When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017. But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017. If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017. There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in. The total H1B Quota as of today is 85,000 and it is split like below.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
- Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
- Other H4, L1 Visas : If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.
- If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
- If you are professional planning to arrive in US from outside America, it can be really tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies. The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?
The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS. H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date. To put things in perspective, last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017… Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018. Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?
We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. Mine is Non-AD. My company started getting rejection notices (Lottery). But still there is chance to get the positive results in between these negative rejection lists. So HR asked me to wait till July Mid. Lets hope
I looked at work theme from last 24 hours. EAC gave only 30 or so approvals while WAC has given almost 200+ as per their data. What can be the reasons for delay @ EAC?
My observation is, Last year it was the same trend. EAC started giving approvals very fast and slowly went down. WAC started slowly but cleared most of the application.
All I could think of is in terms of availability of Visa officers. May be in EAC all the officers are much occupied with work(Other visa processing) or less number of officers but more work.
Hi Ram, Do they filter applications for lottery selection too or it is after lottery selection that they look into it for the first time ?
Before lottery nothing is checked.
After selection of petitions in lottery, on successful honoring of the check and if all the required documents are in order as mentioned by USCIS, the scrutiny of the application starts.
If the proper application package is not sent or incorrect fees is paid, the application is rejected straight away.
As far as I know there is no filtering before lottery.

Really tensed on how EAC is progressing now. I always thought EAC is the main Service Center for USCIS and all other are secondary but in this case WAC seems to be the main player. All we can do is wait and check daily if something comes. But the problem is their is no sync between actual file and website update. I have noticed for few after approval as well website shows CASE WAS RECEIVED.
Ya I agree, this year there seems to be loads of such discrepancy. I have no idea why. Amidst all this, unfortunately we can only wait! Hope some positive news reach the H1B applicants soon.

Yes that can happen. Maybe they decided to withdraw your petition. Maybe they just really don’t have any information and they will inform you when they get your unselected petition back and share the reject receipt with you. Rejected petition just started coming in since last week, so it might take time until your employer receives your unselected petition.

By looking at the recent updates, this year would be a large volume of RFE’s.
So thinking about what will be crunch time once PP is opened in Oct ?
Seems to be this year due to trump effect , only cases with high skill set and higher salary getting approval. My friend has got the approval and his mentioned salary 108 K $ .
I am also worried about it as mine is too less comparatively.
Also my employer says that once PP is open they cannot file for PP as they opted for it into Regular processsing. This seems to be like they are not in favour to go for PP ?? Its very confusing..
I think they are definitely evaluating based on skills required and match to the job description. I don’t think salary is being a concern for now. My offer is for $200K. Mine has still not been processed.
You can always opt for PP in later stage though filed in regular processing. Thats called upgrading your application to PP.
I agree, once PP is reinstated, most of them would definitely opt for PP. If so, there is going to much higher backlog.
I too feel that salary does not play a major role in approval. Its more about the sponsor, job and specialty occupation. If we all of these are clear, I am sure the approval is ours!

Right now, getting an approval would be a miracle that you would tell your grandkids. The only chance would be HR getting the approval but not sharing that information with you. In your case, it seems like HR didn’t get a receipt notice. So, sorry.

Is your case with EAC? EAC is only issuing only RFE; hardly any approvals. WAC gives at a ratio of 2:1 (RFE vs approvals) these days.
Did they put FY-2016 (last years) Still waiting applications into dustbin or what ? as there is no update while this years application are getting results (around 20 thousand is already processed). Last years applications (around 2000 +) still waiting for more than 1.5 Years and looks applications scrapped and trashed I believe. My goodness never expected this wait and from states.

Here’s why I think something shady is going on with your application:
So you’re saying you applied in April 2016; got the receipt notice; then months passed; it was even October; nothing happened; Fall & Winter passed; now it’s March and it’s been ELEVEN months; USCIS announced “no more premium processing after April”;…
… and you have not upgraded to premium processing? Are you insane?
Something is not right here. And I mean not with USCIS.

Richard – it maynot be quite like that. Some consultancies don’t agree for Premium processing. Also it doesn’t mean all approvals were through premium only. Most cases were doen regular processing.
I believe that uscis has put these cases aside for doing aditional scruitiny of these sponsors. But they are runing short of capacity (man power) to conduct such scruitinies.
Friends – I’m one of the several voluntary data updaters at workheme.com site. I believe we can get a good insight into progress of visa processing in each center and series, by gathering data and analysing it. This is exactly what is happening at this site. If you want, you can ask for specific data query or details such hw long it typically takes for processing after RFE etc.
These kind of sites could close if there is not much support from users and all the visibility into broader visa processing status would go away. So my humble request is let’s support it by using it (it has no ads). Thanks!

Really work theme gives some positive vibes when you see numbers increasing everyday. USCIS website is like a black box, nothing available apart from a single case status. Fingers crossed and waiting hopefully for my day of approvals.

Please talk to your attorney and verify as your I797A/B should have correct name. no this will not at all slower the process.
If your attorney tells you to do that then please call USCIS number, they help you in all the extension scenarios
Gautham, its a quite a simple process. You talk to your Attorney. They will raise a SR with USCIS and correct it no time. As other person rightly said, it is not going to affect the processing in any way. It will be corrected immediately.

I can understand your situation but the best thing for you would be talk your immigration team/attorney to raise SR or maximum go for PP(only when it opens)if you are going to have burning requirement
You know now the situation is worst among all the years. people are dying to get H1b but in actual there are hardly firms who are ready to transfer H1B, looking for GC/EAD candidates.
We have no option other than waiting
No body knows how much processed and how much left. It’s just total luck from getting picked in the lottery to getting it approved in time. Many thousands have to stop working if approvals are late or premium processing doesn’t open quickly. September 30th is on everybody’s mind.
US government before bashing H1B first should improve the processing process. Like USCIS website keep on showing CASE WAS RECEIVED and their is no update until it is approved or RFE sent. No body knows on what basis they pick petitions in VSC and CSC. It might be like government offices in India, whosoever’s file is above in the pile will be picked and worked first. Their should be some online tracking system where we can track our application reguarly.

They get the data from USCIS case status site. But all I-129 forms are tracked. The form I-129 represents not only new H1B but can also be transfers, Amendment, extensions, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1 nonimmigrant worker application.

You probably never read the comments section there, it is not only I129 for the current year H1b.,so merely we can guess anything major and conclusive from that.
@NonAD_NonIT – you say “it is not only I129 for the current year H1b”.
May be you need to take one more look at that site. It is ONLY Form I-129, and there are seperate tabs for each year. The data is almost real time, as updates happen round the clock. I’m one of the voluntary updaters of that site. The volunteers directly fetch data from uscis, so there is no question of its correctness.

This is my case.
I am in US and my company applied for H1 this year. It got picked and got receipt number WAS dated 11th April but I am still waiting for approval.
Meanwhile my current office location is closing and I have been asked to transfer to other location. This relocation requires a new LCA and H1 amendment.
My question becomes, if my H1 has yet not been approved, how will they do an amendment to it. One option I have is to Work from Home since my home location across the road from the current office (that would soon close) but that will not require new LCA.
Any suggestions ?

I have a question regarding H1B visa. I selected in the 2017 lottery and I have approvad H1B visa . But now my employeer is saying that I need to wait for some time and he has not any good project to adjust me and said to me either I should wait or I can transfer my H1B.
Is it possible that I can transfer my H1B before the stamping or I should first go for stamping, Once it wil lbe stamped then I should transfer my H1B to any other company.

You should apply for o1 visa or eb1 before end of September to maintain your h1b status..
You can transfer with your approval notice. Stamping is not mandatory.
As per fragomen it could be risk. Better check with ur new employer. Fragomen says that if previous h1 was not stamped then USCIS may choose to reject transfer. It really is a grey area

My concern is i got an offer in other company ,if i change company h1b will be valid? is it possible to transfer my H1B to new company before approval?
H1B CAN NOT be transferred before approval. As long as your company would not withdraw the H1B petition, you wont have any problem if you switch company. If withdrawal happens, then you can never use the H1B again.

No, Withdrawal of petition can be done any point of time. Even before approval if company feels this petition can be never put to use, the company has every right to withdraw it.
If you are sure that H1B will not be withdrawn by your current company and will be approved without any issues, then you can resign and go on with your new offer. After approval, you can easily transfer the visa to your new company.

I got the receipt number and status is ‘Case was Received’ , but some of them who have done masters are getting their cases approved or RFE.
But i dint get any update on this still.
And my case number starts with WAC,dated as April 11.

There is absolutely neither any sequence in which the cases are processed nor any deadlines. Hence we cant be sure when we will get approval. I am hoping that all cases will have some kind of an update by September 30. WAC center has started processing the cases falling in your time frame. Don’t worry, let’s hope that your case is picked soon and its processed.
If the Case gets RFE, then it will take much longer( No deadlines again)
Let me give you a general picture : If a case gets RFE, it takes 2-3 weeks of time to receive the RFE notice. From the date RFE is received, we will have 90 days to respond to it. Once we submit the response, generally a decision is given within two months.

It is becoming a painful wait. I have to switch jobs in October in any case, so waiting for the approvals like anything. It will be big sigh of relief if it comes without any further questioning. I hope and wish they pick up my petition and approve it quickly

Rajen, H1B visa is a game of surprise. Something happens out of no where. We just cant predict anything.
1. There are no clear deadlines for processing- So we might get approval before September or we may not.
2. The most dreadful factor is we may get RFE. If so processing is going to take much more time.
One thing is for sure, if you change your employer now in India, its not going to affect your Visa in anyway.
If your documents prove that you are skilled enough for the job, I am sure you would get your Visa.

This year Trump had promised us with so many things but nothing seems to be working till now other than being strict on H1B visa applicants.They said at end of Lottery they would publish some report on the applicants,NO REPORT till date..
This year they are not even updating the case status online timely..there are so many cases where attorneys are receiving hard copy but online it is still in case was received status.
They have closed the premium processing almost for 3 months and till now no notice for reopening it,why they have closed when there is not much progress on the current year petition cases.
Till now there are so many cases from last year which are still in case was received case.What is USCIS up to.Always the suggestion people get is to do PP for the long pending cases but only employees understand how tough it is to convey your manager to go for PP.
Only good thing what I am observing is USCIS is processing with the I797A/B very fast with normal processing..like forH1b extensions it is taking even less than 40 days even with regular processing..is it possible because they have stopped PP and they are working on these cases more than current year s petitions.
Mostly USCIS has closed EB1 green card processing too for the time being until further notice.
Sorry to say but for the applicants who are still told by attorneys to wait for lottery results,are just waiting for the rejection notices.
Very very slim chances now for them so please make a plan B.
And last but not the least please do not use abusive words here. no one is stealing anyone’s H1B. Everyone is deserving here. Why to bring this dowry and all unnecessary things in between. Abusing others you are not going to get H1b approved. this is a mere lottery process and we can do nothing but wAiring for our luck.

Vaishu,most of the receipt number for lottery selected petitions have been sent. The unselected petitions have also started coming to Attorney. So probably your employer is waiting to get all the unselected petitions.
If none from your company knows the result, then you have a ray of hope. If not, there is nothing more.

Intellitro are big time scammers. They take 4500 dollars from you and donot apply your h1b visa application. They say they are very transparent but never provide a receipt copy or even the number. Once you give money to them through techsel, they will stop responding to you or infinitely tell your application is in process. Techsel is a huge scam in partnership with Intellitro. It’s a chacha batija company… Karan from Intellitro is the Chacha and Teja from techsel is the batija.

You can but you can enter US under only one Visa category. Either H1 or H4.

‘You can’ .. how he can have H1B and H4 at the same time..as soon his H1b is approved and he starts utilizing it then H4 gets void…again to get back to H4 he has to file for status change.
As his spouse case is still not approved she would not be considered anything else but H4
Say The person is out of country. The person has an H1B approved and gets it stamped. But the person could not travel to US on H1B due to non availability of project. If the person’s spouse has H1B, then H4 is processed and can be stamped to the person’s passport without voiding the other. But in POE we can enter in only one class either H1B or H4. Say the person enters on H4, the i94 states the class of admission. In this case the person cant work, either COS is applied or they will have to go back and re enter on H1B
Your logic works when inside the country. When you are in US, you can use only one Visa.
Since the user has stated that he/she is filling DS 160(For stamping) I am sure they should have approved Visa already.

Ram, I know there is no specific date that USCIS commits to for processing. However, would you know whether 80-90% of applications are processed by end of July? Or does it go on till September? I know , some isolated cases go on for more than a year.. but, I am referring to majority (90%) of cases. Anyone has any idea? I need to start planning my move back to India to get familiar with the company in India before I move back on H1B (IF I get approval, of course)
Rahul, Most of the cases would be processed before October 1. If the case gets any RFE then it’s going to take much longer.
Last year there was a spill over and few of them are still in progress. But still majority of the cases had some kind of update before October.
You also have the option of premium processing. Once it’s reinstated, you can explore it.
Definitely not by July… it would take time till September.

Mine is like – EAC 17147511**
So logically my case should be prior to his since 148 is computer workday compared to mine being 147 and normally last 5 digits are in series as cases being processed at the intake facility.
Currently till today i have not heard anything and my case status still shows CASE WAS RECEIVED.
Does that mean – the last 5 digits doesn’t guarantee a series which cases will be processed?
Only difference – Mine is a NON-AD case.

Every case is different and petitions are not processed as per sequence number given to them, dont worry.
I have read at many Law firms’ pages that the receipt number assigned to each petition is the order in which they are processed. At least read at 2-3 different places. Can’t say if it’s true or not.
Well, I am not sure. Also, in general, the number is assigned to all types of petitions that are submitted using I-129 form, which includes many types of visa applications such as H-1B, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1,etc.
Why unfortunate? It is not rare case to receive RFE. Infact, right now there are more cases in RFE than in Approved at WAC. There are probably about 12K cases in RFE at both centers, against around 16K approvals.
Hi – My attorney sent an email earlier today that my petition has been approved. The status on USCIS website still shows as Received. I guess it takes time for the status to change there.
Yet to get the hard copy . Also, yet to find out if COS was approved.

PR, transferred cases are usually processed like any other normal case.
But from few handful examples I know personally, a few have gone to RFE and the rest are still in transferred status.
A whole lots of Transferred cases are already approved (ref: worktheme.com)

Andy, USCIS can reject a petition without RFE.
There is no rule to say NOID or RFE to be issued first. But usually it is done.
I have seen direct denials for application with incorrect fees amount or application not correctly filed. Rest, I have seen only NOID or RFE coming first.
I got denied last year directly due to incorrect start date on petition. Sounds a silly mistake from employer but I can’t explain how painful, heartbroken and helpless I felt.

I am currently on L1 with company A. They are planning to send me back to India in October start. Company B applied for my H1 in Consular Processing this year which is picked in Lottery but i am still awaiting approvals.
My query is when Company B can apply for COS – Is it just after approval of petition? We are hoping Premium will open close to October and will make that process faster.
Also, when my COS from CP is pending – can i stay in US with out job based on 60 days grace period.
My main query is if H1b with CP gets approved in say August end. By when we can file for the COS – is it immediate or after Oct 1.
I don’t want to go to out of country to come under consulate interview situation.
If my COS is till pending in October 1st week? Can I leave my current job and stay on COS pending(not work) – is their a grace period over there?
Since your CP is already in progress, COS can be applied only after H1B approval. Immediately after H1 is approved, the COS can be applied.
About staying in the grace period, please talk to an attorney or an immigration specialist.
I have read at many places that once we are eligible to work on H1 , in case from transfer from L1. The period of 60 days is allowed to find a job and complete other things.
The rule which came on January 17, 2017 clearly states that.
But that 60 days grace period is when you are on H1 right. When your H1 is approved as CP, your i94 still states that you are on L1. So unless your COS is approved, how can you avail that 60 days grace period?

Ram, Any approx idea till when we can receive approvals this year? Mine was CP in initial application so i am thinking it will be faster than COS cases. I have my eyes set on July 31st, if all goes well, i should have approval notice in my hand.

According to your past exp, when do you think Premium Processing will open again. Don’t you think it should open before September End. Else so many students who are currently in Cap Gap mode will have to leave their jobs(if not approved) and might depart US as well. This is kind of a huge business loss to companies.
