  2. Can you tell me what is RFE ???

what is the approval and denied chances???

For what most common thing they will give RFE ???

    • @xyz
RFE stands for Request for Evidence.
Its a lame thing to ask whats your approval denial chances , don’t ask questions like a two year old kid.
Most commonly USCIS asks to prove employee-employer relationship, W2’s, pay-stubs etc.

Does not mean your application is selected!!

Status and work authorization shall automatically continue until October 1st or until the H1B cap case is rejected (including not being selected in the random lottery), denied or revoked, whichever is earlier

    • Thats a good news. I was really going mad about this.
Are you sure they didn’t get the receipt number and the check has been cashed today?

Maybe, your lawyer might have got the receipt and he didn’t checked his email due to bulk of emails.

Please confirm. I’m like my entire future is gone.

My HR caalled USCIS yesterday and they said “No Record found”

      Thanks and appreciated! Good luck!!

  11. Hi Friends,
Do a company has quota in random selection? If Company “A” has filed 10 application and Company B has filed 100 application what is the chance of # of application selected from Company A and Company B respectively?
    Regards,
    Manish

    Reply
    • My Friend there is no company base quota. It will be random based selection. So, there is a high probability that company B has more chance of getting VISA approved since they have filed more no of petitions.

      Reply
    • The correct way of looking at this would be to find the expected number of approvals, which in this case can be given by sum(p1 + p2 +….+ p10) for A, and sum(p1 +…+ p100) for B. If all candidates in both companies have applied for the same quota, all probabilities are pegged at the same value, lets assume 0.62. Then about 6.2 people from A would get the visa while 62 people from B would get the visa. So if you are concerned about fairness, I think the lottery should be fair. The odds will tilt in favor of the company which will have a higher ratio of Advanced degree cap applications to general though since the probability of ADE application getting through is higher at around 0.89, of course considering a 28k-96k split for the 124k visas.

The comprehensive immigration bill and the 110,000/25,000 quotas should provide some relief to us, at least for a couple of years. I wonder how long the house and senate might take to pass it.

  16. Friends pls find below some useful information on timing of reciept:::

At the American Immigration Lawyers Association (AILA) Spring CLE Conference in Washington, DC on April 12, 2013, USCIS stated that although the lottery to select a sufficient number of H-1B petitions to meet the FY 2014 cap was completed on April 7, 2013, USCIS will not issue receipt notices for H-1B petitions submitted via regular processing until late April or early May. The USCIS continues to issue receipt notices for cases filed under the premium processing queue. USCIS has not indicated when they will finish issuing the premium processing receipts. USCIS also stated that cases which were not selected during the lottery will be returned either in late April or early May, once receipts are issued. Regular receipts and rejected cases are mailed out through the US Postal Service with no tracking or advance notice issued as they are sent. This means that it will not be until mid-May before some foreign nationals and employers know whether cases were accepted for processing or not.

We understand that foreign nationals and employers are anxious to receive word regarding whether particular cases have been received or not. XXXX is notifying foreign nationals and employers immediately as we receive receipt notices for H-1B petitions selected for the FY 2014 cap. If your case was not submitted using Premium Processing and was instead submitted via regular processing, we will not know until late April or early May if your case was selected for the FY 2014 cap.

Please note that USCIS also announced that they cannot accept upgrades to premium processing for any cases until the receipts are actually issued. This means that there is no way to “upgrade” a case in order to force out a receipt notice if the case was selected.

      • You are just guessing, there is no way to now. Fwd.us was doing lobbying after they saw that there was 124,000 application for 65,000 H-1b visas. I think it is logical to consider that is going to take effect immediately after they pass the bill. God only knows when the bill will pass.

don’t lose hope… ( m on the same boat) but looked for other options as well….
Infact, had option of filing 2 H1s with two employers.. but I rejected on in the end of March’13 just to save one h1 for another human.

As soon as I started losing hope, started looking for other options (other country work permit).
With grace of god, I’ve got Singapore and Malaysia (accepted one after comparing both offers with respect to India).
All this happened in last one week…. So now I am not just that much frustrated or restless…

Pray to god, looks for other options… God is generous and always with everyone…
    just give a try….

wish you all the best … Keep trying… world doesn’t ends at USA, Right? :)…
