What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. I need to break the bad news here,
We needed to update an important info. We got blindsided and were not able to locate the data which we needed to add. We all were discovering methods to get some estimations as we were going along.
Turns out that there are certain number of non-exempted h1b petition still needed to be taken account of . Around 90,000 of it for the duration of April 15- Oct 1 this year . The data for last years were including that and the data for this year is still need to update as employers will file for more transfers and renewals.
We used data provided by USCIS for last year. Crunched some numbers and came up with estimated 90K to be added for total number of employees attached.
Thank to Rezee, LCA, Franc for all the help and Indu for pointing out this major issue.

I still believe that we can see around 150s K with all the commotion happening around this year. This year is not the same. But i will have to bite the bullet and we will be giving a range from (160 – 180K).
Again this estimation is data driven and we are not considering any external factors.
We may find transfers getting reduced and renewals getting increased more than ever , all the restriction taking place making LCA conversions going down but do expect 160K – 180K.

In my opinion, 90k is rather big-O of additional filings between April 1st and Sep 30, after the H1B cap is closed. I would argue that the number should be less. Since all the applications that would be done during this period have to be the cap-exempt filing. That would consist of three categories of people
A. An individual working for a non-profit research university/organization.
B. People applying for renewal of their H1B.
C. Employees transferring H1B to a different company.
Category A has always been pretty small (should be the order of hundreds), and most of the people in category A get EB1 card. For people in category B, that would mean that they got their Visa in 2015 (out of 85k Visa issued), not everyone would renew it. Some might have got their green cards (EB1, people from countries other than India/China), many of the IT companies (the major share in the year 2015) are not vying for renewal, and a number of people who got the visas never traveled to the US either. The recent changes would also curtail the EVM model applicants and deter them from applying for renewal it is not based on the precedent anymore. Category C should see a lower number than the usual years, in spite of the economy doing better than usual. With all the brouhaha around immigration policies, both employer and employees are a little anxious to hire and switch.
Though from the above, I can not put an objective cap on the number of cap-exempt applications yet 90k seems to be a little high.

I am putting out the link of USCIS data where they have provided number of receipts for each of the year updated on 30th of June, 2017 and 15th of Nov 2015. Found out there were total number of cap exempt petitions from July 1st to 15th of Nov to be around 68K .
Now we took 68 K , found out average number of petitions per day which came around 500. Took that number and multiplied it by number of days for the duration of June to Sept 30. (approx 120 days) as we took these months of data for each year . It came out approx 60 K . We added some some more petitions to it as you will see an average increment of 10% in receipts for each year according to the data. Value came out to be around 66 K. This chunk is supposed to be mostly transfers than anything else.
Now, we don’ t know how many cap exempt petitions the employers will file (from mid of April to end of May 2018 giving the dates between June to Sept 30 on LCA for mostly renewals) so we took an approximation of 24- 25 K . Total will come out to be around 90 K including everything.
These are just approximation based on the limited data we have till now. I understand your point of including all the 3 categories though.
Personally speaking, i am seeing a lot of transfers not happening in coming days and the all filtering which is happening should pull this 90 K below. But right now, we are just taking previous years as reference point and calculating accordingly. Hopefully we are doing some good overestimation here and hope to see numbers going lower.
I also see people from 2009 applying for renewals as the GC backlog has deepened.
Do let us know if you have any other ideas or some useful data we can use.

Yes, that sounds about right 500 apps/day for 180 days ~= 90k Apps
Also, the renewals from 2009 are not “cap-exempt”, they have to apply before April 1st after the one-year “cool-off” period. So, that part is already in the equation. Also, if they could not get the green card application processed in the first six years, I wonder if they would find willing sponsors for H1B this year, though it is inconsequential.

I’m sorry for the mess up .
What happened was: a coworker noticed there was a duplicate check. He thought someone sent in that check by mistake and we could pocket that money, so he called me and told me that over the phone. Unfortunately, due to miscommunication we both cashed one check, thinking the other one will be left untouched.
At this point, you have no check and both cases will be returned for lack of fee. Even if we put the checks back now, they are cashed so that won’t help.

if one is getting selected and other getting rejected, it’s the paths they selected, they may win today but will lose one day selecting this path, your friend might have been from top college, he might have lost, but he will win one day if he had gained good knowledge from the same college, then he knows what to do, I think your friend might not have felt this bad.

Last year the check’s started getting cleared from Thursday of this week., so am hoping this year due to low traffic of petitions (as per LCA, SAM etc), I would be expecting some noise here from late Wednesday of this week, Hopefully lottery will be done by tomorrow or early Wednesday.

I did my own little math after reviewing data from various sources:
FY2017 = Total LCA’s registered (554,953) > Top 30 employers LCA registered (167,841) > H1B applications (236,000)
FY2018 = Total LCA’s registered (414,005) > Top 30 employers LCA registered (106,449) > LCA’s filed with Job title – Computer Programmer = (9197)
– Total LCA filings = down 25%
– Top employer LCA filings = down 36%
FY2018, H1B application estimate in the range of 188,800 – 200,600 (roughly 15 – 20% lower than FY2017)
We see lower numbers for 2018 as the USCIS fiscal year is from Sep30, 2017 to Oct1st. 2018. As we are not counting in the LCS which will be filed for next coming months, we see less number in LCA’s.
Even if we count the number including 1-1 LCA’s or multiple LCA’s, we WILL have lower number for 2018 as we are not counting the next 5 months LCA which will be processed.
But all our counts are base don the LCA count till now, regression models etc.
But if we compare with the LCA’s in 2017 which were filed till April 2017, with one’s in April 2018, WE ARE ON PAR with 2017.
I am expecting we wont be seeing a large drop in applications for FY2019, Just hoping we will be atleast in the range on 160K to 180K. #fingerscrossed.

That’s actually a very good point. We were operating on the following assumption:
1) New employment ones are filed before the H1B window (i.e. before April), and have a starting date around Oct 1.
2) Renewals can be filed 6 months before the expiration. Since they are originally filed with starting date of Oct 1, the window to file those are Apr – Oct.
3) Transfers. Those have arbitrary starting dates, and only those with a starting date close to Oct 1 would be included in our data collection.
The factors that could affect our data collection accuracy is therefore:
a) How many renewals are filed after Apr
b) How many transfers have starting date close to Oct
In an attempt to account for the extra transfer/renewal LCAs indu talked about, we extrapolated from previous year’s data and guesstimated the total LCA at 490k.

I highly doubt that… I think they would do the lottery as usual, just scrutinize the applications more thereafter… which then might create a few delays sending out the approval/denials/rfe.
It’s in the current administration’s interest to include multiple petitions in the lottery and reject them after scrutiny so that USCIS gets to keep the fee while reducing the number of final H-1B approvals.

If a person file multiple application through different employer and one of them got picked in the lottery
When are reviewing the case,how do they ever get to know about the multiple filing as the case numbers will be allocated only upon selection in lottery and initially no number to the applications sent(imagine)
What I believe is that filtering will take place before lottery??
USCIS will do complete data entry for selected and un-selected applications after the lottery. The absence of premium processing gives them sufficient time to do that. They can identify multiple petitions for the same beneficiary using various data points in the application (name, date of birth, country of birth, passport number, etc.)
If USCIS determines that the petitioners are in way related as per new memo, they will reject all such applications and not return fee, even if any of those applications has not been selected in lottery.

To answer your last question, I dont think they would spend the time filtering the applications before the lottery. Just think of it as a reason to reject an application and still keep the money. So for your example, they issue the receipt when one of the applications gets picked, but as soon as they see more applications on your SSN/Passport coming through, they either reject the previously selected application or put you on an RFE. I am just making assumptions here, coz you never can or would know what goes on inside the USCIS. Like USCIS Insider was joking about, they might just be throwing the applications against a fan and see which ones make it to the table… LOL…

DOL keeps on updating with numbers contracting our collective belief that it should have been stopped. The good thing is that i see the rise waning considerably (rise of 281 1-1 LCAs only since last morning i checked) and i am hoping it wont effect estimations now.
There is some time lag on part of DOL website but no way to know how much. We got a bit blinded assuming it gets updated right away on a daily basis.

Each year people look at LCA’s, each year they underestimate the total count. Look through the 2017 and 2018 pages.

@ Bestrong but bro last year the checks started getting cleared before the announcement from USCIS., but not too early like what people commenting here., it started from Thursday or Friday of week after documents deadline.
checks can get cleared only after lottery is conducted and completed. USCIS isn’t going to conduct a lottery on weekend.
Correct me if I am wrong, but according to [1], if 57% of AD petitions were selected in FY2018, and USCIS selected 25k for the master cap and 75k for the regular cap, by using 25k/X + (X-25k)/X * 75/(199k-25k), the number of AD petitions should be 102k.
If there were 52% of AD petitions selected in FY2017 [2], the number of AD petitions should be 98k.
There were 4k more AD petitions in FY2018?! Or, USCIS actually selected less than 25k/75k petitions in FY2017.
According to @BeStrong’s prediction, the number of total petitions this year would be 130k to 148k. Therefore, I think the probability of an AD petition getting selected would be 70.5% (assuming 102k out of 148k are AD) to 78.7% (assuming 98k out of 130k are AD).

You can look for check status which was submitted for the application. If it gets en cashed, you are selected in lottery for sure. Other than that, unfortunately you have to wait for the word from attorney or employer. Good luck!

Question – Does this imply that – after the lottery, they will again review all unselected applications for multiple filings prior to reurning filing fees ? This would mean that a rejection notification might take months to arrive unless they separate the multiple applications from the rest.
Yes, it means exactly that. They would need time to figure out if the multiple filings are indeed for “unrelated entities”.
Additionaly, the rejection notice for a single petition would be straightforward. They should send the rejection to all single petition and keep the rejected petitions that were multiple filings. At least that is my opinion, and it is rather simple to do too.
This means, they are tracking petitions through a unique identifier such as a passport number to track repetitions. This (might) also mean that all petitions will be reviewed prior to the lottery since I am guessing there is no ther way to say how many petitions include multiple filings and thus hard to predict their impact on amount of petitions selected for review. Which might imply that the lottery will take place a little later than normal.

At least one thing confirm – 100 percent multiple filings will receive rfe and rejections. Even if they don’t get remedy, their approval will be intentionally delayed by uscis. New strategy to harass people.

Yes, they will do that. They may not be able to give rejections for every duplicate case right away, some may come later…Everything depends on the case…Having a receipt notice, does not mean that they will not get a reject notice later at some point stating that they filed duplicate petition. They can even revoke an approved H1B petition. You can check an example on USCIS website on Duplicate Petition Revoked and AAO denied too
I wont be surprised to see “multiple applications” being one of the top 3 RFE reasons for this season. other two being SO and day-1 CPT status maintenance. Also, having AD wont help much because day-1 CPT is majority masters’ pool that ran out or OPT and STEM extension.
I have a feeling if they take more time in doing the lottery say not doing it this week , we may think they are working on filtering. But it is just wishful thinking. Too slim !
This is what’s gonna happen:
1) All incomplete applications (missing signature, missing/incorrect checks, etc.) will be rejected straight away without being entered in the lottery. The remaining applications received by close of business on Apr 6, including multiple applications for same beneficiary, will be entered for the lottery.
2) After lottery, complete data entry will be done for all selected and un-selected applications. Checks will be cashed for all selected applications.
3) All un-selected applications for which the beneficiary does not have any other petition filed for him/her – these will be returned along with filing fees soon after the lottery.
4) Beneficiaries who have multiple petitions (whether or not selected in the lottery) – their applications will be further scrutinized to see if the petitioners or job positions are related, as per the new memo.
5) If USCIS is able to prove the petitions are related, all such petitions for the same beneficiary will be rejected and filing fees will not be returned, even if any of these petitions have not been selected in the lottery.
