Anyone applied for h1b visa through agility technologies ltd ?
Employer informed me that check has been cashed for my petition on Apr 29, however they haven’t received the file number yet. I believe , once USCIS cash the check, there wont be much delay to send the acknowledge letter. Since its being 13 days now, I am afraid that my petition is not picked up in lottery and not much convinced by what employer is saying.
Any thoughts or comments on this? please help..

With the tracking number provided, is it possible to verify whether it is your tracking number only and not others. Because the details of the tracking number in the USCIS website does not show the name of the Candidate or any other details.
It just says initial reveiw.

When you search for your tracking number does it show your name or any other details ? So that you can confirm if it was your tracking number only?
Yes..!!! I have receipt Notice from USCIS. As per the notice (Soft Copy), Receipt Nbr is align to my name and Vise fee has been received by USCIS. One of my colleague received confirmation from USCIS for ‘Petition Approved’ But I am waiting for the same..!!
As you say it is 22 April means, I believe it is not from Regular Processing must be from Premium processing. I see all PP got approved by now ….. Please confirm whether it is RP ? PP? I can give you some more details based on that.

Anybody who is in the advanced degree exemption of 20,00 who is still waiting on the receipt? From the research, I had done they were 25,000 applications in this and hence was confident that the chance of getting selected in lottery was 80% . But also heard few rumors that it was 40,000 and hence a 50-50. So don’t know which of it is true and also is there any hope left of getting it.
My Stem OPT expires on June 10 2013 and still haven’t heard of any receipt or reject…. Looks like I have no other option but to leave everything here and fly back to my home country.

Called USCIS, the lady told no entries done after April end. She also said she has no idea about wait list. I was not in their system.
Thank god at least I am not alone. Since you are in a similar boat like mine….what other options have you got to hear from your attorney. At least for having done Masters here, we at least get 60 days grace period to stay in US without work and keep our hopes alive if we are lucky enough to get the receipt .
So lets hope for the best and keep our fingers crossed. Will definitely pray for all of us having spent such huge dollars for our degree, we definitely cant get thrown out like this.
You can get admission in any of the university and keep the status and work on CPT. I did apply for H1b adv / Reg. but no luck this time and I missed the last time as well :(. But I am study and working on CPT.
How are you able to work and study on CPT? I believe if we did one Masters and try again for the same, we dont get OPT or CPT and the only way t get it is PHD?

It’s I-129 when it’s a new H-1 petition. When the petition is already approved and the person just files COS, then it will be I-539.

So when it is new petition I129 takes care of conversion in status in itself so that once that is accepted and approved they switched to H1b status??

The long pending result has been reached to me after raising a ticket. This waiting is similar to when we develop a new module/enhancement and stuck somewhere for the logic.
My application is selected in the lottery and the Visa team will not reveal the receipt number till the application has been approved.
This is what the resolution of the ticket which I have raised,
“Your application has been elected by USCIS and ISG has received the receipt number for your application. But as per ISG and WPC guidelines, H1B application receipt numbers will not be shared with employees but ISG will update the status of your application on a weekly basis from next week. Please reach out to your HR Representative / WPC SPOC if you have any further queries”.
All the best to each and everyone who are waiting for the receipt (100% you will get. Have faith) and all the best to other who are waiting for the approval.

First list has already been shared by FDFU to the managers. Check with your manager whether your name is listed under that or not. Mine is not there and i don’t know whether will get couple of more lists or not.
Ya they have shared 2 lists till now…but my name is not there in that 2 lists and i got a mail from chennai assurance team that my application is pending with USCIS…

the employers/sponsors are getting the lists of selected candidates from USCIS every alternate day or weekly…..If your name is not in the list that means you have to still wait to hear from USCIS on your lottery status. If you are not selected, then USCIS will send your papers back along with fees, wait for the second list, 3rd list..so on till USCIS stop sending lists for all candidates for your particular employer. hope I am clear.

there would be no particular number of lists…if through TCS for example 200 members applied for H1b visa, then USCIS will send the lists in batches for selected candidates..that batches could be 1 or 2 or 3…
No, it is not related to project..it is purely random lottery pick and rest of the candidates do have chance of getting selected in lottery…

Today we got mail from our employer
“We are getting receipts for those who got selected from the lottery system. As per the attorney, it might continue until we get back the papers of those who are not selected.
As per today we did not get your papers back. We will inform you when either one happens. Keep your plans open until you hear from us. As such there is no time frame given by USCIS or the attorney office.”

Hi H1B TCS, There will be many list. Around 15000 people have applied from TCS I guess. All the visa processing is done from Chennai for TCS. So, if USCIS sends 300 selected applications, then all the 300 will reach chennai SSG visa team. This team will segregate the received applications based on the branch like chennai/blore/pune and then they will send the result to your branch FDFU. The FDFU branch will pass the info to respected project PL/PM. This is how it was working some years back for TCS.

I got my Receipt Number last Saturday, my employer said he upgraded my application to premium processing on the same day itself. @ Waiting and Waiting: I didn’t received my application back, but I called USCIS last week asking about my receipt number and the lady told me that my name was not on the system, and more that 90% of the applications were already processed. It has been 2 weeks already and I yet never received my receipt number, that means I was not selected, neither my SEVIS changed status.

Won’t be able to help. My sponsor didn’t share with me the whole mail they received, only the receipt number.
I am currently employed with a service company based out of India with head office in US and working for a US based client. My current employer had filed H1B petition for 2014 and luckily got selected in the lottery as I received the receipt number couple of days back.
I checked the status of my petition on USCIS website and it was showing it in the ‘Initial Review” state.
Below are a couple of related questions
1. If I happen to change my employer during this period (till petition is approved and finally stamped), does that have any legal implications on my petition processing?
2. What could be various reasons for the rejection of the petition once selected in the lottery?
3. In the petition, employer has specified the work location to be the client location? Is that legally correct?

1. You mean resign from the employer that has filed your H-1? In that case, the employer may withdraw the petition. If the petition has not been approved by that time, then you are out of cap and just like those who didn’t make through the lottery. If the petition has been approved (doesn’t matter whether it is stamped or not), you can still qualify for cap-exempt petition in future. Just have the receipt copy or at least the receipt number w/ you.
2. There can be several reasons and its not possible to list all. Most common ones are unqualified for the offered H-1 position, employer’s track history, employer-employee relationship etc.
3. Yes, if you will be working from the client office. They need to have their own manager at the client site to supervise your work. As per employer-employee relationship, client cannot supervise it but only your employer can.

If anybody is receiving receipt numbers starting May 6, please specify if you belong to any big IT company in India (TCS/Wipro/Infy/CTS/IBM/Accenture etc.). You need not mention your company name, but just specify if its any of those.
The reason is, your organization might already have got your receipt number, but did not disclose it to you earlier.
Applicants like me from other small US companies will be able to assess the situation much better if you provide this information.

You have selected in lottery means USCIS will process and send apporval in 3 to 5 months for non premium. Be cool. Even I too got same
OOC used to share receipt number in earlier years but they got problem one time because of some employees. By that time OOC is not sharing receipt number and will share only when petetion got approved and while going Visa interview.

I spoke to GIT team and they said that they are still receiving receipts. Once they receive it, they will update it in intranet which will trigger a e-mail to associate. They are asking to wait until the rejection is confirmed(or they get a returned courier).

Although I decided not to post on receipt numbers again, but it is still tempting.
Like I asked others, why do you think this is FY-14 cap-subject case? If one applies for H-1 transfer now, it will exactly look like that receipt number’s status message.

I applied RP/RQ and have not received a receipt yet. My employer called USCIS yesterday and they said they are now done processing applications. I am waiting to get my rejected application in the mail but I am very sure I was not selected in the lottery at this point. To all of you who are in my situation, you are not alone. 39,000 of us unlucky people will pay for the terrible immigration laws of this country. Just know that we will be OK and life goes on. Keep your head up and never stop following your dreams.

Category: AD/RP/VSC
Application arrival date: 4/1/2013
OPT expiration date: 6/28/2013
– No STEM available for me
– No receipt as of 5/8/2013
– No SEVIS update as of 5/6/2013
– Check has not been cashed as of 5/7/2013
Today, I called USCIS with my firm’s HR manager on the other line. To sum up, the representative told us that
– No receipt number for me as the data entry for me was not done yet
– USCIS is not done with processing and sending out receipts
– There is no hard deadline on data entry
I personally believe her story as she was able to locate the receipt numbers for my co-workers who have already got the receipts (all regular processing).
After this call, we asked our lawyer to contact USCIS. A few hours later, he got back and told us that USCIS also told him that it is not done with data entry.
Let’s keep our hopes alive!!!

Need your help, from past 2 -3 days we are not seeing any good news in this wonderful forum, like received receipt no and receipt no is in this stage now.. such type of comments.
So that it means USCIS may have completed sending receipts for all H-1B selected petitions in lottery.
I applied under RQ/RP/VSC ..not received any update.. Even my employer also didn’t get any update till Monday. My employer definitely shares with me as soon as he receives any update from USCIS.
Can we still keep our hopes alive?
Could you please guide us on the chances to hear positive news from USCIS at this Stage?

As there is no active communication from USCIS (except for what trickles down USCIS service Agent -> Employer/Attorney/HR -> Forum Members), one can only predict.
There might be receipts in transit which is causing the delay or may employer/attorney are holding on to some. Or USCIS may be preparing the wait list. I can’t say concretely. You may decide to wait for few more weeks, but start actively thinking about the back-up plan as well.

Hello there! Anyone filed through MAARKOVERSEAS please feel free to contact/share thier status. Alternatively you may reach me at voidofdeath at gmail dot com. I have filed with desi consultany – MAARKOVERSEAS. While filing during late March, they said they file petitions using Premium Processing, and also that I will have to pay only if I have VISA stamped on my passport, an amount of $8,000. I was naive then, now came to know that one needs client letter and also that the employer who files H1B petition on employee behalf, has to have a physical office in USA. MAARKOVERSEAS definitely does not have any physical location in USA and hence, I assume that they filed H1B through some consultancy companies. But they are very secretive about their process and wont divulge anything – not even courier details. Sometimes I feel as if are they really genuine? Anywayz if no response by June, am opting for refund of Rs 8,200 and filing with a different consultant next year. If you filed through MAARKOVERSEAS, then please contact me at voidofdeath at gmail dot com; Need to group together and put pressure on this desi consultant.

$8200 is pretty huge amount, legally no consultant is supposed to charge any amount for visa processing. But as usual this is business, so they were charging $4000 as security deposit and return that after serving them for 6 months in US.
Yes, you need to have a client letter and the company should have office in US.
So as you said they might have used another “Andhra” contact in US and filed if at all they have done. They are supposed to share the courier details to you, so that you can track yourself atleast if they have filed or not.
Big looting of money by having office in “Andhra” as every andhrite wants to somehow go to US 🙂 ridiculous.

My OPT expired in June 10, and my employer said that my H1b is selected in the lottery. I have been asking for my application so I can file my Cap-Gap. They are not releasing any information but just asking me to wait.
When will it be too late to apply for CAP-GAP? How long does that process takes to apply and get Cap-Gap approval. I heard that cap-gap is very easy to get approved, is it true?

I’m on the same boat. The cap-gap is automatic and your information should be automatically updated in SEVIS. If you want to, you can make a trip to you Office of International Education and have a new I-20 printed that is going to indicate the extension of OPT until September 30. If your H1B is approved by June 10th, you will keep working until September 30th on your current visa. If it is denied before June 10th, you will have a standard 60-day period to departure from the US. Hope it helps and good luck!
What happens in case that I do not hear about the approval of my H1B status (h1b is pending) before june 10th? Will i be out of status, or lose my work permit?
Nothing happens 🙂 you can work as you work right now as long as your H1B is pending. If, let’s say, it gets denied on June 21st, you have to stop working on a date the denial decision was issued so June 21st. As long as it’s pending, you don’t have to worry
