As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  4. TCS guys ,any new updates or we need to keep on the wait for manager’s denial;I contacted chennai visa cell and they keep on saying to contact ISU RMG for lottery status 🙁

    • No chances of hopes.. try next year or have plan B. If you ask chennai visa team they will tell to check with ISU RMG and if you check with RMG they will tell they are updating your account. Check with your GL to update ASAP or ask for release. My case is also similar after lot of follow up came to know that my name was not sent in the H1B Visa list from my account. 🙁

    • If any of your personal details are updated, then the last updated time is displayed in LCA Info part. Actually, No change made to your LCA.

      • I would go by USCIS. If today is the last date for receiving the rejected petitions, i would think there is nothing cognizant can do beyond this point. And as per cognizant, they would update the results the same day. Time to get in touch with GM and let them know you are going by USCIS’s announcement.

  6. Hi..I got my petition approved through a Consultancy. But is there a way that I can apply for a job with some other employer requesting for a transfer of this H1B, even before I enter the US for the first time through the actual Consultancy through whom I got the Visa ? If anyone can please suggest will really be helpful

  7. I work in 1 of the top it company in india. When i ask for rejection mail…they say this week it will come, but got no mail as of now.

    Asked previour year rejects, the company didn’t send any rejection mail to anyone.
    Got stuck in one such sitty company who doesn’t show any clarity to inform people about rejections.

    My question to management, i understand u want to control attrition by holding off the mails, but are we so dumb not to realize that????

    • You said it yourself… what you are exactly…

      If you are not.. then take your decision and move on.. rather then depending on company in your words “shitty”…

      Are they paying you shit for the work you do there…. have some ettiquettes…you are getting paid for what you agreed in your contract… if its shit that you agreed upon… then keep enjoying the shitty company, as you are doing so…. else if you think you can do something good outside…

      MOVE ON or stop cribbing and enjoy monthly shit (per your words)… else pay respect to your number 1 company wherever you are working

      • As per official news uscis will send all petitions either selected or rejected till 2mao
        If u havent receive it then not sure if it is pending due to waiting list. I know lot of people with same status. I think its very very rare to get selected at this time

  9. I applied H1b through a reliable consultant. They shared LCA tracking number which was certified earlier but now it is reflecting WITHDRAWN status for last 2 weeks. They never requested to withdraw the petition. They didn’t receive the h1b return notice either. Though my employer/ attorney are investigating the matter but I wanted to know is anyone having same kind of issue?

  10. I called GI team this Friday they said that your case we havn’t received from USCIS. I know they are true because in my project already few of people received Rejected Status.

    But as official news says that they did with all petitions how my case is not yet received by them.
    WAITING LIST ka kuch zole nahi hai na….. I want to move out from this I want either selected or rejected status asap so can look for US or NON US.

    Any one has any idea if I will not receive any updates till 20th then how long it will take to know the result.

    • As per below link of USCIS, there is nothing called as ‘Waiting list’ in their whole process. It clearly states, one who has applied for H1B this year, should either receive Receipt no. or Rejected petition by Jul 20th.

  11. Hi all,

    My employer asked me to send few documents today to answer an RFE on my case.

    But if I see the status in USCIS website it says ” Document was Mailed” What does this status mean?

    “We mailed your document for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WACXXXXXXXX. If you do not receive your document by June 28, 2015, please go to uscis.gov/e-request to request that we resend the document to you. If you move, go to uscis.gov/addresschange to give us your new mailing address.”

    Is it regarding RFE or in other websites I read that this means a denial.

    Please let me know.

    My Case status says ” My case was Approved on July 15th”. When Can I expect an email from my attorney and when my employer gets the original approval notice. My attorney said, they are monitoring their e-mails and they didn’t get it yet. Is it usual ?

      so wait 7 days — give them time to receive and open

  13. Hi.. My petition got approved for only a year. What are the implications? I know for sure that Visa would also be stamped for a year but does this affect the extension process as well, if I apply for one next year?

  19. Hi,
    My petition is approved and I’m looking forward to attend the visa stamping interview. I’ve a specific question regarding Form I-129. In serveral sites I saw original form I-129, with the approval receipt, is required for stamping interview. How come employer have original I-129, since that is submitted to USCIS and will be retuned only in the case of not selected in lottery. Can anyone tell me what they mean by original form I-129, with the approval receipt?
    Any ideas are welcome since I need to respond to my employer regarding the documents I need from them.

    • To my understanding USCIS will send the hardcopy to your employer. You will get the hardcopy which is the original I-129 from your employer.

      • Thanks for replying. But our attorney said we wont get original petition back from USCIS, and only a copy is required for stamping.

        • The attorney will send you a copy of I129, LCA, Educational Equivalance Report and other releavant documents used for your petition to USCIS. They will attest in the first page that these are the exact photocopies of the original submitted.
          The only original document you need is the I-797.

    • From what I’ve read on many blogs so far, USCIS would send the entire package back. The main difference is if your application has made through the lottery, you would get the entire package you applied+approved I797 and no checks. If it hasn’t you would get package as is with checks :). So you will have the original I 129 form with you in either case.

      • Appreciate your response, but my attorney confirmed that USCIS WILL NOT return the original filed I-129 in the case where petition is selected in lottery. They will return it only in the case where petition is not picked in the lottery. Attorney sent me the copy of the submitted form I-129 with all supporting documents and confirmed that is sufficient for visa stamping.

    • It will take avg. 1 month.
      Btw on which date did your employer replied to RFE. Wanted to calculate how much time USCIS take to change the status online from RFE to reponse received

      • My attorney received it in a week. I got notification about the status change to RFE on Monday evening. One week later on Monday morning I synced with my attorney and she said she had just got it.

    • Seriously? 🙂 Receipt no. on July 15 is actually very surprising when USCIS on Jul 14th announced that they finished sending Rejections and Receipt nos. Your husband seems to be very lucky on that front. Congrats!

      You meant to say that your husband got his “Receipt number” on 15th July, and the receipt notice indicates that USCIS folks are still processing receipt numbers ?
      And this is not because there was a communication delay from your employer ?
      Also, was it an AD or RP- Vermont ?
      your understanding on this would really help people who are still waiting for their receipt number

      • Thanks for responding. I am on same boat and not seen anyone confirming they got selected in non AD /RP.
        Only few PP guys got updates on 21 Apr.

  24. Guys any updates from California Processing Centre??

    Its been more than 2 months time that my case WAC1514151*** has been in Recieved state. However one of the USCIS website provides the timelines for processing in each of its processing centre where in WAC(California) has been given as 2 months.

    Its been a painful wait so far .. Hope it will get over soon 🙁

    • Do you mean to say that for cases which are picked in lotery, USCIS need to update the case status from ‘Received’ to something else (RFE or approved) within 2 months of receipt notice date ?

      I dont think there is any such limit, though I see a link (below one), but I think that tells about something else.

      Because My receipt notice is dated 23rd April, then with this formula I should have got some status change by June 23rd…but it still shows ‘Case Received’

      • Atleast that is what the California processing centre timelines say as per the USCIS site.

        I hope the petition approval/denial process is random and has nothing to do with the order of the case numbers.

  25. So,.,, for people who are waiting for lottery.. 20th July is the revealing ldte..

    USCIS announced on July 14, 2015, that it completed processing the return of fiscal year 2016 H-1B cap-subject petitions that were not selected in our computer-generated random selection process.
    USCIS previously announced on May 4, 2015, that it completed data entry of all selected cap-subject petitions.
    If you submitted an H-1B cap-subject petition between April 1 and April 7, 2015 and have not received a receipt notice or a returned petition by July 20, 2015, you may contact USCIS.

We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by July **, 2015, please call Customer Service at 1-800-375-5283. If you move, go to uscis.gov/addresschange to give us your new mailing address.

    • I guess you got an RFE, you could ask your employer to know the details/information that USCIS is expecting from your end.

    • Not to alarm you, but it might mean a notice of intent to deny. An RFE has a different wording usually. Even if it is NOID, it will be like “unless you can prove this, or provide these within this time, we will deny”. So, your attorney and employer will have a chance to respond.

          • Dude, I feel you. Firstly the lottery process which USCIS is following is horrible and to top that this WAIT of several months is killing.

            And the most frustrating part is you can do nothing but just sit back and wait for your lottery result. Even if you have your lottery result positive the sword of Rejection will still be hanging on your head. Then follows the further WAIT of change of status so that the petition goes into Approved state.

            Now US Govt is deciding business between Countries based on ‘LUCK’. For e.g. If 2 Organisations(1 US and the other non-US) want to do business with each other they can’t go ahead with their plans unless their LUCK favors them to do so. Now I do not see professionalism anywhere in this whole process which USCIS is following. Someone needs to tell them the cannot decide businesses between Organisations merely on LUCK.

  27. Now a days I am observing lot of H1B approval updates from Vermont centre but no approval updates from california centre, WAC is very slow in processing 🙁

    How do i know whether my H1 -B is picked or not bcoz my company 1st list i have not picked but my company saying like there will be second list how to believe???

    I saw the USCIS site they have announced like rejection will be sending so is any hope will get a chance to pick the Visa

    • USCIS asked you to wait till 20th July, considering postal delay. After 20th, you can ask ur employer to share the caseid/rejection notice or you can ask him to give a call to USCIS. If he doesn’t do any of the above, show ur middle finger to him and make a move from that un-trusty fellow

      • 20th will be extreme case….they send return packets in USPS priority mail which guarantees delivery in at most 3 days (depending on starting and ending address). So, 99.999% will get results by 07-17.

      • Buddy I have congratulated you because at least they have started processed your case. Don’t worry for RFE if your employer submits all the documents which USCIS ask’s, then your case will be approved.Think about about some people they are still waiting to know there lottery results,some are still waiting to receive their receipt numbers.

It’s the first time that I apply for H1b NO/AD, and I received my “I-129 H-1B Reeipt Notice EAC151445XXXX” on May 5 from my attorney, and until now I was worryed about the lottery process thinking “I was piked up or not ?” and it’s pain full… and by the way my case is in received status … just need to wait right ?

    As per this site, California Service center are supposed to take 2 months to process H1B. However i am still waiting for my case updates.
    Anybody any idea if we can reach out to USCIS on this.

  34. All guys who are waiting out there for receipt numbers from USCIS (not from employer) accept the truth. Its over… Move on….

    my case(EAC1514952***) was picked up in the lottery and received date is 13th April but till date there is no update. would like to go for a Case Inquiry as its out of processing time(60 days), will USCIS will respond? any idea?

        • In the past several fiscal years, USCIS has never given any timeline for processing H1B. You may get approval in this month, next month, or even September. Be patient, because it’s not handled by you, and you can’t determine when you should get it. If it belongs to you, then it’ll come to you. Don’t worry, because the rejection rate is really really very low.

    • My receipt no is exactly same as urs , EAC1514952*** , even my status is still the same “Case was received”, What i noticed soo far was that all the receipt nos after EAC1514952066 are either approved or are in RFE but before EAC1514952066 very very very few have been processed soo far 🙁 🙁

    • Ibmer, you are correct. And you, in fact your help employer has right to call USCIS or he can raise it online…

      You know, I had called USCIS toll free number on the 61st day from my received date and raised the same query.. They asked me about caseid and employer details and replied that, I am not the authorized person to inquire the status/reason. Asked me to request my employer to give a call to USCIS directly.. But, as you know, no employer will do that 🙂

Hello everyone, I just a question: I’m confuse now… some people complain that they received a notice that they was not selected in the lottery… So it means that they did not received they receipt number such as EAXxxxxxx… or WACXxxxxxx some thing like that ? Or all those that have received they receipts don’t mean that was selected in the lottery?

  37. Raised an AHD today and got to know my file has been rejected. They have got all the status now and are updating it one by one.

    • i did not received any mail or update on AIMS portal till now…how u confirm that they have all status update with them for everyone …..

        • Raised the AHD….still same status ..they replied “Hi As soon as we get an update from the USCIS on your petition status, GI Team will update the AIMS status on priority. • If your petition is selected in the lottery, at least it will take 3-4 weeks to upload the scanned copy on AIMS. • If your petition is rejected in the lottery then AIMS will be updated on real time. Hence we request not to follow up with the GI team on the lottery status and AIMS system update. Note: GI team will not be able to speed up the USCIS ETA and have to wait until they provide an update. We appreciate your patience. “

          • According to below link, the USCIS has finished processing of sending both Receipt no.s and Rejected petitions by Jul 14th so you should receive your status on or before Jul 20th. Good luck!
