    I get the information by checking my case on the attorney’s website. In case you did get a receipt but the attorney did not inform you promptly, you can always contact them.

      • Regular quota with Premium Processing. My attorney said the USCIS will likely be sending out receipts for the premium processed cases that were selected all this week , and they’ll be sending out receipts for non-premium cases all of April.

        All you can do right now is wait if you’ve not received the receipt.

    • Congratulations! My friend received H1-B lottery result yesterday we applied through same lawyer and roughly our applications would have been filed on same date. I am worried why I have i not heard anything. Is it possible USCIS is randomly replying to lawyers and not based on serial numbers?

  6. If singapore and chile countries quota 6,800 is considered, then percentage of chance getting dropped, For Master’s students is 63% and for normal quota is 56%.

  7. So It looks like people are getting their receipt numbers but it also looks like lot of people have not got any updates yet from their attorney (including me). Lets wait for couple of days and hopefully everybody will get through it

  8. Not sure, how people are getting the receipts so early. They did the lottery on April 7th and people are getting their receipt on 9th…..It is too confusing. May be I am wrong, but I am not sure anybody can get the receipt so early..However, if you got this, great, OTHERWISE PLEASE DON’T SPREAD ANY RUMOURS IN AIR.

    • Who knows? May be lottery never happened. There is not enough transparency in the system for us to translate the shadow into some meaningful information.

      I have received my receipt number. I’ve been watching the post and the comments since Apr 1st and of course I wouldn’t make jokes about it because I’m in the same situation as all of you since the beginning.

      I am in the regular quota and Premium Processing. I received the receipt number from my attorney like 2 hours ago. I really wouldn’t make jokes about it.

        • According to my attorney it’s a good news. It means that we are selected to initiate the H-1B process. But she said as well that USCIS has made errors in receipting cap cases in previous years. So we shouldn’t celebrate too much untilmthe actual mailed notice is delivered, which can happen in about a week.

I have observer in this forum few people abusing IT people as if we have committed any crime …..it is not because of IT people but the demand and supply and respect American laws which gives equal opportunities to everyone….. i am also frustated because of my hard luck but this is not the end of the world.

    WASHINGTON (Reuters) – A U.S. visa program ran a lottery on Sunday to award 85,000 slots for high-skilled workers just one week after the application period opened, the Citizenship and Immigration Service said, signaling companies feel confident enough about the economy to hire more foreign workers.

    The USCIS held the lottery to approve petitions for the slots after it received approximately 124,000 H-1B petitions last week, including petitions filed for holders of advanced degrees from U.S. universities. The USCIS started accepting petitions for the visas just a week ago, on April 1 and stopped accepting them five days later because of high demand.

    The last time the USCIS used a lottery this quickly to grant H-1B visas, a type companies must initiate, was in 2008, before the economic crisis hit. In April that year, when unemployment was around 5 percent, it received 163,000 petitions in five days.

    Now the economy seems to be improving, with the unemployment rate nudging down to 7.6 percent last month according to the Bureau of Labor Statistics, as wages edge up.

    The cap includes 65,000 high-skilled workers, plus a separate H-1B allocation of 20,000 masters and PhD graduates from U.S. universities. The actual granting of visas is made by the State Department, the final step for any H-1B applicant.

    Petitioners are being notified by U.S. mail if they have won a slot, USCIS said. Those who have not will receive their petitions in the mail, along with their refunded filing fees.

    The H-1B is a nonimmigrant visa in the United States that allows U.S. employers to temporarily employ foreign workers in specialty occupations. The duration of stay is three years, extendable to six years.

    U.S. companies, particularly in technology, say they need the visas to fill vacant positions. But some worker-advocacy groups counter that the companies are using the visa program to hire cheaper foreign labor.

    While the official quota is 65,000, the actual number of people who enter the United States on H-1Bs is higher because workers at universities and some other workplaces do not count toward the limit. The USCIS is still accepting petitions for those exempted categories of worker, it said.

    Last year, the government issued 129,000 H-1B visas. Indian nationals received the largest number.

    U.S. Congress is currently working on immigration reform legislation. Among the proposals is a revamp of the H-1B program that could raise the quota based on demand and eliminate the lottery.

  19. Here i smy guess. I was reading some post earlier that previous year USCIS has 15-17 % rejections rate. Here is my calculations:
    124,000-20,000 = 104,000
    Let us assume that USCIS rejects 15 % petitions due to qualifications, wrong fee etc, etc:
    104,000 X 15/100 = 15,600 i.e. 104000-15600 = 88,400.
    Now the competition is among 88,400. They will find out 65,00 out of 88,400.

      It should be look like:
      After 15 % rejection:
      124,000 X 15/100 = 18,600 i.e. 124,000-18,600 = 105400
      Out of that 20,000 goes to Advance cap i.e. 85,400 and out of 85,400 65,00 goes to general cap: 20000. So if there are 15 % rejection rate, only 20,000 application will be rejected.
      I hope it is right.

    • unfortunately, they include all petitions (even those which might be rejected in future because of various reasons) and then conduct lottery…..They waitlist some applications to replace the rejected ones but not sure how they predict how many would be rejected. They might waitlist only 10% or 5%. While in ur calculation u have used 15%. So basically we dont know whats gonna happen.

      124,000 applications received and lottery done yesterday.

      If equal percentage of applications were made:
      Masters: 38,154 (wowwwwwwww !!!!!)
      Regular: 85,846

      p(masters lottery) = 0.52
      p(regular lottery) = 0.55, considered the reserved 6800 quota….

      So, pray to god.. Both the probabilities are close to 50%

  25. Since they are going to start working on the Premium Petitions by 15/April/2013, I assume if we dont get our applications back by 30/April/2013, we have made it via the lottery.

  27. Is there any update on “I-Squared Act of 2013″. This bill would increase the cap count to 115000 from the current count. There was a news last week saying that this will passedk in tge coming week.

        Effective Date.–The amendments made by this section shall take
        effect on October 1, 2013, and shall apply to fiscal years beginning
        with fiscal year 2014.
        Does that mean, if it’s passed, will it be applicable to FY 2014 h1b Cap as well ?

  29. Uscis said the same thing on last year cap but no lottery

    H1B Visa Cap / Quota – FY 2013
    On June 11, 2012, USCIS received a sufficient number of petitions to reach the h1b visa quota/ cap for FY 2013.
    On June 7, 2012, USCIS also received more than 20,000 H1B visa quota based petitions.
    USCIS will reject petitions subject to the h1b visa quota for H1B specialty occupation workers seeking an employment start date in FY 2013 that are received after June 11, 2012.

    For this year also they say the same but lottery !!!!!

      If they go over the count, random selection will be conducted. Doesn’t matter what language they use in their press release.

  30. Visa should be sponsored by american client companies and not the consulting comp. This way uscis can keep track of the companies. Offshore consulting must just provide workforce. These offshore companies overcome the lottery system by applying multiple people for a single client position. Thats y thy accumulate so many lca. N usally ha

    Let’s assume USCIS received “A” number of H1B applications under the general cap of which “B” are from the two countries with the special Free Trade Agreement (Chile and Singapore) and “C” is the number of applications received under the advanced degree cap, then:

    – For those under the general cap and who are not citizen’s of one of the specialty treaty countries (assuming that no H1B visas allocated for the special Free Trade Agreement were carried over from last year): 

    If B 6,800 then:

    (65,000 – 6,800) / [A + (B – 6,800) + (C – 20,000)]

    – For people with advanced degrees from the US (assuming again that no H1B visas allocated for the special Free Trade Agreement were carried over from last year): 

    If B 6,800 then:

    20,000 / C + (65,000 – 6,800) / [A + (B – 6,800) + (C – 20,000)] – {20,000 / C x (65,000 – 6,800) / [A + (B – 6,800) + (C – 20,000)]}

    – Last for those people who are citizens of Chile or Singapore (assuming that no H1B visas allocated for the special Free Trade Agreement were carried over from last year):

    If B 6,800 then:

      (B / 6800) + (65,000 – 6,800) / [A + (B – 6,800) + (C – 20,000)] – {B / 6,800 x  (65,000 – 6,800) / [A + (B – 6,800) + (C – 20,000)]}

      I hope that makes sense.  I will illustrate with a numerical example in my next post.

      • A and B mutually exclusive. But advanced cap will be slightly lucky (read as rewarded for their hardwork).

        P(A) – Advanced = 0.7142 (assume 28000 received)
        P(B) – General = 0.6018 (assume 100K gen + 8K of advanced)

        This is better, compared to 9.1 million qualified entries for Green card during the 60-day application period for DV-2009.

        • Following mistakes:

          -You are disregarding the fact that 6800 visas are held aside for Chile and Singapore applicant which if not filled they will be carried over to next year and not made available to applicants under the general cap.

          -Probability of advanced degree applicant is cumulative as it can participate in two lotteries. Increases the odds than just participating in one lottery with just the advance degree applicants

  32. 50% of the software junks as individual aswel as couples exported from india with H1B . That’s Why others have less opportunity and struggling when they get chance after trying a lot to work in usa .

    USCIS should look in to this !!!!!! Should fix and limit the number of petitions !!!!

    Cannot have luck always in life . If individual applied for h1b ( not from Sw as a bunch )that should be approved by uscis if they are eligible .

  33. I know couple of start up’s in the valley sponsoring two students on opt. A negative outcome could cripple the operations of these promising companies. Also working from home country is not viable as they form the core part of the engineering teams and woulf eventually be in leadership roles. This is an extremely anxious situation for the founders and the rest of the staff.
