, moving travel plans. On top of the delay, complete arbitrariness in approvals and status update. After following all the procedure, this is how we have been treated. No respect for the law which states that status adjudication should be done in 30 days. Good luck to all of us who are waiting. I wish there is a way we can come together and put an end to this and urge them to make a decision in timely manner.

Well, there are some groups already working together like Immigrationvoice on some of these issues…Maybe you can reach out to them and help out.

Did any body get a little piece of paper with some bar codes on it, to which the EAD card is attached??

One of my friend saved it when she got her EAD card…That paper said, ‘Including this paper in renewal or replacement card process will speed up your application processing time’..
Did anybody used it and got benefit out of it?
Like processed the application in less time??

  31. Deebika Durairajan

    Hi,

    H1 + H4(PP) – RD July 1st – Nebraska center.
    H4 EAD – July 11th – Vermont Center.
    H1 – approved on July 7th.
    H4 – Biometrics on July 26th.
H4 – Status changed to ‘Fingerprint review completed’ on July 30th – no status change after that.
Called USCIS to expedite my EAD process. Stated the reason as financial loss.
The representative noted down the details and provided a reference number. She also mentioned my EAD was applied on Oct, 2011(taken from my USCIS previous case history) – this was my first L2 (EAD). We corrected her and provided the correct receipt number again for recent H4 EAD and she noted down the same.
Received an email from USCIS on Aug 29th asking for further documents to decide on the expedite (but the email contained details on my very first L2 EAD) – sent bank statements and added my recent EAD receipt no to the email.
Today we received an email USCIS denying the expedite request as the reason was not satisfactory to expedite and it also referenced to my old L2 EAD (which was approved in Dec 2011 and card was received).

    My question is:
    1. When can I call again to expedite my request?
    2. Since the email referenced to the old EAD, can I call right away or wait sometime?

    Thanks,
    Deebika

    1. Ay

      HI Deebika

Atleast they asked for the documentation , so many of us have got their expedite request denied without even asking for more documentations i guess we are in a long queue there are so many people waiting for the approvals hang in there.

    2. Yogini

      Hi Deebika,
You have to wait for 30 days before you ask for another expedite request.
It happened with me too. The moment you call them again they pull up previous history & if you are not over 30 days then they will outright deny expedite request.
      Hope this helps!

        1. Amul

I opened one on 8/6 and there is no update on that req
Then I opened one more on 8/24 I got mail to to send proofs but since case was approved I ignored it
They did not ask a gap for 30 days in my case

      1. RajaKumari

        Hi Kumar and Others,
i applied for H4 extension with my spouse’s H1B approval Receipt date 9th May in PP NSC center.

H1b approved but H4 is still pending.

i did not apply for H4 EAD renewal as wasnt working, now i got a job offer but my EAD is expiring on sep 16th.

can i apply H4 EAD renewal now as a separate application or do i need to wait till my H4 extension gets approved?

attorney is saying to wait for H4 approval.

    1. Shilpy

Hi Anu, I am in same boat like you, can you please tell me how much time it took you to received your EAD after the status changed to new card is being produced?
My ead status changed to new card being produced on sep 7th the h4 still says fingerprint review completed. Will appreciate your response. Thanks

    Hi

Any approvals from Vermont center whose H1 got approval in the month of June?
    Please share your experience ..
MY receipt date is May 9th.
    H1 approved June27th
    H4 bio metrics: June 3
H4 status: Finger print review completed as of Aug 24th
waiting for H4 EAD: Case received status.

i assume from H1 approval date it might take 60 days if its vermont center, Not sure now the processing time is delayed for vermont. Please reply if any one has any information.

    1. Ay

      Hi aiswarya

My application was sent to Vermont yes I guess they are taking a lot of time and not even approving the expedite request they are just denying it without asking for evidence my best bet would be to join the litigation or wait

      1. aiswarya

        Hi AY

Thanks for the immediate response.I think to expedite we should have 60 days time for EAD expiry . if its beyond that they are denying upfront without any request for evidence. When is Ur receipt date and your EAD expiry date?

        Thanks

  34. raji

    1. administrator
      Kumar

      raji,
Thanks for sharing. It is pretty normal. Many users have faced the similar situation. Some of the received H4 after a week to 10 days…so, nothing to worry. What location is your case filed at ?

  35. Patty

Just wanted to share this response from USCIS for my Congressmen inquiry request. Obviously the request was denied but this might help people to get some clarity. My RD is 5/31, so considering this response i should not bother them until Nov. Which is difficult since my EAD ends on 9/14.

“According to USCIS records, your constituent’s Form I-765 is pending assignment to an adjudications
officer at the Nebraska Service Center (NSC). Currently, the NSC is processing Forms I-765 filed
approximately 5 months ago. USCIS records also indicate your constituent’s Form I-539 is pending
assignment to an adjudications officer at the Nebraska Service Center (NSC). Currently, the NSC is
processing Forms I-539 filed approximately 5.5 months ago. While we recognize the employment
concerns of your constituent, we are informed that expedited processing requests based solely on loss

    Hello All,

Finally status changed to “New card produced”.

    Following are my timelines:

    Receipt date: April 29th.
    Service center – Nebraska

From May till July , did 3 or 4 times expedite request by calling USCIS and through senator.

Every time I requested expedite, it got denied.

Finally tired of request raising and started waiting.

August 24th- status of H4 changed to “Fingerprinting completed”.

    September 4th- New card produced.

H4 status has no change. Now also “Finger printing completed “

Thanks to admin. This site helped us to find some unknown friends who are sharing same feelings.

Hoping and praying everyone gets there approval fast.

  37. Rahul

    Hello All,

Thank you for maintaining this forum.
Is there anybody with same situation as me?
    Service Center: Nebraska
May 06 : H1/H4/EAD filed in regular processing
    May 31: H4 biometrics completed
    Aug 06: H1B approved
Aug 21: H4 case status changed to ‘Fingerprint review was completed’. No update on EAD.

    No update after Aug 21.

I see that lot of folks are getting approvals after the status changed to ‘fingerprint review completed’ but no update for my case yet.

Is there someone who has H4/EAD approved even filed in regular processing?

    Thank you!

      1. Rahul

No not yet. I was hoping to get some update but doesn’t seem like they have started processing May applications. All approvals I saw have RD in April.

    1. administrator
      Kumar

Rahul, Thanks for sharing. Most of the cases above are either premium or standalone H4. I guess we need to wait and see, how it will work in regular processing cases. Do update your case info, if you see more update.

  38. April4_NSC_AS

    Hi all,

Anybody with receipt date April 4th received approvals?
My current EAD expires on Sep 6th, haven’t received any response yet. I have raised two expedite requests which have been denied.

Because my EAD is currently “Outside Normal Processing Request” opened Service Request, which is currently not assigned to officer.

However, upon opening SR, received the following response from USCIS:
    “Thank you for your request:
USCIS will review and process the request
    Expect a reply by September 24, 2019
Your request ID number is SR***********NSC.”

Did anybody receive such a response?

    1. Ay

      Hi

So my expedite request got denied again today 09/04 which I raised yesterday 09/03 They did not ask to submit the documents this time either I am not sure how are they reviewing the expedites in Vermont as they just seem to deny for no reason.

    2. Anonymous

That is a standard response from USCIS. Based on what we have seen in some of the cases here your case should get approved in a day or two (if not already approved).

  39. H4-NSC

    @krishsm

Thank you, i was able to see the case history.
    now my ER is completed..

Does that mean I will get a mail saying whether my ER is denied or will be processed ?
or does it mean, they are going to process ER?

          1. Anonymous

I have to convince my HR about the date of approval for rejoining. Just wanted to confirm the validity date is date of approval?

          2. RVN

I didn’t understand what validity date you are talking about . Sorry didn’t understand, probably somebody else who understood can answer this.

  40. Finally.....

    Hi Guys,

First of all thanks @Kumar for maintaining this forum which was really helpful from the beginning. I finally got my approval on Sept 3rd.

    Service Center: Nebraska
H4/H4 EAD receipt date: April 22nd
    Approval: Sept 3rd

I did raise an expedite request through USCIS and Congressman, both of which got denied immediately. Finally logged another request on August 30th stating that my EAD was going to expire in 4 days. I received a mail stating that the case is already with an officer and theter is no need to expedite it.
Also when I called USCIS to raise the expedite request, they told me, NSC received Bio-metrics for my case on August 21st.

      1. Finally.....

        @Amul

My status did not change to “Finger Print Review Completed”, but USCIS call center told me that NSC received my Bio-Metrics on August 21st, when I called them. So if you see your status getting updated to “Finger Print Review Completed”, I think it means service center has actually received your Bio-Metrics and they should be able to process your case.
I am still waiting on approval copy.

        1. Amul

          Oh ok got it,
My status changed to “New Card is Produced” on 8/30 so I just want to know how much time it takes for approval copy to get in
My EAD is expired and leave is until this weekend so feeling little tensed

          1. Finally.....

            @Amul

Yeah no updated regarding card mail for me either. But I remember, last time I got the card within a day after it was mailed.

    1. Anonymous

I called USCIS to expedite my case and she narrated me long eligibility criteria to expedite. I didn’t understand what to tell them I am eligible for.
My EAD is expiring in a week .Can they take it as a reason to expedite?
Also I have completed 148 days from receipt date.(9th April NSC)
For h4 ,Fingerprint review completed on 24th August. No update after that.
      Feeling helpless!

      1. Amul

Most of the cases whose status was updated with “Finger Print Review Completed” status either got/are getting approvals
I would say you may get it this week or by mid next week

  41. krishsm

Based on my research and experience, you will get either an email or mail (USPS mail) in next 7 days asking for additional documents (proofs) if your Service Request shows ‘Completed’, for the reason that you raised the expedite request. Hope this helps!

        1. UW_H4EAD

I never see any update in my USCIS account. It always been case received status, even earlier (last year) applications which are approved.

        2. H4-NSC

so, Login to USCIS->Case Status->verification number?
          Is this correct…
if so where do I get the verification number?

If the path I mentioned is not correct, Please let me know the correct way

    1. Ay

That’s the thing i never get an email however i can see in my case history that my expedite request is completed . After some time they just deny the request without asking for more documentation i have tried it before and email id you mentioned they are no longer in use right?

    1. Ay

      Hi

I have not seen any approvals today my expedite request was completed today but have not heard any response . The online status only shows Expedite request was completed . i am not sure when the Vermont center will start processing the applications as they are very very slow.

      1. krishsm

Based on my research and experience, you will get either an email or mail (USPS mail) in next 7 days asking for additional documents (proofs) if your Service Request shows ‘Completed’, for the reason that you raised the expedite request. Hope this helps!

  42. Gaurav

My case status was updated to “Fingerprint review completed” on Aug 24th. I put in a request to expedite the processing after that and the request got denied today. So my status has changed to “Expedite Request Denied” – you did not provide evidence of an extreme emergent need.

Does anyone know what kind of documents need to be submitted and to whom do we need to submit these docs ? Also should I go ahead and submit another expedite request since I had to travel outside of US due to a family emergency? Or would the request get processed anytime soon without me doing anything now ?

        1. krishsm

You need to submit additional information and/or documents. You may submit a letter explaining why your case qualifies for expedite processing and any documentation or evidence you may have to support your request for expedited handling.

There should be an email id for each service center. (for example, [email protected]). I’m not sure about other service center email ids.
