    Mine is regular processing by my one of the Indian MNC. They didnt reveal the receipt no. Is there any way to get / know the receipt number.

    If I get the receipt number, Can I transfer that H1B to some other employer? Is it possible in india?

    • Hi Sun,

      It is not possible to transfer H1B based on receipt number, you need the approved I797 and documents submitted along with it in hand. If they have not revealed the receipt number, how are you sure that you made it through the lottery. If it was through, you would have known by now.

      The current company you are working, may not give you the I797 (approved petition) untill you go for stamping (as far as i know).

  3. In my row everyday’s is in approved status. why only mine is in initial review? Can anyone guess? series is EAC13143*. Even many after my series are getting either RFE or approval. All are thru RP. What the matter?

  4. My current status of H1B visa is RFE.
    USCIS needs client invitation letter, which my employer is unable to get it.
    1) In how many days, RFE should be responded
    2) If failing to provide the document, can we re-apply next year, with the same petition, with another client. The same petition will be active for next year?

    • Hello,
      I also got a RFE. It should say on the letter or email you received when is the deadline to response to your RFE. USCIS gave me almost 2.5 months to reply to mine. Good luck!

      1. RFE notice will have the deadline mentioned
      2. A new LCA needs to be certified next year and new petition needs to be filed. It can be similar to this, but the same I-129 cannot be used as it has already been submitted. Next time, try to go w/ an employer who can arrange for such documents.

    My petition status has moved to “POST DECISION ACTIVITY” directly from the “Initial REVIEW” with approval status for I129 petition.

    Please let me know what does that mean?
    what steps to be followed after this till interview ?
    Do I need to call my employer ?

  6. I received RFE for my h1b petition and as per the employer they submitted the RFE documents to USCIS on end of July. However the status is still showing as Request for Evidence in uscis website.

    Once uscis receive the rfe documents will they change the status to Request for Evidence Response Review or they update only when they have decision on petition.
    How long will it take for an update/decision from uscis after RFE

    Any comments will be of great help.

      • It will change to “RFE Response Review” with in 1 Week or so..
        Does any one have idea.. Now a days -how long will it take(once RFE response got received by USCIS) to get Approval/2nd RFE/Denial Notice etc… ?
        For an Ex: EAC/RP-(AD/Regular CAP)

        • It can take up to 60 days. I have read on this website that some people got a decision after one week of RFE response, other after one months. I have been waiting 31 days and still don’t have a response.

    • Once USCIS receives your RFE response, the status will change to “Request for Evidence Response Review.” Then, when they make a decision, your status will change to “Decision.” I have been waiting one month and my status is still “Request for Evidence Response Review.” It could take up to 60 days for USCIS to make a decision.       I am in eac 1313751*** series and still in IR. the US is currently processing petitons from April 3rd. They have been doing this for the past two weeks. We should have something soon.

    I have received a RFE notice on June 18. My Attorney already responded on July 29. Now, my status is RFE Response Review. USCIS asks for these documents.

    1. Employment Agreement
    2. Employment Offer Letter (Employer – Employee Relationship)
    3. Valid Contracts, Statement of Work (SOW), Work Order, Service Agreement, Client Letter
    4. Copy of Position Description
    and some Company’s income tax and other stuffs.

    I will be directly working with my Employer. An Attorney house filed my petition on behalf of my company.

    My question is , What are these documents : Offer Letter, Valid Contracts, Statement of Work (SOW), Work Order, Service Agreement, Client Letter ???? Who is client here ?

    I just gave them the signed offer letter. If some of these documents are missing in my response, then would I be rejected ? I’m afraid of getting rejected because my company’s HR is not at all helpful.

    • I have seen so many people complaining about their HR in this forum. Its so annoying to see such a sick response from the HR Dept in most of the companies. I don’t really understand whats their problem to do their job properly and provide the right information to their employees. Heads!

      Most of the RFEs were related to Employment, SOW, Contracts, Job Resp, Client Letter, etc.

      These companies have been filing for H1B visas every year and they do not know what USCIS needs to process a petition? Whats the use of HIRING so called Attorneys to apply for a visa on behalf.

      1. Employment Agreement – The mutual agreement
      2. Employment Offer Letter (Employer – Employee Relationship) – The letter which was given to you from your sick employer which shows the offer.
      3. Valid Contracts, Statement of Work (SOW), Work Order, Service Agreement, Client Letter – If you are going to work for their Client, then client letter, service agreement and work order else they have to show them as an In-house project which may not have a Client letter.
      4. Copy of Position Description – It contains the whole job details you have been offered for.
      and some Company’s income tax and other stuffs. – Some companies never show interest to provide this tax related documents which will play a key role to prove your employer REAL.

      You have nothing to do with the RFE that you have got. Make sure they are going to produce everything that was mentioned in it. If they failed to supply any information then it leads to have another RFE or false information ends with Rejection.

      Bottom line is your employer has to prove his credibility and support all the reasons in bringing an H1b on their payroll.

      Keep poking them like anything until they do their job correctly in TIME.

  14. My company is sponsoring my H1b this year. I got RFE .
    USCIS asked for Employment Offer Letter , Employment Agreement, Valid Contract, Statement of Work (SOW), Service Agreement , Client Letter and Copy of Position Description.

    Can anybody please tell me, what are these ..SOW, Service Agreement, Client Letter. In my case, who is Client here ?
    I’ll be working directly for my company and an Attorney house filed my petition on behalf of my company.

  15. I have been waiting for the results since April 8. My Status is still in IR. By Oct 1st all the receipts should get a result correct or will there be any cases left without any status?

    • @H1bVisa : ya i have the same doubt , even mine was in IR from April 8th .. Can any one clear our doubt ? Will USCIS give the results before Oct 1st or will they take more time ?

        My lawyer told me that USCIS is not bound to arrive at a decision before Oct 1,2013.

        It could take longer as the pipeline of cases is huge.

        • Confusing :(. Typically H1b validity starts from Oct 1st correct. How can they stretch after Oct 1 for publishing the results? This is the first time i am hearing such a scenario that they can go beyond Oct 1st.

      • Not mandatory. there are cases which got decision by December and even early January last year. there is no deadline for USCIS.

    My employer response to RFE and USCIS received and started review on 29th July, Still I have not got approval. Do any one is in same boat or can anyone tell me normally how long it will take ?. Appreciate your answer.

    • Hello,
      I’m on the same boat. USCIS received my RFE response on July 19th and I’m still waiting for a decision. It could take up to 60 days (according to USCIS website), but I have read on this forum that some people got a decision after one week, others after one month. Good luck!

    Looks like there were a lot of activity in the series EAC1313951300 to EAC1313951400.

    As of aug 13, only 18 H1-B cases are in IR status. All others are either approved or RFE.

    I am still awaiting my approval

      • It can be pretty frustrating to wait for nearly 5 months.
        Not sure that USCIS will finish all cases before Sep 30.

  18. Hi Saurabh,
    I got a COS filed from L1b Company A to H1B Company B and H1 got approved with Activation date of Oct1 2013. This causes my L1b to get VOID on 1stOct.
    Is it possible to delaye my H1Activation by about threee months so as to continue on L1B for Company A , as I have medical leave plans and would not want to switch to Company B on 1st Oct.

      You should leave US prior to Oct 1, and then return on L-1 visa after Oct 1. This way, your status will remain L-1. Later, you can file separate COS from L-1 to H-1, or enter on stamped H-1 visa to start working on H-1.

    RP/AD/EAC1313452XXX – IT/ In CAPGAP now..
    Got RFE aroud 1st week of May reg Employe2Employer/Right2controle, Specialty occupation – Initially didn’t submit client letter because of delays in approvals/formalities..
    My employer answered the query @July-1st week, case status got updated in 2nd week of July and its under “Request for Evidence Response Review” for 4 Weeks.
    Planning to upgrade H1B to PP – will it be a wise thing to do or wait for till Sept 2nd week and upgrade to PP..
    If H1b got rejected then CAPGAP will be cancelled immediately and will have 60 days of buffer period?

      You can upgrade in early Sep to know the result by Sep end. If H-1 is rejected, you will still get the 60 day grace period, but confirm w/ your DSO.

    • I believe this means that your employer has withdrawn your H1 B Case and USCIS has acknowledged the same back. Check with your employer on the same.

  20. For WAC 13 143 51 000 to WAC 13 143 51 100 series . out of 100 receipts 72 were in initial review on 5 th AUgust 2013 . Todat as of 12 August there are 30 . out of 42 , 25 gone to RFE and rest Approved . Best of Luck to all

    • call the nearest USA consulate or embassy and find out . I got my H1 b stamped from Australia . I am a indian too … it does nt matter but do check with local USA counslate..

    I have got my H1B application approved on June 3rd 2013. I graduated this year and I will get my final degree on my convocation which will held in November.

    I do have provisional degree with me. Will that be problem at the time of visa stamping? Is is possible to get visa stamped after November?

      Yes, you can appear for stamping even after Nov. You can appear for stamping anytime during the petition validity period. Whenever you appear for stamping, make sure to have recently dated documents like offer letter etc.

      You need to make separate appointments. They can happen on same day, adjacent times; but they need to be separate appointments.

    I have a question related to L1 and H1…My current L1B visa is expired in May 2013, but I have valid I94 until 2015, and I have filed for H1 this year, it got picked in Lottery – but still in IR

    Questions:-

    1. is that legal to stay in US after L1B visa expired, but with valid I94?

    2. is there any problem in approving H1B, since my current L1b is expired? or chances of getting RFE?

    • Hi ,

      you can stay in US with the valid I 94, only issue is if you go to india, you cannot come back without getting a visa stamped.
      Chances of RFE on H1 cannot be predicted, but questions may be raised if job role and place of work for H1 are same as that of L1.

  25. I have got selected in H1B lottery but went into RFE.

    Now my employer is not replying RFE , only last 10 days are left.
    I asked him to reply to RFE but he is not sending any info. Can anyone guess what can be the reason.

  27. Just now My case moved to RFE status. How long does it take to know about kind of RFE ?

    Once we submit, how long does it take to process/approve ?

    • It can take up to a couple weeks to prepare a good respond (depending on what is then type of RFE USCIS is looking for) and from them another 2 weeks for USCIS to update your status. From then another couple weeks for them to change your status to decision again.

      It may take a bit more than a month to have it all set up (being optimistic)… final day to respond will be sept 30th 🙂

  28. I have applied for H1b visa through a consultancy and the petition got picked in lottery. Unfortunately, we received an RFE on petition and last Monday (07/29), the employer submitted the additional documents requested from USCIS.

    Did anyone receive RFE here.
    How long will it take to have a decision once we submit the RFE documents.

    Any comments on this will be very helpful.

    I am working in one country in asia which is not my home country. I applied for my h1 stamping here. After that they asked for more docs. Now i got better job in another country in europe and i want to move their but my h1 is under admin processing. I do not know how much time it may take. Once they complete admin processing. can i get stamping in Europe in U.S embassy or i must come to same country where i applied earlier ?

    • I am also waiting for 4 months now .. all the series in my set got decisions but mine is still in Initial review. Should i also call the USCIS and ask them. Mine is in eac1313854***

        My case id is EAC13137512** and was received on April 8th.
        There is no point in calling USCIS. I called them twice. First, the customer care rep told me that the USCIS is running behind and they are procesing the petitions from April 3rd. I asked her about the numerous petitions tht were approved from april 11th- May 8th(regular Processing) and she said she doesn’t know how that happened. She did transfer me to the USCIS official and after waiting for almost 90 min, I was told that they cannot disclose the info pertaining to my case as I was the benifiiary. Your employer has to be the one to call the USCIS, only then will they be willing to even discuss what is happening.
        We have waited for 4 months now, and we can definitely wait for some more time….
        I hope my employer doesn’t have a change of heart due to the delay by the USCIS.

          I tried to call to the number 1-800-375-5283 but it is asking to enter application number.
          It is not taking the EAC1314650*** and call is dropping.

            May I remind that as a beneficiary you should not call USCIS and let your employer/attorney do all the follow-ups.

            Your employer/attorney will know the reason. RFE means USCIS needs additional clarification or documents than those that were submitted initially. It may be trivial breeze or a full-fledged hurricane.

            My employer confirmed that they replied for RFE 3 weeks back but still USCIS shows it is in RFE. Is it expected & any idea how many days it takes to move to RFE review ?

Vermont center EAC1313751*** AD/RP. when I called USCIS and they said they are processing applications from April 3rd, which sounds ridiculous because we all know they are not processing the applications in the order it was received. Anyone in the same boat?

    My company’s lawyer said that USCIS has asked pretty unusual question this year. Many firms accross the country have seen really unexpected results. What do you guys think.

      I also got RFE regarding job description and some other stuff. My lawyer also thought the information USCIS was requesting was pretty unusual. We submitted RFE response on July 19th. I’m still waiting for an answer. When did you submit your RFE response? Any ideas how long it will take for USCIS to review the response?

    Can you advice me on the MTR to appeal my denied visa based on Employer-Employee relationship? What is chance for success? How long i might have to wait, if I can convince my client one more time to give me a proper client letter can i still have hope on a approval?       Processing can take few months. Chances of approval will depend upon what kind of documentation employer submits w/ MTR.

      See my response to your earlier post. Your employer seemed to have misunderstood what EER is.

  37. I got RFE in April PP for general quota, and received my result this week as denied based on emplyer-employee relationship.. I’m unable to accept this news, I’m working past 2 yrs for the same client, there was no client letter only vendor letter but all my friends had approvals except for me.. thinking for going for appeal, I don’t know how effective it’ll be, will try to get a letter this time around somehow.. wish me luck friends, i truly hope this is not you in my shoes

    • May I ask what did you mean by “emplyer-employee relationship”. Are talking about relation between:
      1. Your and your employerXYZ company
      Or
      2. Your Employer XYZ company and Client ABC.

      Please provide clarity on the reason for rejection.

      • Employer – employee relationship, my consultancy and the client.. they wanted to see a client letter, statiing this relatiosnhip, my cleint was not willing to write such statements because of that i’m in this mess.

        I had submitted offer letter (Employee-Employer relation ) and Client letter(Employer-Client relation) with SOW(statement of work mentioned). I got approval on last 26 th July.

          • In your case the client is your comapny itself, you just have to submit a letter form your comapny about hiring you full time, and then for statement of work (SOW) give a job description detailing your responsibilitites at the company. Uscis seems to think you a working for another client thru your company, you need to clearly talk to lawyer to show you are a direct employee

      EER doesn’t mean client letter. EER means how your employer exerts control over your tasks, activities and progress when you are working at client site. This involves someone from employer side sitting at the client site, who will first interact w/ client and then pass-on the tasks to you. Basically, USCIS wants to confirm that your work is controlled by employer and not client.

      If they submitted client letter in response to EER then basically they didn’t address the RFE. Also, all this comes under the discretion of the officer reviewing the case. So it is possible that one officer approves a petition while another officer denies similar petition.

      • I think by now your attorney/employer should be either getting the receipt number or the return package. check with them again.

  39. Please help.
    My petition(EAC*******) was received on 29th April and till day before yesterday it was in the “Initial Review” status.
    But since yesterday I can see the below status:
    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    Any idea what does this mean? Some blogs say it will result to RFE or approval.

    Please help in understanding this and also should I contact NCSC for more?

    • if its for a fresh 2014 H1 B visa then i think , he is fooling you ..almost everyone got receipt number and your employer should be able to talk to USICS and find out the correct status …
