  1. What the hell – the lottery is because of number of filings head count increased of the below software companies . what we do when the H1B applied for single employer (1 single H1B Petition from engineering company) do we need to accept the hell ?

    USCIS should limit the petitions each employer stated here and should APPROVE THE SINGLE PETITIONS FILED from engineering companies who they looking for their life change from the stress.

    All Peoples who applied H1B from engineering should stresssss about the dam lottery now ?
    they would loose their job because of this !!!! lottery

    they are already in stress now and hurting more now because of this bulshit lottery process.

  2. It is official. There will be a lottery. Here is the official word from USCIS.

    a.) Both the Masters CAP and the General CAP has been met. There will be a lottery.
    b.) USCIS will not accept any more application. It will stop accepting applications today.
    c.) Lottery for the advanced degree will take place first. All degree petitions not selected will be placed in the general lottery.
    d.) Due to the high number of applications recieved USCIS is not able to currently state when it will have the lottery scheduled.
    e.) USICA will not provide the total number of petitions received as it is still recieving it today. Most probably it may do so monday.

    Is it only in california and Vermont , or even texas also there …

  4. Just to Add what Shekhar said , these are extremely genuine and true facts , which Shekhar has put up . These are the major reasons why the US govt decided over the H1b visa category in the first place to , promote research , benefiting mankind and also benefiting America at the first place .

    Just to reiterate to the below mentioned points mentioned by Shekhar , I shall also like to add these points which make it quite self evident that people doing research in US universities add more value ( speaking relatively , of course) :to the system in general and should always be given more priority in granting the H1Bs –

    I am answering to your question and I hope you understand this.

    Listed below are the reasons why they should go lottery for 20k first and then put the remaining to 65k to give them another chance.

    – More than 98% patents files by US (503528 in year 2011) are filed by people who have done masters and PhD from here and more than 50% of them are foreign nationals (who needs H1 initially and they fall under 20k cap).
    – More than 50% masters and PhD graduates from American Universities either become entrepreneur or work for companies less than 10 years old to make them grow and create new jobs for native americans.
    – Organizations like NASA and others hire Masters and PhD graduates in USA for spatial research and more than 40% of NASA employees are graduates from American Universities who are natively foreign origin (they needs H1 initially to work and they fall under 20k cap).
    Unfortunately, Indian IT companies like TCS and Infosys doesn’t have any role in that.
    – 40% of fortune 500 companies were started by students who have Masters/PhD degree (who required H1 at the start). From 1995 to 2005, half of the silicon valley start ups had at least one founder belonging to this category and in 2005 alone, those businesses did 52 billion dollar in sales creating more than 400k jobs.

    None of the people who comes here in 65k category do this.

    I can give you tonnes of similar facts but I know after this post people will start attacking me personally because its impossible to make them understand. People who do routine jobs in India IT companies seriously need to understand the importance of research and what it means by highly skilled labour, if they think they are..

    Now its ur turn baby… Attack me…. But it would be really nice if you can attack me with facts and figures and just not by shear emotions.

    –Also if you take a close look , most of the Research centers , I mean the core research centers for IBM Watson labs , Google Labs , Microsoft R &D , Bloomberg R & D , Yahoo R & D have their research centers here in US and they mostly cater to students who have a advanced degree ( Masters or Phd) , from a US university , and who in turn will be the cause of their next great product or innovation and believe me if you think logically TCS, Infosys , HCL , all have less or no contribution to research from the Indian division and mostly work as a shop to provide cheap labor.
    — Second stats is if you see almost 97 % of the people who come on H1b from India without an advance degree , ( mostly exceptions are there here and there , but cannot be counted ) come for a QA or Testing position , and I don’t disagree that QA / Testing is an important part of the development life cycle , but cannot be compared to core R & D and highly skilled labor for which US started the H1B category at the first place.

    I am sure there will be many people disagreeing with these facts but facts will still remain facts and if you want to disagree or agree with the same .

    • Please request USCIS to accept only Rand D applications and reject other application instead of writing up facts.
      The fact is USCIS accepts any H1B application irrespective of the category…

      I definitely agree that people who have done their Masters/Phd will turn out to provide more value. However all the IT companies are not out there just to provide cheap labor. They come out as a Service Company where they provide end to end IT services for an organization. The overhead, management, services, staffing, training, IT Analysis, Development, Testing, Maintenance, Tech Support, Change Management are all taken care by the Service Company. Point is there is a huge need for this IT service and these people are out there providing them – yes they are relatively cheaper. Thats because of the working Onsite-Offshore model. There is a need to be met and they are meeting them. I still agree that Masters/Phd students should have a special quota which they do.

      It depends upon how much over the cap did the filing go. First the premium petitions selected in the lottery will know about it, followed by others.

This is what given on USCIS website: “We use the information provided in Part C of the H-1B Data Collection and Filing Fee Exemption Supplement (Form I-129, pages 17 through 19) to determine whether a petition is subject to the 65,000 H-1B numerical limitation (the “cap”). Some petitions are exempt from the cap under the advanced degree exemption provided to the first 20,000 petitions filed for a beneficiary who has obtained a U.S. master’s degree or higher. Unless otherwise exempt from the cap, petitions filed on behalf of beneficiaries who have obtained a U.S. master’s degree or higher will be counted against the regular cap once USCIS has received sufficient petitions to reach the advanced degree exemption.”

    There is no lottery for advanced degree cap exempt applications although there are more than 20,000 petitions received. USCIS will select first 20,000 applications snd rest of the applications will go into cap-subject quota. There is random selection for this cap subject quota. Please read following portion of today’s USCIS alert:
    “USCIS will use a computer-generated random selection process (commonly known as the “lottery”) for all FY 2014 cap-subject petitions received through April 5, 2013. The agency will conduct the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected will be part of the random selection process for the 65,000 limit. ”
    USCIS will conduct selection process for advanced degree (it doesn’t say random selection).
    All guys with advanced degree from US and filed petitions early this week, we are in good luck!

    • You are right.For the first 20,000 Advanced exemption that are lawfully and accepted, there wont be lottery. But the rest of Advanced exemption will go into cap and be subject to lottery. So that means they will first conduct an examination to all the ADE exemption petitions and filter out those that are not lawful or not accepted. Second, to choose the first 20,000 out of all accepted ones. Then the rest of the accepted with a later arrival date will be put into cap and random selection.

      However my quesiton is, how do they decide who are the first 20,000? Based on arrival time?

  10. Watever be the numbers. This years lottery would serve as an eye opener for people interested in pursuing advanced degrees in US in the coming years. 20k for advanced degree will not cater to the growing student population within united states. Unlike 2008 the economy is getting better atleast the high skilled job market will continue to see an increase in hiring.

    Some might argue that student visa is only for studies.. but then lot of companies hire opt students n a sudden turn of events like a lottery can be blow for many companies utilizn these group of people.

    A higher degree might not guarantee an h1b unless there are new laws passed.

    Hopefully the probabilities are high this year for all but fy 2015 cud end up being the next fy 2009

  11. Based on the fact that USCIS released the results just some hours ago, can we say that we just reached the CAP a few hours ago, and the winning chance in the lottery would be high, since the number of extra applications would not be much.

  12. Some numerical SPECULATION/ESIMATES (No, I do not have any inside information… obviously):

    I think the key question to estimating our chances is knowing WHEN the cap was reached. I think the USCIS policy was to notify the public as soon as the cap is reached (otherwise, they would have waited until after close of business on Friday). This is a big assumption – it implies that the quota was reach on Thursday, and not on Monday, Tuesday or Wednesday. If the quota was reached before Thursday, the numbers below are meaningless. However, assuming this is true, here are some numbers:

    Total number of H1B applications received: 70k (50k on Monday, 5k on each subsequent day)
    Ignoring reserved caps, this means that 93% of general pool applicants will be granted an H1B.
    Assuming that Masters applications were received at the same rate, Masters applicants have a 99.5% (100% – 7%*7%) of getting H1Bs.

    Again, my biggest question is *when* the cap was reached — that’s the underlying assumption behind these numbers.

USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption. After today, USCIS will not accept H-1B petitions subject to the FY 2014 cap or the advanced degree exemption.

    USCIS will use a computer-generated random selection process (commonly known as the “lottery”) for all FY 2014 cap-subject petitions received through April 5, 2013. The agency will conduct the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected will be part of the random selection process for the 65,000 limit. Due to the high number of petitions received, USCIS is not yet able to announce the exact day of the random selection process. Also, USCIS is currently not providing the total number of petitions received, as we continue to accept filings today. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.
    USCIS will provide more detailed information about the H-1B cap next week.

      • Uscis will run lottery on applications received in the first week of april I.e april 1, 2, 3, 4 and 5.

        The no will be released next week. Usually mid week.

        Then they will have to do data verification on all applicatons

        Then those correctly filled petitions will be subject to lottery

        Then they will notify if petition is selected in lottery or not

        Then the process of scrutinizing the petition begins for selected ones.

    • Fortunately,

      We have not seen the worst… By the predictions and discussions on various forums I was so scared that USCIS will receive more than 100k applications and then even in lottery the chances will be not very great.

      Since USCIS clearly mentions that ” … USCIS announced today that it has received a sufficient number of H-1B petitions ….”, the keyword is today and the notice date is 04/05, that means, they have even counted the applications came today, though not the full day…..

      Taking into consideration the sharp drop in the # of applications since first day, I dont think total applications will be more than 90k… Still much better than 100k+ predictions. Isn’t it?

    • So, if they announced it today (April 5th), does that mean that the cap was reached today? In that case the number of petitions isn’t that higher than the capacity (as today was the last day) and there is a good chance in the lottery?

    • I have a question regarding H1B lottery system. My employer filed my H1B on 2nd Apr. I understand that USCIS will declare result within 3-4 weeks. But how will I find that my case got selected in lottery or not ?

        Your employer/attorney will either receive the receipt number (confirming that you have made through the lottery) or will get the petition package back (confirming that you didn’t make through the lottery).

      USCIS received approximately 124,000 H-1B petitions during the filing period, including petitions filed for the advanced degree exemption.   22. On April first USCIS received 50000 applications. Is these 50,000 applications as well will come under lottery? or else they will take lottery of applications which received on only April 5th ( day which exceeds the cap limit)?

      • This is unfair to treat the applications that came on 1st April on par with 5th April if there is lottery. I think if total applications on 1st April was 20,000 and by end of 4th April if the count was 60000 and on 5th April the count is 70K, only for the petitions on 5th April the lottery would be done. Can anyone correct if this logic is wrong??

      But considering that the cap was filled on 4th EOD, and the no of petitions filed day-wise have had a sharp drop, the lottery would probably be not having some demonic figure. [Just a thought though.]

      • Since the announcement came today at 3:58 PM – Like someone was saying it depends on when the quota was full.

        a) We can assume that the cap is filled by yesterday evening or today morning. Again, this is just an assumption but sounds logical because if the cap was filled 2-3 days back, USCIS could have waited until Friday EOD to release this bulletin. So, the extra number of applications is what they have received since then, which may not be a high number.

        b) Why should USCIS select the Advanced degree people first and push the remaining to the 65000 quota? The logical thing would have been to conduct two SEPARATE lottery draws for 20000 and 65000 quotas. I think that “may be” the number of petitions filed in the 65000 quota may not be that high hence they want to take a chance..

        • I am answering to your question and I hope you understand this.

          Listed below are the reasons why they should go lottery for 20k first and then put the remaining to 65k to give them another chance.

          — More than 98% patents files by US (503528 in year 2011) are filed by people who have done masters and PhD from here and more than 50% of them are foreign nationals (who needs H1 initially and they fall under 20k cap).
          — More than 50% masters and PhD graduates from American Universities either become entrepreneur or work for companies less than 10 years old to make them grow and create new jobs for native americans.
          — Organizations like NASA and others hire Masters and PhD graduates in USA for spatial research and more than 40% of NASA employees are graduates from American Universities who are natively foreign origin (they needs H1 initially to work and they fall under 20k cap).
          Unfortunately, Indian IT companies like TCS and Infosys doesn’t have any role in that.
          — 40% of fortune 500 companies were started by students who have Masters/PhD degree (who required H1 at the start). From 1995 to 2005, half of the silicon valley start ups had at least one founder belonging to this category and in 2005 alone, those businesses did 52 billion dollar in sales creating more than 400k jobs.

          None of the people who comes here in 65k category do this.

          I can give you tonnes of similar facts but I know after this post people will start attacking me personally because its impossible to make them understand. People who do routine jobs in India IT companies seriously need to understand the importance of research and what it means by highly skilled labour, if they think they are..

          Now its ur turn baby… Attack me…. But it would be really nice if you can attack me with facts and figures and just not by shear emotions.

      • They don’t have a final number yet and they won’t make it public until next week. They are still accepting filings until the end of the day, that’s why they don’t have a final number.

        Exempts have been reached as well, so those who are not chosen by the lottery will join the regular ones (65K) for another lottery.

    • Lottery will be held for all application by EOD 4/5 under 65,000 quote. There would be no lottery for Master’s cap and the application not selected for H1B in master’s cap will be included in lottery selection for 650000

        • There will not be lottery for advanced degree cap exempt petitions. USCIS will select first 20,000 petitions eligible for this quota and rest will be pushed into cap subject quota. Cap subject apllivations will be selected from lottery.

      U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2014. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption. After today, USCIS will not accept H-1B petitions subject to the FY 2014 cap or the advanced degree exemption.

      USCIS will use a computer-generated random selection process (commonly known as the “lottery”) for all FY 2014 cap-subject petitions received through April 5, 2013. The agency will conduct the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected will be part of the random selection process for the 65,000 limit. Due to the high number of petitions received, USCIS is not yet able to announce the exact day of the random selection process. Also, USCIS is currently not providing the total number of petitions received, as we continue to accept filings today. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.

      • WASHINGTON—For the first time since 2008, U.S. Citizenship and Immigration Services (USCIS) has reached the statutory H-1B cap of 65,000 for fiscal year (FY) 2014 within the first week of the filing period. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption.

        USCIS received approximately 124,000 H-1B petitions during the filing period, including petitions filed for the advanced degree exemption. On April 7, 2013, USCIS used a computer-generated random selection process (commonly known as a “lottery”) to select a sufficient number of petitions needed to meet the caps of 65,000 for the general category and 20,000 under the advanced degree exemption limit. For cap-subject petitions not randomly selected, USCIS will reject and return the petition with filing fees, unless it is found to be a duplicate filing.

        The agency conducted the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected were part of the random selection process for the 65,000 limit.

        As announced on March 15, 2013, USCIS has temporarily adjusted its premium processing practice. To facilitate the prioritized data entry of cap-subject petitions requesting premium processing, USCIS will begin premium processing for H-1B cap cases on April 15, 2013.         USCIS will continue to accept and process petitions that are otherwise exempt from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap will not be counted towards the congressionally-mandated FY 2014 H-1B cap. Accordingly, USCIS will continue to accept and process petitions filed to:

        extend the amount of time a current H-1B worker may remain in the U.S.;
        change the terms of employment for current H-1B workers;
        allow current H-1B workers to change employers; and
        allow current H-1B workers to work concurrently in a second H-1B position.
        U.S. businesses use the H-1B programto employ foreign workers in specialty occupations that require theoretical or technical expertise in specialized fields including, but not limited to: scientists, engineers, or computer programmers.

  39. I applied for my H1 this year and FedEx tracking said package delivery date 4/1/13. It did not get delivered when it was supposed to and when i called FedEx they said due to the volume of packages a lot of them got misrouted and mine was in LA. Did anyone else face a similar problem. Well it finally got there Tuesday morning so just waiting for the official cap count now.

    Also has anyone received their receipt yet? How long does it usually take for the receipt to arrive?

    • I’m sure 90% people in this particular forum looking for the visa and then an opportunity from the current employer 🙂 …but it’s absolutely diff. for the big IT companies ..they are only processing H1B when they have a specific demand…..

      • In my case I am on different visa it expires soon and I cannot extend it.
        I currently work for state department and if I don’t get this H1B I will loose my job. 🙁
        This entire process is very unfair!!

        • Indeed it is….and if you do some more research on this you will find nearly half of the applicants doesn’t deserve to get H1B ….still they are getting it….i’m not sure USCIS has got technical experts to really assess their credential…..

  41. I talked to the FedEx reps about delivery confirmation to the CA office. The rep said they delivered 22,000 packets on April 1st morning 10:30am delivery and out of which around 350 of them were not scanned properly to get the final electronic delivery confirmation. So they are sending a letter of explanation to substitute for proof of delivery. In other words, we, in that 350, will not have the tracking page updated with delivery confirmation. Note that this is one FedEx guy who dropped 22k on that morning. So if your tracking page is showing no delivery attempt, call FedEx and they are super helpful to give you an explanation.
