    • Can some one throw light….. how USCIS is approving regular processing applications so quickly. And there was a mention that there is 60% rejection rate this year. Are quick approvals having some thing to do with it.

@Saurabh: Your expert guidance is appreciated 🙂

ON a side note, congrats dude on your approval.

Once USCIS officers are done w/ the PP petitions in their queue, they will start picking non-PP petitions. The lucky ones which are picked-up first may get approved quickly (especially if they are straight-forward cases). The ones which are picked later will end up facing weeks or months of delay.

  2. I think in one of the comments a person had suggested todo a self check. I did that and i found that my status was showing something like i could change companies based on the everified employer. ( I had not got the petition number at this time ). After few days i got the petition number from my employer. Now when i did my self check i got a mismatch on the i94 number and i have put in a enquiry with the USCIS team .

For people who had no idea about the petition. Pls chk the self check and see you comments and post it.

PS : The comments will not say that you are selected in Lottery nor it will say that you are on l1. But we can infer based on the comments .

Did you travel outside of US recently? If not, give it few days and then maybe your attorney/employer can follow-up w/ USCIS.

      • Hi Saurabh,
Could you please explain me how back ground checks take place while my application in under ‘initial review’?

        Thanks in advance.

        • Aries,
The process is not public, so one can only guess about it. I think they first check the applicant against their own databases of “known” people. If nothing stands out, it may proceed with the processing, but if something similar is found then they will dig deeper and match other details to ensure you are not the one on the list.

They may also match it against any other list they have from other law enforcement agencies. It is also possible that they have a system of auditing at least certain percentage of applicants every year. Just my guess.

  10. My employer got 8 out of 20 applied H1 receipts, haven’t received any news on my application – hanging in there, it would have been nice if USCIS had announced the names to employers of not-selected candidates next day of lottery – would have saved a lot of anxiety.

  12. Is this end of light for AD/RP ?
I spoke with my DSO and there has been no update on my sevis. Looking at the responses from the last 4 days, I have a feeling that USCIS slimmed down generating the receipts. Please let me know if there is an other forum going on discussing about plan B for the people who are not selected.

      • Ask your employer to call USCIS tomorrow and find out for sure. If your application reached 3rd April, ask your employer to call May3 rd. USCIS wants you to wait 30 days for a receipt. If you do not get it by the 30th day of your filing, request your employer to call USCIS. At least your agony of knowing which way will be over.

        Good luck.

          • Hi Ragh,

So today 30 days are over. Request your employer to call USCIS tomorrow. You will at least know if you were selected or not. You can do a 3 way conference call. You, USCIS and your employer. That is the best way. I know how painful the waiting is.

          • GB,
Actually if the lottery was conducted on 7th, then 30 days get over on May 7 or May 8. That’s because all petitions were not touched until lottery had been conducted.

          • Hi Saurabh,

I called USCIS and the above is what they told me. They asked when was my H1b filed. Then they counted 30 days. Mine was filed April3rd. So, they asked me to call them May 3rd. That’s what USCIS told me. They are very cooperative on the phone.

  19. Sincerely praying god to give me some news on my h1. Rejected package or receipt number!!! Waiting is killin me 🙁

  22. Hi All

Have received confirmation from my employer that my application has been received by USCIS. I was in the RQ/RP category.

This blog has been a great support for me and surely for you guys as well. I have only a small advice. For those who got selected, great, hope all goes well. For those who do not get selected, completely understand the feeling, but start working aggressively on you plan B, whatever it is, and you will be absolutely fine, this is not the end of life. Keep in mind things happen for a reason.

    Take care and thanks.

  26. Hi All ,

I have applied/tried H1 B visa through a ‘ Desi Consultant’ . He is saying i did nt get picked in lottery . IS there a way I can find out if he has applied my Visa .Does USICS sends some letter to all those not picked in lottery ? .

Please advise . I am having a sad feeling that he did not applied my visa and just fooling me or many folks like me .

    Thanks

    • You could have asked him the courier details when he filed, this way you will know whether petition is filed or not.
Now if he says it’s rejected, i doubt you can find out.
Did you pay any fees for the consultant to process your H1B.

        • ABC,
He made 1000 USD from your application. I don’t see any posts about returned packages. It didn’t make through the lottery only if the package is returned. Check w/ your employer is yours was returned. If yes, then ask for a copy of the letter sent by USCIS in that package.

Such companies are in business of making quick money in the lottery season. Collect 3000 USD from 10 employees on pretext of filing, then never file the visa and return 2000 USD. 10,000 USD made in one month.

Also ask him why he deduct the 1000 USD? If you want to take any legal actions then tell him that you will complain to DOL about him collecting H-1 filing fees including attorney fees (obviously you will burn all bridges w/ this firm).

          • Thanks Saurabh ,

I called up him again , he is saying he took 1000 as attorney fees . I have asked him to send some proof , that he has applied …..lets see ……but this H1 B thing is not good . People misusing it in various ways …..

    • @ABC.

If he says you are rejected then USCIS will send a notification that your packet/profile is rejected with a very genuine reason for sure. U can ask your employer to send that information. If he says he dint recieve anything, most likely he would be lying. This case your petetion is not sent to USCIS.

      Good Luck
