News Updates – Official and Unofficial :

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • June 14th, 2016 ( Unofficial ) : USCIS has started to mail out the reject notices for FY 2017 petitions that were not picked in lottery. It says that the start date for next year H1B season is April 1, 2017. You can check out the Sample Reject Notice for FY 2017, Details
  • May 2nd, 2016 ( Official ): USCIS issued an alert earlier today indicating that they have completed data entry of all the petitions. They will start to return all the petitions that were not selected in the lottery. There is no SLA mentioned by them, so everyone has to wait. They also say not to call USCIS for the same. USCIS said that they will issue a notice telling that they have returned everything once the return of all application is completed. You need to just wait for your petition details now.   • April 26th, 2016 (Unofficial): Many users are now posting updates as comments that they are receiving their regular processing petitions, which were filed under non-advanced degree. Also, the SEVIS updates are happening to F1 students who applied for H1B. You may check with your DSO on the SEVIS update…but, not all of them will share the details.  Anyways, we still have a long way to go folks for regular processing petitions, do not give up hope, if you have not got a receipt yet…for premium processing folks, you stilll have time, but the chances are getting slim as we inch towards May 12th deadline…
  • April 22nd, 2016 ( Official ) : Premium Processing Update : USCIS did an official press alert indicating that the Premium Processing for FY 2017 cap subject petitions will begin from May 12th, instead of originally announced May 16th. What it means is that the you should get H1B receipt by May 12th, if you filed under premium processing and you should have the adjudication done by May 27th. You can check alert here
  • April 20th, 2016 ( Official ) : Prepaid Mailers USCIS  Alert : USCIS released an alert earlier today stating that they will NOT use pre-paid mailers for two weeks after premium processing starts. They will NOT use these for about 2 weeks to avoid delays and will use standard mail to send out notices. Typically, employers can send pre-paid mailers ( postage paid by employer) in the H1B Package that can be used by USCIS to send out notices, which could be for employer tracking and speedy delivery. Now, due to resource constraints, USCIS will not have time to do that, so they are suspending using those prepaid mailers for two weeks after premium processing begins for FY 2017 season. They will resume using those mailers after the completion of the given 2 weeks. Check USCIS Alert 
  • April 18th, 2016 ( Unofficial ) : Many are wondering, if there are really case numbers sent out for Regular Processing Petitions. Few of our users have updated that they have received case numbers for regular processing petitions. Below is a screenshot of one of such H1B Cases status.  The regular processing case numbers can come in anytime, but there is no SLA for USCIS to send them before May 16th.  So, no need to worry, if you do not get it…just need to wait ! H1B 2017 Regular Quota Petition Case
  • April 14th, 2016  ( Unofficial ) : Many of the users, who filed under Advanced Degree Premium Processing are starting to get Case Receipt Numbers indicating that they are selected in lottery and case is being processed. Also, other premium processing applicants under general quota are getting receipts as well, but less volume. I have seen one user filed under Regular Processing and Regular Quota post saying that he received receipt number.  All in all, receipts are being sent to many of the premium processing applicants and some of the regular processing applicants. If you have not got anything, nothing to worry or panic, still there is a long way to go…just stay calm folks. All of this update is based on our H1B Tracker and comments on the blog by many of our users.
  • April 12th, 2016 (7:15 PM EST – Official ):  USCIS Released a press alert indicating that they received over 236,000 petitions for FY 2017 and lottery was conducted on April 9th, 2016.   • April 12th, 2016 ( 12:50 PM EST – updated ) : (Unofficial )- It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing. What it means is that USCIS has already conducted lottery. We will keep you posted with updates. If I am not wrong, they are just drafting the press release now. Also, few of our users in community updated their case statuses, indicating that their cases were picked in lottery and their case is in processing mode. Check H1B Tracker .   • April 11th, 2016 : No official or unofficial update on cap number or the lottery. We are in waiting mode.
  • April 8th, 2016 : There are few Indian news sites stating that there was an interview with AILA president and they are guessing of having about 250,000 petitions filed this year. This is speculation, but as it comes from the president of AILA, it carries weight. We will NOT know the official number, until lottery is done and USCIS releases the press note. They also say that most of these were filed by Indian IT Companies like TCS, IBM. Below are the News articles that state this.
  • April 7th, 2016 ( Official ) : USCIS updated that H1B Cap for FY 2017 was reached today and there will be lottery.   • USCIS H1B Visa Cap Reached For FY 2017April 6th, 2016 :  We are in waiting game…No update today either from either official or unofficial sources…
  • April 5th, 2016 :  As of today, No news updates either official or unofficial. We are just waiting…

  • March 16, 2016 :  USCIS released a press note telling that they will accept petitions for FY 2017 from April 1st and the premium processing clock will start from May 16, 2016. Read more at USCIS to accept H1B petitions from April 1st

Key Timeline for H1B Lottery and Results, Premium Processing  : 

  • May 16th, 2016   May 12th, 2016 : ( Updated based on USCIS News on April 22nd ) USCIS Mentioned that Premium Processing will begin no later than May 12th, 2016. May 16th, 2016. Means that, if you filed your petition under premium processing, you will start to receive receipt notices, if you were selected in lottery around this date.
  • H1B 2017 Lottery Date :  You can expect the H1B lottery date to be in the week of April 11th, 2016.   Last year, the lottery was conducted on April 13th and the year before it was April 10th.
  • H1B 2017 Lottery Results : This depends on many factors and there is no hard fast date. Last year, USCIS did a news alert indicating that they have returned all the rejected petitions on July 14th. So, you can expect the last date for receiving lottery decision around mid July 2016. …depending on the number of petitions filed this year, it may be earlier or even later in July or even early August 2016…

    My employer sent rfe response to USCIS , rfe questions are on client related information.

    Here my project end date is 31st Dec 2016 (every year renewal) as per statement of work , so will it be any problem to get approval?

    Why I am thinking it because it’s 3 month from 1st Oct 2016.

    Can you please guide me here as per your experience ?

      Submit current SOW and old SOWs to show that it is renewed annually. Submit a letter from a BRM or similar executive vouching for your case.

    Till now, I didn’t get any response from the employer for my application. They are saying they didn’t get my package return yet. What should I hope? Is there any chance for a positive news. Please give me an idea…..

            Hi Saurabh,

            My lawyer has not received any receipt notice neither any returned package. He says he has mailed to USCIS. This is standard procedure.
            If not heard from them till 31 August then only will call to USCIS.
            Is there any such procedure? USCIS mentioned on their site that any case like this can call USCIS for further assistance.

          I too didn’t receive package neither receipt notice/ RFE.
          Lawyer says he has mailed to USCIS and waiting to hear from them. If don’t get reply by 31 August then only he will call USCIS.
          Is this the procedure? USCIS is telling upfront that some one in this situation should call them…

    Hi Saurabh,

    I am working for client A from employer A, This year H1B processed by employer B and selected in lottery.

    I am planning to go for stamping for employer B once petition approves. Client A now is willing to transfer H1B.

    If transfer is delayed or petition rejects/RFE. Can i still travel to US and work for Employer B?

    Is it safe to do a transfer while outside US or do a transfer in US.

    Please advise me. Thanks.

      2nd time H1B,

      Approved petition from B is not impacted by the decision made on A’s petition. You can still travel through B even if A’s petition is pending, approved, denied etc.

    If my place of residence is Delhi, can I still appear for stamping process at US consulate based in Hyderabad?

    The appointment available in Delhi is more than 2 months away, whereas in Hyderabad the slot available is in 10 days.

            You have to appear for visa stamping. The process for it is to completed DS-160 form online, pay the visa fees and then schedule an interview using the submitted DS-160 confirmation number.

    Hi Saurabh,

    My friend is in a peculiar situation (don’t know if this has been addressed before. If it has been, please direct me to the appropriate thread). She previously worked with a client X through current employer A during June 2015 to Jan 2016. She had started working for the client after LCA approval and I-129 was filed by A in June 2015. She had returned to India after completing client assignment in Jan 2016.

    She got to know that her petition got an RFE in June 2016 and responded to it (I don’t know how it took 1 full year for I-129 and still decision was not made!!). Assuming that her petition from June 2015 was approved, she accepted a full-time offer with a US employer B in May 2016 and provided a joining date for Aug 2016. Since she got RFE after tendering resignation with old employer A in India, she is not sure if she can ask new employer to file for H-1B. How should she proceed? Kindly let me know if you need further clarity on this to provide your input.

      Bhargav,

      So she has an approved H-1 and the amendment petition received RFE, correct?.

      B would still be able to file cap-exempt petition for her using the original approved petition. Any action taken on the amendment doesn’t invalidate her original approval.

        Thanks for your quick reply. My friend’s employer informed that the RFE was received on a bridge petition. Yes, she did have an approved petition with a different client Y (but she could not work on an assignment with them) before working with client X. So, does the term “bridge petition” indicate that Y cancelled their H1B before the petition with X was filed?

        If her prospective employer files for H1B now, would the new petition depend on the outcome of this RFE?

          The new employer can still apply H-1 for her using the previously approved petition. The intermediate petition’s RFE wouldn’t impact the outcome of this H-1. She should also disclose entire case history w/ new employer’s attorney so that they are aware of what’s happening and don’t get surprises later.

            My friend just got an update that her I-129 was denied per the USCIS case status. I am presuming this means here H1B filed for her work with client X was denied. Her employer is not revealing details of why it was not approved. Does this mean the time she had worked for client X become illegal time in US?

            Her prospective new employer hasn’t yet filed for H1B because they wanted this existing RFE to clear up. Considering that she now got a decision, can her new employer file for a cap-exempt petition?

            She was working on the basis of pending petition, and so she didn’t work illegally. Had she continued to work after amendment was denied, she would have been working illegally.

            The new employer can still use the old approved petition to file a cap-exempt petition for her.

      If ABC is at a different location from XYZ, it may not be a good idea to submit ABC information. Change in location requires new LCA, which cannot be done while petition is pending. What is your attorney suggesting? Is XYZ project no longer available?

    My petition is selected in lottery and waiting for petition approval. I am outside US now. Can i transfer to a new employer from outside US.
    My question is should i do a transfer after petition approval or after Visa stamping.
    Which is the better way or should I after reaching US. Any issues?

      Another employer can apply for cap-exempt petition once the current petition has been approved. It is not required to have visa stamping done through this employer first.

        I am in the same situation. I am outside US and I want to transfer to new employer. My question is, can new employer apply for cap-exempt petition when my skillset is not under cap-exempt category?

          Skillset has nothing to do w/ cap-exempt category. If you have a previously approved H-1 petition, and an employer has a H-1 position matching your skill set, then go for it.

      No impact. I assume you are outside of US. When you appear for stamping, just carry your most recent passport.

          I have a very similar case as Pratap’s. My petition is selected in lottery and I am waiting for approval, I am outside US.

          My wife has my name endorsed on her passport.

          Do I need to get her name added in my passport as well?

          My current client has a contract from 2010 till Dec 2016, can this have an impact on approval or further stamping and there are very slim chances of contract renewal. So what are your suggestions?

            Not required to have her name in your passport, but good to have. You can still show the marriage through other documents like her passport, marriage certificate, wedding card/album etc.

            If applying through a big reputed employer, contract end day may not be an issue especially if a person from senior management is ready to vouch for the case. If applying through a small employer, this could be an issue.

    My Employer received two receipts number on behalf of my name for H1B. I am checking the status for both and it is ‘case was received’ for both receipts number. I am confused that why two receipt numbers has been sent by USCIS on behalf of me?

    Anyone, Please let me know what will happen in that case?
    Both receipt numbers will reject or one will reject and one will approve?

    I am regularly asking to my employer to update on this. But, Still there is no update for both the cases.

      It is very subjective question and no one can provide a precise answer. It varies from case to case. Ask your employer to provide RFE details when the same is received.

    “On July 8, 2016, we approved your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC16145XXXXX”

    Does this mean my petition is approved? If so wen shall b the min expected date bfore which I can opt for Visa Interview & be ready for travel?

      I think that after all they are not going to follow the number sequence… The case WAC1614251875 is still in “approved” state…

      Yes, it has been approved. You can appear for visa interview anytime now depending upon slot availability. Earliest you can enter US is Sep 20th, and earliest you can start working on H-1 is Oct 1.

      You can go for stamping anytime during petition validity period. So it can happen next year also. Just make sure your documents are recent and up-to-date when appearing for interview.

    I have a problem, I have got my H1B from a company in which I am not working. I have a niche skill. They have taken my 3 interview rounds, one online test as well as coding test. I applied through them and got H1B. They are not sending receipt number and asking to join them in offshore.

    My problem is Can they will keep me in India for a year before making me travel to USA? Because I can not even transfer my petition to other company as they have not shared receipt number.

    Please help.

      The employer may keep you in India before a while before deciding to send you to US. It is tough to say whether it would be a 1 year affair in India, or a longer one. You will have to judge that on the basis of your interaction with the firm.

    My H1B application was picked in USCIS lottery and I am waiting for the approval notice. However, last name in my passport was blank and due to this my application had First name as FNU.
    Can i get my passport corrected after H1B approval before going for stamping? Are there any issues due to new passport as approval had happened on old passport?

      FNU Correction,

      You can get the passport corrected even now. Later, file H-1 amendment to get the name updated in the H-1B approval notice and finally appear for stamping to get the correct visa stamp.

      Although it is late now, but had you updated your passport prior to H-1 filing, your current petition would have had updated name and no amendment would have been required.

        I am being told by my employer that i can get my passport corrected before Visa Stamping, and, this will not require any amendment. They asked me that i must carry both passports(old & new) when going for stamping.

          FNU Correction,

          There would be a mismatch b/w passport and 797 approval document. I don’t know whether they would approve visa stamp using passport name or 797 document. Further, when you enter US and are issued I-94 what name would they select?

          For that reason, I was suggesting having 797 updated as well so that there is no official document still remaining in old name. Maybe your attorney can clarify.

          Getting a brother to US would be very difficult. He can visit on tourist visa for short term but in the long term he would need his own employment or student visa. I am not sure what the immigration rules in NZ are for family members.

    I have got through H1B lottery and waiting for petition approval now. My passport is expiring on August 2017.. I may go for stamping in couple of months but will that have any impact on visa approval or period of stay can be approved? and also is it possible to renew the passport now?

      MR,

      IMO, you should get passport renewed first and then appear for stamping. This is b/c when you enter US, you would be issued I-94 only until passport expiration date (as it would less than 797 expiration date). You would then have to apply for passport renewal and I-94 extension after entering US. So why not do that now and not worry about it after entering US.

          You have ample time left in your current passport. Unless there is another reason to update the passport (like spouse name change etc), you can continue w/ current passport for H-1 visa stamping.

    You mention that it normally takes 2-6 months for approvals on RP cases. Is that from the notice date given on the receipt notice?

      USCIS started RP processing in June. So the slam-dunk cases may get approved within few days or weeks. For others in queue, it could take 2-4 months (more or less depending upon when it is picked). Most of them will be processed by Oct, but there would still be odd cases left pending beyond Oct.

    I have posted this already, but i am still skeptical about it ?

    Query –
    I got the receipt notice from my employer on May 2nd. But till now if I check the status in uscis.gov … It says “Receipt Number Invalid”.

    I have checked with my employer couple of times and they replied “its nothing to worry about”

    PS – Mine is Non- AD/RP/California

    Could you let me know if I can directly call the helpline number myself or should I go thru employer to raise concern to CIS? Or wait for it to be updated in the portal. #desperate

      Only employer or their representative like attorneys should be calling USCIS. Try again after few days, and if it still fails talk to your immigration team. Maybe a technical issue on USCIS side. I assume you work for CTS, so its not the case that bogus receipt number is provided to you.

      It was assigned to VT but is being transferred to CA. USCIS announced about this few weeks earlier and nothing to worry about.

          There is no SLA for RPs. Based upon historical data, it should take 2-6 months once RPs are picked-up.

      RPs should start seeing movement soon and would continue through Oct (or later in case of some). Yours could be the first in queue, or the last one depending upon the receipt number.

          All RPs have received date of April 11. In order to bring some order of processing they would process WAC-16-130… first, then WAC-16-131, then WAC-16-132 and so forth. This is how they have done in the previous years.

            First don’t add “ji” to my name 🙂

            It is not possible to tell how many sub-numbers there would be. Also, different petitions (H-1 cap-subject, H-1 extension, F-1 COS, L-1 extension etc) all will have numbers from that pool. So there is really no way to know how many sub-numbers are present inside it.

            They can start with any 3 digit number based upon how many working days have passed since Oct 1.

        RP will take at-least 2 months time(as per folks here) so mine probably will process in June.

Till when USICS will send the rejection notice for all people whose application is not picked in lottery. need your help here .

            First thing first – paying for H-1 is ILLEGAL. It is b/w you and employer when the refund happens, if ever.

            I haven’t heard of anyone receiving the rejection notices yet. So the employer may be holding on to that notice as official sign of not having made through the lottery. I expect the notices to start anytime now and continue through July.

          That is very optimistic estimate. IMO, your receipt was issued towards the end of the data entry cycle. So you may hear more like Oct than May.

          Again, all this is tentative and once USCIS starts going through RPs, we would know their speed and can make better projections. Not too many data points available yet.

            We will have to see what is USCIS’ pace when they start going through RPs. Typically it takes 2-6 months once they start picking up the RPs.

      With all due respect, it is YOU who is misleading the folks here. All the mentioned receipts have receiving date of May xx. Cap-subject petitions should have a filing date of April 11 when the lottery was conducted.

      They entered information of all 236K petitions in their db when the lottery was conducted. Data entry completion notice was sent w.r.t. receipt generation.

      Tell me, how did you conclude that this is a cap-subject petition?

      Karthik,

      There is no correlation b/w the two. LCA is filed w/ DOL and is done for all petitions irrespective of whether they made through the lottery or not.

      Only selected petitions will be issued WAC or EAC numbers. You need to get that from your employer. If the employer doesn’t have the number, then you didn’t make through the lottery.

          I don’t see much hopes for anyone still waiting for receipt number. USCIS finished data entry long time ago and all in-transit receipts should have been received by now. If you want, you can continue to wait for rejection notice which would be the official end of road for your petition.

    Just so everyone is aware, game is definitely not over. For my brother’s application, the money was deducted from bank on Friday, May 20th, which means that receipt number generation is still in progress but it has been picked up in lottery. Stay calm and optimistic folks.

      You are correct that “USCIS finished data entry long time ago and all in-transit receipts should have been received by now.”
      But now many Employers have become Smart (Or I would say Over smart). In companies like TCS, Infy Candidate is not directly interacting with Attorney. There is an Immigration support team as a mediator between attorney and Candidate. This immigration team receives the letters from Attorney but they do not share it with Candidates (They think that delaying the result may help in lower the attrition in case of not picked up in Lottery. I do not know how that will help them.) They plan to start sharing the result in the month of June or when they actually receive the Petition approval notice and start Visa interview process.

        I agree with you totally. I am in CTS and we are also facing the same situation here. Global mobility is not revealing the actual results to us. The only case numbers our colleagues received was in first week of May and it has been long enough since then that anyone else has received any mail.

        I have many friends across locations for whom H1B was filed and none of them have received the notice yet. Even their friends and colleagues are waiting.

        It looks like the company has the final list but wants to delay the results so that they can delay attrition too.

        We have been informed that final result will be out by mid June.

          I am also working with same comp but as per my knowledge they(GIT team) will inform only those people who got picked in lottery. if you didn’t get any update by now so its bad luck. better luck next time.

          Because last year I was in same situation, mine also not picked last year in lottery!!!

        The game is over. I was one of the petitioner, I hv received notice from USCIS with EAC # means accepting application for further processing.

        The selection process is completed, a total of 85000 petition quota has been completed. however there is a slight chance that may be if any one from the selected list is dropped.
        So instead of wasting yr time put yr efforts on some thing else and try your luck for H1B 2018 starting in April 2017.
        Its all luck ad destiny, that counts here.

      Usually takes months … maybe 2-6 months. Some of them may take even longer if stuck in security check. In addition, if RFE is issued, then process is further delayed.

      I don’t think there will be any problem, this simple mean due to heavy work load at one center they transferring the case to other service center.

      This means your case is selected among 85000 petitions and for further processing it is forwarded to relevant department. Due to over load they usually distribute the received cases to other concerned departments.

    I got the receipt number from my employer on May 2nd. But till now (May 17th ) if I check the status in uscis.gov … It says “Receipt Number Invalid”.

    My employer has confirmed that they have received the receipts for all the selected petitions even for regular processing. He also confirmed that there are no further chances of updates regarding the lottery picking. I was told that mine was not picked. I appiled through NAD/RP . Is there any still outside chance to see if it might get picked in next 2 -3 weeks. Is there any hope of waiting or should I consider my self as one of those unlucky mates of being rejected. Please advise.
