  1. I probably think its about the timing
    since the Congress is working on a immigration reform
    there mite be a chance they would increase the visas
    which would be effective immediately, so all who have applied
    would get a chance for the papers to be reviewed and hence
    DHS is taking time to work accordingly.
    I mite be wrong on this, but just giving a thought based on
    the timing we are right now.

  2. Hi,

    It looks like uscis did lottery on Pp/rp cases and then sorted the PP/RP cases and then started entering pp cases first since those need to go first. According to the comments I have been reading down the chain, people are receiving emails even today and it is possible that attorney’s have received it but have not forwarded yet (since it is weekend and attorney may not Check their emails or work over weekends). I am sure pp guys will receive emails next week.
    So hang on guys we will see ray of hope for sure

    From what I have been noticing on forums, it seems USCIS is currently in the process of issuing receipts/email for the premium processing cases (normal and advance degree) from both Vermont and California.
    Its surprising that they still haven’t announced the break up of 124,000 cases into the normal and advance degree filed cases.

  4. Received my Receipt Number in the morning. Actually got email from my lawyer today. My application is being processed at California Center. I am not sure whether is for PP or normal one. But I am in regular quota as I have not received my Master’s Degree yet.

  6. Here is what i got from my attorneys news letter. Dont ask me for proofs. Believe it or not.

    1. The USCIS began the process of data entry of the H-1B cap cases. Premium processing cases are being entered first and should be completed by April 15th.

    2. Non-Premium Processing cases data entry will begin only after the premium processing cases are entered. Non-Premium processing case data entry will not be completed until at least the end of April and will very likely not be completed until sometime in May. Please note that when the cap was reached on the first day in 2008, the USCIS did not complete the data entry and issuance of receipt notices until June. Therefore receipt notices for non-premium Processing cases may not be issued for everyone until May.

    3. Rejection notices for cases not selected in the lottery may not be sent until June after the receipt notices are sent out for selected cases.

    4. Premium processing adjudication will begin on April 15th for all cap filed premium processing cases. Mr. Neufeld commented that the USCIS did not receive a larger than expected number of premium processing filings to prevent adjudication (approval, rejection or Request for Evidence) of the premium processing cases within 15 days.

    5. Non-Premium processing cases can only be converted to premium processing cases after a receipt notice is issued.

    6. Mr. Neufeld refused to provide any goals for processing times for non-premium processing cases. He stated that the USCIS may publicly announce a processing goal in the future

  7. My application is under premium and masters quota at VSC. I still haven’t received a receipt no. What is waiting period for PP?? Are they done with PP?? Anyone still waiting like me ? Lost patient,lost concentration ….:-(

    • Well if its PP, then they are bound to process your case (if selected) by 15th April.
      No one knows the waiting period except for USCIS.

        • I am sure that piece of news is not from USCIS?
          It makes sense to keep a certain number of cases in (normal and advance degree) waiting list to deal with scenarios when cases get selected in lottery but eventually are rejected because of insufficient documents, out of status, other reasons.

        I can understand. I received the confirmation on Wednesday, but before that I was half killed in just three days.

        I know this could be pretty hard but I think I should pass the information that my lawyer told me. All PP should receive the receipt number by Friday (i.e. today), if you have not received this yet, there are high chances that you have not been lucky enough to get into the lottery. But don’t loose hope.

  8. My lawyer notified me Immigration announced that they are not going to be able to send out all of the receipts until the end of April and will be returning cases not selected at the beginning of May. Is there anyone who has the detail about that?

      • The lawyer said there was a meeting in Washington, DC this morning where Immigration announced that. recepit being sent out is only PP now? is there any regular?

    The above report lists the top 1 – 25 H1B Visa sponsors in fiscal year 2012. For Example, the first record on this report means that Infosys Limited filed 15,810 Labor Condition Applications(LCA) for H1B Visa in fiscal year 2012. The average salary of those job offerss is $75,062.

    The visa sponsors(employers) are sorted by the number of Labor Condition Application(LCA) submitted. The number includes new, renew and transfer of LCA.

    If two employers have filed same number of visa petitions in the same year and same category, they are further sorted by the average salary in descending order.

    The salary is the average salary of all proffered salary on LCA or Form 9035. Sometimes the visa sponsors(employers) does not enter a specific salary, but a salary range. Our algorithm uses the middle point of the range to calculate the average salary.

    *: The number of LCA includes renewed, transferred and cap-exempt LCA. Department of Labor(DOL) typically certifies more than 3 times the number of foreign work requests than the number of H-1B visas issued by USCIS.

    A new LCA is needed if the foreigner worker changes his or her work location(even within the same state and same company), because the prevailing wage of the position depends on geographic location. However, if the new location is within the same Metropolitan Statistical Area or normal commuting distance, no new LCA is needed.

    I have applied for H1B Regular with PP, still I have not received receipt yet.

  13. They are going to put a bill on vote Tuesday. If approved will it affect this year? Have you guys seem the lobying Marck Zuckenberg is doing?

    Four Democratic and four Republican senators have reached agreement on all the major elements of sweeping legislation to remake the nation’s immigration laws, and expect to unveil the bill next week. Democratic Sen. Dick Durbin of Illinois says the bill probably will be rolled out on Tuesday.

      • I think my gut feeling is that Friday they have to send all lottery selected PP receipts if they have to start processing from Monday April 15. I was scared that I was not selected in lottery until I got the news from my lawyer.

Just got the confirmation from my attorney regarding my case (premium regular service at California center) for precessing a few min ago, I understand all of you guys, I was so much stressed till I got this answer, it was a pure torture. I hope all of you get an answer really soon. Do not worry, USCIS is still sending emails, and in fact my attorney told me that they are sending the answers to us slowly and more are coming. So, if someone is saying it is finished they all want to just make you stressed.

  20. Mine is Regular with no PP. I’m experienced in my field.. till when can I expect to get any news (Accepted/Rejected) ????? My attorney said me to wait this whole month of April. USCIS has received my petition on April 1, 3.00pm afternoon.

    Mine is Regular CAP/PP/VSC. Was following here, saw couple of them reporting they have received the receipts through email spoke to attorney and he informed me that wait for at least two weeks. So bad to expect from a country like USA to have such a bad system for its immigration that they select candidates through lottery first thing and do not publish the results immediately..making hell for everyone…if not for redbus everyone else would have been bombarding emails and calls to their attorneys and employers…thanks to Redbus2us at least we can make speculation of whats going on…please let me know what happens If i didnt get the email by this week as PP starts from Apr 15th.

    • Even my attorney asked me to wait for 2 weeks, seeing guys receiving receipt number make us to loose hope,also for a PP application, I felt they release the receipt unevenly, so as said v need to wait, must be undergoing worst time, waiting for weeks together without even knowing how its going to be.

  23. I may be wrong but I am feeling that USCIS has given priority to Masters ,PP … well I agree they deserve it. But there are people from regular cap who have jobs in USA and looking for VISA to continue their jobs.
    I see only Masters, PP replies on receipts but not regular PP. It does not sound good to me.
    I am afraid USCIS will consider only advanced degree application for waiting list.

      • @the deserving graduate – I work for one of the top organization in USA without having “Masters degree” from USA. What you are saying is completly incorrect. I did say Masters people do deserve it! Ofcourse, I would not like to argue with you.. if one has an ability they will shine no matter if they have masters or not, it is just a matter of opportunity!

        • I absolutely agree with the deserving guy …. people struggle pinch their savings to get a degree and education here. they are more deserving. there are many people who just get in to do subpar jobs through some IT companies so that they wont have t hire people out here .. im thankful for the 20 k cap for advance degree, wish it was higher

Going by your argument, I would say people who have done their PhD in US are more deserving than just a short “Masters”. Masters does not make you an expert in anything anyway. So let us have a seperate preferred category for PhD people. I have done my PhD and more in US, and know what Masters means (not much in my opinion). So I can certainly look at the bigger picture than you guys can. If you are so deserving, you will get it. There is nothing to worry. All I can say is that people who are already working for some company in US (and doing well) are more deserving than those who have just a simple Masters and have not started their jobs yet. Masters? I dont give a sh**t. Talk to me when you have a Ph.D.

          • one of my classmate who was not even medicore choose US to do MBA as he was declined addmission in any decent indian mba college……n there r many examples like this …….so there r many examples where people opt for masters (MS or MBA) just bcoz they dont have a good job or cannt get addmission in top colleges of there respective countries.
            in these cases how do thy deserve more then people who have proved there work in there respective fields/companies?

        • You are wrong but i can say how the USCIS issues visas for other than higher degree people . We came here , paid fees , lost food habits every thing more over you know how the education system works if any one fails in subject have to pay tution fees and retake the subject .
          we are not opposing regular quota people but we are asking US govt either raise MS quota as unlimited why b’coz for this quota , congress may not need voting for a bill . This is a govt decision .
          Think you guys we are here with valid status and paid n paying taxes for every thing —–you know MS guys are getting tension whether its approves or not —even though we are step in USA …

          I hope govt should take a decison for masters quota as unlimited — then no tension .

        Why r you guys fighting on a simple matter ? To all @loosing hope, Guess, the desrveing graduate. Everyone is eager for their own, If anything you can blame – that is the current immigration system. I agree Master’s degree holders deserve that, but also people without having master’s have their credential to have H1B.

        It is unfortunate to say that it is current broken immigration system – which can not use the US graduate and other people properly for the country’s own benefit. For instance, see, I am a PhD holder and working in a Top US company, but we also had to go through this tedious process.

        So please don’t fight between us guys. Everyone is in the same boat

I think they should enlist minimum GPA limits and some other requirement , also seperate the PhDs (You can’t reward your PhD without proven and published work records in US study system…also they should get minimum GPA of 3 out of 4) who can get direct H1B exempt to cap. About Crappy school – I think in US study system, there is very very little room to get schools like “CRAPPY”. Even if some, they can easliy take them out of their list

        • So what about people who did their undergrads from the top US schools and end up at the top US companies in every industry? They’ve spent more money than any masters or phd programs but the degree is at the lowest level in the hierarchy? This argument about spending money and paying taxes is completely irrational. Spending money does not make you more or less deserving. I know people who deserved to go to the top educational institutions in the world but the costs of attendance stopped them from doing so. Yes some schools are need-blind but the majority aren’t.

          Who can tell that a person who holds a “meager” bachelors or masters degree will not go back to school later in life to get an advanced degree and the current work experience will help them achieve that goal?

          Everyone deserves the right to a better life, to provide for their family and make something of themselves. A job with an IT company might seem “sub-par” to one but might mean the world to another. The current situation is indeed very unfortunate but remember there’s a crack in everything, that’s how the light gets in.

          This reply is not meant to upset anyone or add more fuel to the fire. I wish everyone would be able to get their visas but since that is not possible this time around, all we can do now is be patient and make the best of the eventual outcome.

          • My counter-argument does not hold in your case. It only holds true if people suggest that Masters in US makes them more deserving than the others. It’s a matter of perspective, depends on who you are talking to and how much you know. And honestly, when you say someone with a meager degree can go on to achieve a lot more, well, anything is possible my friend. But your employer does not employ you based on what credentials you might have in future, does he? If you are ill, would you go to a Medical student or a registered Physician?
            One thing is for certain though, Masters does not make you an expert, and I know that for a fact . So why should they get a increased cap?

      • Yes true, if unable to perform in CAT, you people choose MBA from US as it is very easy and they arguing that you deserve very much….if you say that you are in US because US gives everyone fair chance then you are contrdicting your own statement.

      • But people with Masters do have a special treatment, don’t they? There is an advanced degree cap.
        It is amazing to me how patronizing someone with just a few more courses under his belt can be to others. I have a PhD from one of the top schools in the US and I am appalled by what i read on this forum. I am very much aware what Masters is and let me tell you my friend: I would choose one B.Sc. person over five people with Masters. Based on what I can see here people with Masters degree have seriously over sized egos and that certainly does not make them good employees.
        I will add this: if you are so special go ahead and apply for an O-1 visa in which you have to show your extraordinary ability within your field of expertise. I am sure plenty of masters people are top experts in their fields after completing a few extra courses and a little research project.

      • Does not matter how many master applicants: for regular cap lottry, the chance will be Approximately 65k / (124k – 20k) where everyone in regular cap has equal chance being selected.

      Why r u so disappointed ? If you are in still India, then there is no question of ending your hope . But if your are already working here in H1B , then your extension should be done. I agree that this year is a bad one in involving lot of unusal things like lottery. But that can not end anyone’s hope.

  27. Hello, my application is under premium and masters quota. I still haven’t received a receipt no. Does that mean I m not selected? How is the receipt no sent to the lawyer? Mail or email? Please reply, m freaking out.

    • They typically email the receipt no. to attorney. They are gradually sending the receipt. I am also in PP/Master’s cap. but I got receipt on just yesterday. So no need to panic as of now. You might need to wait one more week.

    • Premium processing clock of 15 days as per USCIS start from 4/15. so i think most people should get their receipt in email. in PP cases Attorney/employer get email not employee.

      so guys keep hope alive until Monday 4/15. for premium processing Master/General.

  28. I am into masters and regular processing. my attorney says it will takes atleast 7-10 business days to get an update from uscis. till that point regular processing people have to bear this stress.

    • I called my attorney and they told mostly we will get receipt (if we are lucky)/document by Monday .It seems USCIS has already dispatched most of it on 8th and 9th .Hope this helps

  29. Received mine as well. My Attorney received the receipt. PP/Master’s cap/Vermont.

    The guys for regular cap and regular processing – I think not to worry guys. They are sending the premium processing first. So you all can expect the receipt from April 2nd week onwards.

    So don’t panic.

    • I have filed my under premium category in general quota. Do we know is this a manual process of sending the application number and emails? If yes, then I can still hope that mine would be coming 🙁 . Else, its a very bad luck this time for me 🙁
