  1. After long time waiting of the lottery receipt # and finally i received my H1B denied this is the 2nd time. Last year and this year the same reason I got the RFE and got denied my H1b. I lost my time, money and stress out through out the year. Now I have to go and find the school to enroll to maintain the status. I am just sharing coz I am down to the earth and unexpected outcome. Good luck to everyone whoever waiting their result.

      • Well its not. But related to Home Health Company. The RFE was related with job description and qualification. I do not know why my layer cud not fix the problem. He did the several cases similar to me but my case denied twice. I have no idea what is wrong on it. Now layer is asking for MTR. Wud you guys think doing MTR is good idea or just to waste of time and money. Any advise would be appreciated. Thanks

    • I too got the same msg in april and since then no update. status says in Initial Review. checked on site, it says uscis error.

    My employer has filled H1 on April and they say they have received the Receipt number by May14th only. But, are not willing to share receipt no. Instead They have shared the LCA number, LCA start date and end date.
    Mine in Non-premium H1 and as per my employer it is still in Inital review.

    My confusions here, Need your kind suggestions …please.
    1. Can we track the Receipt number using the LCA number ? if yes, can you please guide the process how to?
    2. Anyways I could be travelling to US only after Oct 1st. But, As per the LCA number which my employer shared the start date is August 10th 2013. So Is it means that i would be getting the status of my H1 (approved/denied) earlier to LCA start date i.e on or before August 10th or even later to it.??
    3. As they filed my H1 on april 2nd and have got the receipt number around May 14th after lottery process. I knew it would be 4 to 6 months for an H1 non-premium.
    So, Will USCIS would be updating my H1 status before October 1st by any means, since from Oct1st we can normally work in US Or would they even take more time than October to update the status eventhough we filled H1 by april itself

    only in rare case they prolong the dates but normally all who applied by april will get the updates before october itself?

  8. Hi

    I went for interview and got 221 (g) yellow slip. No documents required. The VO told me it will take anytime between 2 weeks to a month. He further mentioned that the petition was filed properly and no issues should arise.

    So why was I issued a 221 (g)???

  9. Hi All/Saurabh,

    Needed your opinion about it. My employer has applied H1 for me and I am selected in Lottery however it is still in Initial Review status.

    Now my wife’s employer is filing L1 for her, is it a good idea to get my L2 done along with her or will it have any problem with my H1 petition? Will we be able to apply for L2 later if there is any problem with my H1?

    What is the meaning of the following status
    “The 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.”

          • I am not the correct person, but when my company was applying for premium they made me aware that my case will be highlighted which may cause additional scrutiny on documents, resulting in denying or RFE but i took the chance.

        I need your help and guidance.

        I am currently on L1-B in US which is expiring on Aug 3, 2013, I have applied for the extension and the current status is RFE which I need to submit by Aug 14. 2103.
        I have also applied for H1-B this year and it got approved today (I saw the status on USCIS website).

        Here are my questions.
        1. I have heard that there is a rule called “last action rule”, so if L1-B extension denies after filling extension, will it cancel my H1-B also? please let me know your opinions.
        2. Another question on similar lines.
        a. If my L1-B extension gets approved, will my H1-B gets cancel due to “last action rule”
        3. If all these cases are correct what is relevant for me.
        a. Cancel my L1-B extension request and go back to India and get visa stamping or something else.
        Please let me know your opinions

          1. No, it won’t. What ‘LAR’ means is if L-1 extension is approved after Oct 1 (H-1 start date), then your status will become L-1 once that petition is approved. LAR comes into play when 2 petitions are approved. If one gets denied, then LAR is not applicable.
          2. No. Refer (1)
          3. N/A as both (1) and (2) don’t cancel H-1 petition

          Was your H-1 approved w/ COS or w/ consular processing? If L-1 is denied or RFE is not replied, then you should leave US and return after getting H-1 visa stamped.

            My L1 and H1 both are applied by my same company. and Yes I have not replied the extension as of now.
            As you suggested I may go-back come back with visa stamping.

          • I suggest reply for RFE.
            Since your L1 extension application date, you can stay in US for 240 days(~8 months) if you dont receive denial. Mean while your H1 may get approved while you are onsite.

        • I am in the same boat as yours, dates being different & additionally my H1 still shows Initial review 🙁
          The “last action rule” is true and hence it is advisable that you go back to India, withdraw your L1 before 14 Aug and get your H1B stamped to come back.
          because if L1 is rejected you stand to loose H1 as well..

            I have confirmed from my company’s immigration department and they have confirmed that, my H1 will not be cancelled in any case. However if I come back to India my visa will not be treated as L2H but as fresh H1.

            I am on L1.. Applied for extension.. RFE recieved, due by Sep 24th.
            By most probabilities we will not respond to RFE. My H1 is not yet approved, just selected in lottery..
            Can you let me know if my H1 is approved before 24th Sep, do I need to go to India to get my H1 stamped ? Or can I begin working on my H1 from Oct 1 by staying here itself ? Remember my only caveat is we will not respond to L1 RFE..

          • Utkarsh, I am not correct person to respond on replying back on RFE or not.

            But if you decide not to respond to RFE than after sept 24 your stay will be illegal and secondly if H1 is approved it will be applicable from Oct 1 and not early then that.

            If COS is denied, then you have to leave US for sure, get H-1 visa stamped and then return to US. So wait to see what happens to your H-1.

            If no result is received by Sep 24th, then L-1 is considered denied (as you didn’t reply to RFE) and should leave US as you are no longer in L-1 status.

  15. Hi, My company has applied for H1B for me. They did not receive any update on my case till now. What could be the problem? How long it may take to get the status updated? When I ask, they are saying due to lottery system, it is getting delayed.

      Your employer can continue to follow-up w/ USCIS. However, chances of getting through the lottery are pretty slim at this moment.

    One query, I have applied for H1b from H4 this year through a Desi consultancy. If I visit India after H1b approval in december, will i face stamping rejection coz mine is not a known company or an MNC? What are my chances? Should I take risk? Visiting India is very important for me to attend my sister’s wedding..

      If you have applied through a small consulting company, then there is a chance of running into issues. Its best to be prepared for all scenarios. Will you be working in EVC model or EVVC or EC models?

          EC = Employer -> Client i.e. your H-1 employer has a direct contract w/ the client
          EVC = Employer -> Vendor -> Client i.e. your H-1 employer has a contract w/ a preferred vendor who in turn has a contract w/ the client
          EVVC = Employer -> Vendor 1 -> Vendor 2 -> Client

          So you will have to check your case what model it falls in. EVVC has the most chance of running into issues followed by EVC and then EC.

    Out of curiosity, I need to ask this, if my H1B petition happen to be selected in the lottery, does this mean that my petition is approved?

    Also, earliest by when the H1B VISA stamping can be done, or is there any specific date when the stamping is starting?

    I am totally new to this H1B process so pls excuse me if you find the above question stupid. Thanks for your help!!

      Selection in lottery doesn’t guarantee approval. Once the petition is approved, you can appear for stamping at most 90 days prior to H-1 start date.

      • It Just says , USCIS need more information from your client mostly….Once your client respond to RFE , your status will be changed to RFE response Review…Dont worry this time many of them got RFE, even I got….once they hav all the required document that they are asking for you should be fine…USCIS send the RFE letter to your client, it will take couple of weeks, check with your employer if thee have received the letter

          • Hi Hemant,

            Your employer will be notified what are the documents they required. Once USCIS receive the RFE (ur employer will be notified that they received it, as usually it is send it through FedEx) , even the website status will be ‘RFE response review’ usually (case status on USCIS website is not accurate all the time though, if u dont see status change ,just check with ur employer if they received a confirmation letter that USCIS received the documents). Mine took 3 weeks after they received the RFE response.

    I did not get a chance to apply for H1 B since I was out of the country during the first 1 week in April when they started accepting applications.
    I’m back in the US now.
    I’m on 17 month OPT ext which ends this month, July 2013 and my F1 ends next month, Aug 2013.

    What are my options ?

    Going back to school and taking classes is the last thing I want to do. (Though not sure if schools are still accepting applications for this Fall)
    If I have to go back to school, how long do I have to be taking classes before I can apply / get an H1 B ?

    I hear a lot about the CIR (Immigration reform) these days…
    Do I have any chance of benefiting from that if it becomes a law ? Considering the above expiry dates ? My employer is ready to sponsor for my H1b.
    If so, please explain, how, IN DETAIL….

      First of all, why did you wait so long? july is your last month of OPT n u r F-1 is also expiring… dude u should be very proactive in these matters…. u hv missed a good chance as your employer was ready to apply for you… I don’t see n e other way than taking classes for a year now… and the reform, if passed will be a law only in next year… don’t waste more time now in asking questions on the forums… go and figure out which schools can still accept u and offer you CPT so u won’t lose your job…

        I did not wait so long …I was just not in the US at that time…..I have Rheumatoid Arthritis a serious painful health issue…badly needed a break and some domestic help for a few months. I stayed in India for Over 4 months ….lost my job and so did not see any reason to come back and also lost hope that I will be allowed back into the county after such a long absence….. but decided to give a shot and fortunately / unfortunately I was allowed back…. only to pay the rent I guess :)….Did not make any progress after that and now I’m in this situation still thinking whether to stay or go back to India.

        The reason I came back was to work not to go to school
        So I’m still trying to figure out something instead of going to school.
        I hate the idea of going to school just to maintain status ….just don’t have the strength / patience for that anymore…

        I thot the reform if becomes law this Aug 2013 will increase the H1 quota for the fiscal year 2014 and since 2014 fiscal year starts from Oct 2013 …I would still be having a slim chance of applying for H1B during my 60 day grace period without having to go to school.

        Am I wrong here ? Please Advice

        • From what we read about the new law, i don’t think it will be applied for this year. so i would suggest looking for other options.

      Chances of this becoming a law anytime soon is low as the Republican controlled House has some serious issues w/ the Senate passed bill. So there are not many options right now. You can enroll in another school or move to another visa status (if allowed like H-4 etc).

      • I’m unmarried and nobody in the US can claim me as their dependent.

        Schools: Do you know any schools with really low tuition with/without CPT, still accepting applications ?

          What state are you in? if in tri-state area there are many schools. But honestly RA is serious disease. You might want to count the pros n cons of staying back here. In cold it might get worst. Good luck buddy.

          • Yes it does….Most people dont even know what RA is. When I was diagnosed, I did not even know that this was wat I have gotten into….But anyways …I live in NY now ….planning to leave the US …but still not able make the call thinking about all the hard work I put in, in the last 5 yrs..

            Is there any chance of getting H1 visa next yr from INDIA, if my consulting company here decides to file for me ? i’m guessing I wont be having a client letter

            Schools: I came across ITU which is still accepting applications but tuition in 4500….. too much

            Do u know any schools with lower tuition?

    during the h1b visa interview, does visa office lookout for non-laminated version of original document or are they okay with the laminated original document also.

    I recently got my marriage certificate done and registrar office told me not to laminate the certificate as visa office does not accept that. this statement of registrar gave me a doubt as all my educational document are laminated. 🙁

    Please help, if any body walk there for visa interview and presented them laminated original documents.

    • Hi til,

      Laminating documents is a bad idea, but it will not impact your visa interview. My wife’s certificates are all laminated and she went for B1 and H4 interviews and didnot have any issue. What the registrar told you is right, better not to laminate documents, you can get transparent folders for certificates, use them.
      My father works for a govt agency in India and he had told me that laminating certificates is a bad idea. As he was involved in recruitment process, he said they used to doubt certificates which were laminated.

    My status moved to RFE on Jun 10, when i asked my employer yest-day about the details on RFE, he said attorney would have received and they would be working on the same. he said he does not have any info on RFE, Is this how it works ? employer not receiving the RFE mail is little hard to digest for me, So any comments…

    I am working on L2 EAD, I applied for H1B this year but could not make through lottery.

    Ths month I changed job.I paid my earlier employer 4100$, out of that he is returning only 1550$ saying all else went as attorney and Employer fee.Pls suggest is it fine, is there full charge on applications which are returned?

      For petitions that didn’t make through the lottery, USCIS returns the entire fee. The attorney fees is non-refundable as the attorney charges it.

      I don’t know how much the attorney fees is, but there should be nothing like employer fees. That’s an earning for the employer for doing nothing.

        • I heard this from one of my colleague. His friend had applied for H1 through a consultancy and they had charged $4500. Sadly it did not get through the lottery and the employer returned $3650. The attorney fess was $850. Again this fee is dependent on the attorney and varies based on different law firms. So that can vary….still $2600 is way high. Also as saurabh said there is no employer fee. They are not supposed to collect any fees from employee.

    MY H1 petition filed by a new employer is still in Initial Review. In my current organization, I am required to go for a project in UAE, which would be for another 4+ months.

    I don’t want to risk my H1 by applying for visa interview in UAE, can you please confirm, if approval on my petition is given by Jul end or August, by what time should I appear for Interview, as I would only be back to India in Nov.

    Is it justified that even after receiving approval, If I delay for interview for upto 3 months.

    Secondly will my recent trip to UAE, would require more clarification to VO?

      you can got for h1 b stamping anytime in 3 months before the start date of H1 B that means july aug sep .Also u can after that stating you project is delayed and you can get stamping in NOV or dec also.

      you can get stamping in UAE also . I doubt a trip to UAE can cause any harm . You can explain to Visa officer about your work if required .

      as a matter of fact you have equal or better chances for getting H1 B visa stamped outside India . The Visa officers deputed in India and china are specially trained executives …… I have read this somewhere …

    On May XX, 2013, the post office returned your document I129, PETITION FOR A NONIMMIGRANT WORKER as undeliverable. If you do not contact us at 1-800-375-5283 within 180 days from May 13, 2013, this document will be destroyed and you will need to file a new application with fee.

    • It means that your petition had been approved and the USCIS tried to send it to the address you had mentioned on file but USPS (or the other mail service) was not able to deliver it. There must have been a problem with the address on file or some issue as such. Contact them immediately and check the address/contact information to whom the I129 petition is being mailed to.

        I thought since I129 is the petition submitted by employer and since USCIS is claiming that they have returned it , then the submitted I129 has some issues .But my employer is claiming that there is no issues and they are waiting for further reply from USCIS

        But I saw your reply to til that the above mentioned statement means petition has been approved and not delivered due to address issue.Is this your personal experience or the experience of some body whom you know ?

        • Prazz has the I129 and I797 confused. If the petition has been accepted you will receive an I797. The I129 is the petition that has been filed by the employer.

          As for the status that you are seeing on the website, I really don’t know. Looks like USPS tried to deliver a package (I guess it is the petition that you had filed) back but is not able to deliver it.

          You can always call USCIS and ask them what it means.

      • Since the status is undeliverable even now I called USCIS and did inquire the status.
        Luckily the Lady responded properly and she accepted that the I129 undeliverable status
        due to computer glitch and visa processing is going on.But she told me currently she can’t share the exact status because only the case Immigration officer will have the details.

  27. The US Senate voted 68-32 to pass a historic immigration reform bill on Thursday. The bill now moves to the House of Representatives.
    The bill aims to put 11 million undocumented people on a path to citizenship, and dramastically incease the number of H-1B visas and green cards for skilled foreign workers.
    Please click here to read major provisions of the Senate immigration bill. Following are major provisions related to skilled foreign workers: The cap on the H-1B visa program for high-skilled workers would be immediately raised from 65,000 a year to 110,000 a year, with 25,000 more set aside for people with advanced degrees in science, technology, engineering or math from a U.S. school. The cap could go as high as 180,000 a year depending on demand.
    Immigrants with certain extraordinary abilities, such as professors, researchers, multinational executives and athletes, would be exempted from existing green-card limits. So would graduates of U.S. universities with job offers and degrees in science, technology, engineering or math.
    A startup visa would be made available to foreign entrepreneurs seeking to come to the U.S. to start a company.
    A new merit visa, for a maximum of 250,000 people a year, would award points to prospective immigrants based on their education, employment, length of residence in the U.S. and other considerations. Those with the most points would earn the visas.
    The bill would eliminate the government’s Diversity Visa Lottery Program, which randomly awards 55,000 visas to immigrants from countries with historically low rates of immigration to the United States, so that more visas can be awarded for employment and merit ties.
    A new W visa would allow up to 200,000 low-skilled workers a year into the country for jobs in construction, long-term care, hospitality and other industries.
    A new agriculture worker visa program would be established to replace the existing program. Agriculture workers already here illegally, who’ve worked in the industry at least two years, could qualify in another five years for green cards if they stay in the industry.

    I have worked in USA for 3 years on L1 B . Then i moved to Australia . I have not done masters from USA . This is my first H1 B stamping . Can I get it done here , or have to go to India . I called up USA couslate and they are saying you can apply for stamping anywhere in world , but to give VISA , totally depends on Visa officer ? Any suggestions

      Yes, you can appear in AU. But like the officer said, there is no guarantee of visa approval irrespective of where you appear.

      Even i got the status like this initially. It got changed after a week. So no need to panic…You will go through the lottery.

      • I was told that status one month back…what would be the status post that for applications in Tcs ? My manager explained on the status that it has been selected in lottery.
        So what do you mean my “it will go through lottery”
        I’ m little bit confused here..please clarify

            I have 2 queries for you. Please respond urgently.
            1) What is the current status of your application ? What was the previous status ?
            2) Can’t we get a reference number from our Management to track our application status online in USICS portal ?

          Dont worry. Pending means your application is selected in the lottery only.

          Is anyone got the EAC no?
          Still waiting for that only. I think TCS has not yet shared the EAC no….

          • One of my friend have got the EAC no and he was asked to fill the DS 160 for further processing.
