News Updates – Official and Unofficial :

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • June 14th, 2016 ( Unofficial ) : USCIS has started to mail out the reject notices for FY 2017 petitions that were not picked in lottery. It says that the start date for next year H1B season is April 1, 2017. You can check out the Sample Reject Notice for FY 2017, Details
  • May 2nd, 2016 ( Official ): USCIS issued an alert earlier today indicating that they have completed data entry of all the petitions. They will start to return all the petitions that were not selected in the lottery. There is no SLA mentioned by them, so everyone has to wait. They also say not to call USCIS for the same. USCIS said that they will issue a notice telling that they have returned everything once the return of all application is completed. You need to just wait for your petition details now.   • April 26th, 2016 (Unofficial): Many users are now posting updates as comments that they are receiving their regular processing petitions, which were filed under non-advanced degree. Also, the SEVIS updates are happening to F1 students who applied for H1B. You may check with your DSO on the SEVIS update…but, not all of them will share the details.  Anyways, we still have a long way to go folks for regular processing petitions, do not give up hope, if you have not got a receipt yet…for premium processing folks, you stilll have time, but the chances are getting slim as we inch towards May 12th deadline…
  • April 22nd, 2016 ( Official ) : Premium Processing Update : USCIS did an official press alert indicating that the Premium Processing for FY 2017 cap subject petitions will begin from May 12th, instead of originally announced May 16th. What it means is that the you should get H1B receipt by May 12th, if you filed under premium processing and you should have the adjudication done by May 27th. You can check alert here
  • April 20th, 2016 ( Official ) : Prepaid Mailers USCIS  Alert : USCIS released an alert earlier today stating that they will NOT use pre-paid mailers for two weeks after premium processing starts. They will NOT use these for about 2 weeks to avoid delays and will use standard mail to send out notices. Typically, employers can send pre-paid mailers ( postage paid by employer) in the H1B Package that can be used by USCIS to send out notices, which could be for employer tracking and speedy delivery. Now, due to resource constraints, USCIS will not have time to do that, so they are suspending using those prepaid mailers for two weeks after premium processing begins for FY 2017 season. They will resume using those mailers after the completion of the given 2 weeks. Check USCIS Alert 
  • April 18th, 2016 ( Unofficial ) : Many are wondering, if there are really case numbers sent out for Regular Processing Petitions. Few of our users have updated that they have received case numbers for regular processing petitions. Below is a screenshot of one of such H1B Cases status.  The regular processing case numbers can come in anytime, but there is no SLA for USCIS to send them before May 16th.  So, no need to worry, if you do not get it…just need to wait ! H1B 2017 Regular Quota Petition Case
  • April 14th, 2016  ( Unofficial ) : Many of the users, who filed under Advanced Degree Premium Processing are starting to get Case Receipt Numbers indicating that they are selected in lottery and case is being processed. Also, other premium processing applicants under general quota are getting receipts as well, but less volume. I have seen one user filed under Regular Processing and Regular Quota post saying that he received receipt number.  All in all, receipts are being sent to many of the premium processing applicants and some of the regular processing applicants. If you have not got anything, nothing to worry or panic, still there is a long way to go…just stay calm folks. All of this update is based on our H1B Tracker and comments on the blog by many of our users.
  • April 12th, 2016 (7:15 PM EST – Official ):  USCIS Released a press alert indicating that they received over 236,000 petitions for FY 2017 and lottery was conducted on April 9th, 2016.   • April 12th, 2016 ( 12:50 PM EST – updated ) : (Unofficial )- It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing. What it means is that USCIS has already conducted lottery. We will keep you posted with updates. If I am not wrong, they are just drafting the press release now. Also, few of our users in community updated their case statuses, indicating that their cases were picked in lottery and their case is in processing mode. Check H1B Tracker .   • April 11th, 2016 : No official or unofficial update on cap number or the lottery. We are in waiting mode.
  • April 8th, 2016 : There are few Indian news sites stating that there was an interview with AILA president and they are guessing of having about 250,000 petitions filed this year. This is speculation, but as it comes from the president of AILA, it carries weight. We will NOT know the official number, until lottery is done and USCIS releases the press note. They also say that most of these were filed by Indian IT Companies like TCS, IBM. Below are the News articles that state this.
  • April 7th, 2016 ( Official ) : USCIS updated that H1B Cap for FY 2017 was reached today and there will be lottery. There were more than 20,000 petitions for Masters quota as well.  No lottery date is announced due to high volume. You can read full details Summary of the H1B FY 2017 Cap Reached News . Below screenshot is from USCIS site.

  • March 16, 2016 :  USCIS released a press note telling that they will accept petitions for FY 2017 from April 1st and the premium processing clock will start from May 16, 2016. Read more at USCIS to accept H1B petitions from April 1st

Key Timeline for H1B Lottery and Results, Premium Processing  : 

  • May 16th, 2016   May 12th, 2016 : ( Updated based on USCIS News on April 22nd ) USCIS Mentioned that Premium Processing will begin no later than May 12th, 2016. May 16th, 2016. Means that, if you filed your petition under premium processing, you will start to receive receipt notices, if you were selected in lottery around this date.
  • H1B 2017 Lottery Date :  You can expect the H1B lottery date to be in the week of April 11th, 2016.   Last year, the lottery was conducted on April 13th and the year before it was April 10th.
  • H1B 2017 Lottery Results : This depends on many factors and there is no hard fast date. Last year, USCIS did a news alert indicating that they have returned all the rejected petitions on July 14th. So, you can expect the last date for receiving lottery decision around mid July 2016. …depending on the number of petitions filed this year, it may be earlier or even later in July or even early August 2016…

  2. Thank you for all the updates. They have been really helpful. I have applied for my H1 under Non AD/PP/CA and I haven’t received any notification yet. I checked with my DOS and she confirmed that my SEVIS is not yet updated. I also checked with my employer and the checks are not yet encashed.
    I have 2 questions–

    1. Will they be updating the SEVIS anymore since they have completed the Data entry process?
    2. If I applied under premium processing should I still wait for a receipt number after May 12th?

        • HOPEFUL_H1B,

          Even for RP, if nothing is heard this week its almost a done case. If you are still hopeful, then you are relying on being an outlier like receipt lost in transit, employer/attorney holding on to the receipt and not sharing etc.

    My petition is under regular processing and I having a couple of questions here…

    1. Is it posible to upgrade from Regular to Premium processing ?
    2. By when(Maximum time) we can expect the result for a regular processing application?

      1. Yes, it can be upgraded
      2. There is no stipulated max time for regular processing. There are still few petitions filed in 2015 which are pending. There was one filed in 2014, which was approved recently in 2016.

  4. Judging by the announcement on May 2nd:
    USCIS issued an alert earlier today indicating that they have completed data entry of all the petitions

    If I wasn’t notified so far, does this mean that I did not get selected in the lottery?

      Just got a mail from my employer saying the following ::

      “We have pleasure in informing you that your H1B application has been picked up in lottery
      Now the application will be taken for processing. It usually takes around 3 to 4 months for the process
      Once its approved, we will let you know.”

      Just wanted to check now my H1B visa stamping will be done for sure OR there is any other hurdle ?

  5. My case was received (picked in the lottery?), but my attorney nor my HR never gotten in mail receipt for RP , which is confusing. I got the tracking number of my i-129 from school’s immigration officer from checking my SEVIS.
    Now, the checks have not been enchased, but my case has been received, as of today my case the last update was on 4/18/2016. Do I still have a chance? Please help. I am very frustrated and will have gray hair soon.

      USCIS declared on may2nd that data entry process has been completed for this year for all the petitions.
      If your application got picked the respective cheque will be en-cashed and you employer would have known by this time.
      If you haven’t hear any news it means better luck next time.
      Note: Your employer is the right person to give the right status.

    I have a query regarding wait-list petitioners as I there are multiple filings for a petitioner from different employer.

    1. When will USCIS notify about the wait-list petitioners ? Is there any time line? Will they provide any press note officially?
    2. Will USCIS share receipt number to the employer before the decision is made about the rejected/denied petitions that were selected in the lottery?
    3. Will they encash cheque first and then generate receipt notice only after the wait-list petition is considered?
    4. USCIS will officially announce the return of all petitions on a specific date? Does it include wait-list petitions as well?
    5. How do we know that the petition is under wait-list?

    Please respond to my query as this waiting is really killing giving so much stress.

      Today I got email from my employer that, “received acknowledgment from immigration authority “. What dose this mean? Have I got through lottery? Do we get acknowledgment only if we get through lottery?

        Its better to check w/ your employer as to what it means. Unless they use official language, I can interpret it one way but could mean something else. Ask them point blank – “did you receive EAC# or WAC# for my receipt?”

    • My Employer told me yesterday that check issued to USCIS was cleared, but he did not tell when, haven’t received the notice till this moment, Fingers crossed. Hope It is on the way if USCIS entered everything on the system on may2nd. Anyone on this situation?? Mine is Non-AD/RP/VT

          Ask employer if they can see the receipt number at the back of the check. If not, the receipt notice will either be in transit or may be lost. Ask your employer to follow-up if nothing is heard about receipt notice by May 12.

      So, I guess hopes are still alive for couple of weeks for RP.

    Yesterday, I receive an email from my employer stating that your cheque has been encashed. They say they haven’t received receipt notice yet.

    My question is : As USCIS completed data entry on May 2. Is it possible that cheque can be encashed after May 2nd too.

    I see that this question has been raised by few more guys also. Your response is highly appreciated.

      as per my employer, he asked me to wait for other 3 weeks for the result (as the attorney said), i am non ad, RP . is it worthwhile to wait for other 3 weeks ? they didnt not revealed anything apart from this information.

        I would say if you don’t hear anything by end of next week, then chances are pretty low. You will be relying on your case to be one of outliers if you still want to be hopeful. By outliers I mean receipt lost/delayed in transit etc.

    Please clarify me , As per USCIS update , they have completed the data entry for who are picked in lottery and they will start sending the pkgs who were not picked , Does it means first they will share results for NON picked applications / Picked application ? . Please clarify .

      They will notify non-selected cases by sending rejection letters to the employer/attorney. It would contain employer name and employee name, and you would know the final fate of your petition.

      • Does it mean, our wait is over and its just we need to expect hard copy of rejected petition? It clearly says they have completed data entry for who are picked in lottery. In my company also whoever got selected already received the intimation from attorney. But in many comments I see “Still there is hope”. Can you please help me understand.

          So there is a possibility that receipt notice was issued on the last date of entry and then dispatched through USPS. Postal service can take 7-10 days to deliver depending upon employer’s location.

          It is reliance on those petitions that is keeping hope afloat for some members.

      is the receipt number mailed or send as a hard copy? if its a mail, why it will take more time as its just a 2 mins work after data entry…

      without waiting how can i know if my case got picked up like:
      checque got encashed, mail to attorney about receipt number etc…

      is the game over for RP, still i didnt receive a single information from my employer/attorney

        It is not mandatory that check is cashed soon after data entry. So there may still be some delay and the petition may be in transit. If receipt is not received by next week (considering postal delays), then chances of selection are pretty low.

          If we dont receive the receipt by next week, then chances of selection will be low for Regular Processing or Premium Processing candidates or both.

            PP chances are already pretty low, close to zero. Anyone who is relying on PP updates is relying on the assumption that the email receipt was undelivered to their attorney and they would directly receive paper receipt.

            RP receipts may still be received through next week, and after that their chances also go down to close to zero. They would be relying on assumption that USPS delayed their notice, or was lost in transit.

    I am selected in the lottery and received the receipt number from employer. When i checked the i797C , the date of receipt is mentioned as April 11, 2015 and Date of notice as April 20, 2016. There seems error on part of USCIS on Date of receipt which should be 2016 and not 2015. Can you please advise what should be done next?

    My employer is checking with the Lawyer on same.

      Law farm /Attorney will get the information about the case , then Attorney will forward the same to your Sponsored company. USCIS will never sent any receipt or approval/denied/RFE details to candidate even if the candidate is in USA .

          Most of the receipts should be received by next week. However, there may still be some outliers like USPS lost the package, or wrong address etc.

          If you are one of the optimistic ones, then you should remain hopeful until rejection letter is received; but realistically it is very little chance of receiving it after next week.

    I have a query, based on Saurabh reply on April 30 (Based upon historical data, RPs may arrive in May and early June as well)

    Now that data entry is finished, is it still possible that my attorney/employer could receive receipt by May end or early June, please suggest.

  18. Hi Saurabh, yesterday I have received email from CTS HR regarding my receipt number. When I check the status it’s showing as CASE WAS RECEIVED. Does this mean mine got picked up in the lottery? Or do I still need to wait?

      Last year a similar alert was given by USCIS on May 4rth
      uscis.gov/news/uscis-completes-data-entry-fiscal-year-2016-h-1b-cap-subject-petitions….

      But people did receive receipts even in 1st week of June 🙂 So guys don’t loose hope yet

    I have applied for h1b and not sure how long i can wait now, but i have a query now,
    If my petition got rejected then, can apply for L1 , i know , i need to wait till next year for h1b but is there any chance to apply for L1 now.
    2. if i want to change company now and what information i should ask from my employer so that i can use this for next time, may be a year after or two years later but i think we need this details ?
    3.How long USCIS will have our data.

      1. L-1 can be applied if you have worked for that employer outside US for at least 1 year in past 3 years.
      2. No information about current H-1 is needed if you don’t make through the lottery.
      3. If your application didn’t make through lottery, USCIS will not have any data.

  24. Guys, I have not received any communication from my employer about my application. Is USCIS going to mail me if my application is selected? OR they will only mail to my employer? Frustration is creeping me out……

      Based upon historical data, RPs may arrive in May and early June as well. However, USCIS may have sped up the things this year. Hopefully they will make an announcement of completion of data entry.

          No that’s not what I am saying. I am saying the process looks faster than last year (when RPs came through June).

          Also, USCIS should make an announcement about data entry completion as that would set correct expectations in place. Whether that announcement happens next week or 3 weeks from now, is anyone’s guess.

  25. FOLLOWING WRITING COPIED FROM THE USCIS WEBSITE.

    What is Premium Processing Service?

    Premium Processing Service provides expedited processing for certain employment-based petitions and applications. Specifically, USCIS guarantees15 calendar day processing to those petitioners or applicants who choose to use this service or USCIS will refund the Premium Processing Service fee. If the fee is refunded, the relating case will continue to receive expedited processing.

    The 15 calendar day period will begin when USCIS receives the current version of Form I-907, Request for Premium Processing Service, at the correct filing address noted on the form. USCIS will issue an approval notice, A DENIAL NOTICE, A NOTICE OF INTENT TO DENY, a request for evidence or open an investigation for fraud or misrepresentation within the 15 calendar day period. If the petition or application requires the submission of additional evidence or a response to a notice of intent to deny, a new 15 calendar day period will begin upon receipt by USCIS of a complete response to the request for evidence or notice of intent to deny.

    This means USCIS should notify for non-selected candidates also. AM I right?

      USCIS doesn’t charge any PP fees for the petitions not selected in the lottery. What’s the financial incentive for them to inform rejected petitions quickly?

  26. For those of you waiting for results still… My school emailed me on the change of status on my SEVIS. They told me a day or two after we got the receipt in the mail but I don’t think they check every day for you.. That’s probably when they saw my email so hit up your F-1 schools!!

        Through my attorney filed 11 H1b out which 3 are got receipts so far and he said there may be no chances for remaining as each attorney will lotter will be 1:4,but i am not beliving it

        • Its right the chances is like 4:1(236000-20000= 216000 so now they did random selection of 65000 out of 216000), but you can expect receipt notice till 10th may but again there no hard and fast rule , last year all receipt number has been sent from USCIS by 4th may.

            Actually his employer’s attorney is saying that each attorney has chances of 1 in 4. As they have already received 3 receipts out of 11 filed, their attorney’s quota is up and no more will be received. That is ridiculous.

      You made through the lottery. Create an account on USCIS site and add that receipt number and sing-up for email notifications. USCIS will process the petition and will either approve it or issue RFE for additional information.
