As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. I don’t think that recent alert about Delivery Service Error is any indication.it seems to be generic one and they want everyone to have chance within these 5 working days.
    Count likely to be high as i found two companies including mine who are filling more than double this year as compared to last year.

    • I agree,. I guess, that’s a generic statement. With the last year experience, i am saying, only when the volume is too high, the delivery services, will cause such problems and uscis is asking to send those again. It happened last year too.

      • I agree with you guys. The person who mentioned CAP not reached, is just doing wishful thinking…its obvious its a generic statement and nothing more to it. Given most people here is doing double filings, I pity my chances..this sucks.

    • yeah i am surprised by the timeline for this post, if they wanted teams to follow up and ensure everything reaches in a timely manner they should have posted this earlier (given 7th is the last day for second chance). I think its more of a formality statement than anything else. dont read a lot into it.

  2. I am doing MBA on CPT since I exhausted all my OPT period. I was attending my classes this week and most of the people have done 2 applications. So, my guess is the number will be over 200,000 for sure. I dont want to disappoint you guys. Good luck to all of us, I am praying for all. JAI MATA DI!!!

    Here is prof that USCIS have not yet received sufficient number of applications for H1.

    You can easily get that they have yet to fill the cap.

    • Seriously , it nowhere says that cap has not reached. They are not going to ask people to send petition if cap is not reached 🙂 there must have been some issue with delivery system that made them to post this. Come On you are just trying to read in between the lines 🙂

    • Last year few applications were damaged while handling by FEDEX/UPS. Because of that event, this statement has been issued and has no relation to your conclusion that cap has not been reached.

      Usually USCIS disclose whenever the quota has been filled and still they receive the applications. The alert today shows that “If the FY16 cap is met within the first five business days of April” means that is yet to be filled. My understanding is that its not filled by this statement.
      If you understand Better English – You can come up with what they are trying to say.

        With all due respect, I guess various immigration attorneys and guys running the blog can understand the USCIS press release and interpret better than you and me. Other than you, no one is hanging on this false hope that the applications received on date haven’t exceeded 85,000 already. Being optimistic is good and I like it but accept it as a fact that already the quota is full and we shall only get next update after 07th Apr. Best of luck.

    I was also in the same boat like you guys!! 2013 –> Rejected in Lottery, 2014 –> while I was hopeless, out of no where I was through in Lottery, got it approved and reached US in October..

    While there are many rumors spreading across, nothing is reliable. There were predictions last year that the numbers could reach 200k as well as it would be as low as 100k. My advice would be be to forget about all these, cos ultimately once you are in lottery its all about luck, as I went thru last year than the year before when the probability of getting selected was even higher.

    Im guessing, by April 8th/9th they might confirm about the lottery and by April 15/16 they might confirm the numbers post lottery!

    Forget about the numbers/Prepare for the worst/pray for your luck/have back up plans!!

    • This year there are so many candidates filing many H1B applications from different employers.

      Any idea ,, what was the trend of last 2 years ?

        I think in 2013 multiple filings were less heard of in the forums, but last year and this year there seems to be more cases of that!!

        My bet is that the number would go 200K purely because each year the number of applicants might also include the ones rejected in the previous year’s lottery and that count is increasing!!

        Just hope for the best!!

          • Yes, It could be one factor though chances are very less that It will have a big impact.

            1) It came as a very late info!!
            2) A big portion of the applications comes from MNC and it doesnt look like its going down, instead soaring ahead!

            Again me nor anyone can predict as of now, its all guessing at this point of time!! Hope for the best!!

  5. I really like the way people are most positive this year than apprehensive last year. Last Year I was in same forum people were predicting 250 K application and before that year people were expecting 200 K , this year count is really variable due to number of factors. H4 EAD and L1b visa relaxation. 120000 will be application count this year..

    • Lets see man what will be the count, only few days left to know, last year USCIS announced exact no of application on 10 Apr 2014, this year we can hope for the same, so just chill out and hope for the best

    • But how a employer came to know that the package is not delivered properly ? This is no where mention by the USCIS.

      • Your employer (or rather their attorney) will FedEx your petition to the USCIS office in VT. You can ask them for the FedEx tracking # and check if it is delivered.

    Last year on the very first day almost majority of the companies has applied.

    As per the analysis as done by below few experts. Looks like there are less applications as compare to last year.

    Let’s hope for the best for this year. Two more days to go to know about the actual number of applications.

      • India is a IT hub like China is in manufacturing. 98% of the applicants are from India.

  7. Can all of you comment how many of you or your friends have applied h1b from multiple employer, becuase most of my contact have 1+ application this year.

    • I think many candidates has applied more than 1 application as looks like from the blogs.

      I believe to apply from different employers is LEGAL. I know last year one of my friends friend has applied from 3 employers and all three were selected. One has applied from 2 employers and none was selected.

      Not sure what is legal and illegal ? As few says it’s legal and few says there are chances of RFE but no where in USICIS site state this point.

    • The numbers below are LCA’s submitted for not only new employment, but also continuation or change in previously approved employment, new concurrent employment, change in employer and amended petition. so the numbers are not at all correct.

      • You are correct ! But there are few people who are saying that the Big Giant’s are filling thousands and thousands of applications.

        The H1B fresh application should not be more than the total number of LCA filed. It’s a trend so far for all the big giants filling the H1B VISA’s (it fresh & transfer cases).

  9. Hello All –

    The total applications received by USCIS will not be more than 120000 this year due to H4-EAD and L1 liberlization.

    The biggies such as TCS, Infy and WIPRO and other were not too active like last year…

    so, out of 85000 – 5800, you have fair chances this year to get your VISA..

    Ofcourse, this is prediction but it will come true…

    • It might be tru nag.And also this year Uscis Implemented new rule…ie if any company files h1b visa crosess 25% of h1b staff per each applucation they have to pay extra cost…lets see from the uscis update …hope for the best

        Please dont spread wrong figures… What is Total Company employee.. how many are already in overseas … how many will again apply… I was worked for TCS.. I know about that company… If only Infy, TCS, IBM and WIPRO occupied 180000+ applications then imagine the rest US companies and other IT companies..

    • Well, I really hope the number is true as it will increase the probability for many to live their dream. Nevertheless, please note that big consulting companies finalize the candidates for whom they are going to sponsor H1B visa by about Oct/Nov time frame. H4 EAD was just announced around that time and ease of norms for L1-B visa was’nt announced during that time frame, so it may not impact these firms. Nevertheless, it is worth waiting until 7th/8th to hear from USCIS and you never know, luck may be our side

    • Guys I’m in US on L1. I did not get h1 Lottery last year. I have applied h1 this yr too as its my last chance. I have left hope. I have put my car and furniture add on Craigslist to sell and move back. I suggest to do same for folks with last chance.

    • I am with you on this number…somehow this year lot of consultants havent applied for H1’s…Have a few of my friends working / running a few consultancy firms here and their number is far lesser than what they have applied…even my company ( cant name it here) has not even applied 30% of what it did last year.. there are many reasons for it, but it sure is v less….anywaz 7th/8th is not so far….We will get to know…

  11. What our friend below said of about 340k might be true. The largest immigration laywer here in the Bay Area told me the application soared by 200% this year when compared to last year in his company. Companies are desperate after cheaper and more qualified workers.

  12. I predict for more applications than last year.For the past year from my project they initiated for 4 people. This year they have initiated for 9. Moreover major chunk of visa initiated would be from India and also it would be from top tier companies like TCS,Infosys,Wipro etc.So with the above sample size increase and considering other probabilities, if we think logically,definitely there would be an increase from the previous year count and the increase would be more than 40k to 50k from previous year.

    A very good friend of mine who has been working at USCIS for 15 years now told me that the amount of applications this year got crazy. She said that if Mon and Tues keeps on the same rate, they should hit 315 to 340 thousand applications this year. Scary!!!

    • Hope your friend is monitoring only H1 and not all the appliations that USCIS gets… This cannot be true number.. dont just create a panic situation here, there are ppl who are awaiting this opportunity as this is a their last chance.. So have some sense and also let some sense prevail to your friend in USCIS who has been working there for 15 years…

    I have noticed that every company get at least of 40% of lottery selection ratio. Like small consultants who filed for 8 candidates their selection ratio is also around 40%. I never saw any small companies where there is no selection in lottery.

    Any expert comments on it ?

    • If your employer has sent indidual package then u can track the courier, r else u need to get receipt from employer to track status

  17. Hey Yes, I too have seen in FB. I think employer who filed petition alone will get info about mishandling of any petition. We wont get any update to any of our mails/contacts. Dono how much of interest the employer will show in filing of petition again in their busy time with other applications. So one more tense again.. 🙁

  20. My company (American firm) is applying for an H1 for me this year and i wanted to check the status of the filing this year.
    I have to say – I find you people pathetic. Applying through multiple firms ? It’s because of your outsourcing firms gaming the system that genuine candidates (mind you H1 is a SPECIALITY SKILLED visa not something for an Indian firm to send a million generic untrained employees through) that a lottery is forced every year.

    • I too wish there was some way to separate mass applications and the rest. Mine is the only one my employer is filing this year, yet I am worried that it will not be selected when pitted against a 100,000 application by the outsourcing giants.

    Any expert comments on it ? I think the Lottery the selection software must take care that at least every company get some percentage.

    I have a question.
    1) If a Person filed Multiple Applications from Different employer, whether USCIS will consider all if them for Lottery or Duplicate filing they will remove from the Lottery?
    2) If a Person Filed Mulitple Applications from Same Employer,
    whether USCIS will consider all if them for Lottery or Duplicate filing they will remove from the Lottery?

      To answer your question:
      1) yes one person can apply for multiple petitions from different employers.

      2) one employer CANNOT file multiple petitions for same employee.

    The below is a link for the “Heights-Global company”, this company has filed 8 LCA last year and as you said only 2 were selected.

    I have noticed that each company get 40% to 50% of H1B approved out of the fresh H1B filed. I think the USCIS software also picked the company names otherwise there is a chance that the small companies like the one mention may not get no H1B approved.

    Many guys has submitted many H1B applications from different employers ? I heard from one of my friend he has filed 3 applications last year and all of them were accepted.

    In this forum their is a debate with many folks ? Some says it’s legal and some say’s it’s not ?

    Who is right and who is wrong ? How this is decided ? Please comment.

    I am applying for the fourth time & pray to get selected in this year H1B Lottery.

    • If one employer submits multiple applications of his employee,it will be rejected as it is illegal, but multiple employers can submit applications for their same prospective employee.Hope this clarifies.

        But as you read more blogs in the same thread. There are few folks which are pointing out that it increase the chance of RFE. If this is legal that different employers can file the petitions and then why there is a RFE.

        Some how I got confuse with different opinion of folks.

        Please explain little more.

        • People spread these rumors when they are not offered by multiple employers. So do not worry. If you genuinely have offers from 2 different employers, they apply h1 b for you. Its totally legal. You may even get both selected and approved. Choice is with you to pick what you want

        • RFE is purely based on the document your employee has submitted. This has nothing to do with the number of petitions filed for you. If a person submits more than one petitions through different employers and if all the petitions get selected then it is upto that person to decide on which organization he has to work for. But one thing is it will definitely spoil other people opportunities considering the cap count (65000). Hope at least people think about others before filing multiple petitions. There are many students studying in US spending so much amount of money and desperately waiting for H1B to pay their debts.

        • RFE is nothing but request for evidence and that also is perfectly legal . Once you produce proper evidence,you are through.I personally know many folks who got RFE and once evidence is produced,their H1B was approved. As long as its legal,there wont be any issues. Only disadvantage is there will be a little delay.

    • H1B 2016 – Why you didnt get H1B when you apply for the first 2 times? I guess there was no lottery in the FY 2012 and FY 2013.

  30. Guys,

    Visiting this site again after a long time. Me too had the same desperation and lot of expectations on the lottery results. Fortunately my petition got selected and now am in US. Just thought of helping you guys on the date part.

    Here is the last year date.

    1. Announced the number of petitions received as 172500 on April 7th 2014
    2. Started the send the receipt notice from April 24th (Since my team mate was the one to get the first receipt notice on that day)
    3. Waited for my receipt notice till May 6th and finally got my receipt notice as an email from my employer on May 7th. Probably am the last person.
    4. After May 7th Nobody got it from my organization.

    So its worth waiting till May second week at the max.
    Mine was processed under regular processing.

      • I don’t want to comment about my company. I didnt get the hard copy of my receipt on May. I got just an email from my employer that the receipt notice has been received from USCIS.

    • Hello Krish,

      It depend on whether you are filing in PP or REQ quota. If you file under Premium Processing, you will get a receipt number as early as 11th April (The day they conduct the lottery). Usually you will get all the PP receipts in a week or so. The processing of PP application start as announced by USCIS. If you file under regular quota you can expect your receipt number even in mid may.

      • Yes, my case was filed under regular and hence got my receipt number late.
        As per the process, first they will be sending the receipt numbers for premium processing and then they will start the regular processing

        • Hey, so when do they send the tracking number ? & if immigration receives >1L applications in first week will they continue accepting applications in second week ? What is the last day for employers to send the application ?

  31. My employer did not send me any offer letter or agreement letter before h1 filling. As per him for H4 to h1 apply, they don’t required any offer letter as well as any client letter. Please confirm if any one have any idea?

  32. Friends, kindly predict your expected applications to be filed for H1B FY 2016. Lets see how many of us get it right on april 7th.

    if you need more help in this i can give you the company name also “Heights Global IT Service Corporation” this is a company who tried to sponsor h1’s last year and my friend filled his H1 from this company two or three person were selected in the lottery through this company but no body get his approved stamped visa so far, all were rejected

    i didn’t mean to scare you But this is truth, you can search in google for that there should be a genuine company and also should have good revenue and sale only then that company is eligible for h1 sponsor, you can even think that if there could not be a limitation then i could ask to my friend who is already living in US to open a company and sponsor my h1 :), But its not like that atleast that company should have good revenue to sponsor otherwise 200% it will get rejected

      You can apply many times as you want and you find sponsor, in short, every year, the people who are saying this is last chance for them is not because of USCIS rules, may be because of their personal problem or they have another option if they don’t get selected, to let you understand i am giving you example, like i am applying two applications this year and if anyhow my both files got rejected then i will not apply next year i will go to us on F1 visa to study so in short i can write this is my last chance, i hope you understand 😉

        People who do masters in US get 29 months of work authorization on F1 status. Depending on when they get a job they have either two or three attempts for their company to file for H1B and that is the reason they say its their last chance. They are already working in US and it would be tough for them to go back home and start all over again. And getting 29 months of work authorization is a USCIS rule. So technically you can say its their last chance of applying being in US.
