We been told to wait till first week of May..The algorithm which the USCIS use is RANDOM.So hang on…

  6. Hello a doubt. while reading through the comments, i found that its mentioned:
Petition filed under Premium Processing shall have VISA interview appointment date in month of July
Petition filed under Regular Processing shall have VISA interview appointment date in month of October.

Is this fact? I thought that for all cases its October.

    Reply
    • This is not the case.

Your Visa Interview can be scheduled before 90 Days from the Day of eligibility.

Since if your H1 is approved, you are eligible to work in US from 1st Oct, so you can get a visa interview scheduled from 90 days before i.e starting July 2013.

Now the Premium processing guys will already have a Approved or rejected status within 15 Days so they can get their visa stamped at that time.

For Regular guys, if you get a approval notice before 1st July, you are also eligible for applying for a Visa interview.

It will all depend on your Visa Status from USCIC.

      Cheers !!!

  7. Hi,

I have applied through a consulatant(in US) and they have filed close to 200 applications this time. So far, I havent received any updates on my application.

Today, I called my employer who said that they have recevied 70 applications out of 200 that they have filed and they have asked me to wait for 2 more weeks to know the status of my applicaiton as they are receiving receipts batch by batch.

This is really creating so much of frustration/anxiety becuase my application doesn’t fall under 70 selected applications.

God only should help all of us who are anxiously waiting to hear back something!!!

      • Hi,

I advice you to take some crash course of communication skills by the time your H1B is approved. Just don’t go to US because everyone told you to go.

        • you knw how gud u were in English, pl. do the same thing first for us as well. Hurting and talking harsh to somebody will reflects.

          • Well, this is an advice. When you land for a job there in US and you can’t write a mail clearly you will end up in issue.
A desi never takes advice of another desi, you want it from a phirangi go ahead and take it.

          • Well Mr Patel. Chances of you getting is not that great, just because of your last name. There seems to be -ve sentiment of USA consulates towards “Patel”, so I would recommend caution and be prepared even if your case got selected in lotterry and approved.

          • yes but we need to explain it in other way nt straight way. He is holding nerves for his application selection in lottery and u saying won’t go as if everyone told you to go.

He can improve there as well. And also we can’t judge him with those few lines :).

          • Dear Friends,

We are no where to judge anyone in life that too not over here. Please understand the situation and feelings of others in this forum who were waiting to see some +ve updates and tips not personal revenge or tit-tat chat.

This is an humble request. Hope you people understand.

            Thanks in Advance

          • Indian,

I guess, even you need to improve your English a bit. It’s actually an “email” and not a “mail”. Mail refers to a package sent out through post in US and for the others whose feelings are hurt by Mr. Indian’s comments, need to realize that they need to improve their English a lot. It’s a must if you want to come and work in US. If you end up writing and speaking such English you will embarrass yourself in front of others in US.

          • Nobody is perfect/master in English as I see here even white people as well who speaks butler English excluding pure brit. Everybody needs to learn a lot. Before pointing or giving suggestions to others please question yourself how perfect u were first.

No indian should discourage other indian. I feel bad abt it.

Poor guy. He holding nerves for his application and we keep on talking abt him regarding some other topic.

          • Indian – Another correction for you:

A desi never takes advice FROM a desi (NOT of a desi). And your punctuation is all over the place. So please refrain from hurting somebody else who is in great tension already. And please do not use the name “Indian”, you are an embarrassment.

Rajendra – there is still time. Call USCIS and find out.

          • Ha ha… Very True!!

“he is fees ammount” and “diduct” are to be highlighted. And furthermore; he is waiting for reply from USCIC 🙂

Mr.Patel use Google Chrome. At least use its spell-check feature.

    • Hi thr, this is the response we got from my lawyer.

Update on Receipt Notices for FY2014 H-1B Cap Cases

Cite as “AILA InfoNet Doc. No. 13041600 (posted Apr. 16, 2013)”

USCIS has started the data entry process for H-1B petitions selected in the lottery. Premium processing cases are being handled first and data entry for those cases should be completed by April 15. USCIS announced on March 15, 2013, that the 15-day premium processing clock will start on April 15. (AILA Doc. No. 13031549)

At the AILA Spring CLE conference on April 12, 2013, Donald Neufeld, Associate Director of the Service Center Operations (SCOPS) Directorate, informed the audience that data entry for non-premium processing cases will begin after the premium processing cases are entered. Data entry for non-premium cases will likely not be completed until sometime in May, and rejection notices for petitions not selected in the lottery will be sent out after that. Please note that when the cap was reached on the first day in 2008, USCIS did not complete data entry and issue receipt notices until late in May. (AILA Doc. No. 08061261)

Non-premium processing cases can only be converted to premium processing after a receipt notice is issued.

If u were in US n had applied here then the situation would be different as u would have had to leave if u were not selected. u will lose just one year nothing else will happen if u don’t get selected. US is not a very great country my friend, so be patient and even if you don’t get selected just wait for another year then apply again. And first of all please improve your English communication skills (even if u don’t get chance to come to US of A).

  8. Hi, my H1B has been approved. RQ/RP/CSC. I have a few questions.

    1) is there any chance of rejection when i go for stamping?
    2) can i travel to USA before 1st oct (not to start work)?

    Pls repond. Thanks

    Reply
    • There are three stages this year before you get your H1B stamped on your passport:
Hurdle 1) Getting selected in Lottery
Hurdle 2) Getting your application approved – This is verification of documents.
Hurdle 3) Clearing the VISA interview – This is F-2-F verification of yourself and your credentials; You ought to convince the consulate interviewing you, else denied/rejected.

The last Hurdle whoose probality to deny you permission is as good as 0.1 % is.
Hurdle 4) Homeland security immigration officer at port of entry giving you I-94 (Admission to USA).

Responding to your second question: You can travel to USA only after you have your VISA stamped on your passport. If you are a PP, then mostly your interview will be held in July, for RR its during October, so you cannot fly to USA till you have your VISA stamped.

  12. One question:
If breaking down the Receipt Number you have the following sequence:
    For example Receipt Number WAC-13-128-51234
    where:
WAC/EAC = Processing Center (Vermont or California)
    13 = Current Year
128 = The day, where the count starts from October 1st. Therefore 128 = April 8th
    51234 = Case number.

Here comes the question: If the case number starts with 5, means, 50.000 applications, correct? and the maximum would be 85.000, correct?
As I see, the receipt numbers received so far starts with case number 5, which meas, 50.000, so there are about 35.000 receipts to be sent out still, correct?
doing this math, it seems like we still got some chance!!!!

Lets keep faith on it guys. I am going crazy cuz mine never arrived yet.
I applied for Premium Process at Vermont center.

    Good luck everyone!!!!

    • The receipt numbers daily start from 50000 (last 5 digits)
The number representing the day (128, 129, 130…) keeps incrementing.

So you will find receipts with numbers
      WAC-13-128-50000
      WAC-13-129-50000
      WAC-13-130-50000
      .
      .
      WAC-13-140-50000

      Reply
    • What do you mean by this

128 = The day, where the count starts from October 1st. Therefore 128 = April 8th

Is this like from today number of days till October 1st.

        • If the employer applied multiple H1 applications, they are suspecting that there may be possibility that checks may not be accurately cleared for the same individual. They are not revealing the details until they receive the receipt number in e-mail/mail for that individual. My employer says, one of my collegue’s check got cleared, but he don’t want to reveal that information to him until he get receipt in hand. Hope this make sense.

          • Hello,

Can My employer call USCIS and get some information? Or Can I call USCIS to get some receipt related information?

          • Hi pal,
Don’t worry! the USCIS DOES NOT Stop Giving Receipt numbers, I will give you an example: today I’ve got my receipt number from my university by checking the SEVIS number, but till now I did not receive it from USCIS.
So what I am saying is be patient and you will get your receipt within the next few days !

            Good Luck

    • If not received by this friday- as for as my knowledge the hope is bleak & need to just depend on Wait List pick process….which is 0.1% chance and takes too much time with lot of uncertainities…

This is just my feeling /analysis….

  25. I had been informed by my HR last week that i was selected but as it turned out there was some confusion between the attorney and HR. I am still hoping i will get lucky soon. 🙂

Based on the comments here, i advised my employer and attorney to call USCIS and ask the case update. As per my attorney “We cannot follow up with USCIS regarding a specific case especially if there is nothing wrong with the process.”.

Can someone point me to some official link which mentions that the attorney/employer can call USCIS and enquire the status. I can share same with my attorney.

I belong to the group who think that the attorney/employer should call the USCIS and not the employee impersonating as employer. Hopefully i keep my patience, especially because my HR would be on leave for 3 weeks starting next week and the attorney is not too accomodating when it comes to answering my concerns. Despite couple of reminders, my attorney never shared the tracking number for my petition but insists that it was delivered.

Can someone share such official link?

Also, to update this is what my attorney said:

We have been informed that the data entry for regular processing cases will likely not be completed until sometime in May. Please note that when the cap was reached on the first day in 2008, USCIS did not complete data entry and issue receipt notices until late in May.

    • Just wait and watch. Don’t bother the attorney. If it has to happen it will happen, just be little patient. Don’t even think of calling USCIS, they won’t entertain your call. All the best.
