  3. They say , the average processing time is 2 months . My case RQ/RP is still in Initial Review from 8th April 2013 ..Any Idea when can we get a update from USICS . All other near by receipts gone to RFE . Please excuse , if its too silly to ask , its my first H1 B .

    • Nope, sadly there is no ay to find out what is happening with the petition form USCIS. Even if you call them they will just tell you that it is being processed and that you will get to know the status as soon as they finish the required processing.

      Be happy your application hasn’t been marked for RFE.

  4. Currently i am on H4 visa and my H1b is in initial review.Both H4 visa and I- 94 is expired. My H4 extension is filed and its RFE is submitted 1 month back. What will happen if my H4 extension is done after H1b get approved? From 1st oct i will be on H4 or H1b?

    • Lata,
      This is where “Last Action Rule” comes into play. The petition that goes into effect later determines your eventual status. Also, you need to look at the date on which that petition goes into effect and not the actual approval date.

      For example, H-1 approved in July followed by H-4 approval in Aug means you will remain on H-4 until Oct 1 and then move to H-1 (as H-1 I-94 start date is Oct 1)
      Another example, H-1 approved in July followed by H-4 approval in Oct means you will move to H-1 from Oct 1 and again to H-4 from its approval date (H-4 start date is later than Oct 1).

  5. Hi,

    up until last week I was able to view the status as “initial review”. But since then, it says-
    “”at this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.””

    Anybody else in the same situation? what does this mean?

      There are lot of other people who have reported this. After few days it changes to something else (like RFE).

  6. Right now I’m in US on H4 (valid till Oct 2013). I applied for H1 from India and my case was selected in lottery and is in processing.

    Planning to apply for h4 extension as it is getting expired by sep 2013.

    Please answer my below questions.

    1) Will it be a problem if my h4 gets extended after h1 is approved.

    2) Can COS(from h4 to h1) be applied when h4 extension is in process.

    3) If answer to 2) is yes what if h4 gets extended after COS is approved??Will i fall on h4 again??

    • Chinnu,
      1. There is something called Last Action Rule. Depending upon whether you want to be on H-1 or H-4 from Oct 1, your H-4 extension needs to be timed. Your attorney should be able to guide you through various scenarios.

      2. Yes it can be. But if your H-4 I-94 has expired and new H-1 is w/o I-94, then it cannot be applied.

      3. Yes, refer (1). If H-4 and H-1 get approved prior to Oct 1, then you will be on H-1 from Oct 1. If H-4 gets extended after Oct 1 and H-1 gets approved prior to Oct 1, then you will be on H-4 from H-4 approval date (and will be on H-1 from Oct 1 to H-4 approval date). One option is to withdraw H-4 extension once your H-1 gets approved w/ COS and its past Oct 1.

    • In 2011 every single person from my Indian MNC(around 100 from my project only) got a RFE coz of missing client letter, as H1b was filed for the first time. Each RFE got cleared after submitting the doc, so if your papers are correct and your company contract is proper you will get through.

  8. Hi Saurabh/Anyone

    My wife is on L2 visa right now and this year I hv filed for H1B myself and H-4 for her and her L2 visa is valid till DEC 2013. Is it safe for her to travel to India now while L-2 to H-4 is in process and come back before 1st Oct. or there is a risk?

    • She can safely go to India and come back before approval of H4 visa. If H4 is meanwhile approved she have to go for stamping.But whenever a visa status change is applied from US, a person should not take risk of going out of usa.

      If she leaves US, then her COS from L-2 to H-4 will be abandoned. She will have two options:
      – return after getting H-4 visa stamped. Can happen only after your H-1 approval and she can return only after you have move to H-1 status i.e. Oct 1
      – return on L-2 and file COS from L-2 to H-4. This can happen only prior to Oct 1 when you are on L-1

      Like Alice mentioned, its best to avoid travel if possible.

    • Mine is still Awating for lottery result, I called to FDFU for the same and the replied me that they are still receiving updates from USCIS for result and they received last updates result on 7th June.

    How did you got stamping in June itself. As per process, stamping can be done 90 Days before the H1 eligibility start.

    H1 Eligibility for working in US starts form 1st Oct, so Appointment for Stamping should ideally start from 1st of July.

    Secondly Visa Fees can be directly submitted to Axis Bank against the DS160,

    Are you under cap exempt (visa extension) or Regular first time processing.

    Just Curious.

  11. On Monday, I appeared for stamping. Here is the H1B 2014 Immigration Process –

    It is time that most of the applicants who have received H1B visa approval will now need to prepare for their H1B visa stamping. The most sought after question in every candidates mind is “What are the documents required at the time of H1B Visa Stamping. Below is a list of documents typically required at the time of attending your visit to US consulate/ Embassy for H-1B visa stamping.

    Mandatory Documents:
    First Time Applicants:
    1. The first and the most important is H1 approval petition original documents ( I797 and from I129) from your H1 sponsoring employer.
    2. Valid original passport. Along with all old passports
    3. One photograph as per specification.
    4. US Visa Application Form DS-160 confirmation page stamped at the Visa Application Center (VAC)
    5. US Visa Application Fee payment receipt.
    6. Visa Interview appointment letter.
    7. Original Notice of Action-I797.
    8. L1 applicants must carry the original I-129 and a copy of the Notice of Action I-797. And a letter from employer that describes your proposed duties
    9. For applicants applying with a blanket petition, a demand draft for Rs 29000/- favoring “US Embassy, New Delhi” or “U.S. Consulate General, Mumbai (or Chennai or Kolkata, or Hyderabad)” as applicable towards FPD fee. (Do not get a DDs drawn on co-operative banks as these are not accepted.)
    10. Copy of the first and last page of your current valid passport. If you have any observations on your passport please submit a copy of the observation page also.
    11. Letters verifying your employment history and specific work skills.
    12. Original degree certificates along with mark sheets.
    13. Relevant diplomas or certificates, justifying your proficiency in the job applied for and also computer proficiency certificates.
    14. Pay slips from current or most recent place of employment
    15. Names and current phone numbers of the personnel managers at your present and previous positions; and
    16. Resume or CV.
    17. If you are currently working on an H-1B visa, you should carry your pay slips for the current calendar year and your Federal tax returns (IRS Form 1040 and W-2) for all the years in which you have been employed in the United States.
    18. In case of Blanket L1 visa applicants, three copies of the Form I-129s and one copy of the Form I-797 need to be submitted.
    19. Dependents need to submit a copy of the principal applicant’s Petition (Form I – 797 and Form I -129 as applicable) and visa copy.
    Spouse / Dependent Children
    20. Original Marriage Certificate (for spouse) along with your entire wedding photo album.
    21. Original Birth certificate (for each child).
    22. Copy of interview appointment letter, DS-160 Confirmation Barcode printout and US visa application fee receipt.
    23. US visa application fee receipt.

    Visa renewal applicants will have to submit:
    24. A copy of the previous expired US visa stamped on their passport.
    25. First time applicants may consider carrying the following documents:
    26. The original Notice of Action Form I-797 of the Principal Applicant.
    27. Form I-129 (if Form I-797 is a blanket permit, copy of Form I-797 and I-129) of the Principal Applicant
    28. Photocopy of the Principal Applicant’s valid visa (if applying separately).

    Don’t worry and just be confident at the time of appearing for your H1b visa stamping…!

    On June 12, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.

    My H1b packet cameback and my employer told me that they will file my green card untill they file me H1b agian next year. My employer told me that this way I wouln`t lose my time in green card processing which usually they file after h1b. I am currently on CPT and have to keep continue it untill Oct. 2014. Please replay and let me know is this right way to do this. Is it gonna effect on my status?

        I also applied through Maark Overseas and got the same reply that it got approved on May 11th and now he would ask for $650. I also searched that the fee is $190

        I was excited that I got through this lottery and it got approved also, but now I feel sad to hear that he is a fraud.

I would also like to know whether he applied my H1 or not. I would like to highlight that even if he shares the receipt number with us, what is the guarantee that it belongs to us or not as it doesn’t have the name on it.         What company are you from? Do you know if lawyers can contact the USCIS regarding the case? Also, does your lawyer or you know about USCIS giving out in batches. My lawyer has given up hope, but I still feel there is some ray of light.

          My lawyer contacted the USCIS and they told they can’t entertain unless we have receipt number to contact
          So for now the best thing to do is wait,wait and wait…..

        Mine went into RFE and now its in initial review. Spoke to couple of folks and got to know that USCIS generally takes a month to a month and half to review the RFE and reply back with the result.

        Am also waiting patiently and my family is being restless back home. Cant help and the only option is to wait and wait and be patient enough.

          • Mine was Vermont Service Center and I have applied via the Premium Process / Regular Quota. My file was received on April 17th and by 18th got to know that it went to RFE and by 20th it went back to Initial Review and ever since its in Initial Review only. Today spoke to some of my friends and that’s what they said that it would take generally 1 to 1 1/2 months to get the result from RFE.

      Once approved, get the documents from your employer. Then submit visa fees, complete DS-160 form, schedule interview dates, appear for biometrics and finally appear for H-1 and H-4 visa stampings.

        Was going thru your answer. I guess Shiva has applied for H1 for the first time and he was also talking abt taking his family along with him. Even I’ve applied for H1 for the first time and got thru lottery and waiting for the next stage to complete.           Yes, the entire family can appear for stamping together. You need to submit visa fees for each applicant, then complete DS-160 form for each applicant and finally schedule interview date. You can schedule one date for yourself and at the end it asks if you want to include family members. There you can include your spouse.

          Kids under certain age are exempted from personally appearing in the consulate.

    Can anyone pls help me how long it takes to get receipt number???

    • goodluck,
      Ask your employer how they know that you have made through the lottery. If they are relying on the checks being cashed, then receipt number should be behind the check and employer can get the scanned copy from their bank.

      My petition(EAC*******) was received on 29th April and till day before yesterday it was in the “Initial Review” status.

      But since yesterday I can see the below status:

      “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

      Any idea what does this mean? Some blogs say it will result to RFE or approval.

      Please help in understanding this and also should I contact NCSC for more?

  22. I am just sharing this information. Mine is RQ/ changed into PP 0n 05/22/2013. Status showed clock has been stopped on 05/30/2013. So finally on 14th day today 06/04/2013 layer received the RFE and its all about job responsibilities related to qualification. I am wondering how complicated this RFE is. I am so much in tensed now. How much time I have to wait more. Tired of waiting one after another. Anyways Good Luck to Everyone.

  23. Sorry for spamming but i have still not got the answer so re posting

    My employer notified me that they received my package back and my application is not selected in lottery. I wanted to make sure he is not lying, so i asked them for the returned package. They sent me one scanned page which has a general text which says that USCIS reieved your application but you were not selected in lottery. But nothing in that letter confirms that this H1b was filed for me only.

    This page has only a FileNo: which is blank and a FormNo: which has I-129 written by hand. Is the I-129 form returned by USCIS just one page letter with no detailas about the applicant? There must be some way to associate it to an applicant?

    Please advice, what document should i ask my employer to share in order to confirm that my H1b was actually filed?

          Which location are you from. Is this your fresh H1B filing. Did you get your H1B filed via Premium or regular. Was it via a consultancy or an organization.

          I am from Texas and filed via Premium Processing / Regular Quota. I got my EAC number starting from EAC131****** and mine got a RFE by second week of APril and post that the status is back to Initial Review and so has been ever since. Any idea how long I should wait. This is pretty killing me and think we all are more or less on the same boat.

    • Hi,

      They are reviewing your case. I had the same a week ago. My status was the same and then it changed to RFE (request for evidence). So they will either approve/denie or sent you a RFE notification.

      Don’t pani, they are working on it.

        • My consultancy person stated that the RFE was for additional client documentation and that they have already answered and submitted it. It was nothing for me infact.

          It just took a day for my case to change from Initial review to RFE and the same to change from RFE to Intial review. Not sure how much more time I need to wait in here.

          My status was under “Uscis can’t provide…” for like a good week or a bit more. Other people had the same issue as well a few weeks ago. Seems like the operator may change/hold/suspend the status when they are reviewing your case (Some people get faster responses of course)

          USCIS issued the notification last May the 24th. So I am guessing the company’s lawyer should be working on it by the end of this week to collect what ever USCIS needs from my case.

          Also USCIS gives the applicant 2 months to respond the RFE. I want to say a lot of lawyers are kind of big procrastinators so try to push your case untill you make sure they resend the info.

    My employer said that he has filed my H1B however didn’t show me the copy of the EAC number however just gave me the EAC number by word of mouth.

    Initially during the first week of April when I checked it was in “INITIAL REVIEW” and later the status got changed to “REQUEST FOR RFE” and then later got moved to “INITIAL REVIEW” on April 17th. Ever since this has been the status and my EAC number starts with EAC131*******

    When enquired with the Consultancy, he has stated that the RFE was answered around May.
    Any clue when I would get to know on this and also similar is the case with one of my friend here.

    Both of ours was processed via the Premium Processing / General Quota.

  27. Hello Friends, Anyone who applied through MAARK Overseas and got an email that your H1B is approved and later another email about Employer information and asked to pay Embassy Fee (interview). As per Praveen Raj, using BEP login will have $650 as fee and if done through self it is $200. I checked online and with USA VISA helpline in India, and they said that the fee for both is same and its $190. Am really puzzled. If you have filed through MAARK Overseas please speak up. His statements are way off the facts, so makes me doubt his genuiness. Request to all who have filed through him to please reply to this post, or at the least contact me at voidofdeath at gmail dot com. We have formed a group, and we all are puzzled. Please join the group and throw more light or if not interested in joining then at least speak up here.

      • BEP abbreviates for Business Executive Program. This is an initiative of USA Embassy to facilitate hassle free VISA process for Companies with physical location in India (or outside USA where there is presence of USA Embassy and this program is in effect) and needs a significant number of VISAS annually; basically giants such as Infosys, TCS, LNT etc.

        I repeat this makes just the VISA Processing easier, not getting VISA! VISA’s are granted on a cases by case basis per person and BEP has no significant impact on the actual “Approval/Deny” decision.

            Some inputs: L1 can be applied only for intracompany transfer case for an employee who has been on the payrolls of the employer for a minimum 1 year. Meaning…..
            1) The Employer A has to have physical office in USA and also has to have physical location in India (or any foreign non-USA country not blacklisted by USA).
            2) L1 can only be applied by Employer A for its employee X, only if the employee X has been on the direct payroll of Employer A for atleast 1 year outside USA. So if you have worked for Employer A for more than a year in India, you are eligible for L1 to be filed by your Employer A.

            In case of MAARK Overseas, they do not have any office in USA registered in their name, also, since you are applying through MAARK Overseas, it means the Employer will be new for whom you would be working for first time. So neither (1) nor (2) matches. I recommend caution before you pay him any money.

    • I have also apply thru Maark. I am wondering about his genuineness. He has not taken any security amount from us and only taken 8200 ruppee. If he has really apply for H1B petition and If I refuse to go for H1B then what will happen to his money. Either he is too clever or a big fool. Inititally before giving him 8200 ruppe I ask the same question and at that time he told me that he will sign a bond paper and get a blank cheque. But after taking 8200 ruppe he never ask me for the blank cheque and now he is saying my petition is approved and demanding 650 $

    My employer notified me that my current status of H1B is “Awaiting Lottery Status”,
    I heard USCIS already declared lottery result on 8th April, is it possible USCIS did not share all the lottery result with employer or USCIS sharing lottery result in batches?
    Also earlier my employer told me my status as “Pending with USCIS” and now they are saying its “Awaiting Lottery Status”, what does it mean ?

    Please suggest me.

    • I hope u are from TCS. If the status is Pending with USCIS then the application is selected in lottery and further processing is underway. If the status is Awaiting Lottery Status then they are yet to get an update from UCSIS.

    Please suggest

    I am working for company A from India and got a job offer from a small US based IT consulting company B and they filed my H1B this year, I received the receipt number ONLY from them. now my current company A is willing to send me to US, I don’t want to go with company B if I get a chance from company A itself.

    Questions:
    1. Company A never filed H1B for me, can I transfer my H1B filed by Company B to Company A (Status of H1B now is “Initial Review”) ?
    2. I read somewhere that I need I-797 or some other doc for H1B transfer, I don’t have any doc except the H1B filed EACxxxxx number with me from Company B, Can I transfer H1B with just EAC number ?
    3. should my current company A pay any amount to Company B for H1B document exchange/H1B transfer ?

    • You cannot travel having Receipt number alone with you. You cannot transfer your H1B unless its approved. There is no need of paying money to exchange the documents. Best suggestion is don’t do anything stupid as of now. Just wait till your current H1B petition get processed. Its better to be more careful as you have applied from India. Its really very over thinking/talking about H1B transfer without having your H1B approved. You need to get it approved and go for Stamping in India. Much more to happen. Just be patient. Btw whats the name of company ‘A’? and ‘B’

    I am selected in H1B however my wife’s petition is not selected in Lottery. I was reading somewhere person can work on B1 for 6 months and then it can get extended for another 6 months.

    My query was whether she can work on B1 for a client implementation. The wikipedia says following…

    Negotiate and sign contracts
    Purchase supplies or materials
    Hold business meetings or attend/exhibit at a convention
    Settle an estate
    Sit different types of exams and tests held inside the United States
    Perform certain professional services

    I am not sure about what kind of professional services it means.

    We were planning if she can work for 6 months and extend another 6 months and eventually stays for one year and we can file her H1B next year again.

    How feasible is this option?

    Please advise!

      Don’t even think about working on a B1. It is against the very intent of the visa. I am not a professional but can still assure you, no way you should ever work on a B1. It is for business reasons only, like some business meetings or some presentations or some requirement understanding at the most. And 6 months on B1 visa is itself a risky proposition

    • Sahil is correct. DO NOT work on a B1 visa. This used to be the trend long ago and the government found out that many companies are sending in employees under this visa. The rules are very strict these days and if found at fault the government will deport you.

  31. My employer notified me that they received my package back and my application is not selected in lottery. I wanted to make sure he is not lying, so i asked them for the returned package. They sent me one scanned page which has a general text which says that USCIS reieved your application but you were not selected in lottery. But nothing in that letter confirms that this H1b was filed for me only.

    This page has only a FileNo: which is blank and a FormNo: which has I-129 written by hand. Is the I-129 form returned by USCIS just one page letter with no detailas about the applicant? There must be some way to associate it to an applicant?

    Please advice, what document should i ask my employer to share in order to confirm that my H1b was actually filed?

    • This is the only document USCIS sends for not selected package. There is no other way you can find out whether your petition was filed or not rather than trusting your employer.

      I got the same scanned copy without asking my employer and I am 100% sure my application was filed because my employer is more desperate than me to be there.

      • This letter does not have any case number or applicant name, then how does the employer/attorney know that this rejection letter came for my petition and not for any other petition they filed?

    My receipt number is EAC1313851*** and it is still in initial review. I am disparately waiting fo r the decision because I want to transfer my visa. Do you guys have any idea how long more I need to wait. Please share your receipt number and your status if yours have been approved.

    • Even my receipt number starts with eac13138 and my appln is also in initial review stage. My friends appln got approved yday whose number starts with eac13140. Looks like uscis is not processing the aplns in sequence. With this we can not estimate the processing time. We hav to just wait untill it get processed.

      • If it is EAC13138 It means 138 days until October 01 and EAC13140 it means 140 days until October 01. So it looks like there is a logic behind it. I think we need people update their status with their receipt number here

        Any idea whats the consultancy name of your frnd whose application got approved . Mine is the same case , my receipt number starts with eac13138 .. my frnds number which is 13143 got approval . My frnds consultancy name starts with “A” so i thought may be they are processing alphabetically .. (Just a guess )

            Hope you guys are highly educated, don’t think like kids. generally it will take 2-3 months to get approve h1-b. no one knows how USCIS works for cases. don’t be despo to go USA.

    • @h1b applicant, Mine is EAC131485**** and still under initial review since one and half month. I am also eagerly waiting to get approval man. we are in the same boat. I dont know if they process the applications inthe sequence but one guy under EAC131325 got it approved on May 31. I am hoping we should hear it in June.

  34. Today I received my documents from my attorney. Had applied in AD/RP. Application approved, now COS to happen on the 10/1/2013. Next step to get the stamping done when I visit India (and pray that I don’t get 221G).
    To all who have their applications in ‘Initial Review’ be patient, the change to approved happens in one day and they send out the approval notice in 2 days.

        When a person goes for stamping and the consulate needs additional time/documents/information before issuing the visa, they issue 221g. It can be treated as RFE of the stamping process.

      Did you by chance register for automatic case status updates by email feature on USCIS website ?

      If yes, did you get notification by email or did you check it yourself ?

      This will help me stop checking status on website everyday and just wait for email in my inbox.

      • I did sign up for email updates. I did that for my EAD card as well and found it very useful (the updates are regular; for example if the status changes you get an email, if they send out the mail package you get an email)

        Apart from that my attorney kept me updated through my HR rep here in the company. Hope this answers your question .

  35. Senate Judiciary Committee approved the amended Immigration Bill on May 21 with 13-5 majority votes. While the White House immediately praised the result, the H-1B opponents were angry, because the foreign workers and tech industry are big winners!
    The original bill would increase H-1B Visa and “high-tech” green card, and give their spouses work authorization(read details). The amended bill extended more favorites:
    According to Computer World, the revised bill raises the annual H-1B cap from 65,000 to 115,000. The annual escalator increases from 10,000 to 20,000 if occupational unemployment for the management, professional and related occupations is below 4.5%(which has been below 4% in recent years). read details
    If the President could sign the bill into law as it is before the end of fiscal year 2013(Sep 30, 2013), we might have 50,000-75,000 new H1B Visa available starting October 1, 2013(fights still ahead).

    Most employers will not be required to offer a job to an equally or better qualified U.S. worker before hiring foreign workers, only “dependent firms” have to do it. Dependent firms are those with 15% or more of the workforce on visas. The bill mandates the H-1B dependent employers to offer minimum of Level II wage and banning Level I wage.

    A new “intending immigrant” provision excludes the number of H-1B and L-1 employees who have started the green card process from counting the total number of H-1B and L-1 employees for the determination of “dependent firms”.
    This provision will certainly encourage employers to file large number of employment based green card petitions for their employees to avoid the title of “dependent firms”!
    The best part of the original bill is a 60-day transition period for H-1B workers to change jobs. An employer can no longer kick a worker out of the country by firing them and workers who wish to renew their visas no longer have to leave the country. Foreign workers can finally make their own employment decisions without worrying too much about the legal status!

      It means that the petition has either received RFE or has been approved/denied. It should change to something else soon. If not, ask your attorney to check w/ USCIS.

  38. Luckily i got my receipt number around 3 weeks back, but my employer told me that she upgraded my application to premium on the same day. And last week when i asked her she told me the check submitted for premium processing got en cashed. But i still see my application in regular quota. So when i asked her again she is saying application already upgraded to premium but it is just not showing as premium in USCIS website.. My question is – Will it be possible? And can i trust her? My guess is they haven’t upgraded to Premium yet. If they upgrade it by this time i would have got either approval or RFE.. am i correct?

      Yes, it should have reflected the same online. Ask her what’s the exact date on which confirmed the PP upgrade. Then calculate 15 calendar days from that date, and if doesn’t get RFE or approval by that date, then ask your employer about it. Who paid for the PP?

    My L1tiH1 cos application is in RFE. They have asked me the proof of my L1 status validity from 04/12 to 04/13. Unfortunately , i dont have payslips generated in US as per policy. But i have a letter from my company stating the period of my stay (covers 04/12 to 04/13) and my monthly allowance information. i have W2 copy for 2012 as well. Will that suffice to prove my L1 validity ? Please advise .

      My understanding is that the company can pay you either in US or in home country when on L-1. So you can submit your home country pay slips, W-2 and employment letter from L-1 employer about the status. What is your H-1 attorney suggesting?

      Did you submit L-1 I-94 and 797 when filing the H-1?

    Me and my friend has applied for the H1B visa this year , we got the receipt numbers . My doubt is my friends receipt number is eac13143##### which got approval also in 2 weeks(RQ/RP). Mine being eac13138****** (RQ/RP)still is in initial review. Are these approvals given randomly or follow the consecutive numbering ? If they follow the numbering , my number comes first right … If any one can clear my doubt please post it here.

            Nothing required until the approval. Once approved, get the documents from your employer and appear for stamping.

      USCIS returns everything to the employer in case petition doesn’t get through the lottery. However, attorney may charge the employer for his time and effort. How much they charge and how much employer keeps from $4500.00 as his earning is up to them.

        Ask them how much they will return and if they plan to keep some portion then ask why and the break-up. If they put a ridiculous amount for lawyer fees, then ask for an invoice from the lawyer. If they say that they cannot share the invoice, then tell them that as you are paying for the attorney, you want to know about it.

        Legally, they should have paid for all the fees including lawyer fees. You can contact USCIS about it or tell the employer you will contact USCIS if the money is not returned (but keep this discussion as a last resort).

  43. If i applied L-H conversions from two different companies. Company A is a new company & Company B being current company and I am on L1 with them.

    case -1
    Both petitions are approved before october. Can i have a choice to select a company of my choice?

    case -2
    Company’s A petition approved first and before october and Company’s B approved later around November. In this case can i opt to be with Company B?

    Any help on this is greatly appreciated.

      1. Yes, you can join either employer if both are approved w/ COS
      2. In this case, you work w/ A until Nov and then work for B once that petition is approved. However, I am not 100% sure about this and check w/ attorney. May be you can work for B from Oct 1 as your status has already changed to H-1 and H-1 portability allows you to work for B while that petition is pending (or may be it is not allowed as B’s petition was filed prior to A’s approval).
