  1. Hi,

    I am currently in US and applied for H1b visa for my wife through an employer at US. She was at US along with me (on H4) when we applied for h1.
    Our petition got through lottery, but unfortunately it moved to RFE. Employer submitted the additional document and the status of my petition is RFE review since Aug 30th.

    – Do you know how long will it take to get a decision on my petition.
    – Will upgrading to Premium processing help in favour of getting it approved.

    My wife returned to India 2 months back and since she got H4 visa extension approved last year , we are planning for H4 stamping this month.
    – While H4 stamping interview do they ask any questions on H1b Petition ? like whether we applied for any H1b visa ?
    – What would be the best way to reply if they ask about H1.

    Really appreciate your comments on this.

    • Hi,
      I had to expedite my process since it was taking forever. You should have consulted your lawyer before she travelled to India. The reason being, even though the H1B petition is new, there is an adjustment/change of status(i-539) going on from H4 to H1. While this is in process, your wife needs to be in US and if you travel outside US, your Change of status will be nulled, as it depends on the existing i-94.
      If our wife’s H1B petition is approved, her H4 will be cancelled. The best option for your wife at this time is to enter US on H1B visa.
      Expediting might be a good idea, but please do consult with your immigration lawyer.
      If she attends the Visa interview on H4, they are bound to ask her regarding the H1B petition.
      I know this sounds complicated, but if you lie or hide things during the interview, the consequences are far worse.

  2. My h1b visa is still under administrative processing from 12 Semtember. Is this kind of case done with in the USCIS? As we know, some part of the goverment are closed. Will it affect the process?

  3. I had my interview in Cairo consulate on 22 Jul. From that date my case is still under administrative processing and I got a case number to follow on white receipt. I got a call 2 weeks ago from the embassy just asking some routine questions and so did my employer. How long I should wait until I got a final clearance?

    • I got my visa issued yesterday, just wanted to write that down here to make people who are searching for the same subject to feel hope. I have waited almost 16 weeks after the interview until I got it. Thanks

    With the grace of God, my case has been approved. AD/Vermont center.
    April 8th -IR
    Sept 6th-RFE
    Sept 17-responded to RFE
    Sept 25-RFE response review
    Sept 26- upgraded to PP- Acceptance stage
    Oct 4th- 5:30 PPClock stopped, a notice was sent explaining why the clock stopped
    Oct $th -8:30 pm- Decision- Your petition has been approved!

    I want to thank everyone for all the support you have provided through this forum. To all the people still awaiting the results, please don’t lose your hope. your approvl will come through soon.

    Finally got the great news ‘Petition has been approved’. Status got updated just a couple of hours back :).
    Here are my details.
    Receipt no.: WAC1313851***.
    Type: RP/RQ/IT
    RFE Date: 2nd July.
    Response Date: 19th Sept
    RFERR: 20th Sept.
    PDA: 4th Oct 🙂

    I was one the of the candidates who had to wait a long time to get the receipt no. Even after a lot of follow ups from my attorney and company USCIS could not provide any information about my receipt.By then I had assumed that I was not selected in the lottery and was preparing for plan B.Worst phase of my life probably was doing rounds then.Only after 4 months from the date of lottery I came to know my receipt no. Good news and bad news came together :). RFE was issued on 2nd July,the first time I got to know my petition was picked up :). My company answered the RFE with a lot of focus and the waiting continued for long 2.5 months, which eventually fetched success. Am from IT field from India.
    God has plans for all of us. Pls don’t lose hope
    Thanks to the forum. Am now preparing for the Visa interview,will keep posting.

    Could anyone pls let me know the list of documents to be carried along for the interview.

This company owner is Naren kotti and Srikanth Palla. both are from Andhra Pradesh india but they live in USA.you will find lot of agents working for them. they don’t give any kind of contract or offer letter before visa apply.be aware dogs are looking for you. Interesting part is that they change their name every year or two.

      • I don’t think any rule has come that H4 visa holders can work… there is a possibility that H4 can work if they are on wait period of Green card. apart from that i don’t think any rule for h4 is coming up in the new bill.

        • Hi,

          People on H4 visa cannot work until the CIR passes. Even if it does, there are certain conditions that have to be met for people on H4 to be eligible , eg:mutual employment. The countries that permit employment of US dependents will qualify for mutual employment. The other options are to find a sponsor in the US or have an EAD/GC.

    I just wanted to know if anyone has been receiving any updates on their visa statuses… I have read from many blogs that USCIS will not be affected due to Givt shutdown as its revenue is mostly from the fee the petitioners pay. However, I also read that the USCIS was processing less than 100 cases a day during previous govt shutdown… please let me know if anyone has had their cases approved/ RFE… This processing has been streched beyond human reasoning…

        Could you please let me know how may weeks/days it would take to change status from RFE to RFE response review after the employer addressed the RFE.
        My case status changes to RFE on September 13 and employer received the RFE on September 17. The RFE was simple, they just asked for my Feb 2013 to April2013 pay stubs. Employer sent the requested documents on September 18.
        My status still showing RFE.

    Currently I am working on L1B visa for company A. Company B applied for H1B and COS.

    My family staying with me on L2 visa.

    Query?
    – Once my H1B and COS approved, does my family L2 visa automatically tranfer to H4?
    If not,
    – how soon I need to file for visa status transfer (L2 — > H4) for my family after my approval?
    – Do I face any issue while applying for GC, If there is delay during applying visa status transfer (L2 — > H4) for my family.

    Me : How are doing sir (greeted with smile)
    VO : I’m doing fine and you.
    VO: Can you please show me your passport.
    Me: given.
    VO: Are you going to work or business.
    Me: Work.
    VO: Have you ever been in US before.
    Me: Yes, On B1 Visa in 2010.
    VO: How long and purpose.
    Me: 3 months. To attend business meeting and knowledge transition.
    (Note: My B1 got cancelled during L1B visa interview at Hyderabad. L1B also got rejected in 2011).
    VO: Why your B1 visa got cancelled.
    Me: I don’t know the reason sir. But it was cancelled during L1B interview at Hyderabad.
    VO: Ok, Typing something… Who is your US employer and salary offered.
    Me. Answered company name and XXX dollars PA.
    VO: What would be your work location. (asked two times beginning and at the end)
    Me: Answered.
    VO: Your duties and work profile. (No client name asked. That is good part 🙂 )
    Me: Answered.
    VO: Show me your petition.
    Me: Produced I-797 and other supporting docs. But VO only look through I-797 and returned back.
    VO: Feeding details in computer and took 4-5 mins. (But I’m very confident right from start)
    VO. Golden words finally came. “Your visa is approved” and you will get PP in 3-5 Working days.
    Me. Have a great day sir.

    I got my passport in 2 Working day. I’m very happy and thanks you so much to GOD.
    It’s been wonderful journey in this forum start from my petition date 1st April 2013.
    This forum is really amazing and worked as a moral booster during interview preparation.

    Will the Sequester have any impact on the petitions haven’t been processed yet? If I were to expediate the process using Premium, will the decision come through within 15 days? Incase the USCIS takes more than 15 days, will I get the premium processing fee back?

  21. Hi,

    This year my h1 has been filed by two different companies. And I have L1 status with Company A and want to stick with Company A and not move to company B who also filed H1 this year. Both Visas got approved and I had to tell company B that i will not join them any more and want to work for company A. The company B is really mad at me now and started to threaten me that they will write a letter to USCIS on how they can approve two h1’s for me and told me to make both of my h1 visas cancelled.

    Can any one help is this really possible for company B to do this? And what steps should i take so that i wont be effected?

    • I really hope company B denounces you and that you lose your chances. What you did is illegal and punishable. It is very clear by USCIS law that you can’t file 2 application or more.
      Lots of people didn’t make it to the lottery for people like you. You took someone elses spot and hopefully USCIS will realize what you are trying to do.

    My petition was in IR status at first and then it was on hold as they were not able to process the check. Later it was all cleared and they started the processing again on May 24th. But its in ‘Acceptance ‘ stage from that time onwards.
    Any idea why its not changing? I am really confused about it. Any chances of it getting approved by October?

    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    What is this? I called the above number they say its a system problem. But the system problem is only for me? Kindly help if any one know what this is about?

            Today I came to know that my employer converted the case in Premium. My employer provided me a new receipt number and told me just to follow the new receipt number. When I searched the receipt number online, it is showing me the below message : “Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283.”. I am really confused now…!!!!
            Does the receipt number changes when we convert to premium?
            Why my new receipt not showing any status?

            I confirmed with my employer, the receipt number is not changed.
            Today i checked with my case status online. I see a different message. The message says “On September 17, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.”
            Any one have idea about this?? Please suggest.

    My H1B petition got approved and I have also filled and submitted the DS-160 form. But, I have two concerns right now…
    1.while filing petition, in my CV I had mentioned my graduation as Electronics and communication but I am actually graduated on Electrical and eletronics. However, i have mentioned the correct stream while filling my DS-160. Will there be any problem during the interview are there any chance of rejection based on this???Pls reply to me urgently am very worried about it.
    2.In CV and Ds-160 I have mentioned my degree as bechelor of engineering but it is actually bachelor of technology. Will there be any problem during the interview are there any chance of rejection based on this???Pls reply to me urgently am very worried about it.

    Intially while proccesing my H1b i had mentioned my company A details in the CV and this company A which is presently closed, now i am filling ds160 form so kindly suggest me whether i can add company A’s details or not.

    Including company A’s i will have 4.8 years of experience
    without company A’s i will have 3.4 years of experience.

    • Hi,

      I am not Saurabh, but i think i can answer your question.
      If you mentioned X years of experience, you can prove that with the experience letter which you received from company A (unless Company A was the one which filed your H1).
      If you dont have the experience letter, get in contact with that company and try to get something on their letter head.
      Consulate processing asks for experience letters.

    Currently i am in L1-B visa and working for X company. My H1B visa got approved with COB for Y company. So my visa status will automatically change it to H1-B from 1st october.
    When should i resign from X company? What if i resign september, 15th and X company will ask me to leave the X company imm’ly? Is it better to resign on 30th september for saferside. Please advise.

  38. Hi Saurabh/all,

    After 6 months of waiting, i gt an RFE on my case. mine is a status change from H4 to H1 and the USCIS has asked for the following docs:
    SUbmit evudence that the beneficiary’s Spouse (the principal) has been gainfully employed by the petitioner from which he/she last obtained his/her H1B non immigrant status. Submit copies of benefirciary’s spouse’s last three paystubs. in addition submit beneficiary’s spouse’s most recent W2 form and/or Form 1099, as additional evidence of maintenance of status.

    Do i have to provide anything other than my husband’s paytubs and W-2?
    Please respond immediately.

      Did you apply through any agent or your employer in India processed it ?
      I went through the agent and have been deceived by him.. they got caught to police on Tuesday.

      Atleast for next year I can try, but need to know how can I approach the right consultant/employer for H1b processing.

    1.) I got the following RFE. Could you please explain me in detail about it.

    Multiple Beneficiaries on LCA : The Labor Condition Application submitted indicates that more than one H-1B nonimmigrant has been certified for employment with the petitioner. Title 8 C.F.R. 214.2(h)(4)(i)(B)(3) state that in the situation where more than one individual has been certified for employment with an employer/petetioner it will be necessary to identify all file numbers for the beneficiaries who have previously “used” this LCA. Therefore, submit a detailed list of all Service file numbers for beneficiaries who have been approved using this Labor Condition Application.

    2.) Does the above RFE reflect in denial of my H-1B petetion.

      Did you apply through any agent or your employer in India processed it ?
      I went through the agent and have been deceived by him.. they got caught to police on Tuesday.

      Atleast for next year I can try, but need to know how can I approach the right consultant/employer for H1b processing.

    Before applying h1b visa consultancy should take signature on contract from applicant or consultancy can apply for h1b visa without taking any permission from applicant .is it law or not ?one consultancy has applied for my H1B visa without any contract sign with me. even they didn’t take sign on single document from me.

    Hello Everyone,

    I have a query. My H1b is applied and along with my H4 extension as me and my husband’s visa got expired in feb along with I-94. I had an emergency to visit my home country in a week. Can my husband go back and I can stay here in US for a month or two? He will come back after the stamping of H1B. Meanwhile my H1b will get approved in next 5 days. Please its Urgent.

    • Ok the answer to your question, you can stay here while your husband travels.

      But the main question i have is why did you apply for both h1b and h4, are you not aware of the latest approval rule. Can you please let us know how you applied for both h4 extension and h1b and how you know it will be approved in 5 days.

      • H4 extension was applied in 1st week of Feb whereas h1b was applied on 1st april. I can’t stay in US without the H4 extension receipt. Its more than 6 months neither got approved. My plan was to withdraw h4 after H1b get approved. But both are pending. I went for premium h1b thats why i know it will get approved in few days. Mu husband alos don’t have any visa or I=94 currentlt. Applied status. Now plz answer how can either of us visit India? as my dad is critical and its urgent.

        • OK let us say your husband’s h1b extension is with USCIS, in that case he can go to India and then wait for the extension to be approved and then go for stamping and then return to USA. in the mean time you can stay here.
          any one of you going at this time to India is not advisable, but given a point that you said it is emergency, it is better for your husband to travel, and it is not really advisable for you to travel, as your H4 to H1 might get invalidated if you step outside US before approval.

  50. I wanted to know if one must book an appointment for the finger print at VAC office if he/she has already been 10 printed for a visa previoulsy?
    I hold a F1 visa and was 10 printed for that 2.5 years back and am planning to attend my H1 stamping in December this year. I want to know if I can directly go for the interview or if I have to go through the same 2 step process?

    • If your finger print older then 2 years then you have to go for finger prints again. So, in your case, Yes you have to go for finger print. (I am not legal person, this is just my opinion only). Contact with attorney for more accurate answer.
