As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    Me and some friends have been doing some data crunching and here are the stats

    Applications in RFE stage ( Response + approved ): 40%
    Applications approved: 53%
    Not processed : 7%
    RFE response stage: 16%
    Number of application processed in 4.5 months ( Approved + RFE) : 93%
    Remaining ( RFE + not processed) = 47%
    processing run rate: 20%applications per month
    Estimated end date: Mid November ( if all RFE’s respond in time)

    • Yes once your petitioner/attorney sends in the request to upgrade to USCIS. USCIS will update the case status on the USCIS case status website mentioning that “Request to upgrade to Premium Processing has been received”.

      1. Approved – Excellent
      2. RFE – Another chance given this year
      3. Denied – Next Year Plz

      Usually it should not but as number of RFEs is very high this year hence it might go beyond Oct but there is no SLA from USCIS. Only option is to wait else move to PP for faster processing i.e. within 15 days.

    I have one query and need your support for clarification

    I have applied for H1B for programmer analyst as suggested by my consultant.

    But I am from telecom testing background and currently working as a manager in a MNC and with no development background

    Pls let me know if this will be any problem while seeking job once H1B is approved

    • Best is to consult your consultancy about the technology their clients are more involved into. Then start working on the same before going to US else moving from management to technical would be difficult but not impossible. Also, try to find out the technologies which has future in US market, for example Big Data.

    My status changes to RFAE(additional evidence), why they additional evidence, already picking up in lottery is a huge process. They can approve if they find initial verification is good right? otherwise they can check cibil check and approve.
    By the way, any one were denied after rfe, please respond if anyone heard rejections after rfe so that it will help others like to check their status. and also please mentions what all things they likely to ask in rfe because it is very important to know it and how you responded, after all we are on same earth and should help each other for common purpose. Please help!!!!!

    • What i lastly found is USCIS turned like generating revenue to the country by making all applications into rfe and expecting PP on top of that. After long long wait this happened to me, they could have raise rfe in the initial days…..:( i am so unhappy, cannot discuss with others since many of the people doesn’t know the steps/process…i am seeking help from you guys

        Its just Sep. You can travel anytime to usa after h1B gets approved in next 6 yrs….so just chill & thanks god for picking your case in lottery.

    • Hey, Mine is still in Case received status so planning to go for PP.

      Can you tell me how many days/hours it will take to convert it ?

      And also, now since your is approved through PP, when can you expect a soft copy ? Will they send soft copy via courier or they will e-mail you ?

      Is there any way we can come to know if our employer has really converted it to PP ?
      Your knowledge on this will help since I have plan for PP.

    • Congrats. My interview is scheduled in Chennai next week. Is there any parking facility available near by OFC and Consulate. I am planning to go by car as my wife and kid will also be attending with me. Thanks.

      • No Sundar, Plan accordingly. There is no facility for any parking. mobiles and bags are not allowed. there is a locker facility but for that big Q will be there and u cannot offer time to stand for locker Q. better don’t take any such things. Book hotel near to consulate so that u can park your car there and go to consulate 15 to 30 mins before. Only carry your document folder. once you get inside consulate, everything will be very quickly, max 30 to 45 mins you will back outside. All the best and cheers!!!!

      • For OFC, you can park CAR in the road. Some people are parking their vehicle on road. and again its about any place available the time you visit there. Can carry mobile in switch off mode. Only small hand bags are allowed. No back pack or trolley kind of bags.

          • You need to fill DS-160 for your dependents. While scheduling interview you can include their details and their DS-160 confirmation no. Then need to pay the money which shows there. Once payment confirmation is updated automatically, you will be able to fix appointment.

  9. Anyone with WAC still have their status in “Case Received”.

    I just checked 140 cases (60 before my number and 80 after my number) and I am the only one with status ‘Case Received’.

    I was last in studies in grades but never this last…my god..

      • My Employer started today process to convert to Premium. What if it gets approved before the conversion happens …. not sure,…I will be happy with the approval anyways but if the approval happens under premium processing then I would be more happy now since I can get the soft copy of my petition may in 5 days and then can book a slot for visa interview…I am little eager for stamping since my client is expecting me to travel asap….till I travel my client wants me to continue in night shifts….I got vexed with the night shifts… 🙁

    • Depends who’s your employer. I understand it’s a consultancy, but it still depends on the company. What’s your employer’s name?- I may be able to help

    • Your consultancy should take care of this. The RFE document has all the documents mentioned which USCIS expects from them. It’s all transparent. Check with your employer.

    • Yes, i understand that but i would like to know what kind of docs usually they will request, i am yet to receive mail from uscis to see the requested docs. meanwhile i will do some initial research and be prepared. I heard each they will add new set of requests for docs…….i a m tensed……..please help me if any of the forum visitors either heard type of docs/any denial notices after rfe and reason for denial. Remeber mine is a company with less than 1 employees i guess and running from last 19 years.applied with internal project, i only prepared the project documentation and estimations and resource allocation except financials….

    I work for an MNC in Pune and I got RFE today thru mail from our travel team. And the travel team said, they will respond for the RFE before 15th Sep and as per mail, that is the end date to respond for RFE. So just curious, how many days it takes once our travel team send the required documents to USCIS to get the H1B case approved.

  13. i have recd. I-797 , when i checked my i-129 my attorney has not added my wife name in the “Are you filing any applications for dependents with this petition” my doubt is, can i take my wife for visa interview with out this. Please help me at the earliest, Thanking you in anticipation

    • I had the same question, but I was told that dependents name in petition is no necessary. We can still file H4 visa for dependents.

    Since my status is still is ‘Case Recived’, my employer is planning to convert it to ‘Premium Processing’ as client expects me to travel asap.

    Now with premium processing, I know the approval or RFE has to happen in 15 days. But my question is, …if I assume the approval happens without RFE, lets say on Sep 5th…then how many days will it take for my company to receive the soft copy/hard copy of my petition from USCIS.

    For normal processing I think it takes about 7-15 days, for receiving petition,..so for premium processing will it fast as well like approval…or same time lines?

      I am not sure on exact days. but for my case normal processing got approved in first week of June and got soft copy on 11th August, but hard copy didn’t yet received. Mine EAC (Vermont Service Center)

    • I am also in same boat… Its been more than 4 months and no updates from uscis… EAC15139XXXXX series…
      My employer has raised a SR with uscis and there is nothing they did for that.. USCIS nowadays processing only if its premium fee is paid..

    • I have checked some 40-50 petitions around me and found 2-3 in “case received” status. So about 90-95% of the cases moved to some state, either ‘approved’or ‘RFE’or some other…..I think we are among those unlucky 5-10% people who have to wait for such a long time and not even sure how long.

    • I think WAC is moving fast now. Mine is WAC series. But when I checked some 140 cases today around me….I am the only I129 guy with “Case Received” status. Till day before yesterday there were 2 other cases with ‘Case Received’ status but both got RFE when I checked today …. So mine is coming is what I am guessing..hopefully no RFE 🙂

  18. My H1B is approved, but somehow the US requirement gone, currently I have approval notice but no US Project, My company is saying it can take 4-6 months to get the new requirement,

    My approval notice is valid from 10/1/2015 to 09/07/2018. So till what date I can go for stamping?
    I am getting opportunity to work in Malaysia for 1 yr. Can I go for stamping in dec 2016 also?

  20. Transferring Cases From Vermont Service Center to California Service Center
    In order to balance workloads, USCIS recently began transferring some cases from the Vermont Service Center to the California Service Center. The affected cases include:

    Form I-130, Petition for Alien Relative
    Form I-751, Petition to Remove the Conditions on Residence
    How You Will Be Affected

    If your Form I-130 case is being transferred, we will send you a notice listing the transfer date and the new location where your case will be processed. Your original receipt number will not change and this will not delay your case’s processing except for the additional time needed to transfer the file to the new location.

    If your Form I-751 case is being transferred, we will send you a notice listing the transfer date and the new location where your case will be processed. Your original receipt number will not change and this will not delay your case’s processing except for the additional time needed to transfer the file to the new location.The words “Case Type: CRI89 Approved Removal on Conditions” will be printed on the transfer notice. This refers to your pending Form I-751. The transfer notice may not contain the original receipt number of your pending Form I-751.
    ( if the approved case also will be transfer to California) pls let me know

  21. Today my non-ad/reg(WAC) visa got approved. lottery picked on 13th April, RFE on 4th Aug, RFE submission on 20th Aug, Visa approved on 31st Aug. These 5 months waiting was horrible.   22. Going to be 5 months now. Still in case received status. Case was received on April 13th. Checked the status online for other numbers, looks like most of them got approved or RFE. Very few in ‘case received’ status. EAC15149*****. Meanwhile some applicants got RFE, submitted the response and got it approved. Very frustrating.

  25. I don’t know what’s taking so long. My employer sent the RFE response on July 30th, and still waiting for the decision. I’m Masters cap as well- I thought they are pretty quick when it comes to Masters cap due to cap gap etc

    • It is super-frustrating. I’m Master’s cap (but RP) too, USCIS got my employer’s RFE response on June 16th (yup, it’s been over 2 months) and still no updates. And I saw a couple other pending statuses where the RFE response was received as early as June 8th!! Talk about no sensible system or process whatsoever.

Seems like 90% of the WAC applications have been validated (either approved or RFE) …. as a sample I have checked 40 number related to WAC and found only 4 in ‘Case received’ status and one of them is mine 🙂 . I know all these 40 may not be I29 but still I guess majority of them are. Assuming max in another 2 weeks the remaining 10% WAC validations should also get complete. Having said that, I felt India Govt. organisations are lot better then USCIS. I know because of EAD applications this delay happened but they should have planned, foreseen this ….. Anyways, since I want to work in US I think I have no right to blame them 🙂 , since this is something I chose..

    • probably in that 4, i am there too. it is frustrating. i spoke with asks today. they said we are working on applications that were received by 4/22. mine was received on 4/13… USCIS doesn’t share updates with the individual and expects the employer attorney to call up to get updates

    Case Approved: 27th Aug.
    My guess: People will receive approval status when the deadline of the RFE Occurs.(90 days)

    my petition was approved on 1st of July. but i am still waiting for my employer to send the documents and I-797.
    My question is can i file DS-160 and book an appointment for stamping. because i can see there is a waiting period of 15 days for mumbai consulate. meanwhile i would get all my documents also.
    Plz share your suggestions/experience!!

    • DS-160 would need Petition (I797) number. If you have that already then you can go ahead and fill the DS-160 . Atleast create the profile and start filling teh basic DS-160 information.

      But please be sure that you will be getting the papers in time before making an appointment. You cannot reschedule the appointment multiple times. In case your employer is holding on to the documents until October then I would suggest waiting until you have documents in hand.

    • well there are very few people who are still waiting for the case to be received or you can say waiting for the receipt number. But i am not sure if anything is going to come now…!!

  32. Why are people getting updates on their petition status on ween-ends when USCIS does not work on week ends ? … Does USCIS work on week-ends or due to huge volume they started working….Its not a serious question but just thought of asking as I noticed updates on week ends.

    • With their ‘super quick’ work in 2016, they should work not only on weekends, but also at night!)
